AN ORDINANCE GRANTING A SPECIAL USE PERMIT IN THE NATURE OF A PLANNED UNIT DEVELOPMENT WHEREAS, the Plan Commission of the Village of Mount Prospect did heretofore conduct a public hearing under Case No. 73-8P on March 16., 1973, at the our of 8: 00 P.M. , pursuant to a request for a special use in the nature of a Planned Unit Development-, and WHEREAS, a notice efthe aforesaid public hearing was made in the manner pro - v ided by law and published in the February 28, 1973, edition of a newspaper of i general circulation within the Village of Mount Prospect; and WHEREAS, the Plan Commission recommended, that the development proposed during the course of said hearing be authorized in that it would in no way be detrimental to the Village of Mount Prospect; and WHEREAS, the Corporate Authorities of the Village of Mount Prospect on April 5, 1973, at the hour of 8:00 P.M. did hold a public hearing upon the proposed Annexa- tion Agreement for the regulation of an annexation of certain property to the Village of Mount Prospect, which property is located on Map 47-S of the Zoning Ordinance of the Village of Mount Prospect- and which public heari 1973, at the hour of 8: 00 P.M. -9 9 and 1 ing was continued to April 26, WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by 4 the adoption of the Petitioner's request under Case No. 73-8P regarding the subject property; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have �assed and 'approved Resolution No. 19-73 authorizing the annexation and development 0 of the subject property as a Planned Unit Development-, NOWTHEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: -. That a special use permit be and is hereby granted to allow Chicago Title and Trust Company, as Trustee under Trust No. 43076, or its assigns, to con- struct a Planned Unit Development upon the following described property.. Lot One of The Colony Subdivision, being a subdivision of the Southeast I- of the Southeast -1 of Section 23, Town - 4 4 ship 41 North, Range 11 . East of the Third Principal Meridian, in Cook County, Illinois; which plat of subdivision of the subject tract is attached hereto and made a part hereof as Exhibit A; and which subdivision shall not be subdivided hereafter in accordance with the special use permit granted herein. SECTION TWO: That the Planned Unit Development herein and above authorized and permitted shall be constructed pursuant to the terms set forth in an Annexation Agreement between Chicago Title and Trust Company, as Trustee and Owner, and the Village of Mount Prospect, which Annexation Agreement, entered into and executed April 26, 1973, is attached hereto and hereby made a part hereof as Exhibit B. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue, upon proper application, such building per- mits as may be required for the said Planned Unit Development, the construction of which shall be governed by the terms of the said Annexation Agreement, Section 5.1 of the Mount Prospect Zoning Ordinance in effect April 26, 1973, this Ordinance here- in, and all other applicable Ordinances of the Village of Mount Prospect. SECTION FOUR-; That thlis Ordina'nce togielther with all 'its exhibits and pI ns shall e recorded in the Office of the Reclorder of Deeds, of Cock County , Illinoi§, upon, completion of the Planned Unit Development herein; and the Restrictive Covenants contained on Exhibit C hereto shall be recorded upon the execution thereof and the passage and approval of this Ordinance. SECTION FIVE', That this Ordinance shall be in full force and effect from and after ... . ..... . .... .. . . ... . I its passage, approval, and publication in a manner provided by law and the record- ing of Exhibits A and C attached hereto-, which Exhibit C shall guarantee among other things: (1) the development of the subiect property in accordance with the Planned Unit Development herein; (2) the continued maintenance and protection of all public open space and common open space with said Planned Unit Development; (3) the right of the Village of Mount Prospect to enforce said Covenants by any appropriate action in law or in equity; and (4) that the Owner shall guarantee common ownership or control extending to all portions of the Planned Unit Development for a period of not less than eighteen (18) months following its completion and which shall extend to all common open space, landscaping, exterior maintenance, and all other exterior aspects of the development for a period of not less than twenty (20) years; which Covenants shall run to and be for the benefit of the Village of Mount Prospect. AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED NORTHWEST OF ELMHURST ROAD AND OAKTON STREET IN THE VILLAGE OF MOUNT PROSPECT WHEREAS, the President and Board of Trustees of the Village of Mount Prospect and Chicago Title and Trust Company, as Trustee under Trust No. 43076, heretofore entered into a certain Annexation Agreement dated April 26, 1973, with respect to the property hereinafter described; and WHEREAS, prior to the execution of said Annexation Agreement the Board of Appeals of the Village of Mount Prospect he a. special joint meeting with the Mount Prospect Plan Commission on March 16 � 1973 , at the hour of 8: 00 P.M. in the Mount Prospect Village Hall pursuant to notice published in the Mount Prospect Herald on February 28, 1973; and WHEREAS, the Board of Appeals of the 'Village of Mount Prospect heard testimony presented under Case No. 73-10A pertaining to a request by Chicago Title and Trust Company for certain variations from the Mount Prospect Zoning Ordinance to permit the development of the property hereinafter described as a Planned Unit Development-, and WHEREAS, the Board of Appeals of the Village of Mount Prospect has filed a report w ith the President and Board of Trustees recommending the allowance of the varia- 1 1 tions for the reasons stated therein-, and WHEREAS, said property has been annexed to the Village of Mount Prospect and duly classified in the R-4 Residential Development District; and WHEREAS, pursuant to the aforesaid Annexation Agreement the Village has agreed that it will adopt an Ordinance pursuant to Sections 30 and 34 of the Mount Prospect Zoning Ordinance granting certain variations with respect to the subject property; and WHEREAS, the Village has given all the notices and held all of the public hearings required by law to be held in connection with the approval of such Annexation Agree- ment and of the variations hereinafter authorized; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the said proposed variations and have determined that the same are in the best interest of the Village of Mount Prospect-, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE That the following variations be and they are hereby granted for the property which is the subject matter of Case No. 73-10A, which property is legally described in Exhibit Z�A attached hereto and made a part hereof by this reference, and which is classified in the R-4 Residential Development District pursuant to the Mount Prospect Zoning Ordinance in effect on April 26, 1973: (A) The terms of Section 31 of said Zoning Ordinance be and they are hereby varied so as to permit the construction of two or more main buildings on a "Lot" as that term is defvined in sa1d Section 31; (B) The terms of Section 20 (B) (1) of said Zoning Ordinance be and they are hereby varied, so as to permit off-street parking spaces that are no less than nineteen (19) feet by nine (9) feet-, (C) The terms of Section 5.1 of the said Zoning Ordinance be and they are hereby varied so as to permit the calculation of off-street parking spaces provided for dwelling units to be' made on the basis of 1.5 spaces per dwelling unit-, (D) The terms of subsection (c) , paragraph 4 of Section 5. 1 of the said Zoning Ordinance be and they are hereby varied so as to permit the increasingpfor the duration of such development the specific uses not permitted under the use regulations of the R-4 district in which the said development is locats dpto a total of thirty percent (30%) of the ground area of such development; and (E) The utilization of the entire 31.747 acres annexed to the Village of Mount Prospect via Ordinance No. 2418 for the computation of the allowable number of dwelling units, the computation of allowable area to be utilized for certain commer- cial uses allowed under Ordinance No. and ground coverage. SECTION TW 110-, That the Director of Building and Zoning of the Village of Mount Prospect is hereby directed to issue building permits for the subject property in accordance with the variations and limitations thereon hereinafter set out. The variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variations is made and construction commenced within five (5) years of the date s "d Ordinance becomes effective. al SECTION THREE.- That this Ordinance shall be in full force and effect from and .....a . ..... fter its passage, approval, and publication in the manner provided by law. AN ORDINANCE GRANTING SPECIAL USES FOR PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF ELMHURST ROAD AND OAKTON STREET IN THE VILLAGE OF MOUNT PROSPECT WHEREAS, the President and Board of Trustees of the Village of Mount Prospect and Chicago Title and Trust Company, as Trustee under Trust No. 43076, heretofore entered into a certain Annexation Agreement dated April 26, 1973, with respect to the property hereinafter described; and WHEREAS, prior to the execution of said Annexation Agreement the Board of Appeals of the Village of Mount Prospect held a special joint meeting with the Mount Prospect Plan I"Aion March 16, 197,3, at the hour of 8: 00 P.M. , in the Mount Prospect Village Hall pursuant to notice published in the Mount Prospect Herald on February 28, 1973; and WHEREAS, the Board of Appeals of the Village of Mount Prospect heard testimony pre- sented under Case No. 73-10A, pertalning to a request by Chicago it and Trust Com- pany for certain special uses pursuar"it to Section 5 of the "Mount Prospect Zoning Ordi- nance to permi,t the development of the property hereinafter described, upon annexation, as a Planned Unit Developmeyit, and I WHEREAS, the Board of Appeals of the Village of Mount Prospect has filed a report with the President and Board of Trustees recommending that such special uses be allowed for the reasons stated therein-, and WHEREAS, said property has been annexed to the Village of Mount Prospect and duly classified in the R-4 Residential Development District; and WHEREASpursuant to the aforesaid Annexation Agreement, the Village has agreed that it will adopt an ordinance pursuant to Section 5 of the Mount Prospect Zoning Ordinance permitting certain special uses on the subject property; and WHEREAS,, the Village has given all the notices and held all of the public hearings required by law to be held in connection with the approval of such Annexation Agreement and of the special uses hereinafter authorized; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the said proposed special uses and have determined that the same are in the best interests of the Village of Mount Prospect; NOW9 THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION' ONE: That pursuant to Section 5 of the Mount Prospect Zoning Ordinance in effect April 26, 1973, the following special uses are authorized on the property described in Exhibit Z%..k attached hereto and made a part hereof by this reference: (A) A hotel or motel containing no more than 256 rooming units and normal accessory uses thereto; (B) Office and Financial buildings -, (C) A retail shopping center; (D) An automobile service station located at the intersection of Elmhurst Road and Oakton Street; (E) A central recreational building not to exceed 10,000 square feet in floor area, which will house the following facilities and uses.- Leasing and management offices, game rooms, sauna baths, exercise rooms, meeting rooms, and dining facilities, and 30 (F) Enclosed, off-street parking structures which may be partly underground and which shall contain at least two and not more than three levels. SECTI*N TWO: That special uses authorized to be established in SECTION ONE above shall be valid and effective only upon the performance and continuous maintenance with respect to the property hereinabove described and the following conditions and • (A) Not more than 704 multiple family dwelling units shall be constructed on the subject property. No more than 70 of the multiple family dwelling units may contain as many as three bedrooms, and none shall contain four or more bedrooms. (B) Only one (1) automobile service station all be constructed. (C) At least 1.5 parking spaces shall be provided for each resi- dential dwelling unit; one (1) parking space for each 200 square feet of gross floor area utilized for offices and/or banking; one (1) parking space for each 300 square feet of gross floor area utilized for retail businesses; one (1) parking space for each 100 square feet of floor area utilized as public seating area in establishments dispensing food or beverages for consumption of same on premises; and at least one (1) parking space shall be provided for each hotel or motel room. (D) No building shall exceed six (6) stories or seventy (70) feet in height, whichever is the lesser. (E) Double locks will be installed on all dwelling unit entrance doors. (F) Beco ore anti -syphoning devices shall be installed within every building in excess of two (2) stories in height. SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. AYES: PASSED and APPROVED this day of 1973.
