Mayor Teichert called the meeting to order at 8:35 P. M.

INTRODUCTION OF NEW MEMBERS OF THE FIRE DEPARTMENT
Commissioner Grittaniand Chi of Pairitz introduced 13 newly -
appointed members of the Fire Department.
LETTER OF RESIGNATION - TRUSTEE MONROE
Trustee Monroe read a Ieater of resignation as a member of
the Village Board, necessitated by his son's injury and
required rehabilitation. Mayor Tei chert deferred acceptance
until the end of the present Board meeting and stated there
would be a Committee -of -the -Whole meeting on May 20th at
8:00 A. M. in the Village Hall and called a Special Meeting
for Tuesday, May 23rd for the appointment of a Trustee to
fill the vacancy.
INTRODUCTION OF DIRECTOR OF HEALTH SERVICES
Mrs. Marjorie Boswell, newly -appointed Director of Health
Services was introduced to the Board.

COMMUNICATIONS AND PETITIONS
Mr. Richard Hendricks 'discussed Fa,irview Gardens street light-
ing and asked the reason for denial of a special assessment
program. The Board of Local Improvements did not recommend
a hearing for the purpose of a special assessment for under-
ground wiring because it was deemed a luxury instead of a
necessity. Trustee Furst, seconded by Trustee Ahern, moved
the Board concur with the recommendation of the Board of
Local Improvements not to proceed with a hearing for the pur-
pose of a special assessment to install lighting in the Fair-
view Gardens Subdivision in excess of the standards required
by the present Village policy.

Mr. Lester Krasnowski appeared before the Board re Case 72-8A
which is a petition for a variation to permit a garden apart-
ment to be constructed in an existing two -flat at 213 W.
Prospect Ave. Considerable discussion ensued, and Trustee
Anderson, seconded by Trustee Scholten, moved to defer a vote
on this matter until the next regular Board meeting June 6th.

Motion carried.
Attorney Braithwaite requested the Board to have the amount of
the special assessment #70 reduced. He represented 55 property
owners who are in favor of the Hatlen Heights project but op-
posed to the amount of assessment they would be required to
pay. However, Mayor Tei chert indicated it was not the posture
of the Board to proceed with an appeal.

Mr. Charles DePaul , representing the Civil Air Patrol, stated
the organization was having a carnival at the Mount Prospect
Plaza June 7th to the filth and requested a waiver of fees.

MANAGER' S REPORT
Trustee Anderson, seconded by Trustee Richardson, moved to
authorize the Mayor and Clerk to sign an agreement for engineer-
ing services (Section 45 -CS) with Alstott and March.

The Village Manager reported that he approved field changes as
set forth in Section 5.1 of the Mount Prospect Zoning Ordinance,
Sub -section (F) in Kenroy's Huntington Estates PUD, changing the
floor layout of two buildings from "U" to "P and in five other
attached buildings substituting "Y" and "T" shapes for "L".
The Village Manager reported on the bus service to Randhurst
and Trustee Richardson, seconded by Trustee Monroe, moved to
authorize the participation in the shoppers bus service be-
tween Jefferson Park to Randhurst to the" end of May, 1972.

The Village Manager requested authorization to contract for
drilling of Well #16 in south Mount Prospect on 1 acre of
land known as the Semrow property, explaining that a rotary
type of well equipment would be used and could be available
immediately. Discussion followed on costs involved and fur-
ther consideration was deferred until the special meeting on
May. 23rd.
BUILDING COMMITTEE REPORT
Trustee Richardson, seconded by Trustee Ahern, moved to concur
in the recommendation of the Building Committee in Case 72-7A
to over -ride the 5-2 Board of Appeals recommendation for de-
nial and grant the variation to provide for a free-standing
building at Randhurst (Metro Sports, Inc.)

The Building Committee conside'reid the petition of Addressogr.aph-
Multigraph (Case 72-12A) and recommended concurrence with the
Board of Appeals to approve the request to erect a temporary

The Building Committee reviewed Case 72-1 OA - Commonwealth
Edison - petition for variation to erect a sub -station north
of Kensington near Wolf Road and recommended concurrence with
the recommendation of the Board of Appeals and granting of a
variation. Trustee Richardson, seconded by Trustee Ahern,
moved to concur with the Board of Appeals and Building Com-
mittee to grant the Variation to erect asub-station as out-
lined above.

Trustee Richar,dson presented an ordinance granting the varia-
tion to Commonwealth Edison and requested the Clerk to place
it on the agenda for the next regular meeting June 6th.
The Building Committee gave a status report regarding a swimming
pool ordinance and Trustee Richardson, seconded by Trustee Ahern,
moved the Village Board concur in the recommendation of the Chair-
man of the Building Committee to revise the swimming pool ordinance
so that swimming pools are not a special use.
Mrs. Paul Seliager, 1103 Sycamore Lane, spoke before the Board
against above -ground pools and the invasion of privacy of neigh -

with the recommendation of the Board of Appeals and Building

FINANCE COMMITTEE
The Finance Committee reviewed the request for a liquor license
at the Bon Ton Poultry Restaurant, located at 303 E. Kensington,
and studied the various ordinances governing the use of the
property which stated that at no time wool d there be the sal e
of liquor, the main building must maintain a one floor only
operation, the property was rezoned to B-3, and the Building
Committee requested an opinion of the Village Attorney -
PUBLIC HEALTH AND SAFETY COMMITTEE
The Public Health and Safety Committee discussed senior citizen
housing and devised a questionnaire to determine if there is a
demand for such a service. The method of distribution of the
questionnaire was recommended to be done in three phases; 1)
all residents on individual water meters will receive it by
mail; 2) the Jaycees will hand deliver the survey to all
multiple dwelling units not on individual water meters-,
3) Citizens Utility Co. will be contacted for water billing
listing of the newly -annexed area for mailing surveys to that

area. The target date for completion of the survey distribution
has been set for Saturday, May 7th. The Committee recommended
that the Board authorize the expenditure of up $1,000 for the
project and that the administration be directed to purchase the
necessary supplies and distribute the survey. Trustee Scholten,
seconded by Trustee Anderson, moved to concur with the recommend-
ation of the'Public Health and Safety Committee and authorize the
expenditure of $1,000 for the project, and the administration be
directed to purchase supplies and conduct the survey.

Village Manager in the changes as outlined above regarding Hunt-
ington Commons.

Mayor Teichert proclaimed the week of May 15, 1972 as National
Police Week and May 15 of each year to be Police Memorial Day.

Mayor Teichert reappointed Norman Dozy to the Board of Appeals
for a 5 -year term and requested Board concurrence. Trustee
Richardson, seconded by Trustee Anderson, moved to concur in
the reappointment of Norman Kozy to the Board of Appeals.

AN ORDINANCE GRANTING A HEIGHT VARIATION FOR PROPERTY
LOCATED AT 1500 EAST CENTRAL ROAD
WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet
on April 27, 1972, at the hour of 8:00 p.m. in the Mount Prospect
Village Hall pursuant to notice published in the manner provided by
law; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect heard
testimony under Case No. 72-11A pertaining to a request for a variation
to allow an overall building height of sixty-two ( 62 ) feet no (0) inches
for a church to be located at 1500 East Central Road; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect have
recommended to the President and Board of Trustees the granting of the
variation requested under Case No. 72-11A for reasons that:
1. There is a practical difficulty and particular hardship
on the petitioner in that the cpntribution to the esthetics,
of the community that the proposed church would otherwise
make will be lost by current restrictions limiting the
height of the steeple and cross proposed herein;

2. The purpose of the variation is by no means based on a
desire to make money;
3. The plight of the owner is due to unique circumstances in
that the land is so located in an R-1 Zoning District,
wherein churches and the owners of churches must abide
by the same height restrictions as owners of single-
family residences -- and yet churches are only an
allowable use in such residential zones;
4. The alleged difficulty or hardship has not been created
by any person presently having an interest in the property;
5. The proposed variation will not impair an adequate supply
of light and air to adjacent property, or substantially
increase the congestion in the public streets, or increase
the danger of fire, or endanger the public safety, or
otherwise substantially diminish or impair property values
within the neighborhood; and
6. The granting of the variation will not be detrimental to
the public or injurious to surrounding property in that
it will not alter the essential character of the locality
in fact, it will enhance the Village of Mount Prospect in
that it would be the only church built of this particular
design in this area; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the
same is for the best interest of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 72-11A,
being legally described as follows:

Lots 19, 20, 21, 22, 23, 24 in Bluetts Fairview Gardens,
and Lot 198 in the second 4dditipp to Bluetts Fairview
Gardens in ' subdivision duo and part of West half of the

East half f the Southeast 1/4 and part of the East
half of the West half of the Southeast 1/4 of Section
25, Township 42 N,, Range 10, East of the Third PM.,
is currently zoned R-1 (Single -Family Residence District) under the
Zoning Ordinnace of the Village of Mount Prospect, which zoning classi-
fication shall remain subject to the following granted variations:
(a) That the maximum height of the roof peak of the proposed
church shall not exceed forty-two (42) feet;
(b) That the chimney shall not exceed fifty (50) feet in
height; and
(c) That the maximum height of the cross atop the church shall
not exceed sixty-two ( 62 ) feet.
SECTION TWO: That all other requirements of the Village Code shall
continue to be applicable, except those height variations as specified
in Section One hereinabove mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village
of Mount Prospect is hereby directed to issue a building permit in
accordance with the variations herein contained.
SECTION FOUR: That the variations granted by this Ordinance shall be
null and void and of no force and effect whatsoever unless an application
for a building permit pursuant to such variations is made and construction
commenced within one (1) year from the date this Ordinance becomes
effective.
SECTION FIVE: That this Ordinance shall be �n full force and effect
from and af:Eer the recording of a properly approved plat of resub-
division; and the passage, approval, and publication of this Ordinance
in the manner provided by law*

WHEREAS, the Board of Appeals of the Village of Mount Prospect heard

to allow the erection of two ( 2 ) buildings with a height of twelve (12)
stories; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect have
recommended to the President and Board of Trustees the granting of the
variation requested under Case No. 72-6A for reasons that:

AN ORDINANCE GRANTING A PARKING VARIATION FOR PROPERTY LOCATED
AT 107-109 WEST PROSPECT AVENUE.
WHEREAS, the Board of Appeals of the Village of Mount Prospect .did hold
a public hearing on April 27, 1972, at the hour of 8:00 p.m. in the
Mount Prospect Village Hall pursuant to notice published in a newspaper
of general circulation within the Village of Mount Prospect; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear
testimony presented under Case No. 72-9A pertaining to a request to
construct at 107-109 West Prospect Avenue three (3) stores with only
six (6) parking spaces instead of ten (10) spaces as presently pro-
vided by ordinance; and
WHEREAS, the Board of Appeals recommended to the Building Committee of
-the Board of Trustees of the Village of Mount Prospect to allow the
variation petitioned for because:
1. There is a practical hardship on the petitioner, since at
the time the property was rezoned to its present zoning
classification, parking requirements were less stringent;
2. The purpose of the variation is not based exclusively
upon the desire to make money;
3. The granting of the variation will not be detrimental
to the public or injurious to surrounding property in
that it will not alter the essential character of the
locality; land

OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case
No. 72-9A, being legally described as follows:
Lots 18 and 19 in Busse's Resubdivision on Lots 1
to 6 inclusive in Block 4, also of Lots 2 and 3 in
Block 5, all of Block 6, Lots 13 to 24 inclusive in
Block 7, and Lots 17 to 20 in Block 8, all in Meier's
Addition to Mount Prospect, being a Subdivision in the
Northwest Quarter of Section 12, Township 41 North,
Range 11, East of the Third Princip4l Meridian in
Cook County, Illinois;
is currently zoned under the Zoning Ordinance of the Village of Mount
Prospect as B-3 (Business - Retail and Service District), which
zoning classification shall remain subject- to the following granted
variation:
That the land described above may include the construction
and erection of a building to house three (3) stores according
to the plans attached hereto and made a part hereof, and
that only six (6) parking spaces need be provided to serve
the above-described building.
SECTION" TWO: That all of the requirements of the Village Code of Mount,
Prospect be applicable except those variations set out in SECTION ONE
above.
SECTION THREE:i That the Director of Building and Zoning of the Village
of' MountProspect is hereby authorized and directed to issue a bung
permit in accordance with the variations and limitations hereinbefore
mentioned.
SECTION FOUR: That the variations granted.by this Ordinance shall be
null,
andvoid;and of no force and effect' whatsoever unless an application
for a building permit pursuant to such variation is made and construction
commenced within one (1) year of the date said Ordinance becomes effective.
SECTION FIVE,: That this Ordinance shall be in full force and effect
