Northwest Highway and requested the Clerk to place it on the next agenda for second readi ng FINANCE COMMITTEE Trus tee Furs t pres en ted f or f i rst readi ng an ordi nanc'e creating a Class "W" liquor license. The intent of the Finance Committee was to issue such license to JOJO's Restaurant on Rand Road. However, Mayor Teichert read a I ette r di re cted to h i m f rom Carl ' s Pi zz a req ues ti ng the same type of liquor license. The Clerk was requested to place this ordinance on the next agenda for second r e a d i ng Trustee Furst presented for first reading an ordinance adopting the "Municipal Budget Officer", system of Finance - and requested the Clerk to place it on the next agenda for second reading. Trustee Furst gave a re-sum4 of a meeting of the Finance Committee with the Chamber of Commerce regarding business licenses, applications5 fees and reported further study of the bL)Siness code would be made. AN ORDINANCE PROVIDING FOR THE PLANNED UNIT DEVELOPMENT OF PROPERTIES COMMONLY KNOWN AS CRYSTAL TOWERS WHEREAS, the Plan Commission of the Village of Mount Prospect did hereto- fore conduct a public hearing under Case No. 71 -ISP on September 24, 1971, at the hour of 8:00 p.m., pursuant to a request for a special use in the nature of a planned unit development; and WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by law and published in the Soptember 8., 1971 edition of a newspaper of general circula"tion within the Village of Mount Prospect; and WHEREAS,, the Plan Commission recommended that the development proposed during the course of said .easing ng be authorized in that it would in no way be detrimental to the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by -the adoption of the Plan Commission's -recom- mendation under Case No. 71 -ISP regarding the subject property-, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That a special use permit be and is hereby gra nted,to allow the Prospect Development Company, or its assignees, gnees, to construct a planned unit development upon the following described property, herein- after referred to as the "subject property": Being a consolidation of Lot ''A" and Out of "B" of Tally -Ho Apartments, a development of part of the Northeast Quarter of the Northeast Quarter of Section 22, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois,* is Plat of Subdivision of the subject tract is attached hereto and made a part hereof as Exhibit A; and whicn subdivision shall not be re - subdivided hereafter -- in accordance with the special use permit granted herein. SECTION TWO: That the planned unit development hereinabove authorized and permitted all be constructed pursuant to the land uses and standards shown upon the Site Plan, attached hereto and hereby Inade a part hereof as Exhibit B, except as may otherwise be provided herein, and as necessary modified to solve engineering layout and design problems at the time of the construction of the said planned unit development. SECTION THREE: Prospect Development Company, as owner of the subject property sh I execute and see to the recording of the "Restrictive Cove - nants'l,attached hereto and made a part hereof as Exhibit C. SECTION FOUR: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to isstie upon, recording of the aforementioned Exh-ibits A an.d C and. upon. proper application for building permits, such permits as may be required for the construction of the said planned unit development --- which constructioln shall 'be governed by the terms of Section 5.1 of the Mount Prospect Zoning Ordinance, this ordi- nance herein, and all othor applicable ordinances of the Village of Mount Prospect, construction shall be in general conformity with the "Prospectus" prepared by Rabin. - Le Noble Associates, attached hereto and hereby made a part hereof as Exhibit D, with the furtl-i.er reqtiiremerit: that all of the aforementioned ordinances shall govern and. control. said. construction rather than said "Prospectus". A. Th,e owner., Prospect Development Company,,, shall have the option to construct the ent.fre planned unit development at once -- or in stages as shown in the Stage Plan Exhibit attached hereto and hereby made a part hereof as Exhibit E. B. If Prospect Development Company desires to construct the entire planned unit development at once rather than in stages as per said Exhibit E,'before drawing building permits it shall have constructed and installed all of the on-site water mains and storm and sanitary sewer lines shown on the On -Site Utility Plan attached hereto and hereby made a part hereof as Exhibit F. if, however,, Prospect Development Com- pany desires to construct the said planned unit development in stages as shown upon the said Exhibit E, the stages of development may proceed in any sequence as determined by Prospect Development Company so long as the water mains, storm and sanitary sewer lines, and access roads within any given stage shall have been constructed and installed by the owner and approved and accepted by the Village, fDefore the Village shall issue any building permits for buildings located within that given stage. For fire fi.gliting purposes, the aforemen- tioned "access roads" shall mean those private roads reflected on the Site Plan (Exhibit B), except that no asphaltic topping has been installed thereon. C. Before the acceptance by the Village of ownership of any on- site water mains or sanitary sewer lines reflected in the said On -Site Utility Plan (Exhibit F), Prospect Development Company shall convey to the Village of Mount Prospect sufficient ease- ments (minimum 10 feet i,\Tide) for the maintenance of such on- site water mains and sanitary sewer lines and shall post with the Village bonds in a form approved by the Village Attorney and in sufficient amount as to guarantee said construction and installation for a period of two (2) years from the date of acceptance of said water mains and sanitary sewer lines. D. The storm water retention lake shown upon the Site Plan (Exhibit B) shall b�e of a M i 1-1 -1- ITIU. M acre feet capacity. SECTION FIVE: That as each stage of deve.Lopii-ient is completed and occu-- pancy certificates are issued for all of the residencies in such stage, Prospect Development Company will cause a Plat of Open Space Easement to be delivered to the Village, of Motint Prospect. A. These plats shal-1 be recorded and shall contain such wording sufficient -to permanently guarantee the open space as shown on such easement in accordance with the said planned unit development and any amendif1(_,n.tS thereto. B. That said Plats of Open Space Flasement shall constitute a covenant running with, the land and shall be enforceable by the said Village of Mount Prospect. SECTION SIX: That this ordinance together with. all., its exhibits and plans shall be "recorded in the Office of the Recorder of Deeds of Cook County, Illinois upon completion of the pla-lined. unit development herein; and the Restrictive Covenants contained on Exhibit C hereto shall be recorded immediately upon the execution thereof and the passage and approval of this ordinance. SECTION SEVEN: That this ordinance shall be -in ful.1 force and effect 'From and at—tert. s passage, approval, and publication in the mannerpro- vided by law and the recording of the Plat of Subdivision and Restrictive Covenants attached hereto as Exh.-_-i'bit A and C, respectively. AN ORDINANCE GRANTING A VARLATION FOR PROPERTY LOCATED AT _....93_0 E. NORTH'11EST HIGHWAX�,_ MOUNT PROSPECT.�_­I'LLINOIS WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet on the 23rd day of September, 1971, at the hour of 8:00 p.m. in the Village Hall of Mount Prospect and did hear Case No. 71'31A., pursuant to legal notice published in the Mount Prospect Herald on September 8, 1971; and WHEREAS,, the Board of Appeals of the Village of Mount Prospect did hear a petition requesting a variation from the requirements of the Mount Prospect Zoning Ordinance in order to operate a retail sales store with less available parking spaces than those required under the said ordi- nance; and WHEREAS, the Board of Appeals of the Village of Mount Prospect has recommended to the President and Board of Trustees the granting of the parking variation requested under Case No. 71-31A for reasons that: 1. There is a practical difficulty and particular hardship on the petitioner in that this parcel has been utilized for retail sales in the past and is zoned B-3, which zoning district allows such retail sales but requires one (1) parking space for every 300 square feet of gross floor area of such building; 2. The purpose of the variation is not based exclusively on a desire to make money; 3. The plight of the owner is due to unique circumstances in that the land is so located that additional parking is not available, since contiguous land has been im- proved with office buildings, railroad tracks, and re- tail stores; alleged 4. The ed difficulty or hardship has not been created 1 0 1 by any person presently having an interest in the property; 5. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger of fire, or endanger the public safety, or sub- stantially diminish or impair property values within the neighborhood; and 6. The granting of the variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS., the Building Co ' mmittee of the Board of Trustees of the Village of Mount Prospect have reviewed Case No. 71-31A and have concurred with recommendations of the Board of Appeals to grant this variation; and WHEREAS., the President and Board of Trustees of the Village of Mount Prospect have determined that the matters herein are for the best inter- ests of the Village of Mount Prospect; NOW, THEREFORE., BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 71-31A, E—eing legally described as follows: Lot Twenty -Five (25) and that part of Lot Twenty -Four (24) lying Easterly of a line drawn from a point in the Southerly line 4 1/2 inches Easterly of the South- west corner of said Lot to a point in the Northerly line 3 1/2 inches Easterly of the Northwest corner of said Lot Twenty -Four (24) in Maplewood Heights, being a Subdivision of the East 15.00 chains of that part lying North of Railroad of Southeast Quarter (1/4) of Section 12 (except the Southerly 66 feet for road) also of Block Twenty -Six (26) in Busse 's Eastern Addi- tion to Mount Prospect in the East Half (1/2) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business - Retail and Service District), which zoning classification shall remain subject to the following variation hereby granted: That the five (5) parking spaces presently provided upon the subject property shall be sufficient to serve the existing building located thereon. SECTION TWO: That all requirements of the Mount Prospect Building and honing Code shall be applicable except the variation noted in SECTION ONE heretofore mentioned.
