April 1, 1980 Mayor Krause cal -led the meeting to order at 8: 13 with Trustee Farley absent. The minutes and bills were approved as submitted. The Board accepted the low bid submitted by Lattof Chevrolet for the purchase of police vehicles. Authorization was given to amend the Well 17 contract with an additional $10,,562.96 payment to J. P. Miller., and proceed with putting that well in operation. ANT MFT RESOLUTION was passed, Resolution 13-80, appropriating $6,000 for the installation of a left turn signal -for north and south bound traffic at Central & Main along with installation of Opticom, equipment. AN MFT RESOLUTION was passed, Resolution 14- 80, appropriating $12, 000 for the installation of a full signal at Willow Lane & Busse Road . along with Opticom, equipment. An Ordinance Making Certain Appropriation Transfers Within the Annual Fiscal 79-80 Budget had its first reading, with 2nd reading to take place on April 15th. The Manager noted a request had been received from Prospect Cab to increase fares. Mr. Burghard also brought up the fact that BFI would drop their proposed 2 day pick - UT) schedule, since Mount Prospect denied the program. That matter will be brought up at the April 15th meeting for another vote, pending research into whether matter's can or should be brought back to the Board level even after votes have been taken. Mayor Krause proclaimed April 1, 1980 as Census Day, and the week of April 13 - 19 as Mount Prospect Library Week, I.V The Board concurred in the recommendation to accept the Stipulation to Discontinue the Brickman case. That proposal will go before the Zoning Board of Appeals , with the filing fees having been waived by the Board. A Public Hearing was held for the purpose of creating Special Service Area #2 (Blackhawk area). Many of the residents requested that they be allowed to pay cash instead of having to pay increased taxes . the matter will be looked into, especially since so many of the residents made that request. Page TT., ZBA 5-V-80, Kensington Center An Ordinance Granting Specified Variations for the Rauenhorst Property, and An Ordinance Granting Specified Variations for a Portion of the Rauenhorst Property had first readings and will be presented April 15 for 2nd reading. The Board authorized the Mayor to sign the Plat of Dedication for the Rauenhorst property. A Public Hearing was then held to consider the proposed Annexation Agreement with Rauenhorst Corporation. Following discussion, the hearing was continued to the April 15th Board meeting with the Resolution and Ordinances to have 2nd readings and possible passage that date. The Manager gave a brief presentation of the 80- 81 budget,, noting that it will be presented April 15th for adoption. The Board authorized the Mayor to sign Mannella's Plat of Subdivision as well as the Plan of Annexation for the Shell station at Rand & Euclid. The following items were referred: Building Committee Finance Committee Fire and Police Committee ZBA 8-V-80 9, 1414 Sauk Lane Total review of employee benefits Feasibility of creating a Public Safety Department (Fire and Police) Vehicle sticker due date - proposed May 1st Declaration of Intent - Entitlement for Central Dispatch Legislative /Judiciary Committee Membership in HIPC - Benefits Public Health & Safety Contract with County Police - Mutal Aid A Committee of the Whole meeting has been called for tomorrow April 3, at 7: 30 to discuss acquisition of Lake Michigan water. Lowden Lane , requested the Board require a 70 fent setback from residential property,, instead of the proposed setback of 40 feet. Hal Ross , Chairman of the Mount Prospect Planning Commission , Torn McGovern, member of the Plan Commission , and the President of the River Trails Pare District spoke in favor of the project but requested the Village Board to consider additional open space for the purpose of recreation be required. BURGHARD DATE MARCH 27, 1980 SUBJECT Well #17, Contract Increase The Board may recall that last year the administration was authorized to proceed with completion of Well #17 and the implementation of the existing reservoir on Rt. 83 near our northern border. As background, I offer the following information: In February of 1977, the Village entered into a contract with J.P. Miller Well Company to drill and install the well and for another company to construct the 2 million gallon reservoir. After the initial work was completed, the Village suspended the contract until the matter was brought before the Mayor and Board of Trustees again last year. During that time the well, of course, has not been operational and the 2 million gallon storage tank has sat idle. We proposed to the Board last year that the well be completed and that the pumps and pumphouse be constructed so that the reservoir could also be put to use. The problem we have at this point is that the prices in the 1977 contract for J.P. Miller are no longer adequate and Miller is asking for an increase over the original contract in the amount of $10,562.96. In 1977, the original contract amount was $277,887. Since that time, the well has been drilled and casing installed at the depth of 1,947 ft. and we have paid bills in the amount of $134,528. Additionally,, pumps and shafts were purchased in the amount of $41,328.96 and three . variable speed pumps were also purchased in the amount of $36,000. Therefore,, the total amount spent on the contract to date is $211,856.96. J.P. Miller expects that the remaining work including 1,000 ft. of outer column pipe, 300 ft. of inner column pipe, an airline pump bowl and strainer is $76,593. This is an increase over the original contract in the amount of $10,,560.96. Essentially, the Villagecontract with J.P. Miller 'i nally i executed in 1977, has no provi., orig sion that I or Barbara Baran can determine for authorizing contract increases and the matter is, therefore, brought to your attention. Given increases, in labor and materials since 1977, 1 believe the $10,000 request is reasonable and should be approved. Memo emo to Mayor and Board of Trustees Re: Well #17, Contract Increase Page 2 Some Board members may question the wisdom of proceeding with this contract at this time in light of our discusssions with Des Plaines, DAMP and Venture. However, the basic well, i.e., the hole in the ground, is completed and what the remainder of the contract calls for with J.P. Miller is the installation of the well casing and the pump inside the well. The additional contracts that we are budgeting for next year are the pumphouse and the necessary pumping station to put the reservoir on-line as well as to connect the well `to the reservoir. While it does appear that the pursuit of an ultimate water source is "right around the corner" and the State Department of Transporation is indicating that local governments receiving lake water allocations will have to abandon their deep wells, this abandonment apparently will not be enforced until 1990. According to Herb Weeks, our Director of Public Works, we would begin by abandoning other wells in the community that are either lower producers or have substantial operational problems. This well, Well #17, would undoubtedly serve us until 1990. The remaining portions of the contract are necessary to put the reservoir on-line which is going to be a requirement whether we have lake water or local water. TERRANCE L. Hemmeter, Village Engineer DATE: March 26, 1980 SUBJECT: Traffic Signa,ls11111at Main Street and Central Road The Illinois Department of Transportation(IDOT) is planning to upgrade the traffic signals at Main Street and Central Road this coming summer. This improvement will include left turn arrows for the north and southbound traffic. The'Village has been requesting that IDOT approve these left turn arrows for several years. We have requested IDOT to include Opticom, pre- empting equipment in the improvement in accord with the Fire Department's program to have all traffic signals in the Village equipped with the Opticom, The Federal Government is paying for 85% of the improvement costs, and IDOT is paying for 15% of the cost. Mount Prospect must PaN7 for the added cost of the Opticom equipment which amounts to $6,000 and can be paid for with MFT funds. This expenditure had been included in this year's budget. I recommend that the attached resolution be adopted in which $6,000 will be appropriated from HFT funds to pay for the Village's share of the traffic signal improvement. Provided that the Buyer submits plans to the Village which comply with applicable Village ordinances, the Village agrees to issue necessary permits to the Buyer to allow grading, the installation of drainage and utility facilities and construction of building foundations prior to the Buyer's submission of plans for the entire building to be constructed on a lot provided, however, that any such permits issued shall not authorize and shall not be construed to authorize to permit construction of any portion of a building or any improvement for which plans have not been reviewed and approved by the Village. A 54 -inch sanitary sewer main is located along the right-of-way of Wolf Road which forms the easterly boundary of the Land, and a 36 -inch sanitary sewer and a 54 -inch sanitary sewer are located within the right-of-way of Rand Road, and a 10 -inch itary sewer is located along the South twenty (20) sani I feet of the Northwest Quarter of Section 35. B. Water. A nch water main 'is located in the vicinity of the intersection of Kensington Road and Wheeling Road, a water main is located within the right-of-way of .and Road, and a water main is located at or near the South line O -5f the Northeast' Quarter of Section 35, lying Westerly of the South 820 feet of the East 480 feet of said Northeast Quarter, occupied by River Trails School Distric] C. The Buyer agrees that it will construct on the Annexed Land, at its sole cost and expense, the public improvements set forth on the fol- lowing exhibits, attached hereto and incorporated herein by this reference: A. Exhibit T. Grading, Storm Sewers, and Retention Ponds. B. Exhibit M. Sanitary Sewers and Water Mains. C. Exhibit N. Rights of Way, Streets, Sidewalks, Street 4 LigbtCinq? and.Landscapj_ng. The parties agree that Exhibits I, M, and N are conceptual exhibits only and that the final alignment and loca- tion of improvements shall not be required to conform exactly to the alignmenL and location shown on said exhibits, but the purpose, function and capacit,, of the improvements shall be in� substantial conformity with the exhibits. All improvements shown are in conformity, to the degree represented, with the requirements of the Village ordinances except as set forth herein or on the exhibits. In connection with said public improvements, the Buyer further agrees as follows: D. Temporary Lift Stations and Force Mains: The Buyer agrees to construct, install and maintain at its sole cost and expense,) temporary lift stations in the locations shown on Exhibit M and of the quality and , capacity as required and approved by the Village Engineer. The Buyer shall expeditiously remove and properly abandon such temporary lift stations from the sanitary sewer lines to be developed on the Land when, in the opinion of the Village Engineer, such temporary lift stations are no longer necessary to facilitate the flow of sewage through such sewer lines. Streets, RGad way and Intersection Improvemen'rLs.. 1 Interior Streets . a. Construction Road. Within �welve months after the execu4.--,J'-on of this Agreement, the Buyer at its sole c-cst and expense will com- plete the construction of a temporary con- s-#,-_ruct_`Lon access road from Wolf Road, pro- ceeding westerly across the Land to the Annexed Land. The Buyer-shall maintain such construction road at its sole cost and expense. The roadway shall be constructed with such materials so as to be usable under all weather conditions. The minimum width shall be eighteen (18) feet and the mini-mum thick- ness shall be sufficient to support concrete ready mix trucks and emergency vehicles. Con- struction of the road will include a "shaker section"ly to remove mud from trucks before such trucks enter public roadways.' The material for such roadway, the minimum thickness and the shaker section thereof, shall be sublect to the review and approval of the Village Enginee:i�. The Buyer shall require construction vehicles entering and exiting the Land to use such construction road upon its completion and shall limit the use of such construction road to construction traffic and emergency vehicles. Interior Roads. P-1--ior to the construction and installation of the construction road, the Village agrees to permit Buyer to use the existing -roads in Phase I of the Kensington Center development to be used for construction traffic and to permit construction traffic to enter the development from Kensington Street provided that -Buyer constructs, installs and maintains at 'Its sole cost and expense in the locations and to the ifications required by the Village speci 1 Engineer, shaker strips or the equivalent in appropriate locations. 2) The Buyer shall construct at 'Its sole cost and expense a permanentf"-Interio'r road extending from the Annexed Land to Wolf Road whenever 300rOOO square feet of off 'ice space has been constructed and 'Is Ni for office purDOses in the development, excludi ing office space occupying fifteen percent (15%) or less of a building used primarily for another use, or 200 gross acres hav-e been developed and are occupied lin'the development, whichever occurs first. Development for purposes of this paragraph shall include Kensington Center Phase 1 plus any construct' ion and development of the Annexed Land. - 18 - - 19 - attached hereto as Exhibit P and by this reference made a part hereof. The Bu er will not request the i Vllage to share in y in or absorb any of the above described construction costs associated with the Annexed Land. F. Water L-ine and Mairls. The Buyer agrees Lo construct at its sc-le cost and expense the twelve inch (12") water lines and mains and appurtenances thereto to serve the Annexed Land as shown o.n Exhibit M attached hereto. The parties agree that twelve inch (1�") watermains and lines are required to serve the Annexed lx� Land. Buyer agrees to construct and install the si teen inch (16") water lines and mains in the locations shown on Exhibit M hereto provided the Village pays the difference in cost between the materials necessary to construct a twelve inch (1211) water line and mai,n and the sixteen inch (1611) water line and main. The Vj-llaqe aqrees to pay the Buyer for such material cost after completion of construction of such water line and main' and within thirty (30) days after receipt of a bill therefor lf�bm the Buyer. The Buyer agrees to provide the Village with any documentation in the possession of the Buyer verifying the 'amount and charges for the cost charged to the Village. The Buyer shall construct such pedestrial path in connection with the development of the portion or portions of the Annexed Land on which such path is to be located, E., Storm Water System. In connection with such for water system, Buyer agrees to construct and install a storm water system on the Land as shown on Exhibit I attached hereto and incorporated herein by this reference. Buyer agrees to construct and 'Install at its sole cost and expense wells on the Annexed Land for the purpose of maintaining the water quality in water retention ponds to be located on the Land as shown on Exhibit I hereto. Such wells shall be con- structed and installed to specifications approved by the Village Engineer. In order to determine the amount of the increase in price, if any, to be borne by F the Village, alternative bids for such facilities or improveq-ft 4 ments, that is, including and not including such increase in size or capacity, will be obtained by the Buyer i in accordance with standard public bidding procedures. The Village agrees to accept such bids as determinative of the portion of the price for labor and material for such facilities and improvements to be borne by the Village. The Village will reimburse the Buyer for the Village's share of such price after completion of construction of such water line and main and within thirty (30) days after receipt of a bill therefor. SECTION FIFTEEN.- Environmental Controls During, Construction. Buyer understands and agrees'that Buyer and 'any and all of its agents, servantst employees, contractors and subcontractors, shall comply with the following regulations during the development of the Subject Property: A. No exterior work in connection with the development of the Land shall take place on Sundays. exterior work in connection with the Land shall take place only during the hours specified in the Building Code,. C. Noise from the Land during development shall not exceed the limits under the 1-1 Light Industrial District regulations of the Zoning Ordinance. D. Counterparts of the Ordinances and Codes described in subsections A, B, and C above of this Section Sixteen have been initialed and idetitifi'ed by the Village and the Buyer, and the Village and the Buyer have each retained an initialed and identified counterpart of such ordinances. In the event of a dispute regarding the content of the ordinances described in A. B and C applicable to the Annexed Land, the content of such ordinances which are so initialed and identified shall be controlling. 'C �._ I F. When used in this Annexation Agreement, the following terms shall have the following meanings. - 1. "Applicable Ordinances" or similar terms shall mean the ordinances and codes described in this Section Sixteen. 2. "Zoning Ordinance" all mean the Zoning Ordinance described in subsection A of this Section. 3. "Development Code" shall mean the Develo pment Code described in subsection B of this Section. Notwithstanding anything in the foregoing to the EEMEEMM G. The Buyer agrees to be bound by any ordinances which the Village is required to enact and make applicable to the P,nnexed Land by federal, state or other govern- mental authority. H. The Buyer may consent to the application ofc some amendments to the above ordinances, or portions of ordinances, to the Annexed Land. I. The Buyer agrees to be bound by any amendments to the ordinances set forth in this Section which apply in the VJ_llage generally with regard to fees, charges and costs charged by the Village. J. The Buyer agrees to be bo■ und by any amendments to such Codes described in subsection C of this Section which are adopted by the Village during the term of this Agreement provided that such amendments apply to the Village generally and are promulgated by an organization which is a recognized national authority for such code or codes. The Buyer shall convey the title to the Village with the same condition of title as received by the Buyer shall deed by special warranty deed such four -acre parcel to the Village simultaneously with the Village's annexation of the portion of the Land annexed after the annexation of the Second Phase Property. The Village agrees that the four -acre parcel will be bound by any covenants and restrictions which apply generally to the Annexed Land provided, however, that Buyer shall waive any requirement in such covenants and restrictions is would t the Village's right to freely convey such parcel. D, Buyer shall dedicate an easement to River Trails Park District for a jogging and bike path in the approximate location shown on Exhibit R attached hereto and incorporated herein by thi's reference. Buyer shall construct and install such jogging,and bike path in connection with each phase of the development of the Land and shall dedicate an easement therefor to said Park District at the completion of each such phase. Said easement shall be conditioned upon said Park District's agreement to maintain said Jogging and bike path. Chapter 9 Article IV shall be amended to include regula- tions for identification signs 'in Industrial Districts. The Village has no ob3ection to the Buyer's erection of three permanent monument identification signs within the public rights-of-way at the intersections of Rand Road and Business Center Drive and along Wheeling Road south of Kensington Drive and the, 14olf Road entrance to the Land provided-. A. Such signs otherwise comply with the regulations of Chapter 9 Article' IV; and B. The petitioner seeks to split a lot containing 1.15 acres in area, measuring 1651 in frontage, and over 3031 in depth. Staff notes that Westgate Road has recently been improved with new pavement, curb and gutters. There are, however, A no sidewalks on either side of Westgate Road, Water service is available on the west side of Westgate Road while sanitary sewers are located on the east side of Westgate Road. On March 12, the Village Plan Commission considered the resubdivision and recommends that the resubdivision be approved subject to the following conditions: the sidewalk requirement be waived at the present time, suggesting a special assessment could be levied if sidewalks were felt necessary at some future date. The recommendation of the Plan Commission passed unanimously. The proposed resubdivision meets the requirements of the Development Code in all other respects. The property has adequate access for all utilities in the area and would require no additional easements. The property would be brought in to the Village zoned R -X, single-family. The property has previously been zoned C-4 Service Business, which allows service stations as permitted uses. As you are aware, the property is presently developed with a Shell Service Station. Since the Village is annexing the property involuntarily, it would be my recommendation that we process an application for rezoning before the Zoning Board of Appeals to a conforming use district. Since the property was not within the corporate limits at the time of the zoning moratorium adoption, I see no reason why a petition to rezone to conforming business (B-4) would be subject to the zoning moratorium. All necessary parties have been notified of the Village's intent to annex this parcel of land according to State law. Rauenhorst Corporation is presenting a plat of dedication to the Village which will provide for a full width dedication of 80' for Business Center Drive at its intersection with Rand Road. The triangular piece measures 60.49' on Rand, and has a depth of 104.44' on Business Center Drive, containing an area of ap- proximately 3200 square feet. This dedication then completes the necessary right-of-way for the improved street that has been constructed as the major access to the Kensington Center for Business from Rand Road. The plat of dedication contains the properly executed signatures of the owners of the property conveying the land to the Village for public right-of-way.
