Bids
Dear Members of the Board. -
Bids for the above captioned pro3ect were received and opened at the
Mount Prospect Village Hall at 10.-00 A.M., June 20, 1980. Six
contractors submitted bids for the project (see enclosed Tabulation
of Bids).
Twenty-elight (28) contractors and suppliers picked up plans and spec-
ifications for this project (see enclosed list).
Our office has reviewed the submitted bids. The low bid of $327,600.00
was submitted by Keno & Sons Construction Company from Highland Park.
This bid was 1.5% higher than the engineer's estimate of $322r655.00.
The high bid was 9.2% over the engineer's est, imate.
An Alternate A bid was also received. Alternate A deleted Items 1E,
2D and 3E (painting and cathodic protection). The same contractor
was low bidder on Alternate A. The: bid for Alternate A was $313,600.00,
$14,00.00 less than the bid.
It is our educated opinion that for a savings of $14,000.00 'it would
not be to the Village's advantage to delete the painting and cathodic
protection from this project.
Keno & Sons Construction Company is well regarded as is evident after
checking their extensive list of references. Not one of the references
that we contacted had anything adverse to say about this contractor
(see enclosed list of references),
Therefore, it 'is our recommendation that the Board accept Keno & Sons
Construction Company's bid of $327,600.00 for the complete project
and award the contract to this contractor..,
Thank you very much for, cello wi'ng us to be of service 'to you. If
we can be of further assistance, do not hesi.-tate to contact 'us.
Very truly yours,

N70/29
The lowest bid as submitted by the Runnion Equip. Co. on a Natio`l N70/29
should be disqualified for not meeting the follo-ving basic specifications,
a, Specifications call for a hydraulically extended boom to 27 ft.
The National crane extends hydraulically to 16 ft. with manual
extensions to 28 ft. (When you're moving a heavy load, you
need hydraulic movement on lateralposit' ,
ioning.)
b. Our specifications call for a lifting capacity of 2750 lbs.
fully extended, and the National crane is only rated at 2000
lbs. (On numerous occasions we require maximum lift at
maximum reach. This becomes critical when we are working
near excavations and the crane truck is set up away from edge
of hole for safety-)
I 1*ecommend that the next lowest bid as submitted by Tractor and Eollipmtint Co.
be accepted. alleir net bid of C7 CC (includes -trade-in) on a lab 1165 AW
crane meets or exceeds all of our specifications.

President and Board of Trustees

Gentlemen:'
tl been r asked to review a
'I have recently en y request e s
by the Woodview Civic Association for an additional
payment .of $2,500-00 for attorneys fees in connection
with the Wheeling Trust and Savings case. This would
be a second payment, the sum of $700.00 having been
ogo"
previously made.
As you are , e and several g
e aware the Villa
trustees have been sued as a result of the first
payment to Woodview Civic Association. This suit
remains pending and although it is my opinion that
the Village was justified in making payment, I feel
that it would be more judicious in making no further
payments to the Woodview group until the court has
determined the legality of the first payment.
Therefore, it is my opinion that the Village should
delay any action to make an additional payment to
Woodview Civic Association until a decision has
been reached in the pending litigation.`
If you need any further information, please
contact me.
Fours very truly

INTEROFFICE MEMORANDUM
TOM Public Health and Safety Committee
Trustee Theodore J. Wattenberg, Chairman
Trustees Norma J. Murauskis, Gerald L. Farley
FROM: Board of Health
Dr. A. Dressen, Chairman
SUBJECT: Proposal To Allow For No -Smoking Areas In Restaurants
DATE: June 26, 1980
Managers or representatives of 50% or 35 of the 71 restaurants or food service
establishments within the Village of Mqpnt Prospect were contacted directly by
a member of the Board of Health regarding the establishing of a non-smoking
area within each facility.
Eight of the restaurants checked were found to have non-smoking areas and three
used air purifiers- for smoke elimination as shown on the accompanying classifica-
tion list.
Sixteen were amenable to either establishing a non-smoking area or did not consider
it a problem in their establishment because of their ability, upon request, to
seat people in a -vented or smoke free area.
Eight of the managers contacted objected in principal, because of their clientele
or because of the limited amount of available space within the facility.
In almost all cases managers of restaurants not havinq non-smoking sections have
not encountered problems because of the lack of a non-smoking area.
Our canvass would suggest that most restaurants listed in Item 2 of the classifi-
cation would voluntarily set a -side a non-smoking section upon request of the
Village Trustees, either directly or through the Chamber of Commerce. Alternatively,
establishing non-smoking areas as an accomodate on'is possibly best handled by
the public, by individuals requesting to be seated in non-smoking areas.

Incorporation of Federal and State Health
I_
Re2ulations Reference
In your
memorandum to me dated June 16, 1980, you asked whether
the Village
of Mount Prospect could incorporate by reference specified
Federal and
state regulations concerning sanitation. The Illinois
Municipal Code in Section 1-3-2, Ill'. :Rev. Stat. , 1979, ch. 24, §1-3-2
%provides in
part as follows:
"Any municipality is -likewise authorized and
empowered to adopt by reference the provisions
of any public records, provided likewise, that
3 copies of such public record are kept on file
in the office -of the clerk of the municipality
as provided above for regulations. The filing
requirement herein prescribed shall not be deemed
to be complied with unless the required copies
of such regulations or public record are filed
with the clerk of such municipality for a period
of 30 days prior to adoption of the ordinance
which incorporates such regulations or public
record by reference. No regulations nor public
record of any jurisdiction other than the_ State
of Illinois shall be adopted hereunder covering
-any subject matter for which standards are
available in any public record of the State of
Illinois."
Mr. Patri jeuhring

Section 1-3-1 of the Illinois Municipal Code, Ill. Rev. Stat.,
1979, ch. 24, §1-3-1 provides that a public record means "any
municipal, state or federal statute, rule, or regulation
Therefore, it would be possible for the Village of Mount Prospect
to adopt by reference federal -and state sanitation regulations.
