Leslie Woul lett, Lt. Ervin vide, and Lt. E. Druffel to the Mayor and Board of Trustees. PUBLIC HEARING - PRE -ANNEXATION AND ZONING - LAKE BRIARWOOD AREA A public hearing was held to consider a petition for annexation and rezoning .from RX to R-1 Lots 45, 46, 47, 48 and 49 and all that .part of Bri arwood Drive West lying Easterly of a straight line drawn from the North West corner of Lot 49 to the South West corner of Lot 42 and lying Westerly of a strai ght 1 ine drawn from the North East corner of Lot 45 to the South East corner of Lot 44 all in Lake Briarwood Unit No. 2. The petition was at the request of E. L. Trendel Assoc, Inc. (Case 71-3P). A Resol uti on di recti ng the executi on of an annexati on agreement regulating the annexation of property located on Map 37-S of the Zoning Ordinance of Mt. Prospect, a Pre -annexation agreement, an ordinance rezoning Map 37-S of the Mount Prospect Zoning Or- dinance from RX to R-1, and an ordinance annexing property lo- cated on Map 37-S of the Zoning Ordinance of the Village of Mount Prospect, were presented. (At this point in the meeting Trustee Anderson arrived.) Trustee Furst, seconded by Trustee Scholten, moved for passage f of Resolution No. 27-72: A RESOLUTION DIRECTING THE EXECUTION OF AN ANNEXATION AGREEMENT REGULATING THE ANNEXATION OF PROPERTY LOCATED ON MAP 37-S OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT Upon roll cal 1 : Ayes: Ahern Anderson Furst Richardson Scholten Motion carried. An ordinance annexing property located on Map 37-S of the Zoning Ordinance of the Village of Mount Prospect, and an ordinance rezoning Map 37-S of the Mount Prospect Zoning Ordinance were read for first reading, and the Clerk was requested to place these on the agenda of November 8, 1972 for final passage. Trustee Ahern, seconded by Trustee Richardson, moved to authorize the Mayor to sign and the Clerk to attest, upon annexation of the property, subject to the pre -annexation agreement, the plat of annexation. M. and dusk. Trustee Anderson, seconded by Trustee Richardson, moved to indicate the interest of Mount Prospect in cooperating with the Village of Arlington Heights on an area anti -flooding program. - Upon roll call: Ayes: Ahern Anderson Furst Richardson Scholten Motion carried. Mayor Tei chert announced there would be a meeting of the Committee -of -the -Whole October 30th at 8:00 P. M. in the Village Hall regarding the Central School property. Trustee Ahern, seconded by Trustee Scholten, moved for waiver of the rules to considering supplementing documentation for the TOPICS program on Route 83, Central and Evergreen. The Village Manager stated that illegal signs posted on park- ways would be removed. Busse Road. Petition for sign variations) - The Village Attorney reported there is a problem with this property, located adjacent to Fire Station #2, created by the setbacks of 50' and 30' on the corner, the need for clear visibility for the fire apparatus as well as easy ingress and egress, and location of the signs. The Village has placed restrictions on the subdivision plat which had been previously recorded, and the question posed now is whether or not variations can be granted to those restrictions or whether Marathon Oil Company will be required to produce a new subdivision plat., The matter was referred to the Village At- torney. Wille Co. 100 W. Northwest Hwy. - petition for variation in rear yard, parking and sign. Case No. 72-32A. It had been learned that Commonwealth Edison was requiring a 5' easement at the rear of the property, and the petitioner's attorney, Allen Fagel, agreed to the granting of the easement. Discussion followed regarding the 9 parking spaces at the front of the p 5 10/17/72 store, adjacent to Northwest Highway, creating a hazard. The case was to be further cons i de red at the next meeti ng on November 8th. EXECUTIVE SESSION - Litigation The Mayor and Board of Trustees adjourned for Executive Session regarding litigation at 10:35 P. M. The members reconvened at 11:15 P. M. Present upon roll call: Anderson Furs t Richardson Scholten Teichert Absent: Ahern Link The Board met in Executive Session to discuss the final draft of the proposed Consent Decree in the litigation with Century Til -e, and the Village Board will meet in Execution Session on November 8th for further discussion. The matter will be on the agenda November 8th for formal vote to accept or refuse the Consent Decree. FINANCE COMMITTEE Trustee Richardson reported that no action was taken by the Committee regarding the request by Dover Inn for a Class "C" liquor license pending investigation of the status of S & H Liquors within one block of the location. The request for a modified Class "C" license by National Health Foods Co. located in the Randhurst Montgomery Ward store was deferred because no representative appeared at the meeting. FIRE AND POLICE COMMITTEE Trustee Scholten presented for first reading a I n ordinance regarding stop and yield sign warrants and requested the Clerk to place it on the next agenda November 8th. Trustee Scholten , seconded by Trustee Anderson, moved to con- cur with the recommendation of the Fire and Police Committee to approve the sight distance ordinance. Upon roll call: Ayes: Anderson Furst Richardson Schol ten The sight distance ordinance was read for first reading and the Clerk was requested to place it on the next agenda November 8th. Mr. Claus Dyck, 1722 Camp McDonald Rd. discussed the problems involved if the ordinance were enforced. He is the owner of property on a corner. He questioned whether, if they were judged to be a hazard, he would be reimbursed for the removal of some blue spruce trees. The matter was debated at great length but no action was taken. P. 6 10/17/72 The Committee recommended designation of streets as arterials as suggested by the Village Engineer and Safety Commission. These streets were those also recommended in the Crawford, Bunte and Roden Traffic Survey. 1 Trustee Scholten , seconded by Trustee Furst, moved the Board concur with the recommendation of the Fire and Police Com- mittee and Safety Commission in designating streets as outlined on a map presented to the Clerk as arterial streets. AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 100 WEST NORTHWEST HIGHWAY, MOUNT PROSPECT ILLINOIS , 1 01040.2 WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet on September 28, 1972, at the hour of 8,-00 p.m., in the Village Hall of Mount Prospect and did hear Case No. 72-32A, pursuant to legal notice published in the Mount Prospect Herald on September 12, 1972; and , wow WHEREAS, the Board of Appeals of the Village of Mount Prospect did hea.m a petition requesting variations for the reduction of off-street park- ing and loadingfaci*llties- the increasing of the size and height of P a sign; the installation of a basement; the reduction of rear yard requirements; and the installation of outdoor lighting of certain park ing areas; and I WHEREAS, the Board of Appeals of the Village of Mount Prospect voted 3-1 to allow the variations provided the entire buildings would be sprinklered to the satisfaction of the Mount Prospect Fire Department; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has recommended that the President and Board of Trustees grant these variations; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is for the best interests of the Village of Mount Prospect, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT., COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. lw11 111 I'm 11 1, r, 72-32A being legally described as follows: Lots 2-12 inclusive in Block 2 in Busse and Wille's Resubdivision in Mount Prospect, a Subdivision in the West Half of Section 12, Township 41 North, Range 11 East of the Third Principal Meridian, Cook County, Illinois; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business - Retail and Service District), and I-1 (Light Industrial District), which zoning classifications shall remain subject to the variations granted herein below: A. RW98MW Village Cle—rk' ,- 2 - 'Village president I 0 ORDINANCE NO, AN ORDINANCE CONTROLLING SIGHT -DISTANCES AT UNCONTROLLED OR YIELD INTERSECTIONS WHEREAS, the Safety Commission of the Village of Mount Prospect has reviewed the condition of our streets and intersections along with the properties adjacent thereto; and WHEREAS, the Safety Commission has recommended to the President and Board of Trustees that an ordinance controlling sight -distances at uncontrolled or yield intersections be adopted to further carry out a program of traffic safety within the corporate limits of the Village of Mount Prospect; and WHEREAS, the Fire and Police Committee of the Board of Trustees of the Village of Mount Prospect and the Fire and Police Committee of the Board of Trustees of the Village of Mount Prospect has recommended that the President and Board of Trustees concur with the recommendation of the Safety Commission; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Section 9.501 of the Municipal Code of Mount Prospect Teas as amended, be and the same is hereby further amended in its entirety by reducing the height of shrubs and other obstructions to thirty-six (36") inches and by adding additional sight -distance regu- lations thereto, so that hereafter the said Section 9.501 shall be and read as follows: "Section 9.501 Planta 0 A. It shall be unlawful to plant any tree or shrub in any public street or parkway or other public place without having first secured a permit therefor. It shall be unlawful to plant, maintain or permit to grow any tree, shrub, or planting of any type within six (61) feet of any fire hydrant. Applications for such permits shall be made to the Clerk, and shall be referred by him to the Village Manager, or his duly authorized representa- tive. No shrub shall be planted, maintained or allowed to grow to a height of more than thirty-six (3611) inches. Trees shall be planted at least fifty (50') feet apart. All trees and shrubs so planted shall be placed subject to the direction and approval of the Village Manager, or his duly authorized representative, and shall become the property of the Village of Mount Prospect. 1. On corner lots adjacent to uncontrolled or yield intersections, no obstruction in excess of thirty- six (36") inches in height shall be permitted or located within the area of an isosceles right tri- angle having equal legs of thirty-five (351) feet along the front and side lot lines and which tri- angle lies within the corner of any lot or land formed by the intersection of any adjacent public rights-of-way. a. As used within the subsection, "obstruction" shall be construed to include evergreen trees, bushes, and other shrubs; fences; and all other structures as defined in the Mount Prospect Building Code. bo The acts prohl"'bited by this Section, are hereby declared to be a, public nuisance and a traffic hazard, in that 'they obstruct the clear view of motorists, cyclists, and pedestrians travelin,g on and, along adjacent streets and sidewalks,. Immediately upon detection by him, the Village Manager, or his duly authorized represent 'ati,v,e shall be and is hereby authorized to cause the remoa,l of such obstructions pursuant to the following procedure: In order to carry out the purposes of this ordinance and to implement the enforcement thereof, the 'Village Manager or his duly authorized, representative is hereby author zed and empowered to enter upon any lot or land in the Village of Mount Prospect at all reasonable hours for the purpose of measuring the aforedescribed distances to determine whether any obstruction lies within the afore- mentioned isosceles right triangle in viola- tion of these sight -distance regulations. It shall be unlawful for any person, firm, or corporation to take any action to prevent the Village Manager or his duly authorized repre- sentative from entering on any lot or land in the Village of Mount Prospect for the purpose of such inspection, or to interfere with the Village Manager or such representative in the performance of any of his duties provided for herein. iii If, upon said inspection, it is determined that said obstruction lies within the said isosceles right triangle, the Village Manager or his duly authorized representative shall serve or cause to be served a written notice upon the person, firm, or corporation who is the owner of the lot or land on which said obstruction is located, which notice shall inform the said owner of the violation and the obligations of the owner to comply with the provisions of this Ordinance* If the aforedescribed owner upon whom such notice is served fails, neglects, or refuses to remove or otherwise eliminate said obstruc- tion within thirty (30) days after the service of such notice, the Village Manager or his duly authorized representative may proceed to remove said obstruction and assess the cost thereof against the said owner of such lot or land and the amount of said cost of removal shall be paid by said owner to the Village of Mount Prospect. 1- 2 - iv.
