MANAGER'S REPORT
Mr. Eppley T—e-a-F a communication from the Mount Prospect
Jaycees petitioning the Village of Mount Prospect for a
special events liquor license and other necessary licenses
for the period of time September 1, 1972 thru September 5, 1972
to hold their 4th annual OKTOBERFEST held at the Mount Prospect
Plaza. The Village Manager recommended a waiver of fees for
this event.
Trustee Furst,, seconded by Trustee Link, moved for the waiver
of fees for the Jaycees 4th annual OKTOBERFEST to be held
September 1 thru Septmeber 5, 1972.

Mr. Eppley read a letter from Mr. Robert E. Birks, President
of Prospect Cab Company requesting the Village Board approve
the licensing of three additional taxi cabs in the Village.
It was the recommendation of the village Manager that these
licenses be issued.
This matter was referred to the Finance Committees meeting on
August 21st for recommendation.
The Village Manager reported on opening of bids for the
William Street Bridge (37 -CS) and recommended the award go
to John Burns Construction Co. of Orland Park, Illinois
with the low bid of $84,884.40.

award the contract for William Street Bridge (37 -CS)

requesting the Board of Trustees approve the Resolution
for 47 -CS. This will widen and improve Burning Bush,
William, Sunset and Henry Streets at a cost of $125,000.

ORDINANCE NO.
AN ORDINANCE GRANTING FRONT YARD AND SIDE YARD REQUIREMENT
VARIATIONS FOR PROPERTY LOCATED AT 700 SOUTH CANDOTA AVENUE,
MOUNT PROSPECT, ILLINOIS
WHEREAS, the Beard of Appeals of the Village of Mount Prospect did meet
on the 27th day of July, 1972, at the hour of 8:00 p.m., at the Mount
Prospect Village Hall and did hear Case No. 72-23A, pursuant to proper
legal notice; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear
this request for a front yard variation and a side yard variation to al-
low the petitioner to expand his residence to within thirty (30) feet of
his front property line and to within ten (19) feet of his side property
line of the lot legally described herein below; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees the approval of this request
under Case No. 72-23A for the reasons that:
1) There is a practical difficulty and particular
hardship on the petitioner;
(2) The purpose of the variations is not based ex-
clusively upon a desire to mare money;
(3) The conditions upon which the petition for these
variations is based are unique in that its layout
was not similar to any other lot in the area., being
of unusual physical shape; and
(4) The granting of these variations will not be detri-
mental to the public or injurious to ,surrounding
property in that they will not alter the essential
character of the .locality; and
WHEREAS, the President and Beard of Trustees of the Village of Mount
Prospect have concurred with the recommendation of the Board of Appeals
that the variations herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the
,same is for the best interests of the Village of Mount. Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No.
72-23A, 'being legally described as follows
Lot 13 in Block 26 in Prospect Park Country Club
Subdivision of the South East Quarter of Section 11
and the South 15 acres of the East half of the North
East Quarter of Section 11, Township 41 North, Range
11, East of the Third Principal Meridian, in Cook
County, Illinois,

SECTION FOUR: That the variations granted by this Ordinance shall be

such building permits as may be required for the said planned unit develop-
ment, the construction of which shall be governed by the terms of the said
annexation agreement, Section 5.1 of the Mount Prospect Zoning Ordinance,
this ordinance herein, and all other applicable ordinances of the Village
of Mount Prospect.
SECTION J FOUR: That as each stage of development is completed and occu-
pancy certlTicat es are issued for all of the residencies in such stage,
Bertram A. Lewis, Harvey B. Lewis and J. Laurence Kleinfeld, or their
assignees, will cause a Plat of Open Space Easement to be delivered to
the Village of Mount Prospect.
A. These plats shall be recorded and shall contain such
wording sufficient to permanently guarantee the open
space as shown on such easement in accordance with the
said planned unit development and any amendments thereto.
B. That said is of Open Space Easement shall constitute a
covenant running with the land and shall be enforceable by
the said Village of count Prospect.
SECTION FIVE: That this ordinance together with all its exhibits and
Flans all. be recorded in the Office of the Recorder of Deeds of Cook
County, Illinois upon completion of the planned unit development herein*
and the Restrictive Covenants contained in Exhibit C hereto shall be re-
corded immediately upon the execution thereof and the passage and approval
of this ordinance.
SECTION SIX: That this ordinance shall be in full force and effect from
and a terns passage, approval, and publication in a manner provided by law
and the recording of the Restrictive Covenants which shall enure to and
be for the benefit of the Village of Mount Prospect and which covenants
are attached hereto as Exhibit C; said covenants guaranteeing among other
things: (1) the development of the subject property in accordance with
the planned unit development herein; (2) the continued maintenance and
protection of all public open space and common open space with the said
planned unit development; (3) the right of the Village of Mount Prospect
to enforce said covenants by any appropriate action in law or in equity;
and (4) the guarantee of the Owner that common ownership or control shall
extend to all portions of the planned unit development for a period of
not less than eighteen (18) months following its completion, which common
ownership or control shall extend to all common open space, landscaping,
exterior maintenance, and all other exterior aspects of the development
for a period of not less than twenty (20) years.

AN ORDINANCE VACATING THAYER AVENUE BETWEEN
KENILWORTH AVENUE AND WAVERLY PLACE AND AN
ADJOINING ALLEY
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have signed an agreed order in order to preserve the best
interests of the Village of Mount Prospect and terminate Case No. 69L16498;
and
WHEREAS, by the teras of said order the village Board of Trustees
have agreed to vacate Thayer Avenue between Kenilworth Avenue and Waverly
Place, and the alley heretofore existing between Kenilworth Avenue and
the above described area of Thayer Avenin to be vacated. herein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS.*
SECTION ONE: That the following area of Thayer Avenue between
