AN ORDINANCE DETERMINING CERTAIN
PREVAILING WAGES TO BE PAID FOR
CERTAIN PUBLIC WORKS PROJECTS
WHEREAS, the State of Illinois has enacl ' -ed "An ACT
d. o
regulating wages of laborers, mechanics anther workmen
employed in any public works by the Stater county, city
or any public body or any political subdivision or by any
one under contract for public works," approved ,Tune 26,
1941, as amended' being Sect -ion 39s--1 throuclh 39s-12,
Chapter 48, Illinois Re,y.J.-sed Statutes,. 1977; and
WHEREAS, the aforesaid Act requires that municipalities
investigate and ascertain the prevailing rate of wages as
defined in the Act for laborers, mechanics and other workmen
in the locality of the municipality employed in performing

jurisdiction of the Village of Mount Prospect is hereby as-
certained to be the same as the prevailing rate of wacTes for
construction work in the Cook County area as determined by
the Department of Labor of the State of Illinois as of June 14,
19;80, a copy of that determination being attached hereto and
incorporated herein by reference. The definition of any terms
appearing in this Ordinance which are also used in the a -Fore -
said Act shall be the same as in the Act. Maintenance work
of the Village of Mount Prospect is excluded from the appli-
cation of this Act.
SECTION TWO : That, nothing herein contained shall be
construed to apply the general prevailing rate of wages as
herein ascertained to any work or employment except public
works construction of this municipality to the extent required
by the aforesaid Act.
"SECTION THREE: That, the Village Clerk shall keep available
for inspection by any interested party in the Office o.- the
Village Clerk of the Village of Plount- Prosuect this determina-
tion of the prevailing rate of wage.
SECTION FOUR: That, the Village Clerk shall mail a certi-
fied copy of this determination to any .employer, and to any
association of employer ' s and to any person or association of

requesting copies of any determination stating the particular

The Chicago and Northwestern Railroad (CNWRR) and the Village of Mount
Prospect had planned and were ready to begin construction on improving
the crossing at Emerson Street last Monday morning (July 7). Late last
week Mr. Vanderleest, the CNWRR project engineer for this project, was
informed by Mr. Vaughn Stoner, the area engineer for the RTA, that the
RTA was stopping this project. Mr. Vanderleest could not contact the
Village before Monday because of the holiday. I got word of RTA's
action the first thing Monday morning.
There were several reasons given for stopping the project. I have talked
with the CNWRR, the RTA and Mr. Fialkowski of the NWMC and found out the
following.
The Chicago Area Transportation Study has earmarked funds transferred
from the Cross Town Expressways Project for improving railroad crossings
in the Northwest area with a rubberized crossing,. The Emerson Street
crossing is included in this program and construction maybe started next
year. The RTA did not want to go thru the expense of improving the
Emerson Street crossing at this time and then have the crossing rebuilt
again next year to have a rubberized grossing installed. They also felt
that an improvement at this time may jeopardize having the crossing
improved next year with a more desirable type of construction.

The Village has just received - approval from the Department of
Housing and Urban Development for its Fiscal Year 1980-81
Grant Application. The.Federal Coimunitv Development Block
Grant (CDBG) is currently tly entering its fifth year of funding
local programs, Mount Prospect is entering its third year of
funding as an "en'ti tlem'en't" coim'uni'ty,
The CDBG Program was established to address community de-
velopment and housing needs and priorities, principally for
low and moderate -income per . sons.-and,for the prevention or
elimination of slums and blight Through the use of these -
funds, communities have 'dev'eloped:housing for elderly, handi-
capped, and low-income residents; rehabilitated residential
and commercial facilities' which have'deteriorated, and de-
veloped or improved community facilities in an attempt to
prevent blight.
Mount Prospect has completed -roof and parking --lot improvements
of the Senior Citizen's Center- and Village Hall area with,
Community -Development - Funds.- - Additilonal-programs currently
in progress are the acquisition of a site"for senior citizen
housing, weatherization-of homes of low and moderate income
residents, and improvements for sidewalk modification for
handicapped access*
our application for- funding was approved for $398,000 of
federal funding for this year. The major projects proposed
for these and previous years' funds are: the acquisition of
the senior citizen housing site; $100,000 for residential
and $75,,000 for commercial -rehabilitation - in the Central area
of the Village; $50,000 for improved handicapped access; and
$180,000 allocated for any future acquisition of land.
In the past two years, the Village's Community Development
Program accomplishments have fallen short of HUD's expectations.
Thus, in this third year the completion of past years'
programs, as well as, .significant progress on the current year's
proposals will be the -basis for continuing federal Community
Development funds to Mount Prospect.,

Mr. Bruce Hoppesch, owner and operator of Bruce Automotive,
located at 422 E. Northwest Highway, in regard to his Special op
Use request for ani office addition and second floor apartment,
to the North of his present automotive repair business.
Staff will meet with Mr. Hoppesch on site,early during the
week of July 14th, in an effort to arrive at a satisfactory
design solution for access control and landscaping as directed
by the Village Board of Trustees. Z anticipate that the
staff will develop a site plan for review by Mr. Hoppesch
based on our site analysis and then present these findings

Gentlemen:
I must clear up a few points regarding your July 3 letter. I cannot
attend meetings when I don't know that they are taking place. I am
more than happy to be there to defend my I position regarding increases,
etc., and in the past, they would call me or send me a letter regarding
meetings that concerned me.
I cannot raise my rates 5% as the meters we use won't take that kind
of an increase.
As the summer months are here, a good portion of our business is seniors
where the drivers are losing money as I am, too. Your attention to my,
letter regarding a senior citizen rate increase would be greatly appreciated
at this time. On top of all this,, the drivers are reading in the paper
about deregulations and sharing the business with someone else will
reduce their income drastically and they have indicated they would leave
me, and seek employment elsewhere. So you can see the dilemma that I'm
in and I feel that the Village just doesn't understand all of this.
Let me know if there is anything more that -I can supply you with in the
way of information.

Sec. 12-101. Purpose. The provisions of this Article are
designed to protect the public health., safety and welfare by
providing sa,n,t4tiah regulations governing the storage, prepara-
tion and serviceoffood and the condition of the premises
where such food is stored, prepared or served in food processing
and food service establishments and retail food stores.
Sec. 12.102. Incorporation of Food Service Regulations. For the
purpose of establishing sanitation rules and regulations for the
storage, preparation and service of food and the condition of
the premises where such food is stored, prepared or served in
food processing and food service establishments and retail
food stores, there is hereby adopted the 1975 edition of
the Rules and Regulations Pertaining to the Sanitation of
Food Service Establishments promulgated by the State of
Illinois, Department of Public Health, together with all
appendices thereto, except such portions thereof as are
amended, deleted or modified as set forth in Section 12.103.
Sec. 12-103.-'--Ame-ndmentst Deletions and Modifications* The
following provisions of thes and Regulations Pertaining
to the Sanitation of Food Service Establishments (hereinafter
referred to in this Section as "Sanitary Regulations") are
hereby amended, deleted or modified.
A. Rule 1.01(g) of the Sanitary Regulations is hereby
deleted in its entirety and a new Rule 1.01(g)
substituted therefor, which said new Rule 1.01(g )

Sec. 12.203. Amendments, Deletions and Modcations. The

Food and Beverage Vending Machine Ordinance (hereinafter
referred to in this'Section as "Vending Machine Regulations"

Procedure if Infection Suspected:
Sec. 12.301. License Re uj*-red.' It shall be unlawful for any
person, firm or corporation to engage in or do business in the
Village as a - food processing establishment, food service
establishment, retail food store or to sell or distribute milk
or cream, without first having obtained a license therefor
pursuant to the provisions of Chapter 10 of the Municipal Code
of the Village of Mount Prospect.
Sec. 12.302. License Fee. The annual fee for the licenses
required by this, Ax"ticle shall be thirty dollars ($30.00).
Sec. 12.303. Sus erasion of Licenses.
A. The regulatory authority may, without warning,
notice, or hearing suspend any license to operate
a food processing establishment, food service
establishment or retail food store if,the holder
of the license does not comply with the requirements
of this Chapter, or if the operation of the establish-
ment does not comply with the requirements of this
Chapter, or if the operation of the establishment
otherwise constitutes a substantial hazard to public
health. Suspension is effective upon service of
the notice, required by Section 12.303E of this
Article. When a license is suspended, operations
shall immediately cease. Whenever a license is
suspended, the holder of the license, shall be
afforded an opportunity for hearing within 20 days
of rece� pt of a written request t for hearing by the Director
of Health Services of the village of mount Prospect.
B. Whenever a -license is suspended, the holder of
the license and the person in charge shall be
notified in writing that the license is, upon
service of the notice, immediately suspended and
that an opportunity for hearing will be provided
if a written request for hearing is filed with the
Director of Health Services of the Village of
Mount Prospect by the holder of the license within
10 days. If no written request for hearing is
filed within 10 days, the suspension is sustained.
The regulatory authority may end the suspension at
any time if reason for suspension no longer exist.
Sec. 12.304. Revocation of Licenses.
A. The regulatory authority may, after providing
opportunity for d hearing, revoke 'a license for
serious or repeated violations of any of the
requirements of this Chapter or for interference
with the regulatory authority in the performance
of duty.
B. Prior to revocation, the regulatory authority shall
notify, in writing, the holder of the license and
the person in charge, of the specific reason for
which the license is to be revoked and that the
license shall be revoked at the end of the 10 days
following service of such notice unless a written
request for hearing is filed with the Director
of Health Services of the Village of Mount Prospect
by the holder of the license within such 10 -day
period. 11 no request for hearing is filed within
the 10 -day period, the revocation of the license.
Sec. 12.305. Service of Notices. A notice provided for in this
Article is properly served when it is delivered to the holder
of the license and the person in charge, or when it is sent by
registered or'.certified mail, return receipt requested, to the
last known address of the holder of the license. A copy of
the notice shall be filed in the records of the regulatory
authority.
Sec. 12.306. Hearings. The hearings provided for in this
Article shall be conducted by the regulatory authority at a time
and place designed by it. Any oral testimony given at a hearing
shall be reported verbatim, and the presiding officer, who
shall be the Director of Health Services, shall make provision
for sufficient copies of the transcript. The Director of Health
Services shall make a final finding based upon the complete
hearing record and shall sustain, modify or rescind any notice
or order considered in the hearing. A written report of the
hearing decision shall be furnished to the holder of the
license by the regulatory authority.
Sec. 12-307. Apication after Revocation. Whenever a
revocation of a,license has become fi—na-1--Ithe holder of the
revoked license may make written application for a new license.
Sec. 12.308. Access for Inspections. Representatives of the
regulatory authority, after proper identification, shall be
permitted to enter any food processing establishment, food service
establishment and retail food store at any reasonable time for
the purpose of making inspections to determine compliance with
this Chapter. The representatives shall be permitted to examine
the records of the establishment to obtain information pertaining
to food and supplies purchased, received, or used.
Sec. 12.309. Re ort of Inspections. Whenever an inspection of
a food Processing establishment, food service establishment or
retail food store is made, the findings shall be recorded on
the inspection report form of the regulatory authority. The
inspection report form shall set forth a weighted point value
for requirement of this Chapter. Inspectional remarks shall
be written to reference, by section number, the section violated
and shall state the correction to be made. The rating score
of the establishment shall be the total of the weighted point
values for all violations, subtracted from 100. A copy of the
completed inspection report form shall be furnished to the
person in charge of the establishment at the conclusion of
the inspection. -
Sec. 12-310. Correction of Violations.,
A. The completed inspection report form shall specify
a reasonable period of time for the correction of the violations
found; and correction of the violations shall be accomplished
within the period specified, in accordance with the following
provisions:
1. If an imminent health hazard exists, such
as complete lack of refrigeration or sewage
backup into the establishment, the establishment
shall immediately cease food processing or
service operations or operation as a retail
food store. Operations shall not be resumed
until authorized by the regulatory authority.
2. All violations of 4 -or 5 -point weighted items
shall be corrected as soon as possible, but
in any event, within 10 days following inspection.
Within 15 days after the inspection, the holder
of the license shall submit a written report
to the regulatory authority stating that the
4 -or 5 -point weighted violations have been
corrected. A followup inspection shall be
conducted to confirm correction.
3. All 1 -or 2 -point weighted items shall be
corrected as soon as possible, but in any
event, by the time of the next routine
inspection.
4. When the rating score of the establishment
is less than 60, the establishment shall
initiate corrective action on all identified
.-vio*lations within 48 hours. One or more
reinspections will be conducted at reasonable
-time intervals to assure correction.
5. In the case of temporary food service establish-
ments, all violations shall be corrected within
24 hours. If violations are not corrected within
24 hours, the establishment shall immediately
cease food service operations until authorized tc
resume by the regulatory authority.
B. The inspection report shall state that failure to
comply with any time limits for correction may.
result,in cessation of food processing or service
operations or the operation of a retail food store.
All opportunity for hearing on the inspection
findings or the time limitations or both will be
provided if a written request is filed with the
regulatory authority within 10 days following
cessation of operations. If a request for hearing
is received, a hearing shall be held within 20
days of ._receipt of the request.
C. Whenever a food processing or service establishment
or a retail food store i's required under the
provisions of this Section to cease operations, it
shall not resume operations until it is shown on
reinspection that conditions responsible for the
order to cease operations no longer exists.
Opportunity for reinspection shall be offered
within a reasonable time.
Sec. 12.311. Examination and CondemnatiLon of' Food. Food may
be examined or sampled by the regulatory authoras often as
necessary for enforcemient of this Chapter. The regulatory
authority may, upon written notice to the licensee and person in
charge, specifying with particularity thereasons therefor,
place a hold -order on any food which it believes, is in violation
of the provisions of this Chapter. The regulatory authority
shall tag, label, or otherwise identify any food subject to the
hold order. No food subject to a hold order shall be used,
served, or moved from the establishment. The regulatory
authority shall permit storage of the food under conditions
specified in the hold, order, unless storage is not possible
without risk to the public health, in which case immediate
destruction shall be ordered and accomplished. The hold order
shall state that a written request for hearing may be filed
with the Director of Health Services within 10 days and that
if no hearing is requested the food shall be destroyed. If a
request for hearing is received, the hearing shall be held
within 20 days after receipt of the request. on the basis
of evidence produced at that hearing, the hold order may
be vacated, or the licenseeor person son in charge of the food
may be directed by -written,,* -order to denature or destroysuchfood or to bring it into compliance with the provisions of
this Chapter.
Sec. 12.312. Submission of Plans. Whenever a food processing
establishment, food, service establishment or retail food store
is constructed or extensively remodeled and whenever an
existing structure is converted to such use, properly prepared
plans and specifications for such construction, remodeling or
conversion shall be submitted to the regulatory authority for
review and approval before construction, remodeling or
conversion is begun. The plans and specifications shall indicate
the proposed layout, arrangement, mechanical plans, and
construction materials of work areas, and the type and model
of proposed fixed equipment facilities. The Director of Health
Services shall approve the plans and specifications if they
meet the requirements of this ordinance. No food service
establishment, food processing establishment or retail food
store shall be constructed, extensively remodeled, or converted
except in accordance with plans and specifications approved
by the Director of Health Services of.the Village of Mount
Prospect.
Sec. 12.313. Pre -operational Inspections. Whenever plans
and specifications are required by Section 12.312 of this
Article to be submitted to the regulatory authority, the
regulatory authority shall inspect the food service
establishment, food processing establish�.ent or retail food
store prior to the start of operations, to determine compliance
with the requirements of this Chapter.
Sec. 12.314. Procedure if Infection Su ted. When the

regulatory auth'o"rlly has reasonaKle cause to suspect possible
disease transmission by an employee of a food processing
establishment, food service establishment or retail food store,
it may secure a morbidity history of the suspected employee or
make any other investigation as indicated and shall take
appropriate action. The regulatory authority may require any
or all of the following measures:
1. The immediate exclusion of the employee from
employment in the food service establishment,
food processing establishment or retail food
store;
2. The immediate closing of the establishment
concerned until, in the opinion of the
regulatory authority, no further danger of
disease outbreak exists;
3. Restriction of the employee's services,to some
area of the establishment where there would be
no danger of transmitting disease;
4. Adequate medical and laboratory examination of
the employee and of other employees and of
his and their body discharges.
ART ICE IV

12.401 Fines
12.402 Injunctions
Sec. 12.401. Fines, Any person, firm or corporation convicted
of a violation of any of the provisions of this Chapter shall be
punished by a fine of not less than ten dollars ($10.00) nor
more than five hundred dollars ($500.00) for each offense.
A separate offense shall be deemed to have been committed for
each day a violation occurs or continues.

SECTION TWO.:
—_w ,w - If any part or parts of this Chapter shall be
held to be unconstitutional or otherwise invalid, such
unconstitutionality or invalidity shall not affect the
validity of the, remaining parts of this Ordinance and
to that end, the provisions of this Ordinance are deemed
to be severable.
SECTION THREE: This Ordinance shall be in full force and
effectfromand after its passage, approval and publication
in pamphlet form in the manner provided by law.
