AN ORDINANCE AMENDING THE MOUNT PROSPECT
TRAFFIC CODE
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that it is in the best interest of the residents of the Village of
Mount Prospect to 0 1 1
impose a five ton load limit on Wheeling ... between
Kensington Road and Euclid Avenue and on Westgate Road between Central Road
and Cardinal Lane in the Village of Mount Prospect.

SUBJECT : Tree Trimming Bid
On Tuesday, May 6th, one of the bid items,is for the 1980-81
tree trimming contract. The director of Public Works recommends
that we utilize the second lowest bidder, Nels Johnson,, and I
concur whole-heartedly. While Mr. Weeks is correct in recommending
the rejection of Tree Toppers under the specifications in awarding
the contract to the lowest and. res-oonsib�le bidder, I have always
felt that there is some jeopardy --To--t-h-e--Ru-n,icipality by publicly
announcing that one of the firms is "Mot responsible". I would
suggest that during the discussion of the bias we stay with the
facts of the matter indicating that some other communities have
initiated lawsuits against Tree Toppers and have expressed
disatisfaction with the completion of previous contracts. Then
we could reject all bids and based upon the successful performance
of our current contractor authorize the Municipality to purchase
the services from the existing contractor. I -contrac,tor. Tree trimming -tree -
removal firms are a unique group of people and they may well be
in attendance at the board meeting. Rather than emphasize the
"irresponsibility" of the low bidder, we should stress, the positive
aspects of the current contractor and stick to the factual
information regarding Tree Toppers since our specifications allow
us to reject all bids.

On checking some of the references that Tree Toppers Inc. were
required to furnish we are told that all of them were for a
lower contract award than the one being contemplated by the
Village of Mount Prospect.
Therefore, I recommend that the next lowest bid as submitted by Nels J.
Johnson Tree Experts be accepted. Their base bid of $64,757.75 is the low-
est qualified bidder. The Nels Johnson Tree Expert Co. was our successful
bidder last year and they did a commendable job. The trimming was to
specifications, the count was accurate, and the contract was completed in
its entirety within the time frame which was spelled out in the bid.

SUBJECT: Review of 1979-1980 Tree Trimming Contract

Last June I received from you a copy of a memo from Mayor Krause to Mr.
Burghard. Mayor Krause asked to receive in one year, a report from
Public Works on Nels Johnson's performance on the 1979-1980 trimming con-
tract. Here are my observations, now that the contract has been completed.
In general I was very satisfied with both the quality and quantity of work
performed by bels Johnson's crews. In most cases the trees were trimmed
to our specifications the first time through an area. Deadwood removal
was very thorough, and the trees were properly thinned and -raised as requir-
ed. In the relatively few cases where corrections were needed, I received
the full cooperation of the contractor in sending the crews back to correct
deficiencies.
The reports listing trees trimmed were generally fairly accurate, and were
turned in regularly, although not every week as we had.specified. Measur-
ing of trees for payment purposes was also done accurately.
There were several complaints last summer from very irate citizens in two
of the trimming areas. Upon checking the trees in question, I found that
they had been trimmed according to our specifications. I attributed the
problem with the residents to the fact that most of these trees were in the
smallest size class, where pruning usually causes the most complaints. As
you know, trees of this size must usually be "raised" to prevent hazardous
low -growing branches in the future. This often involves removing only a
few lower branches on a small tree, but, since the tree is already small
the change may be quite visible.
I felt that the real problem here was basically a lack of information
available to the public. Therefore'. I drafted a letter explaining our
trimming procedures and the reasons behind them. This letter was distribut-
ed to residents in areas scheduled for trimming, with good results. I
received few complaints from the residents in these areas, so I feel we
should continue this practice in the future.
The $85,000.00 budgeted for the trimming contract was almost entirely used
($131.50 left) as of February 19, 1980. All trimming work was done as of
April 7, 1980, when Johnson's crews completed a list of corrections I had
given them. -

I would highly recommend this company for our future tree trimming work.

I have made some inquiries regarding past performances by Tree Toppers, Inc.
I have learned that this company is presently 'Involved in a civil suit
filed by the Village of Arlington Heights, for failure to complete a trimm-
ing contract in 1977-1978. According to Erwin Page,, Village Forester,, the
company had only finished 20% of the contract when they walked off the job.
I also talked to Charlie, Gouveia, Landscape Architect for the Illinois
Department of Transportation, Division o,f Highways. Tree Toppers worked for
them two, years ago on, a removal and trimming contract. Mr. Gouveia said
the quality of work was good, but they had any headaches trying to get them
to finish the contract. Apparently, the Statets contract allows them to add
a limited amount of additional work to a contract, which they did in this
case, but Tree Toppers had already pulled off the job. Mr. Gouveia said
that he tried many times to get in touch with the company, but there was
only an answering service to take his calls. He also sent registered letters
which brought no response from the company. Mr. Gouveia stated that he
would not have Tree Toppers work for him again.
I have also learned through talking with area foresters that Tree Toppers
had great difficulty in completing a tree removal contract for La Grange
recently. Apparently La Grange did not pursue the matter, but the foresters
I spoke to felt that the contractor did not hold up his end of the contract.
I also spoke with Dennis Ceplecha, City Forester of Evanston. He recently
refused to award that city's trimming contract to Tree Toppers for the above
reasons, even though they were the lowest bidder.
I also checked three of the references that Tree Toppers supplied with their
bid. The response as to the quality of work was acceptable, but I noticed
that the contracts were all smaller than ours will be (specifically they
were for $10,000.00, $30,000.00, and $46,000.00). 1 question whether Tree
Toppers would be able to complete our contract, knowing that there is only
one climber working for the company (he also happens to be the Vice Presi_
dent'of the company and the only holder of a tree expert license within the
organization).
For the above reasons, I feel we should not accept Tree Toppers bid, and
award the contract to the next lowest bidder, Nets J. Johnson Tree Experts,
Inc.

To improve the aesthetics of the new roof an alternate bid was requested

The plans for this new roof were drawn by Archiplan and they have checked
out the qualifications of the various bidders and have checked with each
of them regarding interpetration of the specifications so there is no
misunderstanding.
After reviewing all the bids with the architect, I met with the apparent
low bidder, Martin Builders. I am confident that he qualifies for this

type of job and thoroughly understands all of the ramifications of the
project. He has assured me that the work should be completed in a months
time with favorable weather conditions. There is $70,000.00 allocated in
the current budget for this proposed contract.

Building, it will be necessary to remove the communication tower during
construction.
Because of the age of the existing tower, 12 years, and the fact that it
is designed to be mounted on a flat surface, we have three alternatives
to consider:
New 70 foot roof mounted tower designed for pitched
roofs.
2.. Refurbish existing tower to include a new bottom sec-
tion for pitched roof installation.
3. New or used self-supporting 100 foot tower.
We have been advised that because of the age and present condition of the
existing tower that to consider refurbishing would be more costly than to
purchase a new roof mounted tower. Therefore, proposals for the two re-
maining alternatives were requested from eight possible suppliers. Only
two responded with the following results:

*Included in the price for installation of a new roof mounted tower is labor

The funds to cover this expenditure were included in the budgeted amount
for the construction of the new pitched roof. it was necessary to wait
until he had the results from the roof bid in order to determine which
alternative to pursue. Based on the base price of $65,858.00 to construct
the roof, and the time element involved in going out for formal bid on the
communication tower, I recommend we accept the low propos'al as submitted
by Witting Communication Tower, Inc. in the amount of $5,567.80.

engine In -lieu of the 23 HP enginewhichwas specified. Lower horsepower
engine and reduced capacity pump will impose limitations on the machine
which would have an adverse affect on the type of work we are trying to
accomplish.
The second bid of Permalawn, Inc. meets our specifications but is in excess
of our budget figure of $9,500.00. As there is -a 45 day delivery time pro-
jected for the new _unit, we would receive minimal benefit from the avail-
ability of the machine this year. I would therefore recommend that this
bid also be rejected as being over budget and to consider a rebid of the
unit later this summer using modified specifications. It is conceiveable
that a more favorable price can be obtained at that time.

The 1980--81 Budget includes provisions in the capital outlay account
for the purchase of one auto. This replacement vehicle will allow
the retirement of one (1) 1974 Chevrolet Nova.
In recent conversation with Public Works Director Herb Weeks, he
informed me of the bid results on two Chevrolet Chevette automobiles
at a unit price of $5,250.00. I would like to add to this purchase
the one automobile to be purchased by the Fire Department this fiscal
year. This would satisfy our need without going through the process
of drawing specifications, advertising, etc. involved with the bidding
process. This would also allow us to obtain a current year model and
avoid price increases to be anticipated for next years model. We have
checked with Lattof Chevrolet and they can supply the additional
vehicle.
The 1974 Chevrolet to be retired will be declared surplus and recommended
for sale at the semi --annual N.W.M. C. auction.

The meeting was called to order at 8:00 P.M. Present were Chairman Miller,
TrusteesE. F. Richardson and T. J. Wattenberg; Assistant Village Manager
Edward Geick, D3*Xector,,of Management Services -Martha H. Peppler,, Ernest
Blamquist,, Attorney and Robert Phelps, owner,- of Arlington Club Beverage
Company.
Chairman Miller asked the petitioners for Arlington Club Beverage Company
to present their request. Mr. Blomq4ist gave a brief history of the opera-
tion of Arlington Beverage. When the original license was granted it was
for a special P classification which allowed unrefrigerated,,beer and wine
only. Mr. Phelps, the owner, indicated that his clientele is mostly indl-
viduals looking for - ' large quantities of beer or pop for,picnics , parties,
or church functions. He has numerous requests,for iced beer or pop and
for keg beer. The hours for Arlington,Beverage are Tuesday - Saturday -
9-6,, Sunday -Beer 12-3, Friday or summer, open till 8-:00. Mr. Phelps
noted that this doesn't show him to necessarily be creating an additional
source of liquor for young people. The committee expressed no objections
to this,change.- Mr. Miller requested that the committee report out at
the May 6, 1980 meeting its recommendation to amend the liquor ordinance
P classificaticn to allow refrigerated beer and wine.
Chairman Miller requested a discussion of the funding of Clearbrook Center
if the township ceases its support. Trustee Wattenberg agreed to hear
the matter in his committee.
Chairman Miller opened a discussim of Village employee fringe benefits.
Mrs, Peppler corrected the memo that was distributed with the Committee
Agenda to read, Police EMT pay $150.00. Mr. Gelck noted that most increases
in benefits have come through negotiations with the various unions over the
past years.

I ENTITLEMENT/CENTRAL DISPATCH
As of March 31, 1980, 4CJC, will cease to exist. -Each municipality must
decide to pursue one of the options listed below. The amount of funding to be
received can only be procured .by becoming or being part of an entitlement
agency. Failure to become or be part of an entitlement agency places the
municipality in the "balance -of state group" and puts their allocation back
into the pot. Thus, all of the Balance of State units are in competition

for the $1,637,700 in project�d"funds available in this pot. It should be
noted that as more agencies become entitled the "balance of state" pot becomes
smaller. only mtun cipelzties,of 100,000 or more may -became an entitlement
agency, but municipalities can band together to form a unit of over 100,000
people and eligible to receive over $50,000 in funding. Thus, the options
presently open are:
Options: 1. Become part of LEAA Entitlement thru N.W.C.D.S.
2.= Seek to become part of the City of Chicago Entitlement
3. Seek to become part of the Cook County Entitlement
4. Seek to organize a'Suburban Entitlement group. The
communities of the Northwest Municipal Conference would
comprise over 100,000 people and would receive an annual
level of approximately $371,000
5. Do nothing and automatically become part of the "balance of
state," group

Additionally, Chief Doney reported that N.W.C.DZ most probably would
be eligible for about $60,000 per year. He also pointed out that if
we do not act by May 15, 1980, we become a part of the "balance of
the state" fund. Chief Doney reported that he recommends the entitlement
through N.W.C.D.S. By a vote of 3-0 the Fire and Police Committee
recommends the passage of the entitlement resolution based on a report
out on the May 6, 1980 board meeting.
mApj;E CREST SUBDIVISION WATER SYSTEM
Public Works Director Herb Weeks gave a brief history stating that he has
been able to find no record of any offer by Citizens utilities to sell
Just this part of the system to the Village of Mount Prospect. Herb
also stated that Citizens Utilities still has not proven ownership of
the system nor any proof of a contractual agreement with the Village
of Mount Prospect for, water. The coTmni tee directed the Village Manager
to pursue the subject of proof of ownership With Citizens Utilities.
PUBLIC SAFETY DEPARTMENT
After considerable `discussion regarding the history of Public Safety -
Departments as well as their design, the committee directed the Manager
to investigate the feasibility of obtaining a graduate,student from
Northern Illinois University to conduct a study during the summer.
VEHICLE STICKERS
used upon citizen's concern-with,the obtaining and affixing of,vehicle
stickers -during' -the winter months ,,,diiscusslon centered around the feasibility
of changing the sticker date from January 1 to May 1. Based on a vote of
3-o,, the committee recormnends that the 1981 vehicle stickers will be applicable
to the period -of January 1-,, 1981-thru May 1, 1982,, - The,cost of -the stickers"I"
for that year to be determined based on a 16 month usage.
SHOPLIFTING ORDINANCE
Since this item, continues to await the cooperation of the Circuit Court
-it was recommendedcharge that this cbgebe removed from the Fire and Police
Committee. Such action is recommended based on a vote of 3-0.

A RESOLUTION AUTHORIZING THE NORTHWEST CENTRAL DISPATCH SYSTEMS
TO SERVE AS A LOCAL CRIMINAL JUSTICE ADVISORY BOARD., AS
DEFINED IN THE JUSTICE SYSTEMS IMPROVEMENTS ACT OF 1979
WHEREAS, the Villages of Arlington Heights, Buffalo Grove, Elk Grove and
Mount Prospect have for many years cooperated in local efforts to improve the
law enforcement and criminal and juvenile justice systems in said municipalities
through the Northwest Central Dispatch Systems; and
WHEREAS0
., through the association the aforesaid municipalities have determined
that there is need to plan and coordinate the efforts of the numerous public and
private agencies in said systems; and
WHEREAS, the Juvenile Justice and Delinquency Prevention Act of 1974 already
provides for the active consultation with and participation of local governments
and private agencies in the development of both local and state plans for the
improvement and coordination of the juvenile justice systems; and
WHEREAS, by means of the Justice System Improvement Act of 1979, the
Congress of the United States has determined that local efforts to achieve such
improved planning and coordination of local law enforcement and criminal justice
systems should be expanded and strengthened through a program commonly
known as the "entitlement" program; and
WHEREAS, the Illinois Law Enforcement Commission has passed certain -
resolutions , regulations and guidelines implementing the aforesaid entitlement
program in Illinois; and
WHEREAS, the Village of Mount Prospect has determined that the aforesaid
entitlement program is one which would benefit said municipality, as well as
the various other communities within the Northwest Central Dispatch System
and one in which the aforesaid Region should participate.
NOW 9 THEREFORE , BE IT RESOLVED BY TME MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That pursuant to Article VII, Section 10 of the Illinois
Constitution of 1970 and the provisions of the Intergovernmental Cooporation
Act, the Village of Mount Prospect hereby authorizes the Northwest Central
Dispatch Systems to serve as a local criminal justice advisory board "as defined
in the Justice System Improvement Act of 197911 and agrees to cooperate With said
Region so that it may fulfill the duties imposed upon such boards by Federal or
State law.
SECTION TWO -.. The Village of Mount Prospect hereby agrees, through the agency

of the Northwest Central Dispatch- Systems, with each other participating unit of
government within said Region to cooperatively promote improvements in the law
enforcement and criminal juvenile justice systems within said Region, particularly
those which transcend the departments, agencies or geographical boundaries of
any single such unit, all as more fully set out in the -Charter and By -Laws of the
Northwest Central Dispatch System. to
SECTIO CTION THREE: The Village of Mount Prospect hereby endorses the authorized
services and activities of the Northwest Central Dispatch System, as set out in
its Charter and By -Laws, which said Region proposes to provide to its
constituent units of government upon request, as beneficial to said municipality,
and more generally as in the best interest of all units of local government situated
with said Region.
SECTION FOUR: The Village of Mount Prospect authorizes the Northwest
Centra -1, Disp a tc : System, to apply for, receive, utilize and expend such
Federal or State funds as might be available to it to assist it in performing
services and activities, all in accordan.+ce with applicable law.

have to be acquired-. This was not feasible so the residents
were promised that signs would be installed to prohibit vehicles

after referred to as the "Village").
W I T N E S S E T H
WHEREAS, the Association is the owner of the private
streets legally described on Exhibit A which is attached hereto
and incorporated herein by this reference, which serve a condo --
minium development commonly known as Colony Country -Condominiums
which is located at J� S5 Plead in the Village of Mount
Prospect; and
WHEREAS, the Illinois Vehicle Code in Section 11 -209.1,, -
Ill. Rev. Stat., 1977, ch. 95-1/2 511-209.1, authorizes the
Village to enter into agreements to regulate and enforce traffic
restrictions on private streets upon written request of the
board of directors of an association; and
WHEREAS, the Board of Directors of the Association
has filed a written request, a copy of which is attached hereto
as Exhibit -B and incorporated herein by this reference, with.
the Chief of Police of the Village of Mount Prospect asking
the Village to regulate and enforce specified traffic restric-
tions on the private streets, legally described -on Exhibit A.
within. the Colony Country Condominium development; and -
WHEREAS.. the President and Board of Trustees of the
Village find that it would be in the best interest of the Vilwft
lage and the residents of the Colony Country Condominium
development for the Village to regulate and enforce traffic
restrictions on the private streets, legally described on
Exhibit At within the Colony Country Condominium development.
NOW, THEREFORE,, for and in consideration of the
mutual agreements hereinafter set forth, the parties hereto
agree as follows:
SECTION ONE.- The Association hereby authorizes the
Village to establish and the Village does hereby establish the
traffic and parking regulations set -forth on Exhibit C attached
heretoandincorporated herein by this reference, on the private
streets legally described on Exhibit A and designated on
Exhibit -C - within the Colony Country Condominium project.
SECTION TWO: The Association hereby. authorizes the
Village to enforce and the Village hereby agrees to enforce
the traffic and parking regulations set forth on Exhibit C on
-the private streets-deslignated on Exhibit C within the Colony
Country Condominium project subject to the provisions of
Section Three hereinafter.
SECTION THREE: The Association, at its sole cost and
expense, shall erect or cause to be erected any and all signs and
make or cause to be made any and all markings required by the
Chief of Police of the Village of Mount Prospect in connection
with the regulations on traffic and parking set forth on
Exhibit C hereto.
SECTION FOUR,-, The parties -agree that the Village of_
MountProspect Police Department may issue traffic and parking
tickets for violations of the regulations set forth on Exhibit C
and that penalties for violations of such regulations shall be
the same as for like traffic and_parkingviolations under the Muni -

pal Code of the Village of Mount Prospect,

SECTION FIVE: The parties agree that neither shall
have any cause of act -Ion of any kind or character whatsoever
against the,other or for any type of relief against the other
for any breach of this Agreement,
SECTION SIX: The authorizations contained under the
terms of this Agreement shall be in addition to any other
authority of the Village of Mount Prospect existing by reason
of any other statute of the State of Illinois or ordinance
of the Village of Mount Prospect and such additl-Onal authoriza-
tions shall not be construed to be in --lieu of such statute--or
--
ordinance,
SECTION SEVEN: This Agreement shall continue in full
force and effect for a period beginning as provided -in Section
Eight hereinafter -and ending December 31, 1984,
SECTION EIGHT: A fully executed Copy of -this Agree-
ment shall be recorded by the Association in the office of the
Recorder of Deeds of the County of Cook, as provided by statute,
and none of the regulations made pursuant to this Agreement
shall be effective or enforceable until three days after this
Agreement is so recorded.

On February 28, 19802 representatives of the Colony Country Community
Association met with the Public Health and Safety Committee to dis-
cuss our desire to have the Mount Prospect Police Department enforce
traffic regulations on the private streets within our condominium
development.
We had previously submitted a detailed legal description of the
streets affected, and a draft of the proposed ordinance. It was the
suggestion of your counsel that in .addition, we formally request
this service in writing.
Accordingly, as President of Colony Country Community Association,
I respectfully request, on its behalf,, consideration to enter into
an agreement with the Village of Mount Prospect for its enforcement
of traffic regulations established for the private roads and
streets of our complex.

NOTES TO EXHIBIT C.
The Village will enforce on the private streets legally described
in Exhibit A all posted traffic and parking regulations indicated on Exhibit C,
and all related provisions of the Village Code except those referring to all-night
parking, snowfall parking and parking where fire hydrants are located in parking
bay areas. The Association authorizes the issuance of traffic citations by the
Village for violations. It is understood, however., that posted traffic and parking
regulations indicated on Exhibit'C may be changed by the Association from time
to time at its discretion as conditions, in the opinion of the Association, so
warrant.

The Plan Commission reviewed the subject subdivision on
April 2nd and April 16th,
The Harris Subdivision contains two lots, both meeting the lot
area and width requirements of our Zoning Ordinance. The property
is located at the northeast corner of White Oak Street and Central
Avenue in the west -central section of the Village. Pa * ge 1 -AS of
the Zoning Ordinance indicates the property is zoned R-1 single-family,
The property has access from paved streets but there are no curb,
gutter or sidewalks installed in this section. The Develo'pmen't Code
requires these improvements; but since no other lots developed in
this area have these improvements, the Plan Commission recommends
waiving the improvements until a special assessment could be considered
at some future date, if the Village Board so desires.
The property is served by a township sanitary sewer at Central Avenue
and a Village water main at Prairie Avenue and White Oak Street,, - Special
assessment #SA72-14 provided for a storm sewer to be installed in this
area. The special assessment remaining to be paid on lot I is $435.39
and $326.34 for lot 2.
The Plan Commission questioned the alignment of the lot line separating
lot 1 from lot 2 since in the proposed subdivision it was not perpendicular
to the front and rear yards. The land surveyor produced evidence at the
April 16th meeting of the Plan Commission indicating that the reason for
the slight angle of the lot line separating lots 1 and 2 was made to avoid
a large tree which could not otherwise be contained on lot 1 where the
existing principle residence is located. The placement of the principle
residence on lot 1 conforms to the building setbacks as required on the
subdivision plat and the Zoning Ordinance.
