CAF/ 6/26/95 ORDINANCE NO. 4736 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 1742 INDIGO COURT WHEREAS, Larry Parks (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 1742 Indigo Court (hereinafter referred to as Subject Property), legally described as: Lot 76 in Brickman Manor, Second Addition, Unit #4, being a subdivision of part of the Northwest 1/4 of Section 25, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner has submitted a request for a variation from Section 14.306.B.1 to allow a 12' x 16' (192 square foot) shed the rear yard; and WHEREAS, a public hearing was held on the variation requested, being the subject of ZBA Case No. 5-V-95 before the Zoning Board of Appeals of the Village of Mount Prospect on the 8th day of June, 1995, pursuant to due and proper notice thereof published in the Journal Topics on the 19th day of May, 1995; and WHEREAS, the Zoning Board of Appeals did consider the request stated herein and have forwarded their recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees have given further consideration to the variation requested and have determined that the best interests of the Village would be served by granting the variation requested. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant a variation from Section 14.306. B.1 allow a shed 12' x 16' (192 square feet) in size, which shed shall be located as indicated on the Site Plan attached hereto and hereby made a part hereof as Exhibit A. SECTION THREE: Except for the variation granted herein all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.203.C.12 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its BA 5-V-95 Page 2 of 2 passage, approval and publication in pamphlet form in the manner provided by law.
