COMMUNICATIONS AND PETITIONS
Mr. Dick Huntsinger, 921 S. Nawata, Mrs. A. Bial las, 919 S.
Nawata, appeared before the Board to seek relief from flood-
ing problems at Nawata and Golf Rd. caused by cons'truction
of the new roadway. The Village Manager was requested to
discuss this matter with the Village Engineer and State

Mr. Paul Bangston , 2106 Jody Court, described the di ffi -
cul ties he encountered during the recent heavy rain when
his home was flooded. In his opinion the damage was
caused by a dike built to divert water from a farm at
the rear of his property. The administration was requested
to i nvesti gate.
MANAGER'S REPORT
Bids were opened on September 5th for MFT Contract 47 -CS,
for resurfacing 3694 feet of Burning Bush Lane from Euclid
to Tano Lane, Henry Street from Kenilworth to dead end,
William Street from Golf Road to Weller Creek,, and Sunset
Road from Edward St. to William St. It was the recommend-
ation of the Deputy Engineer, with concurrence by the Village
Manager, that the award by made to Arrow Road Construction
Co, for a total of $150 3946. 10, the I ow bi d. Trustee
Anderson, seconded by Trustee Schol ten, moved to award the
bid on MFT 47 -CS to the low bidder, Arrow Road Co. in the
amount of $150,946.10.

The Village Manager directed a memorandum to the Board
regarding the Randh urs t 'Corporati on request for financial
relief for their operations involving Village water. It
was the recommendation of Mr. Eppley that a credit of $1000
applied quarterly be allowed Randhurst Corporation on bill-
ings to them effective May 1, 1972. Trustee Ahern, seconded
by Trustee Link,, moved to concur in the above recommendation.

A memorandum from the Village Manager was directed to the
Board regarding a request from the Fire Chief to sell one
Ford Darley 500 GPM Pumper, and recommended authorizWon

the purchase of firehose. Trustee Scholten, seconded by
Trustee Anderson, moved to authorize advertisement for bids
for the Ford Darley 500 GPM Pumper and the funds to be used
for the purchase of fi reh'ose.

the 1972-73 fiscal year as indicated in the Budget Officer's
memorandum dated August 31, 1972.

Present during the consideration of the above ordinance were
several mail carriers who voiced opposition to its passage and
requested permission to park all day on Maple Street while they
deliver mail. Mr. Albert Motsch, 600 S. Pine, spoke on behalf
of the postal employees. No further action was taken.
MAYOR'S REPORT
Mayor Teichert procalimed the month of September as Children's
Lung Disease Month and September 10 through September -17 as
Children's Lung Disease Week, urging the citizens of Mount
Prospect to join with the National Cystic Fibrosis Research
Foundation.
Mayor Tei chert proclaimed September 5, 1972 School's Open Day
to insure the safety of the children as they travel to and from
their classes.
In order to keep the following ordinance in proper sequence with
Ordinance No. 2369, No. 2370 was reserved. Trustee Ahern, sec-
onded by Trustee Link, moved for waiver of the rules requiring
two readings of an ordinance. (Case No. 72-13P).

Mr. Klein, 2116 Jody Court, appeared before the Board to advise
he had been to Arlington Heights to seek information on the
small business association flood relief program. He was unable
to obtain the proper forms. The Village Manager was requested
to furnish a supply to Mount Prospect residents who desired to
make use of this program.
BUILDING COMMITTEE REPORT
It was the recommendation of the Building Committee to approve
the petition for variation requested by Mt. Prospect Moose
Lodge #660, for a special use permit to operate a lodge at the
rear of 225 East Prospect Avenue, concurring with the recom-
mendation of the Board of Appeals. (Case 72-22A). Trustee
Anderson, seconded by Trustee Ahern, moved to concur with the
recommendation of the Board of Appeals in Case 72-22A and
grant a special use to permit to Mt. Prospect Moose Lodge #660
at 225 E. Prospect Avenue.

in the recommendation of the Finance Committee for issuance

The attorney was requested to draft the appropriate
ordinances.
The Building Committee recommended that the Mayor and Board
of Trustees submit a resolution to the Illinois State Toll
Highway authority indicating a need for additional ramps
for ingress and egress from the Northwest Tollway in the
southern portion of Mount Prospect. Trustee Anderson ,
seconded by Trustee Scholten , moved to concur in the recom-
mendation of the Building Committee and instruct the Village
Attorney to draft an appropriate resolution indicating the
need, as outlined above.

The Building Committee considered the condition of public alleys
within the Village. It was the opinion of the Committee that
the a] I eys shoul d be of such condi ti on that the motori ng pub I i c
can use them without fear of damaging the automobile or causing
dust to circulate. Trustee Anderson requested an opinion from
the Village Attorney concerning the problem of special assess-
ments and whether or not the matter should go before the Board
of Local Improvements.

rules requiring two readings of an ordinance relating to Case
72-23A Robert Novak
Trustee Anderson, seconded by Trustee Schol ten, moved for
passage of Ordinance #2373:

MENT VARIATIONS FOR PROPERTY LOCATED AT 700 SOUTH CAN-
DOTA AVENUE, MOUNT PROSPECT, ILLINOIS

petition for variation 12'4" on front lot line to con-
struct a garage addition to the house. Trustee Anderson,
seconded by Trustee Ahern, moved the Board concur with
the Board of Appeals and direct the Village Attorney to
draft the appropriate ordinance.

The Building Committee Chairman requested that considera-
tion of Case 72-28A - Di Mucci Home Builders - 1821 Golf
Road be deferred to the special meeting to be held
September 12, 1972.
Case 72-29A - Arnar-Stone Laboratories, 601 E. Kensington,
request from one space per 200 square feet in 1-1 District
and continuation of nonconforming use as it exists, to a
total of 125 parking spaces.

concur with the recommendation of the Building Committee
in granting the variation under Case 72-29A, subject to
the petitioner granting a 17' dedication on Kensington and a 50'
dedication on Wheeling as part of the plat of subdivision,

The Bucaro application for a beer and wine license was de-
ferred to the September 19th agenda.

concur in the recommendation of the Finance Committee to es-
tablish a corporate revolving fund for engineering investi-
gation of MFT in the amount of $3,000.

PUBLIC WORKS COMMITTEE
Trustee Link submitted a report on a tree mai nterianice pro-
gram for the balance of the fiscal year 1972-73 and the
Public Works Committee recommended that the Board approve,
and in turn, direct the Village Attorney to draft an appro-
priate contract to cover the tree program with A. J. Davis
and Co. at a monthly rate of $6,500 for the period 9/l/72
through 4/30/73. Trustee Link, seconded by Trustee Scholten,
moved to request the Village Attorney to draft the appro-
priate contract to cover the above -discussed tree maintenance
program.

OF THE
MAYOR AND BOARD OF TRUSTEES
September 12 1972
CALL TO ORDER
Mayor Tei chert called the meeting to order at `:9:15 PM.
This special meeting was called by Mayor Tei chert on
Friday, September 8, 1972 pursuant to Chapter 2. Sec-
tion 2.103 of the Municipal Code of Mount Prospect.
The purpose of the meeting was to hold a public hear.-
ing on a pre -annexation agreement governing the e anne'x-
ation of the Rob Roy Driving Range, located north of
Euclid Avenue. During this hearing, a court reporter
was present to record word-for-word the discussion
between the petitioner, Roy Gottlieb of Kenroy, Inc.,
the Mayor and Board of Trustees, and interested citi-
z e n s . A copy of this transcript is in the file of the
Village Clerk.

BUILDING COMMITTEE REPORT
While awaiting the arrival of Trustee Furst, the Board
considered the petition of Di Mucci Home Builders, 1821
Golf Road, Case 72-28A - request to move existing non-
conforming TV antenna tower from 1407 Golf Road to 1821
Golf Road. The TV antenna is 100' in height, and it was
determined that it was not hazardous to the neighboring
area. Trustee Anderson, seconded by Trustee Ahern, moved
to concur in the recommendation of the Building Committee
Chairman and Board of Appeals for transfer of the tower
from 1407 Golf Road to 1821 Golf Road.

ROB ROY DRIVING RANGE
At this point in the meeting Trustee Furst arrived.
A.resolution was submitted, authorizing execution of an
ahnex.ation agreement in Case No. 72-11P. Representing the
petitioner, Roy Gottlieb, was Attorney Howard Borde,
4849 Golf Road, Skokie, Ill. Exhibits submitted to
the Plan Commission at the time of the pre -annexation
zoning hearing were displayed. Trustee Anderson ex-
pressed concern about the traffic intensification at
the intersection. Mr. Carl Kupfers Registered Engineer
with the Kenroy Corp. showed a diagram of the traffic
flow within the complex.
The agreement was read page by page and amendments in-
serted.
Interested citizens were then given an opportunity to
be heard. Among those present who voiced opposition
to the proposed project were Donald Bostrum, 1600 Iron-
wood, a member of the Northwest Community Council and
President of River Trails Civic Association, Warren
Hanson, 1407 Cedar,, J. Hawne,ssey, 1101 E. Alder Lane,
SCh ri's Botus, 1,602 Ironwood, DonRebb, 904 Westgate,
Ashby Gibbons, 1615 Dogwood, L. Heideman, 1106 Bar-
berry, and Thomas Warde�n, Superintendent of Schools,
District 26 IM a J ry Semridge, 600 Greenwood, George Parlier,
1614 Dogwood, Judy Starkey, '1780 Eastman Dr.
Some of the objections concerned the construction of
buildings in the flood plain area, overcrowding of
schools traffic hazard, use of the proposed park for
water storage for the complex, and the problem of the
supply of water.
Mayor Tei chert polled the Board, and all members indi
-
cated they would Vote -nay, with the exception of Trustee
Link, who sated he had represented the River Trails
Ci vi c Association and voting would constitute a con -
f1 i c t of interest.
Trustee Scholten , seconded by Trustee Ahern, moved to
approve the concept as presented by the Kenroy Corp. for
a multi -family complex proposed for the Roy Roy Driving
R a n g e .

LOCATED AT 1821 GOLF ROAD MOUNT PROSPECT ILLINOIS
WHEREAS,, the Board of Appeals of the Village of Mount Prospect
held a public hearing on August 24, 1972, at the hour of 8:00 p.m.,
in the Mount Prospect Village Hall, pursuant to notice published
in the Mount Prospect Herald on August 4, 1972; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect
heard testimony presented under Case No. 72-28A pertaining to a re-
quest by DiMucc-i Home Builders, Inc., for certain variations from
the Mount Prospect Zoning Ordinance to permit the erection of an one
hundred (1001) foot tower upon the property hereinafter described,, and
WHEREAS, the Board of Appeals of the Village of Mount Prospect
have recommended to the President and Board of Trustees that the re-
quested height variation be granted; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matter contained herein and believe
that the best interests of the Village of Mount Prospect will be served
by the granting of the said petition;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the following variation be and it is hereby
granted for the property which is the subject matter of Case No. 72-28A,
which property is legally described as follows:
Lot 659 in Elk Ridge Villa Unit No. 7A,
being a subdivision of part of the North
East 1/4 of Section ion 15, Township 41 North,
Range 11, East of the Third Principal Meri-
dian, in Cook County, Illinois;
(a) The terms of the Mount Prospect Building Code are
hereby varied so as to permit the construction and
erection of an one hundred (1001) foot high tubular
television antenna support within the existing develop-
ment upon the subject property in a location which
will allow a full drop of the entire length of the
antenna and tower within the property lines of the
subject tract and without affecting any building
except the recreational center to which this tower
will be adjacent,
SECTION TWO: That the aforesaid variation will be valid and
effective only upon the performance and continuous maintenance with
tespect to the subject property of the following conditions and re-
strictions:
(a) That the base of the subject tower shall not be
located within two hundred fifty (2S01) feet of
any public right-of-way;
(b) That the base of the tower shall not be located
within two hundred (2001) feet of aboveground
electrical wires; and
(c) That the antenna to be located on the subject
property shall in no way cause any interference
with radio or television reception to any other
properties in Mount Prospect.
SECTION THREE: That the Director of Building and Zoning of the
Village of Mount' ospect is hereby directed to issue a building permit
for the subject tower in accordance with the variation and limitations
herein set forth.
SECTION FOUR: That the variation granted by this Ordinance shall
be null and void and of no force and effect whatsoever unless an appli-
cation for a building permit, pursuant to such variation and restric-
tions contained herein., is made and construction commenced within one
(1) year of the date this Ordinance becomes effective,
SECTION FIVE: That this Ordinance shall be in full force and
effect from and after its passage, approval, and publication in the
manner provided by law.

AN ORDINANCE GRANTING FRONT YARD REQUIREMENT VARIATION
FOR PROPERTY LOCATED AT 1409 SAUK LANE, MOUNT PROSPECT,
ILLINOIS
WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet
on the 24th day of August, 1972, at the hour of 8:00 p.m., at the Mount
Prospect Village Hall and did hear Case No. 72-25A, pursuant to proper
legal notice; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear
this request for a front yard variation to allow the petitioner to con-
struct a 241x241 garage to be attached to the front of petitioner's
property, thereby expanding his residence beyond thirty (301) feet of
his front property line of the lot legally described herein below; and
WHEREAS., the Board of Appeals of the Village of Mount Pros ect did re-
commend to the President and Board of Trustees the approv2 of this re-
quest under Case No. 62-25A for the reasons that:
(1) There is a practical difficulty and particular
hardship on the petitioner;
(2) The purpose of the variation is not based ex-
clusively upon the desire to make money;
(3) The conditions upon which the petition for this
variation is based rests in the original develop-
ment of the property, which has a 4118" setback
from the street, versus a 301 lot line setback
for all adjacent property.
(4) In order to construct a 2 -car garage,which is a
necessity for the petitioner within the confines
of the road, it will be necessary for him to build
a long, narrow drive and construct the 2 -car garage
to the rear of his yard, which is already restricted
by the fact that the residence is constructed with
the aforesaid 4118" front setback.
(5) The construction of the proposed structure would
not obstruct any windows or doorways to the existing
building, inasmuch as the wall to which it would be
affixed is presently devoid of windows and doors.
(6) The granting of this variation will not be detrimental
to the public or injurious to surrounding property
in that it will not alter the essential character
of the locality; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have concurred with the recommendation of the Board of Appeals
that the variation herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the
same is for the best interests of the Village of Mount Prospect;

AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO PROSPECT
MOOSE LODGE NO. 660, LOCATED AT 225 EAST PROSPECT AVENUE,
MOUNT PROSPECT_, ILLINOIS
I
WHEREAS, the Board of Appeals of the Village of Mount Prospect did hold
a public hearing on July 27, 1972, at the hour of 8:00 p.m., in the
Mount Prospect Village Hall,, pursuant to notice published in the Mount
Prospect Herald on July 3, 1972; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear
the testimony presented under Case No. 72-22A pertaining to a request by
the Prospect Moose Lodge No. 660 for a certain special use to permit the
utilization of the property hereinafter described as a lodge or private
club; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect has re-
commended to the Mayor and Board of Trustees of the Village of Mount
Prospect that said request be granted for the following reasons:
(a) That the establishment, maintenance, or operation
of the special use upon the light industrial pro-
perties herein involved will not be detrimental to
or endanger the public health, safety, morals, com-
fort, or general welfare of the citizenry of the Vil-
lage off -Mount Prospect;
(b) That the special use will not be injurious to the
use and enjoyment of other property in the immediate
vicinity for the purposes already permitted, nor sub-
stantially diminish and impair property values within
the neighborhood.
(c) That the establishment of the special use will not
impede the normal and orderly development and im-
provement of surrounding property for uses permitted
in the district.
(d) That adequate utilities, access roads, drainage
and/or other necessary facilities have been or are
being provided.
(e) That adequate measures have been or will be taken
to provide ingress and egress so designed as to
minimize traffic congestion in the public streets.
(f) That the special use shall in all other respects
conform to the applicable regulations of the dis-
trict in which it is located; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the said proposal for a special use and the
recommendations of the Board of Appeals under Case No. 72-22A and
have determined that the same are in the best interests of the Village
of Mount Prospect";

SECTION ONE: That the following special use be and is hereby granted

WHEREAS, the Board of Appeals of the Village of Mount Prospect held a
regular meeting on August 24, 1972, at the hour of 8:00 p.m., in the
'Mount Prospect Village Hall pursuant to notice published in the Mount
Prospect Herald on August 8, 1972; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 72-29A pertaining to a request to
provide 125 parking spaces for an industrial use occupying 80,200 sq.ft.
of floor area; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect has
recommended to the Board of Trustees of the Village of Mount Prospect
to allow the variation for reasons that:
(1) There is a practical hardship on the owner in that
the existing and proposed laboratory use has not
and will not require more than 125 spaces for parking;
(2) The conditions upon which the petition for a variation
is based are unique and would not be generally appli-
cable to other property within the same zoning classi-
fication;
(3) The purpose of the variation is not based exclusively
upon a desire to make more money out of the property;
(4) The granting of the variation will not be materially
detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which
the property is located;
(5) The proposed variation will not impair an adequate
supply of light and air to adjacent property, or sub-
stantially increase the congestion in the public streets,
or increase the danger of fire, or endanger the public
safety, or substantially diminish or impair property
values within the neighborhood; and
WHEREAS., the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the
same is for the best interests of the Village of Mount Prospect;
NOW., THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
