Village of Mount Prospect April 5, 1973 Special meeting of the Mayor and Board of Trustees of the Village of Mount Prospect called by Mayor Teichert on Tuesday, April 3, 1973 pursuant to Chapt. 2. "The Board of Trustees" Section 2.103 "Meetings." of the Municipal Code of Mount Prospect. The purpose of the meeting is to hold a public hearing on pre -annexation agreements, including Plan Commission and Board of Appeals reports. Call to order 2. Invocation - Trustee Link 3. Adjournment ORDINANCE NO. AN ORDINANCE GRANTING A SIDE YARD REQUIREMENT VARIATION FOR PROPERTY LOCATED AT 223 NORTH MAIN STREET, MOUNT PROSPECT, ILLINOIS. WHERBAS, the Board of Appeals of the Village of Mount Prospect did meet on the 22nd d,a,y of February,, 1973, at the hour of 8:00 p.m at the Mount Prospect Village Hall, and, did hear Case No. 73 -SA, pursuant to proper legal notice; and "WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear thi4,.,;, request for a side yard varl'ation to allow the petitioner to con- struct a r,e,.sidence to wJi-thin fifteen feet 63/1.00 inches (15.63) of the side yard lot 1,11ne instead of the required, thirty (30) feet of the lot legally described hereinbelowand WHEREAS, the Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees the approval of this request under Case No. 73 -SA for the reasons that: (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variation is not based ex- clusively upon a desire to make money; (3) The conditions upon which, the petition for thisariation is based, are unique in that the pro-, pert y is, a, corner lot, having a, width, of only forty-seven (47') feet and ' because a thirty ('30) foot setback would be required from, both streets, If the required thirty (30) foot s' etback were to be maintained on, Isabella �Street, the petitioner t would on,ly, be able to, construct a b 1 uilding 2 511 wide- (4) The granting of this variation will not be detri- mental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have concurred with the recommendation of the Board of Appeals that the variation herein be granted; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE, That the property being the subject matter of Case No. 73-5A eing legally described as follows: Lot 161 in Laudermilk Villa, beina subd givision i the Southeast 1/4 of Section 34, Township 42 North Range 11 East of the Third Principal Meridian, in Cook County, Illinois, I is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-1 (Single Family Residence), which zoning classification shall remain in effect subject to the variation granted herein, (a) That the side yard abutting Isabella Street be reduced by fourteen feet 37/100 inches (14.37). SE-C-TTON TWO: That all requirements of the Mount Prospect Building and oning o e shall be applicable except the variation noted in SECTION ONE heretofore mentioned. . . . SECTION THREE.- That the Director of Building and Zoning of the Village 0 sp Mo­u__nf"Tr'o ect is hereby authorized to 'issue a building permit for construction in accordance with the variation hereinbefore mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be anU d and of no force and effect whatsoever unless an applica- tion for a building permit pursuant to such variation 'is made and con- struction commenced within one (1) year of the date said Ordinance becomes effective. SECTION FIVE .: That this Ordinance shall be in full force and effect . .. . .... ........ . - - trom and after its passage, approval, and publication in the manner provided by law.
