had tendered their resignations to take employment in
another northwest suburban police Department and that
the Fire and Police Commission were in the process of
recruiting replacements .

Prospect Parr District on their 25th Anniversary.

STBJECT: Beautification - Bid for Village Entrance Markers

At the recent budget hearings there were presentations made for the inclu-
sion of funds in the amount of $16,000.00 to construct five separate
entrance beautification sites -in the -Village.- This- request --vas reduce7d-
to a $6,000.00 total for two entrance markers.
After the budget was adopted, I was invited by the Chamber of Commerce to
attend -a. meeting'- with -them _an.d --other....- i nterested civic organizations to dis-
cuss priorities an the locations of the two markers which had been funded.
I had a broad based beautification plan when I made my original budget
request and the marker was to have been similar to a sign at Golf & 83.
Howev-er-, -at the -meeting I -was A*_nv31.-ted------to, there was al -so -a representative af
11-100 r ton Arboretum present. The general consensus of opinion that it would
,be beneficial to draw upon the expertise of Mr. Tyznik from *Morton Arboretum
to design the areas.
After receiving the designs and evaluating the scope of services which should
be bid, I advertised for sealed bids on May 19, 1980 for planting of the
nursery stock andr,bringing in dirt for the planting areas. The bids were
opened on June 11, 1980 with results listed below:

To complete the landscape design the remainder of the work was scheduled

Assuming acceptance of the low bid of $8,563.00 and adding the additional
$4,300.00 we have a total proposed expenditure of $12,863.00 for construc-
tion of -the two markers. As this is over double the $6,000.00 allocated
for this phase of beautification, I am submitting the foregoing information
without recommendation.

Re.- Northwest Central Dispatch System v. Honeywell, Inc.
Gentlemen:
On May 30, 1980, Judge Richard Curry of the Cook County
Circuit Court dissolved his previous Temporary Restraining Order
which had prohibited Honeywell, Inc. from soliciting subscribers
to the NWCDS and from removing their present equipment from the
NWCDS premises. Our cause was ditmissed.base'd upon Judge Curry's
finding that the NWCDS has no inherent legal power to sue to -
enforce its co ' ntracts. Judge Curry reasoned that any suit must
be brought in the name of the municipalities which compromise
the membership of NWCDS.
I disagree strongly with that ruling. However, if we
wish t - o pursue this matter, I believe that it would be more
efficient to refile our case in the names of the member munici-
palities rather than to appeal Judge Curry's decision. We already
have the pleadings from our prior action, therefore it is a matter
of identifying' the municipalities as Petitioners, rather than NWCDS.
I will be awaiting your reply as whether your municipality
believes it to be advisable to continue our efforts in this matter.

SUBJECT Central Dispatch
Attached for your review is correspondence from Mr.
Hill, the attorney for Central Dispatch. You may
recall that earlier this year we received correspondence
from Central Dispatch and Honewell regarding a disputed
bid authorized by Central Dispatch. Subsequent to
these discussions Honeywell has continued its program
to its own course of action regardless cif the direction
of Central Dispatch. Allegedly Honeywell has failed
to supply information to Central Dispatch regarding
coded accounts of existing burglar systems and has
initiated allegedly its own alarm board for its current
customers. What this means is the new alarm operator
is having difficulty even impossibility on installing
the field alarm at the dispatch center and with Honeywell
using its own board allegedly future burglar alarms
would go to the Honeywell center and then Honeywell
would call Central Dispatch by telephone. This extra
link provides some time delay, increases the risk of
error and give us little control over the details of
the operation of these alarms.
Central Dispatch sought a restraining order in the
Circuit Court. The Judge rejected the case ,stating
that Central Dispatch had no legal standing. Under
the Intergovernmental Cooperation Act we believe that
we do; however, this is not our main objective at this
point. The Judge recommended that the case be brought
in the name of the municipality's.
Although I am on the Board of Directors of Central
Dispatch and the funds for the suit will come from
the Central Dispatch Center, I am of the opinion that
I will need some advice from the Mayor and Board as
to whether or not we should proceed. I will have more
information available at the meeting including cost
estimates.

VILLAGE OF MOUNT PROSPECTr COOK COUNTYr ILLINOIS, AS FOLLO
SECTION ONE: Section 17.107 of Article 1 of Chapter 17 of the
Code of the Village of Mount Prospect be, and the same -7 --
is hereby, amended by deleting the present language of Section
17.107 and substituting therefor the following language, so tha-=----
said Section 17.107 shall hereafter be and read as follows:

Section 17.107. Time of Payment; License Year. Licenses
issued for calendar year 1980 shall expire on December 31,
1980. Licenses issued for calendar year 1981 shall expire
on April 30, 1982. Fees for licenses Issued for calendar
years 1980 and 1981 shall be due and payable in advance of
the first day of January of each of said years. Beginning
in 1982 and continuing each and every year thereafter, fee-=------_

The regular meeting of May 27, 1980, was called to order by Chairperson Norma
murausk"Is and the following agenda items were discussed:
MAPLE CREST SUBDIVISION WATER SYSTEM
Committee members reviewed and discussed the recent letter to,,Mayor Krause
from Mr. Weiss of Citizens Utilities. Herb` weeks reported that, to date,
we have received no proof of ownership on the Maple Crest system or any
proof of an agreementbetween the Village of Mount Prospect and Citizens
Utilities regarding the purchase of water. Public Works Director Herb
Weeks further commented that he was not in favor of the trading of water
with, Citizens Utilities based on the history of a previous arrangement with
the DiMucci Water System on the south side that was unsatisfactory. Addlitionallv,
he questioned the quality of the water that we would receive from Citizens
and the possibility that pressure differential problems could arise. Both
Herb Weeks and Fire Chief Pairitz commented on the advisability of an emergency
cross connection between Mount Prospect and the Citizens system to be located
at approximately Wheeling and Kensington. This connection would provide water
for firefighting purposes and to the residents of the new town area in the
event of breakdown on the part of Citizens Utilities. Jacquelyn McDermott
raised several issues regarding water rates, maintenance by Citizens Utilities,
late Xest
etc. In conclusion-.
I. The committee requests that the Village Manager continue to pursue
the subject of proof of ownership and water agreement from Citizens
utilities.

DEVELOPMENT CODE
Ken Fritz, Director -of Community Development presented an overiew`of the
staff's recommendations that have been,gathei6d pan 'the subject cad` the
Development Code. Public Works Director Herb Weeks suggested that
Section 16.415 of the Development Code be revised to require a miniMUM
of a 2 1/21' tree for all parkway trees and also recommended that Public
Works be responsible for all planting. He also recommended a provision
to allow larger trees under specified circumstances.
Ken Fritz reported that it was their desire to also require tree plantings
in various areas of parking lots to break up the large asphalt areas.
Ken Fritz also referred to staff, comments - regarding design engineering
standards for sewer and water indicating -he felt.that-this should be part
of a separate ordinance. that ,"s referred to -in the Development Code.'
On the subject of',land donations,, Ken reported that the existing
Development Code doses not require mandatory donation of funds or land
to the park district or"school district. It is his suggestion that
these donations be mandatory in all cases. Ken also indicated that he
would like some direction from the committee regarding how deeply the
board wants to be involved on plan and site review. The general
consensus was thatIff the developer met well established standards there
would probably be little need for their involvment but in cases where
there was adispute the board should be the'review body.

meeting of the Fire and Police Committee.

Chairman Farley called the Public Works Committee Meeting to order at 7:32

A. CentrallBusse Roads Detention Basin
Chairman Farley stated that the Village and the Metropolitan San-
itary District had signed an agreement ,,on June 5, 1980, granting
the Village of Mt. Prospect and the Mt. Prospect Lions Club a
permit to use 'the MSD reservoir site for the 4th of July carnival
and fireworks. Mr. Weeks then stated that this permit is only
valid for the period July 2nd through July 6, 1980, and limits
the use of the property to the carnival and temporary parking.
We have permission only to level the existing ground and will not
be allowed to haul in any additional stone for parking. Chairman
Farley indicated that if weather would prevent the use of parking
on site, the Lions Club had secured use of the parking lot at
Multigraphiese
As far as any future recreational use of the MSD reservoir site
is concerned, it is still being discussed by the MSD 'Commissioners
and is very doubtful that anything will be finalized for this
season.
The residents who live adjacent to the property expressed concern
as to the actual police security plan to be implemented during
the carnival. The Committee requests that the Police Department
have this information available for the next Village Board Meet-
ing, June 17, 1980, and that a representative of the Police
Department be present to answer any questions concerning the plan.

B. Lake Bri_arwood Drainage Problem
Herb Weeks presented a memci from Ben Hemmeter which estimated the
cost to repair the drainage ditch between Mr. Plaza and Mr.
Henneberry's homes at $24,000.00. Actual design drawings are not
complete and the above estimate only includes the east portion
of the ditch. Mrs. Beucherie indicated that their side of the
Aitch also was in dire need of repair and that they should be
included in the proposed bank stabilization project.
Mr. Do,wdle, President of the Homeowner's Association, stated that
the Association, has not yet met to discuss their passible partici-
pation. There is a special meeting planned for June. 12, 1980
on another matter and 'they hope to have time to discuss the
drainage ditch. He indicated that until they have actual cast
estimates of the complete project, it is hard for them to present
this to their members. Chairman Farley asked that staff finalize
drawings on the complete drainage ditch so that accurate cast
figures can be available prior to the June 12, 19801 meeting. Chair-
man Farley further stated that the Village's legal counsel has ad-
vised him that a special Service District could be established in
the Lake Briarwoo`d area as a means to pay for the project.
C. Cable TV
Mr. Dulacher of the Mt. Prospect Park District presented the
Committee with a preliminary resolution regarding the proposed
Cable TVfranchise. Their mainconcern�ls that the service be
compatible from ' one community to another. He requested that he be
notified of all future discussions concerning Cable TV. Chairman
Farley directed staff to include Mr. Dulacher on the agenda mailing
list.
D. Rauenhorst Phase T
Mr. Weeks stated that the Village had requested Rauenhorst to over-
size some water mains in the first phase project and have agreed
to pay $25,000.00 for this oversizing. He feels this is a fair
price and indicated that we have $30,000.00 budgeted this year for
this oversizing.

Ren Fritz requested approval from the Committee to secure the
services of a landscape architect for a sum not to exceed
$1,000.00 to aid in beautification planning for the new intersection.
Mr. Fritz stated that this moneys would come out of his traffic
engineer budget, a. position he has yet to fill. The Committee
approved this expenditure unanimously.

SECTION THREE: The first paragraph of Section 16.202 of Article
II of Chapter 16 of the Municipal Code of the Village of Mount
Prospect be, and the same is hereby, amended by deleting the
language "Planning Commission and has been reviewed and approved
by the President and Board of Trustees of the Village" as it
appears in the first paragraph of said Section and substituting

approval and shall specify with particularity the
aspects in which the proposed plan fails to meet
the standards of Section 16.317 hereof.
SECTION SIX: Section 16.306 of Article III of Chapter 16 of the
Municipal Code of the Village of Mount Prospect be, and the same
is hereby, amended by deleting the words "or plan" wherever such
words appear in said Section, by deleting the language "or
Section 16.317'" as it appears in said Section and by deleting the

Section 16-306. Board Review of Preliminary Plat. The
President and Board of Trustees by motion shall accept or

its next regularly scheduled meeting following the date of
the written report of the Planning Commission. If it
rejects the plat, the motion shall set forth the reasons
for its disapproval and specify with particularity the
aspects in which the proposed plat fails to meet the
standards of Section 16.316 of this Chapter.
SECTION SEVEN: Section 16.307 of Article III of Chapter 16 of
the Municipal Code of the Village of Mount Prospect (the
"Development Code") be, and the same is hereby, amended by
deleting the language "as the case may be" as such words appear
in said Section and adding thereto the language "and approval
of the preliminary plan by the Director of Community Development"

SECTION TWENTY-ONE: The Preamble to Article IV of Chapter 16 of
the Ru�nicipal Code of the Village of Mount Prospect be, and the
same is hereby, amended by deleting the language "or plan" as it
appears in said Preamble and adding to said Preamble the language
"and the Director of Community Development to require as a condi-
tion of approval of any final plan," so that said Preamble shall
hereafter be and read as follows:
Preamble: This Article authorizes the Planning Commission
to recommend and the President and Board of Trustees to
require as a Condition of approval of any final plat and
the Director of Community Development to require as a condi-
tion of approval of any final plan that certain public
improvements be provided or installed on or adjacent to the
parcel. It establishes specifications to be, followed in
the design and installation of those improvements.
SECTION TV&NTY-TWO: Section 16.401 'of Article IV of Chapter 16

Section 16.401. General Authority. In order to ensure the
orderly development and improvement of land within the
jurisdiction of the Village, to ensure the provision of
vehicular and pedestrian circulation - ways, utilities, ser-
vices and facilities necessary and desirable for the citi-
zens of Mount Prospect, to protect and enhance the value of
public and private property, the Planning Commission may
recommend and the President and Boa ' rd*of Trustees may require
that as a condition of approval of any final plat and the
Director of Community Development may require that as a
condition of approval of any final plan subject to this
Chapter, that certain improvements set forth in this
Article shall be provided and that certain design standards
and improvement specifications be followed. Only those
improvements which are specifically and uniquely attributable
to the impact to be generated by the subdivision or develop-
ment of a parcel may be required hereunder.
SECTION TWENTY-THREE: 'This Ordinance shall be in full force and
effect from and after its passage, approval and publication in
the manner provided by law.,'

ORDINANCE OF THE VILLAGE OF
MOUNT PROSPECT
WHEREAS, in an Annexation Agreement dated May 6, 1980 by
and between the Vi'llage I of Mount Prospect, an Illinois munici-
pal, corporaition (hereinafter referred to as the "Village")
American National Bank and Trust Company of Chicago, a national
banking association, not individually, but solely as Trustee
under a Trust Agreement dated February 10, 1979 and known as
Trust No. 45771 and the beneficiary thereofr Northern Illinois
Gas Company, an Illinois corporation (,referred to hereinafter
as "NI -Gas") and the Rauenhorst Corporation, a Minnesota
corporation, the Village has agreed' to amend the sign regulations
of the municipal Code of the Village of Mount Prospect, Article IV
of Chapter.9 of the.Municipal Coder to include a definition of
identific ' ation signs in said Article, to permit identification
signs in the I-1 Industrial,Light District under the Village of
Mount Prospect Zoning Ordinance and to provide -regulations for
such Signs; and
WHEREAS, the President and Board of Trustees of the Village of
M , ount.Prospect find that it would be in the best interest of the
Village to amend the sign provisions of Article IV of Chapter 9'
of the municipal Code of the Village of Mount PrQspect-as'set
forth hereinafter.

SUBJECT: Plat of Subdivision - CHARLIE CLUB located on
South Elmhurst Road immediately West of Red
Lobster
DATE: June 13, 1980
Vavrus Company, developers of Charlie Club, propose to
locate on the site immediately West of Red Lobster and
gain access to their site via Midway Drive which had
previously been dedicated as a means of access to the
Westerly edge of property -owned -by Mr.-Hiotis.
Vavrus will be responsible for the construction of
Midway Drive and extending the utilities to the property
from Elmhurst Road West to the site. Midway Drive will
end in a cul-de-sac and provide the necessary turning
radius for emergency vehicles,,
The Plat of Subdivision has been reviewed by all departments
and satisfactorily meets all of the considerations of staff
operations and development code requirements. The Plan
Commission reviewed the Plat of Subdivision on June 4, 1980,
and has recommended approval of the Plat of Subdivision in
its present form. Vavrus will be presenting their request
for modifications to the Zoning Ordinance Text and related
variances at the July Board Meeting*
