COMMUNI CATIONS AND PETITIONS - CITIZENS TO BE HEARD
Mayor Krause brought up the request received from the Lions Club
CINTRAL/BUSSE
to conduct their annual carnival at the Central and Busse Roads
RETENTION BASIIJ
Retention Basin, which property i's owned by the MSD. The staff
CARNIVAL SITE
had determined from MSD that such an event could be held at
that location however , the MSD would await a recommendation
from the Village Board before Orantine final avproval on the site.

Village Manager Burghard presented s report on the relocation

Elk Grove Youth Services have located a house on Golf Road
just west of Elmhurst Road and since they will have to pay rent,
have requested financial assistance from the Village. A further

wording to the effect that the Village will become a member
of the M.E.R.I.T. Program. subject to the Boards approval
of the By -Laws of that joint venture.

SUBJECT: Traffic Signals at Rand Road and Euclid Avenue 01%R90
The Illinois Department of Transportation (IDOT) is planning to upgrad
the traffic signals at Rand Road and Euclid Avenue this coming summer.
We have requested IDOT to include Opticom preempting equipment in the
0
improvement in accord with the Fire Department's program to have all
traffic signals in the Village equipped with the opticom.
The Federal Government is paying for 85% of the improvement costs, and
IDOT is paying for 15% of the cost. Mount Prospect must pay for the
added cost of the Opticom equipment which amounts to $4,500 and can be
paid for with MFT funds. This expenditure has been included in this
year's budget.
I recommend that the attached resolution be adopted in which $4,500 wil.

A RESOLUTION ESTABLISHINC-3 MUNICIPAL POLICY FOR STORMWATER CONNECTIONS
!N THE RANDVIEW-HIGHLAND SUBDI-VISION
WHEREAS, the Randview-Highland Subdivision is residential property bounded
on the north by Kensington Road, on the south by Highland Street, on the
wee C_ by Forest Avenue and on the east by Elmhurst Road and a map of which
is attached hereto as Exhibit A and incorporated herein f
by reference- and,
WHEREAS, this a is served by combined sanitary and storm sewers; and,
WHEREAS, engineering data has demonstrated that the combined sewers of
the Rand -view -Highland Subdivision are at or near capacity as of the date
of thisResolution-F and,
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect
are desirous of protecting the properties of the residents in the
Randview-Highlad Subdivision front flooding by prohibiting further
storms water connections to the combined sewer and sanitary sewers located
within the Randview-Highland Subdivision unless a person requesting such
a stormwater connection presents engineering data to the Villaqe Engineer
which, in the opinion of the Village Engineer,, "show that such connection
will not overload the combined storm and sanitary sewers located in the
Randview-Highland Subdivision; and,
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT OF COOK COUNTY, ILLINOIS, AS FOLLOWS:
SECTION' ONE,.- That the Village Administration shall permit no further
mwater connections into the combined sewer system of the Randview.-

The meeting was called to order at 7:50 p.m. by Chairman Fl oros.
Present were Chairman Leo Fl oros dnd Trustees Richardson and
Murauski s . Staff present were Ken Fritz, Director of Community
Development, Bill Amundsen, Zoning Officer, and Laura Mansfield.
The petitioner for cases ZBA-74-Z-79 and ZBA-X75-V--79, Roppol o
Bros. Development, Inc., did not appear at the meeting.. Therefore,
this matter has been continued to the April 14th Building Committee meeting.

.. ..Peter Jarvis, engineering and planning consultant for Rauenhorst,
presented the case. Petitioner is. requesting the following
add.i ti anal variations to Phase 1: 1 ) to reduce the required off--street
parking spaces for light industrial and light assembly uses, and
2) to allow more than one main use to occupy any building upon a lot,

Petitioner claims that the required number of parking spaces would
result in excessive parking since the Zoning Ordinance makes no
distinction between var7o*us uses in the I--1 district. Rauenhorst
is requesting that the number of off-street parking spaces: for light
industrial and light assembly uses be determined by the formula:

0.8 spaces for each person-employed in the
primary work shift, plus o.5 spaces for each
person employed in the shift having the next
largest number of employees
OR
one space for each 1,000 square feet of floor area,
whichever is the ,greater.
The request for variance allowing more than one use in a building upon
a lot is to allow for the multi-tenants for each building and to allow
for tenants who have both office and/or manufacturing or warehousing uses.

Rauenhorst Corporation outlined to the Building Committee the
following variations to the Development Cede. These variations
have been placed before the Plan Commission for their approval.
I. Procedural
A. As long . as the proposed plat or plan being considered is
substantially in conformance with the heretofore* approved
Exhibits with respect to planning and engineering, no further
information, data, designs, sketches, studies, surveys, or
reports need' be furnished. Only information, within the
specific boundaries of the parcel need be furnished to comply
wi th your code.
B. The Village hereby agrees to permit Buyer to complete all
paving within the dedicated streets without delay, weather
permi tti ng.
C. The Village hereby agrees not to withhold"occupancy cert+if l* -
cater if the street base course is in place according to the
plans and specification's and sufficient surety is posted
guaranteeing the completion of Public Improvements as set
forth in the Development Code,
II. Design Standards

Subject Economic, Engineer and Traffic Analysis
of the Proposed Rauenhorst "Kensington Center
for Business Development"
At your request, I have assembled the latest draft of the consultants'
analysis of economic, engineering and traffic feasibility of the
"Kensington Center for Business" as conceived by Rauenhorst Corporation.
The attached information is broken into three segments. The first,
economic feasibility, -was prepared by Real Estate Research Corporation;
the second, engineering analysis, was prepared by Sheaffer-Roland
Environmental Engineering Consultants; and the third, traffic feasibility,
was prepared by Paul C. Box & Associates. The section dealing with
traffic feasibility represents a final report document. The section
on economic and engineering feasibility is being further refined by
Real Estate Research Corporation and Sheaffer-Roland. The engineering
studies will be refinedfollowingconversations with Village Staff and
Rauenhorst representatives regarding stormwater management alternatives.
Being responsible for the coordination of all staff reviews and
consultants' reviews in this project, I would like to stress the fine
cooperation that I have had from all parties concerned in meeting very
tight meeting schedules and review deadlines. 'I am sure that the
thoroughness of the review will be of benefit to the Village since the
impact that should result from this development should enhance the
economic stability of Mount Prospect when the development is complete.

(10) false alarms at the same premises in a calander
year, the Chief of Police may iate alarm system
license suspension or revocation proceedings by
forwarding a written request for such a proceeding,
along with any and all reports of false alarms at
such premises in such calendar year, to a designated
committee of the Board of Trustees of the Village of
Mount Prospect.
B. Upon receipt of such a request from the Chief of
Police, the committee designated by the Board shall
set a date for a hearing to consider whether a
licensee's alarm system license should be suspended
or revoked and shall mail written notice -thereof to
the licensee at least fifteen (15) days prior thereto.
C. The committee designated by the Board shall presi
at alarm system license suspension or revocation
hearings at which the Chief of Police and the
licensee,shall be permitted to present evidence.
The committee shall determine by majority vote
whether to suspend or revoke a licensee's license
within fourteen (14) days after the close of such
hearing and shall notify the licensee of its deci-
sion in writ. -Ing by personal delivery or by mail.

D. In determining whether to suspend or revoke an alarm
system license, the committee shall consider the

to deactivate false alarms within one (1) hour
as required by Section 24.1409 of this Article;
3. The efforts made, if any, by licensee to con-
trol, direct and instruct employees withre.qard
to the proper use of the alarm system;
4. The efforts made, if any, by licensee to repair
and maintain the alarm system in proper working
order;

5. Any other matter the committee deems rele)jant.
Sec. 24.14,14. Grace for, False Whenever a new

Sec. 24.1415. Tl'rze for Any person, firm or

file an application for an alarm system license.
Sec. 24.141.6. Penalti "es Any person, firm or corporation
convicted of a violation of any Qf the provisions of this
Article shall be fined not less than fifty dollars (""'50.00)
nor more than five hundred dollars ($500.00) for each offense
and each day that sum h'violation continues shall be con-
sidered a separate offense.
Sec. 24.1417. Severability Clause. If any provision or part
thereof of this Article XIV is declared invalid and of no
further force and effcct, the other provisions of this
Article shall remain '(n full force and effect.

748 of the Illinois Revised Statutes, authorize and encourage
intergovernmental association and cooperation; and

ference represent twenty-nine local government bodies and a

to the suppression of crime in the northwest suburban area of

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF

SECTION ON.1:3: The Village of Mount Prospect agrees to participate

The North��est Municipal Conference Area Manpower and Equipment
Resource Investigative Team .T.) is a cooperative, multi -
jurisdictional pilot project designed to supplement the resource needs
of a law enforcement agency of a member municipality upon their request.
It is the designed and expressed purpose of this orgahization.*
A. To provide investigators, additional officers with specialized
expertise, and equipment to requesting member agencies in
order to facilitate the thorough investigation of a major
case in a minimal amount of time;
B. To investigate those similar type cases which have a multi -
jurisdictional pattern or trend; and
C. To foster the exchange of information among member agencies
and their personnel.
Article H
The M.E.R.I.T. shall have the power to:
A. Make manpower and equipment inventories applicable to the purpose
of this organization as set forth in Article, I.
B. Request participating municipalities for the utilization of
manpower and equipment to accomplish the purposes of this
i
organization as set forth in Article I.
make rules, regulations and procedures for the conduct of
personnel attached to this organization.
D. To make rules applicable to the operation and internal organi-
zation to accomplish those purposes as Set forth in Article 1.
All municipalities who adopt a resolution of participation by their
respective Boards of Trustees/City Councils shall be members in equal
standing of the Consortium.
The policy-making responsibility of M.E.R.I.T. shall be in the Board of
Directors. The Mayor/President or his(her) designate of each municipality shall
serve as the representative to that Board. The powers of the Board shall
be to exercise those powers necessary and incidental to the purposes as
set forth in Article I of these BY -Laws including but not limted to:
A. Election of the Executive Committee.
B. Approval of the Rules, Regulations and Procedures governing
the administraton of personnel and equipment attached to this
project.
C. Admission of new members.
Executive Committee
There is hereby established by these By -Laws an Executive Committee
of three Directors and one Alternate Director chosen by the Board of
Directors from among the Police Chiefs of the member municipalities as
outlined in Article IV. The Chairman and other member of thi's Committee
w ill be chosen by the Board of Directors at their annual meeting in November
and shall serve in this capacity with staggered terms for the period of
two years. At the completion of a term, two Directors will be replaced
w ith the Alternate Director filling one vacancy and the entire membershi,p
i
selecting one new Director and a new Alternate Director. The powers of
the Executive Committee shall be to:
A. Upon a majority vote of the three members and upon the request
of the chief law enforcement officer of a member jurisdiction
commit the some or all of the staff and equipment attached to
M.E.R.I.T. to that Jurisdiction for the period not to exceed
72 hours.
B. Act upon all requests by the ch*.,Ief law enforcement officer in
the same manner for an extension of time beyond the oria,inal 72

hours after obtaining approval from the furnishing municipality
for such an extension.
C Make recoMmendations to the Board of Directors for amendments
or changes to these By -Laws and/or Rules,, Regulations a,nd

D. Direct the 'training efforts as may becowe necessary for members
of this unit.
E. Seek on behalf of and with the approval of the Board of Directors
federal, state and county manpower, equipment or assistance as
may be required to meet the purposes as outlined in Article I.
Article VI.

Command of the investigative team shall be from the requesting who
shall provide for the coordination and supervision of all aspects of the
investigation. As such the individual chosen shall be of supervisory
or command rank within that jurisdiction and shall direct all operations of
the team and make progress reports to the Board. In order to utilize the
highest caliber or expertise available within the team, the commander
shall have the authority to designate a team member as th,e second in
command. All standard operating procedure shall be as outlined by the
Board of Directors in efther the "Standing Orders" or Rules and Regulations.
Article VII.

This cooperative police service and assistance shall be rendered with-
out charge to a participating municipality. The member agencies providing
their personnel will pay the salary and other direct related expenses of
that personnel including but not limited to hospital ization coverage, over-
tire (if authorized) and pension benefits.
The requesting agency is expected to provide secondary support cost ' s
and arrangements for M.E.R.I.T. team personnel. These support arrangements
may include but are not limited to: office space, conference area,

Upon activation the responding member agencies will provide personnel,

Article VIII.
Liability and Indemnification

Article IX.
Withdrawal,, Termination and Dissolution
A. Withdrawal,
Any member municipality may withdraw from this agreement effective
upon receipt of notice to the members of the Executive Committee.
B* lermination,
The membership of any municipality shall be terminated at the
discretion of the Board of Directors. All motions for
expulsion shall require a 2/3 vote of the existing membership
eligible to vote on the question.
C. DiSSOILItion
The dissolution of thi's organization shall be deemed t ' o, have
occurred upon the withdrawal of all but two members or upon
successful adoptilon of a motion of dissolution whi'ch must be
aapp�,oved by a majorit of the'ren-bership. Any funds and/or assets

Article X.
Amendment—

The Committee "reviewed -comments ,-7from,,the" staf f- on -:the,, -most ----recent
draft of the Property Maintenance Code. Items such as the definition
of a seller, the drainage,of sumps across public sidewalks or other
m. right-of-ways, including septics in the definition of plumbing,
and a connection of any type of guide wire to trees in the public
right-of-way were considered. Junk yards were excluded from the
subsection .regarding ,the storage of motor vehicles.since this
business - is not allowed under the,,.village' s building -ordinance.
"Attorney Barbara Baran will make -final -adjustments -in the draft of
the Property Maintenance Code so that it may be presented to the
Village -Board. The Committee -voted. -2=0. in favor of sendingg-a
final draft of the Property Maintenance Code to the Village Board for
comments prior to the presentation of any draft ordinance for first
reading.
Downtown RehabilitationPro
Attorney Barbara Baran "pre sented a draft of an ordinance that would
establish a loan subsidy fund and standards and procedures in
connection with this fund for business redevelopment. The Committee
considered the scope of such an ordinance and whether it should be
written to include only the downtown business district area or whether
ri
it should be written in a broad form to include any business area
that would so be designated by the Village -Board -for -this program.
The consensus of the Committee was to draft the ordinance so that it
may be used in the future for other business rehabilitation programs.
The-,,Commi-ttee discussed the type of downtown rehabilitation programs
that should be included in the ordinance. The two principal tools
discussed thus far are the loan interest subsidy and the revolving loan fund.

The role of the Downtown Development & Redevelopment Commission and
of the Planning Commission in the Downtown Rehabilitation Program was
discussed. In other communities where such programs exist, there has
been established a design committee and a loan, committee to consider
all business rehabilitation requests. It -was the consensus of the
committee that similar groups should,be established for Mount Prospect's
rehabilitation program and what groups should take up those roles
shall be discussed further at the next committee meeting.

Section 11.1101. License Required. It shall be unlawful
for any person, firm or corporation to operate or to permit
• motor vehicle owned or controlled by it to be operated as
• taxicab or to engage in the business of operating taxicabs
within the Village, without first obtaining a permit auth-
orizing the operation of each such vehicle within the
Village as herein provided.

Section 11.1102. Application. A written application veri-
fied under oath for a taxicab license shall be filed with
the Village Clerk pursuant to and in accordance with the
provisions of Chapter 10 of the Municipal.Code of the
Village of Mount Prospect. In addition to the 'information
required under said Chapter 10, an application for a taxicab
license shall also contain the following.,,
A. Applicant's financial status., in -

cluding details of unsat isfied liabilities.
B. Applicant's experience in the trans-
portation of passengers.
C. A factual statement setting forth the

reasons why additional taxicabs are necessary for the public
health, safety and convenience of Village residents.
D. The number of taxicabs proposed to be
operated and controlled by the applicant.
E. The make, model, year and seating
ity of each taxicab proposed to be operated under the

place of business or taxicab depot.
G. Such other information as the President

Section 11.1103. Public Hearing on Taxicab License Appli-
cation. When an application for a taxicab license is deter-
mined by the Village Clerk to be complete, the Vitl

Trustees which shall schedule a public hearing on such
application to be held before the Publtl

on an application for a taxicab license, the Public
Health and Safety Committee shall make written finding

of this Section, the Committee shall direct the Village
Clerk to issue a taxicab license to the applicant.
C. If the Committee finds that the applicant falls to
satisfy one or more of the requirements of Al. 2 and 3
of thi's Section, the Com,11IL'ttee shall deny shall applica,11--ion
and s1iall mail the written notice thereof to the appli-
cant, which notice shall set forth the reasons for such
denial.
Sectlon 11.1105. Increase in Number of Taxicabs Authorized
By a Taxicab Licensel; Procedure.
A. The holder of a taxicab license issued under the pro-
visions of the Article may file an application with the
Village Clerk requesting the President and Board of
Trustees of the Village to allow additional taxicabs to
be operated by the license holder under said taxicab
license. Such application shall be in writing, shall
be verified under oath, and shall contain the following
information:
1. A statement setting forth the changes, if any,
the inforrotation contained in the application filed

3. The make, model, year and seating capacity of each
additional taxicab proposed to be operated under

Section 11-1106. Duration and Renewal of Taxicab License.
A taxicab license issued, pursuant to the provisions of this
Article shall expire on,April 30 of each year and, unless
such license was revoked, shall be renewable on an annual

taxicab license shall be issued or renewed and no taxicab
continued in operation unless the licensee shall have paid
to the Village Clerk appropriate annual fees in accordance

Section 11.1110. Designation of Taxicabs.

Section 11-1113. Inspection of Taxicabs.
A. A taxicab licensee shall submit to the Chief of Police
or the Chief's delegate at times and dates to be
established by the Chief during the months of March and

and testing.

If upon the conclusion of such inspection and testing
the Chief of Police, or his delegate, shall find such
taxicab to be safe and suitable for its intended pur-
pose, the Chief shall evidence compliance with the
inspection and testing requirements of this Article"by
signing the license card in the appropriate space pro-
vide'd therefor.
D. In the event the Chief of Police, or his delegate,
shall refuse to sign such license card by reason of the
vehicle's noncompliance with this Section, he shall
accompany such refusal by a signed statement to the
licensee setting forth the particular grounds for such
refusal.
E. There shall be a charge for such inspection and testing
which shall bE-_A paid by the licensee prior to the Police
chief's signing the license card for such vehicle.
Section 11.1114. Continued Maintenance and Periodic Inspec-
tion -
A. Every taxicab licensed hereunder shall be maintained in
a safe, clean and mechanically,sound condition and the
taximeter of each such taxicab shall be maintained in
an accurate working condition.

taxicab licensed hereunder, to be inspected in the
manner provided in Section 11.1113.
C* The taxicab license of any taxicab found to be in other
than'a safe, clean and mechanically sound condition

taxicab shall not again operate in the Village until
such taxicab is resubmitted for inspection and testing
and found to be in compliance with this Article.
Section 11.1115. Age of Taxicabs. Notwithstanding anything
in the foregoing to the contrary, no taxicab more than four
years old as determined by the model year shall be operated
in the Village and no taxicab license shall be issued or
renewed therefor,
Section 11.1116. Regular Service. Every licensee hereunder

to the extent reasonably necessary to meet the demands of
the public for such service. Such licensee shall answer all
calls received by it for services de the corporate

Section 11.1117. Transfer of Taxicab License. No taxicab
license shall be sold, azisli-gned, pledged as security, or
otherwIse transfierred and no licensee shall lease a taxicab

Section 11.1118. Suspension and Revocation of Taxicab
License.
A. A taxicab license issued under the

G. Notwi-tChstanding any provision to the contrary contained
herein, an owner of a taxicab may establish flat rates
for trips which originate within the Village with a des-
tination point outside of the Village or trips which
ginate outside of the Village with a destination point
within the Village. Any such flat rates established
shall be filed with the Village clerk.
Every taxicab operated under this Article shall have a rate
card setting forth the authorized rates of fare, displayed
in such a place as to be in view of all passengers.
Section 11.1127. Procedure for Taxicab Rate Increase Requests.
A. Increases Proposed by the Public Health and Safety Committee.

ittee of the Board of
Trustees of the Village of Mount Prospect may on its
own initiative by majority vote of such Committee
recommend that the President and Board of Trustees of
the Village consider a taxicab rate increase. If the
President and Board of Trustees concur in the recom-
mendation of the Committee, the Board shall consider
such proposed taxicab rate increase at a re■gular or
special meeting of the Board after mailing written
notice of the date, time, place and tax■
icab rate
increase proposal to each taxicab licensee and after
publishing notice thereof in a newspaper of general
circulation within the Village at least fifteen (15)
days prior to -t-he meeting at which the tax■
icab rate
increase shall be considered. The President and
Board of Trus+%-_ees shall consider the proposed taxi-
cab rate increase and the procedure shall be the same
as for -'(Zhe consideration of any other ordinance of
the Villag,.,---A which does not require a public hearing.
2. If the President and Board of Trustees do not concur
w I itli the Committee's recommendation, the matter shall %_
not be considered further.
B. Increases Proposed by Taxicab Licensees.
Any taxicab licensee may initiate a request for a
taxi.cab rate increase by filing a written application
therefor with the V-11ageClerk. Such application
shall contain at least the following. -
(a) Name, address and telephone number of the
applicant;
(b) A statement setting forth the rate increase
requested;

(c) A statement setting forth In detail the neces-
sity for such rate increase;
d)
Any and all documents which support the neces-
sity for the requested rate increase;
(e) A statement verifying that all statements con-
tained in the application and the informati
ion
contained in any documents submitted in support
thereof are true and correct.
2. Within 10 days after a completed application for a taxi-
cab rate increase is filed, with the Village Clerk by a
Licensee,, the Village Clerk shall forward such applica-
tilon to, the Public Health and Safety Cormnittee which
shall place the matter on its agenda within 60 days
after receipt of such completed application.
3. The Public Health and Safety Committee shall hold a
hearing on the requested rate increase and shall deter-
mine by majority vote whether to recommend to the Presi-
dent and Board of Trustees that a rate increase is
appropriate and, if so the amount of such increase.
In its deliberation the Committeerequest and, the

Notice of such hearing shall be malled to each taxicab
licensee and all be published 'in, a newspaper of
general circulation within the Village at least 15 day's

Trustees of the Village.

Co-mmittee's recommendations in the same manner as other

Section 11.1130. Duty to Pay Fare. It shall be unlawful
for any person to refuse to pay the legal fare of any taxicab
licensed hereunder after having hired such taxicab.
Section 11.1131. Additional Passengers. No taxicab driver
shall carry any person other than the first person to occupy
ide in said taxicab unless the person first employing

the taxicab shall consent to the acceptance of another
passenger -or passengers.or the taxicab owner or driver by con-
tract with the Village is authorized to accept additional pas-
sengers.
Section 11.1132. Restriction on Number of Passengers. No
driver shall permit more persons to be carried in a taxicab
as passengers than the rated seating capacity of his taxicab
as determined by the Chief of Police, or his delegate. A
child in arms shall not be counted as a passenger.
Section 11.1133. Revenue and Expense Records. Every
holder of a taxicab license hereunder shall keep accurate
rMMcords of receipts from operations, of operating and other
expenses, and of capital expenditures. Such records shall
be available to the President and Board of Trustees upon
reasonable request.
Section 11-1134. Manifests. Every taxicab driver shall
maintain a daily manifest upon which are recorded all trips

made each day, showing time and place of origin and destination
of each trip and amount of fare, and all such completed
m ifests shall be returned to the owner by the driver at
ani
the conclusion of his tour of duty. The forms for each
manifest shall be furnished to the driver by the owner and
shall be of a character approved by the Chief of Police.
Every holder of a taxicab license hereunder shall. retain and
preserve all di,:iversl manifests in a safe place for at least
the calendar year next succeeding the calendar year in which
it was prepared. Such manifests shall be available to the
President and Board of Trustees and the Police Department
upon reasonable request.
Section 11.1135. Taxicabs Licensed Elsewhere. Notwithstanding
any -thing to the contrary contained in this Article, a taxicab
licensed by another municipality may discharge and accept but
shall not solicit passengers with -in the Village of Mount
Prospect.
Section 11.1136. Penalty, for Violation. In addition to the
revocation or suspension of_ a license as provided for 'in
rthis Article, an,.y person, firm or ccrporation shall be
sub"I'ect -to a -fine of noL less than $50.00 nor more than $500.00

this Article is severable, and if any provision shall be

Trustee Farley called the Committee of the Whole Meeting to order at 7:35
P.M. The purpose of the meeting was to discuss acquisition of Lake Michi-
gan water.

The Village Manager gave a brief summary of the VENTURE meeting,
,stating that the group had received Phase II of the Engineering
Plans as well as Phase II of the Financial Plan, however, no
further work could be performed until a determination is made as
to what municipalities would be included in the Plan. The dead-
line for making a decision is May 7, 1980. Studies are being
conducted as to the best method of financing, noting that those
municipalities using the service should be those that pay for
such service. It was also stated that using General Obligation
Bonds would be the most cost efficient method since bonds could
be pro -rated on the basis of consumption. Although not recommended,
the creation of a Special Service Area was also stated as a possible,
means of financing.
Mr. Soyka announced that the courts had entered their decision that
Chicago could not increase the water rates for suburbs. Mr. Soyka
also stated that the City of Chicago had stated that they would re-
negotiate their current contract with Des Plaines, which presently
forbids any connections to that system. A 15% reduction in the
wholesale rate would be realized with the court decision - if the
VENTURE plan was adopted.
With respect to the DAMP proposal, the staff will study the costs
to the Village. It was noted that it would cost more to acquire
water from Evanston than Chicago, however, the rates are less from
Evanston than from Chicago.
It was brought out that Des Plaines has expressed some concern as to
whether or not they had the capability to produce the capacity needed
and whether their transmission lines could handle the increased flow*

DAMP is in the process of updating the 1978 report relative to
municipalities involved, rates, etc. and will have that report
by .April let.
It was noted that Mount Prospect currently requires 4.5 million
gallons of water per day.
The actual costs involved could not be determined until contracts
had actually been let. There are many areas involving costs that
must be looked,into, including the fact that Chicago requires a
0 days consumption deposit, whereas Evanston does not require
such a deposit.
Mr. Bur,gh,ard will have a report prepared by the staff pointing out
the various alternatives available.
Trustee Farley adjourned the Committee of the Whole Meeting at
8:20 P.M. noting that a meeting would, be called before May lst to
make some sort of decision.

Ms. Susan Stern,' Legal Counsel for the Village, presented a legal
opinion relative to the Village's responsibility towards assisting
Mr. Henneberry and Mr. Plaza to stabilize the banks of the drainage
ditch that runs between their properties. A discussion followed
which ended with staff and legal counsel being instructed to each
prepare a summary report compiling all the information that has been
presented to this committee concerning the Lake Bri.arwood Drainage
Ditch. This is to then be presented to the full Village Board for
their consideration at the next scheduled meeting on March 18, 1980,`
but with no recommendation from this Committee.
B CENTRAL/BUSSE ROADS RETENTION __BASIN
Trustee Parley ,announced that discussion would take place at the
April 3rd Public Works Committee meeting relative to the charge
made to Committee to review the uses for the subject property and
determine the events that would be allowed by the Village.

Lake Briarwood was voluntarily annexed into Mount Prospect on December 19,
1978 and is located in the southwest section of the Village, south of
Algonquin Road and west of Busse Road. There are 92 homes there located
around a man-made lake that was developed as a result of constructing the
Illinois Tollway.
The lake is fed by two sources; one at the northwest corner between lots
21 and 22 that originates in Elk Grove Village and also meanders through
parts of Arlington Heights before draining into Lake Briarwood, and two
that comes from an industrial park in Elk Grove Village and enters the
lake on its west side between lots 35 and 36, as indicated on the attached
map.
In October 1979, per attached letters, the owners of lots 35 and 36, Mr.
Henneberry and Mr. Plaza submitted a request for assistance to the Village
of Mount Prospect for drainage ditch bank stabilization and repair of an
existing metal retaining wall that is collapsing. This wall is located
along the north side of Mr. Plaza's home as depicted in the attached photo-
graphs.
Also in the photographs you will note the red and white stakes which indi-
cate the 20 foot easement for storm water drainage. This easement appears
on the plat of subdivision for Lake Briarwood Unit No. 22 but does not
show a dedication of any kind, therefore, the ownership is in question as
well as the question of responsibility. Legal counsel has submitted their
opinion on this subject, a copy of which opinion is attached to this report.
Back when the lake was originally formed and the Illinois Tollway was
constructed, there existed a natural drainage swale that covered a
number of the present Lake Briarwood lots. The Illinois Tollway installed
a culvert on their right-of-way to allow the natural flow of water under
the Tollway. However, the developer diverted the flow of water to its
present location in order for the surrounding properties to be developed.
Prior to Mount Prospect annexing Lake Briarwood it was an unincorporated
area serviced by Elk Grove Township. In 1973 Mr. Plaza's problems first
began when the drainage ditch washed away to such an extent as to expose
the foundation of his home. His first appeals went to the Homeowner's
Association, who denied any responsibility. That same Homeowner's Associa-
tion is still in existence, and has complete charge of the maintenance on
the lake itself. But again they have refused any assistance to Mr. Plaza
and Mr. Henneberry for required bank stabilization work.

Mr. Plaza then appealed to Elk Grove Township who in 1973 did pay 90%
of the cost to install the existing metal retaining wall. He again re-
quested their help when the current situation developed and had- alledgedly
reached an agreement with Elk Grove Township to make the necessary repairs
on a 50-50 basis. However, since Lake Briarwood is no longer unincorporated
and is now a part of Mount Prospect, the township will no longer assume
any responsibility.
Mr. Henneberry and Mr. Plaza's request for Village assistance first went
to the Public Works Committee in November of 1979. At that time the staff
was instructed to secure estimates to repair or replace the damaged retain-
ing wall. These costs were extremely high and ranged from $25,000 for a
new steel seawall to $65,,000 for a buried concrete culvert. The Committee
has spent considerable time reviewing this matter and now bring the matter
to the full board for their consideration and final determination, without
recommendation or prejudice.
Since the last meeting date, information has been received relative to the
areas of responsibility in matters concerning erosion control and the
various agencies responsible. The attached information will be forwarded
to Messrs. Plaza and Henneberry. Needless to say, they are anxious to
resolve this problem before spring rains are upon them.

The Woodise Bluebirds presented Colors and then presented cupcakes to
the Board members in honor of Camp Fire Service Month.
Mayor Krause called the meeting to order at 8: 11 with Trustees Murauskis
and Richardson absent.
The minutes and bills were approved.
Several residents spoke in opposition to the use of the Central/Busse Retention
Basin for the Lions Club Carnival, after which the Board gave their approval
to hold the carnival at that site. The subject of the retention basin and future
uses was referred to the Public Works Committee .
A Resolution will be prepared for the March 18th meeting to state that no
future connections will be made to the Randview /Highland area storm and
sewer mains.
Following discussion of the annex building, the Manager stated he would obtain
input from Wheeling Township as to their support for Omini House and any
increased use of that facility after the Elk Grove Youth Services moves its
quarters to Golf Road. Mr. Burghard will report back at the March 18th meeting.
The Board acknowledged receipt of the 1978 MFT audit.
The Board authorized Chicago Bridge to proceed with the necessary repairs
to Well #11.
The 1980-81 budget was distributed and hearings will begin March 12th.
I-Tlayor Krause proclaimed the month of March as Camp Fire Service Month.
AN ORDINANCE VACATING A PUBLIC WALKWAY BETWEEN ALBERT STREET
AND THE VILLAGE was passed, Ordinance No. 2983. The residents on either
side of the subject property will pay $115 each to cover the administrative costs
of said vacation.

it was the opinion of the Board that if the By -Laws were changed as indicated,

AN ORDINANCE REGULATING THE SOLICITATION OF CONTRIBUTIONS ON
STREETS AND HIGHWAYS WITHIN THE VILLAGE was passed, Ordinance No. 2988.
A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN
HUNGTINGTON TOWERS AND THE VILLAGE (relative to enforcing handicapped
