MANAGER' S REPORT The Vi 11 age Manager reported that the E Hart Gi rl s had contributed $200-00 toward the recycling program. The annual operating agreement with Metropolitan Sanitary District of Greater Chicago was submitted. Trustee Anderson seconded by Trustee Scholten , moved to authorize the Mayor and Clerk to sign the agreement with the Metropolitan Sani tary District of Greater Chicago agreement for maintenance of the sewers within the Village limits at an amount not to exceed $43.750. Upon roll call: Ayes: Ahern Anderson Furst Monroe Richardson Scholten Motion carried. The Village Manager reported on the commuter bus rides to Randhurst, cost of which is shared by the Village, the United Motor Coach Co. and Randhurst, and daily counts showed there is an upswing in the use of the service. The Village ,Manager reported on opening of bids for two 32,000 GVW trucks, truck bodies, an automobile for Public Works, 3/4 ton pick-up truck and three 12' platform bodies and in each case the low bidder was recommended. MAYOR' S REPORT Mayor Tei chert reported May lst is the expiration date for several members of Boards and Commissions and and he an- nounced his intention to make new appointments at the next regular meeting and invited recommendations for members of the Board. p. 2 5/2/72 COMMITTEE CHAIRMEN REPORTS BUILDING COMMITTEE The Building Committee will review the possible adoption of the BOCA 1970 Plumbing Code and the latest draft of the swimming pool ordinance at the next meeting on May 1 Oth The Committee is reviewing BOCA regulations coveri ng housing and commercial buildings and will make recom- mendations to the Board. There is no provision making it mandatory for persons to screen and conceal garbage containers from view of persons off the property and the Committee requested the Building and Zoning Commissioner to review this subject and refer it back to the Village Attorney for possible amendments to a draft ordinance. FINANCE COMMITTEE Trustee. FIRE AND POLICE COMMITTEE Trustee Monroe requested the following matters be dropped from the Fire and Police Committee: Lighted entrance markers on Louis St. at Golf Road; Chamber of Commerce transportation survey; shoppers bus report. OTHER BUSINESS The pre -annexation hearing regarding property south of Algonquin and east of Nordic Road was continued to the next regular meeting. Trustee Anderson, seconded by Trustee Scholten, moved to authorize the Mayor and Village Clerk to sign and attest the Cumberland Terrace plat of subdivision, subject to posting of public improvement bonds, if any. (c) That the building design and layout shall be similar to those "center core plans" attached hereto and hereby made a part hereof as Exhibit B. (d) That the operation of the complex itself shall be classified as providing a retail service and shall be li- censed as such upon payment of the proper fees provided for such business within Chapter 11 of the Municipal Code of Mount Prospect. SECTION TWO: That all other requirements of the Village Code of Mount Prospect be applicable, except those variations as specified in SECTION ONE heretofore mentioned. AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED ON THE COMMONWEALTH EDISON RIGHT-OF-WAY NORTH OF KENSINGTON ROAD IN MOUNT PROSPECT, ILLINOIS WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet on the 27th day of April, 1972, at the hour of 8:00 p.m. in the Village Hall of Mount Prospec"C and did hear Case No. 72-10A, pursuant to legal notice published in the Mount Prospect Herald on April 12, 1972; and WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear a petition requesting a variation from the requirements of -'the Mount Prospect Zoning Ordinance in order to construct and operate a distribu- tion substation and seven (7) foot tall fence on property zoned R-1; and WHEREAS., the Board of Appeals of the Village of Mount Prospect has .1 recommended to the President and Board of Trustees the granting of tlt�, use variation requested under Case No. 72-10A for reasons that: I 1. There is a practical difficulty and particular hardship on the petitioner in that this parcel has been utilized for transmission lines and utility right-of-way in the past and is zoned R-1, which zoning district disallows commercial enterprises including those that are quasi - public in nature; 2 The purpose of the variation is not based exclusively on a desire to make money; 3. The plight of the owner is due to unique circumstances in that the land is utilized for transmission lines into which the proposed substation will be connected; 4. The alleged difficulty or hardship has not been created by any person presently having an interest in the property; 5. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger of fire, or endanger the public safety, or sub- stantially diminish or impair property values within the neighborhood -- in fact the equipment is necessary to pro- vide adequate service to the community; and 6. The granting of the variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality-, and I WHEREAS, the Building Committee of the Board of Trustees of the Villag4 of Mount Prospect have met on May 10, 1972, and have reviewed Case No. 72-IOA and have concurred with recommendations of the Board of Appeals to grant this variation; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the matters herein are for the best inter- ests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 72-10A, ge'17-ng legally described as follows:- ,wo"101/1", M That part of a strip of land 210 feet in width, lying Westerly of and adjoining the Westerly line of the Soo Line Railroad Company in the West Half of the Southwest Quarter of Section 25, Township 42 North, Range 11, East of the Third Principal Meridian, bounded and de- scribed as follows: Beginning at the intersection of the South line of the West Half of the Southwest Quarter of said Section 25, with the Westerly line of the Rail- road; thence West along the South line of said West Half of the Southwest Quarter a distance of 221.93 feet to the intersection with a line 210 feet Westerly of measured at right angles and parallel with the Westerly line of the Railroad; thence North along said parallel line a distance of 400 feet; thence Easterly along a line measured perpendicularly to the last described line a distance of 210 feet to the Westerly line of said Railroad; thence South along said Westerly line of the Railroad to the point of beginning, containing 2.1 acres more or less and situated in the Village of Mount Prospect, Cook County, Illinois; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-1 (Single Family Residence District), which zoning classi- fication shall remain subject to the following variation hereby granted: 1. AN'ORDINANCE ANNEXING PROPERTY LOCATED AT THE SOUTHEAST CORNER OF LINCOLN AND OJIBWA WHEREAS a written P 1 �etition under oath signed by the owners of record of land hereinafter' described has been filed with the Village Clerk of the Village of Mount Prospect requesting that said land be annexed to the Village of Mount Prospect; and WHEREAS, all electors residing within the said property to be annexed have affixed their signatures indicating their consent; and WHEREAS, the said land is not within the corporate limits of any muni- cipality, but is contiguous to the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find and believe it to be in the best interests of the said Village that said land and territory be annexed thereto; NOW, THEREFORE, BE .IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That all land and" territory legally described as follows: 10. Village President ATTEST: Village Clerk ORDINANCE NO* WHEREAS., the Mount Prospect Park District has a need for a portion of bwa Trail south of Man-A-Wa Trail for golf course purposes; and WHEREAS, the Mount Prospect Park District owns the properties on one side of and abutting that portion of Ojibwa Trail to be vacated and pri- vate persons own properties on the other side of and abutting the said portion of Ojibwa Trail to be vacated; and WHEREAS, in consideration of` the vacation herein, the property owners have agreed to cooperate with the ' Village of Mount Prospect in relocation of the right-of-way of Ojibwa Trail to the west; and WHEREAS, the President and Board of - Trustees believe such vacation and relocation is in the best interests of the Village of Mount Prospect; and WHEREAS, authorization has been granted the President and Board of Trustees to make such vacation pursuant to Section 11-91-1 of the Illinois Municipal Code; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: 0 SECTION ONE: That the following portion of Ojibwa Trail be and is hereby vacated, to wit: All of Ojibwa Trail, being 66.0 feet wide, which lies South of the South line of Lincoln Street and North of the South line of the North 1/2 of Lot 3, extended East in Willson and Florence's Country Club Subdivision ' of the East 233 feet (as measured on the North line)of the Northwest 1/4 of the Northwest 1/4 of the Southwest 1/4 of Section 11, Township 41 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois* SECTION TWO: That the Village Clerk of the Village of Mount Prospect is hereby directed to file in the Office of the Recorder of Deeds of Cook County, Ill,inois, a copy of this Ordinance, together with an accurate map of the territory so vacated.
