Lions Club (yarn val
on Central Road at Busse Road for the 1980 July 4th Carnival',
and requested the Board waive the fees involved with such a
carnival.
Mr. Steve Kelly, 110 N. Kenilworth , presented a petition with

retention basin site.
The following people spoke in opposition to the proposed use:

Mayor Krause explained that while the Village has an agreement
with the MSD for the use and maintenance of that retention basin ,

legal counsel would have to determine whether the Village has
the authority to grant permission to the Lions Club to use the
subject property. This matter was referred to the Public
Works Committee for further review.

SPECIAL SERVICE
R. V. Norene & Associates as financial advisor for the
AREA #2 - Blackhawk
possible creation of a Special Service Area for the Blackhawk
Fxpenditure
area (east of Busse Road , north of Golf Road) in order to
provide water to that area.
Trustee Wattenberg, seconded by Trustee Richardson , moved
to authorize the Mayor to sign and Clerk to attest her signature
on a contract with R. V. Norene as financial advisor for
Special Service Area #2 at a cast not to exceed $4,000.

The Village Manager presented a request for authorization
KENSINGTON CENTER -
to retain Real Estate Research Corporation as planning advisor
RAUENHORST -
in conjunction with the Rauenhorst Development (Ni -Gas
Expenditure
Property - Kensington Center), which firm would provide
an impact study to the Village relative to taxes . impact on
traffic, utilities, public safety' requirements, retention,
employment, etc. at a fee not to exceed $21,400, $15tOOO
of which cost would be paid by Rauenhorst Corporation.
Trustee Wattenberg , seconded by Trustee Floros , moved to
authorize the administration to retain Real Fstate Research
Corporation at a fed not to exceed S21 0 400 as a planning
advisor to the Village , and to authorize the Mayor to sign
and Clerk to attest her sr nature on a contract with that
firm.

Re: Proposed Saturday Opening of Village Hall
DATE: February 12,, 1980
As has been suggested, Management Services would
like to present the following plan for Saturday opening
of the Village Hall.
The office will be open from 9:00 - 12:00 on the
first Saturday of every month in conjunction with the
Mayor's Coffee. Residents will be able to pay water bills,
tickets,, -buy vehicle and dog licenses and register to vote.
The switchboard will not be open. The office will be
staffed with two members of the Management Services Depart-
ment who will be paid overtime --or be granted compensatory
time for time worked. If all time worked is paid, the
annual cost would be approximately $750.00.
It is anticipated that this plan could be in place
by March 2. 1980.

Village of Mount Prospect
We have examined the financial statements of the various funds (listed
in the attached exhibit) of the
VILLAGE OF MOUNT PROSPECT, ILLINOIS
ACCOUNT NO. 1420160612
as of April 30, 1979 and for the year then ended and have issued our report
thereon dated August 29, 1979 under separate cover. Our examination was made
in accordance with generally accepted auditing standards, and accordingly in-
cluded such tests of the accounting records and such other auditing procedures
as we considered necessary in the circumstances (except for the "Old" Special
Assessment Funds). i
In connection with our examination, we also (1) performed tests of
compliance with Revenue Sharing and Antirecession Fiscal Assistance Acts and
regulations as required by Sections II.C.3. and III.C.3. of the Audit Guide
and Standards for Revenue Sharing and Antirecession Fiscal Assistance Fund
Recipients (Guide) issued by the office of Revenue Sharing, U.S. Department
of the Treasury, and (2) compared the data on the State of Illinois Annual
Municipal Supplemental Report Form MA -2 (pages 16 and 17) with the audited
records of the Village of Mount Prospect, Illinois as required by Section
III.C,4. of the "Guide". Our findings are set forth below:

OFFICES IN PRINCIPAL CITIES
1. The Village did not maintain a record of voucher numbers and amounts of
expenditures Funded by Revenue Sharing monies during the year ended
April 30, 1979, as required by Subpart F, Section 51.100(d)(2)(iii) of
the Revenue Sharing Regulations. All expenditures ox Revenue Sharing
monies for the year ended April 30, 1979 were for fire department
salaries. Revenun. Sharing monies received by the Village were depos-
ited into a general checking account from which disbursements for fire
department salaries were made. The total amount expended for fire
department salaries ($1,558,190 per the Village's audited financial
statements) exceeded total Revenue Sharing Entitlements received during
the year. Entitlements received totaled $391,652.
2. The Village prepared the Bureau of Census Form F -21A from its unaudited
Summary of Cash Receipts and Disbursements, for the year ended April 30,
1979, rather than the audited financial statements for the same period.
The year-end audited financial statements were prepared on the modified
accrual (or accrual basis) of accounting, as applicable to each fund.
We verified the accuracy of the completed form F -21A as compared to the
Village's April 30, 1979 Summary of Cash Receipts and Disbursements.
Public Library transactions were omitted from Form -21A. Total Library
revenues were $509,394 and total expenditures were $523,659, as reported
in the audited financial statements.

WHEREAS 9 CLARENCE 0. SCHLAVER was a member of our community for
over thirty-five years; and
WHEREAS . during his residency, CLARENCE 0. SCHLAVER served his
fellow citizens and his community as Village Trustee from 1954 to 1961; as
Village President from 1961 to 1965; as Vice President and Executive
Director of the Mount Prospect Chamber of Commerce from 1971 to 1980; and
WHEREAS , CLARENCE 0. SHCLAVER further extended his community service
by serving as president of the Mount -Prospect Historical Society from 1973 to 1974;
as an active member of St - Paul's Lutheran Church; as a member of the Moose
Lodge; as a charter member of the Mount Prospect Toastmasters; an
Honorary Member of Rotary; and as a dedicated member of the Lions Club.

O'HARE AIRPORT
kk, WHEREAS, the Village of Mount Prospect is a municipal corporate
organization chartered within the State of Illinois and the
County of Cook; and
WHEREAS) the public officials of the Village of Mount Prospect
represent a population of over 54,000 Illinois residents; and
UTHEREAS., the Village of Mount Prospect has a particular interest
in the environmental effects of operations at'O'Hare Airport; and
WHEREAS, the ongoing O'Hare/Midway Master Plan -calls for an
increase in average airport operations per hour from 158 operations
in 1980 -to 198 operations in 1995 at O'Hare; and
WHEREAS, the Village of Mount Prospect feels such a dramatic
increase in operations without additional controls to limit or
reduce noise pollution is detrimental to its citizens and the
surrounding environment.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND -BOARD OF TRUSTEES,
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Village of Mount Prospect endorses the
concept of regulating and reducing the impact of airport noise.
SECTION TWO: That the Village of Mount Prospect requests the
inols Pollution Control Board to take immediate action to limit
additional airport noise at O'Hare Airport.
SECTION THREE: That copies of this Resoltuion shall be forwarded
to the Illinois Pollution Control Board, the Federal Aviation
Administration, and the Chicago Department of Aviation.

PUBLIC TRANSPORTATION PLAN
WHEREAS, the Village of Mount Prospect recognizes the need for
44 public transportation in the community; and
WHEREAS, recent inflationary times have brought increased
cost in vehicles, energy and parking; and
WHEREAS, recent studies conducted by the Village have indicated
the need for additional public transportation in the southern
portions of the village to the railroad station and to Randhurst
Shopping Center; and
WHEREAS, the -Regional Transportatkon Authority and the North-
west municipal Conference have, through an Advisory Committee,
studied transportation problems--:L-n-the northwest suburbs and
have developed the Northwest Cook -County Public. Transportation
Plan;
NOWr THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECTj COOK COUNTY, ILLINOIS:
SECTION ONE: That.the Village -of Mount Prospect has reviewed
the Northwest Cook County--Public--:Transpor-tation--Plan and. -finds -
that its recommendations meet the additional transportation
needs identified in the Village.

The February 11, 1980 Building Coimnittee was called to
order at 7:35 p.m. Present were Trustees Floros and -Rich-

Petitioner* showed pictuers of his automobiles, and a diagram of
the property and the proposed garage was shown by stiff. The
Building Committee voted 270 to recommend approval of the var--.,

Gene Nauert represented petitioner in the request~ to seek
variations for the side yard and the. chimney. He claims the
encroachments are due to subcontractor's error, although Frank
5tape Builders, general contractor is responsible for the ac-
curacy of the work. He sees a variation to resolve this pro--
blem so that construction may proceed. Mr. & Mrs. Bruz zini, owner
of the lot, were present and without objection Mr. Nauert
claimed the adiacent lot 68 owner had no objection either, and he
would obtain a letter stating such.

Conditional on obtaining written approval from lots 68
and 69 owners, and on moving the house on lot 68 (not yet under
construction) over to compensate for the encroachment, the
Building Committee voted 2-0 to recommend approval.

The request is an amendment to the Zoning ordinance to provide
for a temporary suspension of reviews and 'public hearings held

concerning rezoning applications. During this time, the
Comprehensive Plan will be reviewed and revised'.
Len Lorenson, of the PlanniAg Commission, was present.
Discussion ensued regarding th6 need for a new Comprehensive
Plan versus merely updating the Plan, and it was decided by
the Building Committee members and Mr. Lorenson that merely
updating would not be enough.
The moratorium would be in effect for 12 months. The
effective date will be determined at the Village Board of
Trustees meeting. The Building Committee voted,2-0 to re-
commend approval of the temporary moratorium.

6. The decorative fence shown on Exhibit A hereto at the
Busse Road entrance to the Subject Property may be
eliminated and a different fence, plans and specifica-
tions for which shall be submitted to and be subject
to the review and approval of the Director of Com-
munity Development, may be substituted therefor.
7. The berms and landscaping consisting of trees and

Audit for FY 1979-80 - Lester Witte and Com an
The Comm"Ittee unanimously agreed to recommend that the audit for
the year ending April 30, 1980 be prepared by Lester Witte and Company at
a cost of $12,000 - 14,000. This Is the same cost as last year.
Fiscal Ptalic
The staff recommendation for a year-end ,,,balance -contingency policy
for the Village was presented. WhilO. considerable research has been doner
no clear "Expert" formula was found for what would be an adequate cash
balance for a village; rather, fiscal policy is general1v cited as a
cash-flow consideration within political constraints. The suggestion
was made to use the greatest cumulative cash flow deficit of the previous
fiscal year. For Fiscal Year 1980-81 this would result in a balance of
$900,000, the cumulative deficit for the month of August, 1979. A copy
of the cash flow analysis is attached.
The Committee discussed the matter in depth. Mr. Miller noted that
it was logical to plan a year end balance which would meet the cash flow
requirements of the next year without having to resort to borrowing to
meet cash needs. The final recommendation was that the following formula

be used in determining the budget for subsequent years!
Ninety Percent of the Greatest Cumulative Cash Flow Deficit of
the Previous Year.
The Committee concurred that this policy should be discussed during
budget meetings.

Mrs. --Peppler reported.thatshe met -with representatives of the
Department of Insurance and Jim Bliss of GIE to discuss 'the procedures
for the Village obtaining the refund of their $156,000 deposit. As a
result of that meeting, staff is optimistic that the money will be
received during the last week of April.
Mr. Miller announced that because of the budget meetings in
Marcl-4 the Committee will not have a regular meeting during March unless

important business arises..,_ In that event,_ a .meeting -will be held i
conjunction with one-of the -budget meetings.

Ladies and Gentlemen:
This letter sets forth the arrangements for our various services to
be provided to the Village of Mount Prospect for the year ended April 30, 1980.
ACCOUNTING SERVICES
We will assist in the preparation of the financial statements of the
various Funds of the Village of Mount -Prospect for the year ended April 30,
1980. The general format of the financial statements,,. we suggest, should be
modified this year in order to incorporate changes in reporting standards that
will become mandatory for years ending after June 30, 1980 (however, implementa-
tion now is suggested). -These standards are set. forth in the National -Committee -
on Governmental Accounting's Statement 1. The statements will be prepared from
the financial records maintained by the Village.
AUDITING SERVICES
We will perform an audit of the financial statements of the various
Funds of the Village of Mount Prospect as of April 30, 1980 and for the year
then ended.
Our examination will include all Funds of the Village, however, we
expect to issue a separate report for the Mount Prospect Public Library.
Arrangements for services to the Library are under separate cover,

Our examination will be made in accordance with generally accepted
auditing standards and accordingly will include such tests of the accounting
records and such other auditing procedures as we consider necessary in the
circumstances. The objective of such an examination is the expression of our
opinion on the fairness with which the financial statements of each of the Funds
present financial position and results of operation in conformity with generally
accepted accounting principles consistently applied.
If during the course of our assignment it should appear that we will
be unable to render an unqualified opinion on the financial statements, the
matter will be discussed with you at that time. This examination is not designed
and cannot be relied upon to disclose defalcations or similar irregularities-,
however, such matters, if discovered, will be reported to you promptly. We will
make reviews of the Village's system of internal control and inform you from
time to time of any significant weaknesseswhichwe believe should be corrected
and of our recommendations in this respect.
We will also submit our Management Letter setting forth our detailed
findings and suggestions in those areas we feel require your attention and
special consideration.
If the reproduction of your financial statements and our Accountants'
.Report thereon is contemplated for any purpose whatsoever, we require that masters
or printer's proofs be submitted to us for review and approval before publication.
We direct your attention to the fact -that the Village has the respon-
sibilities for the proper recording of transactions in the books of account, for
the safeguarding of assets and for substantial integrity of the financial state-
ments.
It is anticipated that Village personnel will supply the following
data to us.- adjusted trial balances for the various funds, selected account
analyses, bank reconciliations, budget data, ordinances relating to levies, other
revenues and expenditures, selected paid invoices and other documentation or
information relevant to our assignment.
Our fees will be based on professional personnel time requirements,, at
the standard billing rates of our firm, plus any out-of-pocket expenses incurred.
We estimate that our charges for the above services will be in the range of
$12,000 to $14,000. These estimates are exclusive of charges in connection with
the Mount Prospect Public Library and are based on the expectation that your
personnel will assist us as discussed above.

If at any time during the engagement an extension of our services
.requiring an increase in our estimated fee appears to be required, we will

Chairperson Murauskic requested that the ordinance be rewritten with a
reduced service charge to $25.00 and a graduated fee of $5.00 increments and
violations be spelled out. Also that there . he three (3) free ,alarms per
year. This is to be completed before February 14, at which time it will be
available at the Village Clerk's office fear distribution to interested
persons.
The discussion will continue and review of ordinance will continue at the
next meeting of February 18, 1980.
Review of the I-IER.IT Program -- Chief D,ney explained the merit plan to the
members present. Both Chairperson Murauski's and "Trustee Miller wants
to see the revised By --laws of the MERIT resolution and agreement before they
would make any recommendation to the 'Village Board concerning this program.
Trustee Floros likes the program _as is. A vote of 2 to 1 to carr; over
this discussion until next meeting February 18, 1980.

,Request for Mutual Aid by American Emergency Service.. Inc. - A brief

agreement was taken.
Mount Prospect Rural Fire Protection District �- ,A brief discussion by members

AGREEMENT WITH THE ELK GROVE RURAL FIRE PRO -
PROTECTION DISTRICT
WHEREAS, the Elk Grove Rural Fire Protection District has asked
the Village of Mount Prospect to enter into a mutual aid agree-
me.nt for fire protection services; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that it would be in the best
interest of the Village and of said District to enter into an
agreement with the terms and conditions set forth in Exhibit A
hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECTF COOK COUNTYr ILLINOIS
AS FOLLOWS
SEC'T'ION ONE: The President of the Board of Trustees of the Vil-

MUTUAL AID AGREEMENT
These Articles of Agreement, made and entered into on the
day of A. D. 19 by and between the Elk Grove Rural
Fire Protection District and —the, Villa,Se of Mount Prospect
SECTION ONE PURPOSE
The purpose of this agreement is to provide for a program of Mutual Aid
between the Elk Grove Rural Fire Protection District and the Village of
Mount Prospect whereby the Aiding Municipality
will be obligated to respond to the Stricken Municipality with such equipment
and manpower as has been predetermined by the Fire Chiefs of each municipality
through the Box Alarm Assignments.
SECTION TWO DEFINITIONS
For the purpose of this agreement-, the following terms are defined as . .....

A. "Municipalit fl: A City, Village or Fire Protection District
having a recognized Fire Department-,
B. "Mutual Aid": A definite and prearranged written agreement and
plan whereby regular response and assistance is provided for in
event of alarms from certain boxes or locations in a Stricken
Municipality by the Aiding Municipality in accordance with the
Box Alarm Assignments as developed by the Fire Chiefs of each
Municipality;
C. "Partici at ng Mun�ici,2alities A Municipality that commits itself
to this Mutual Aid Agreement by adopting a resolution authorizing

participation in the program with another participating Municipality
for rendering and receiving Mutual Aid in the event of a fire or
other disaster in accordance with the Box Alarm Assignments;

SECTION THREE AGREEMENTTO
EFFECTUATE THE MUTUAL AID PLAN
The Village President, Mayor, or Board of Trustees of - each participating
Municipality is authorized on behalf of that Municipality, to enter into and
from time to time to alter and amend on the advice of the Fire Chief and with
the consent of the governing body of that Municipality, and agreement with
another Municipality for Mutual Aid according to the following:
1. Whenever afire or disaster is of such magnitude and consequence
that it is deemed advisable by the Senior Officer present, of the
Stricken Municipality, to request assistance of the Aiding Munici-
pality, he is hereby authorized to do so, under the terms of this
Mutual Aid Agreement and the Senior officer present of the Aiding
Municipality is authorized to and shall forthwith take the following
action.
a. Immediately determine what equipment is required according to
the Mutual Aid Box Alarm Assignment.
b. Immediately determine if the required equipment and personnel
can be committed in response to the request from the Stricken
Municipality.

c. Dispatch immediately the equipment required to the Stricken
Municipality, in accordance with the Box Alarm Assignments.
2., The rendering of assistance' under the terms of this Mutual Aid
-Agreement shall not be mandatory in accordance with the Box Alarm
Assignments if local conditions prohibit response. In that event
it is the responsibility of the Aiding Municipality to immediately
notify the Stricken Municipality of same.
3. Both of the participating Municipalities agree to waive all claims
against the other party for compensation for any loss, I damage, per-
conal injury or -death occurring in consequence of the performance
of this Mutual Aid Agreement-.-- General Liability- Insurance,-- Per-----
sonal Injury and Property Damage Insurance against loss or damage
of equipment is the responsibility of each of the Municipalities
as it applies to their own personnel and equipment. All services
performed under this Mutual Aid Agreement shall be rendered Without
reimbursement of either Municipality.
4. The Senior Officer present of the Stricken Municipality shall assume
full responsibili'tyand command -for operations at1the scene.- He
will assign Senior Officers and equipment of the Aiding Department
to positio'ns when and where he deems necessary.
5. The Fire Chief . Officers and personnel of both Municipalities are
invited and encouraged to frequently visit each others facilities
for familiarization tours,, and to jointly conduct training sessions
and hypothetical disaster exercises.
SECTION FOUR INSURANCE
It is a requirement for each participating Municipality to be responsi-
ble for their own Comprehensive and Bodily Liability Insurance to cover all
of their own manpower and equipment and apparatus while operatiiig in any Com-
munity. It is further the responsibility of each participating Municipality

to provide full and complete Liability Insurance.
SECTION FIVE TERMINATION
This Mutual Aid Agreement may be terminated by either participating Munic-
ipality notifying, in writing, the Fire Chief of the other Municipality of the
termination.. Whereupon the Mutual Aid Agreement shall be terminated 90 days
after receipt of the written notice to the Fire Chief.
SECTION SIX ADOPTION
This Mutual Aid Agreement shall be in full force and in effect with the
passage and approval of a companion resolution by both participating mun-31-c-
ipalities in the manner provided by law and the signing of- this Agreement by

ADDENDUM TO ARTICLES OF AGREEMENT
The Mount Prospect Rural Fire Protection District and
the Village of Mount Prospect agree as follows:
'The District agrees not to object to the disconnection
from the District of any territory shown on Exhibit 1 'attached
hereto and incorporated herein by this reference. Accordingly,
the District agrees not to file any petition in any court alleging
that the disconnection of any territory shown on Exhibit 1 hereto
will cause the territory remaining in the District to become non-
contiguous or that the loss of assessed valuation will impair
the ability of the District to render fully adequate fire pro-
tectionservice to the territory remaining in the District. The
District hereby states and represents that the disconnection
from the District of the territory shown on Exhibit 1 hereto
shall not cause territory within the District to become non-
contiguous and shall not impair the ability of the Di -strict to
render fully adequate -fire protection service to the territory
remaining within the District.
The District shall notify the Village of Mount Prospect
at least forty-five (45) days prior to the holding of any rate
increase referendum during 1980. If requested by any property
owner who annexed property to the Village during 1980, the
District will consent to the disconnection of such territory
from the District priorto the automatic disconnection of such
territory which would occur on January l,'1981. Such discon-

nection may.take place in any manner authorized by Illinois law
and the District will cooperate with and take any action
requested or required of its. corporate authorities to effectuate
such a disconnection.

RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT
WITH THE MOUNT PROSPECT RURAL FIRE PROTECTION
DISTRICT
WHEREAS, the Mount Prospect Rural Fire Protection District has
asked the Village of Mount Prospect to provide the services of
the Fire Department of the Village to said District during
1980; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that it would be in the best
interest of the Village and of said District to enter into an
agreement with the terms and conditions set forth in Exhibit A
hereto for the provision of Village Fire Department'servic-es to
said District, provided that said District agrees to the
addendum to Exhibit A which is attached hereto as Exhibit B,
and incorporated herein by this, reference.
,NOW -j THEREFORE,, BE.IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
AS FOLLOWS:
SECTION ONE: The President of the Board of Trustees of the Vil-
lage of Mount Prospect be, and she is hereby, authorized to exe-
cute and the Village Clerk to attest, the Agreement by and
between the Village of Mount Prospect and the Mount Prospect
Rural -Fire Protection District and the -addendum thereto which
are -attached hereto-, resuectively,--as Exhibits A and B and are

incorporated herein by this reference.
SECTION TWO: This Resolution shall be in full force and effect
from and after its passage and approval in the manner provided by
law.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24
ARTICLE XIII OF THE MUNICIPAL
CODE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, subsequent to the passage and approval of Ordinance
No. 2961 on November 20, 1979 which established regulations
on the sale of condominiums, several interested parties have
made recommendations for amendments to the regulations
established by said Ordinance; and
WHEREAS, the Legislative/judiciary Committee of the Board of
Trustees of the Village of Mount Prospect has received said
recommended amendments and has reported such recommendations
to the President and Board of Trustees of the Village; and
WHEREAS, the President and Board of Trustees of the village
find that it would be in the best interest of the Village to
amend specified provisions of the regulations on the sale of
condominiums.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
AS FOLLOWS:
SECTION ONE: Section 24.1304 of Article XIII of Chapter 24 of
the Mun-kcipal Code of the Village of Mount Prospect be, and
the same is hereby, amended by deleting therefrom the language,
"13. A preliminary draft of the Condominium Declaration" and
renumbering Section 24.1304 14 through 22, inclusive, as
respectively, Section 24.1304 13 through 21, inclusive.
SECTION TWO-., Section 24-1304 of Article XIII of Chapter 24 of
the Municipal Code of the Village of Mount Prospect be, and the
same is hereby, amended by deleting the following language from
Section 24.1304 20 (renumbered as 19 in Section One herein-
above) "and a statement setting forth t -he consequences to a
purchaser and the remedies available to the purchaser against
the developer if the condominium project is not completed by
the projected date;" so said Section 24.1304 20 (renumbered as
19 in Section one hereinabove), shall hereinafter be and read
as follows:
"If the condominium project 'is under construction.,, the
projected date for completion of the condominium projectf-"

SECTION THREE: Section 24.1310A of Article XIII of Chapter 24
of the Municipal Code of the Village of -Mount Prospect be, and
I` same is hereby, amended by adding to said Section the
language "provided that any tenant who is 62 years of age or
older, or who is deaf, blind or unable to walk without
assistance shall -have the right to additional tenancy on the
same terms -and conditions and for the same rental for 180 days
following receipt of said notice of intent by giving notice as
aforesaid," so that said Section 24.1310A shall hereafter be
and read as follows:
A. Any tenant who was a tenant as of the date of the notice
of intent and whose tenancy expires, other than for
cause, prior to the expiration of 120 days from the
date on which a copy of the notice of intent was 'given
to the tenant shall have the right to extent his tenancy
on the same rental until the expiration of such 120 day
period by the giving of written notice thereof to the
developer within 30 days of the date upon which a copy
of the notice of intent was given to the tenant by the
developer; provided that any tenant who is 62 years of
age or older, or who is deaf, --blind or unable to walk
without assistance shall have the right to additional
tenancy on the same terms and conditions and for the
same rental ental for 180 days following receipt of said
notice of intent -by giving notice as aforesaid.
SECTION FOUR- Section 24.1310 C of Article XIII of Chapter 24
of the Municipal Code of the Village of Mount Prospect be, and
the same is hereby, amended by deleting the present Section
24.1310 C and substituting therefor the following language, so
that said Section shall hereafter be and read as follows:
C For a period of 120 days following his receipt of the",
not -ice of intent or in the case of a tenant who is 6'-_:
years of age or older or who is deaf, blind or unable
to walk without assistance for a period of 180 days,
any tenant who was a tenant on the date the notice of
intent was given shall be given the right to purchase
his unit on better or substantially the same terms and
conditions as set forth in any duly -executed contract
to purchase the unit, which contract shall conspicuously
disclose -the existence --of, and shall.' be subject to, the
right of first refusal. The developer shall notify the
tenant within--five--45) days after -execution by the I
developer of any contract to purchase the unit during
the 120 day period or 180 day period in the case of a
tenant who is 62 years of age or older or who is deaf,
blind or unable to walk without assistance. The tenant
may exercise the right of first refusal,. by giving notice
thereof to the developer prior to the expiration of 30
days from the giving of notice by the developer to the
tenant of the execution of the contract to purchase
the unit.
SECTION FIVE.- Section 24.1312 of Article XIII of Chapter 24 of
Code of the Village of Mount Prospect be, and the
same is hereby, amended by deleting the present Section 24.1312
in its entirety and substituting therefor the following language,
so that Section 24.1312 shall hereafter be and read as follows. -
SECTION 24.1312. Condominium Conversions
Certificates, -Inspections and Fees.
A. No unit in a building which is being converted to a con-
dominium shall he occup-sed--unl-ess--and--unti--1 an occupancy -
certificate has been issued for such unit by the
Direct -or of Community Development.
B. Before an occupancy certificate may be issued for a
unit in a building being converted to condominiums, the
common areas of such building and such unit must be
inspected by the Village of Mount Prospect for com-
pliance with applicable Village ordinances. No occu-
pancy certificate shall be issued by the Village for
any unit in a building being converted to condominiums
unless and until the common areas of such building
and such unit are in compliance with applicable Vil-
lage ordinances.
C. The fees for inspection of a conversion condominium
project shall be as follows. -
1. The fee for inspection of the common areas of a
conversion condominium project shall be $100.00 for
each ten condominium units or less which are a part
of a conversion condominium project, which fee shall
be payable on or before the date upon which the com-
mon areas of the conversion condominium project are
inspected by the Village.
2. A fee of $10-00 for the inspection of each unit in
a conversion condominium project shall be payable
on or before the date upon which each such unit is
inspected by the Village.
D. The developer of a conversion condominium project shall
arrange the dates and *times for the inspections required
by this Section with the Director of Community Develop-
ment.
SECTION SIX: Article XIII of Chapter 24 of the Municipal Code of
the Village o I Mount Prospect 'be, and the same is hereby amended,

by adding thereto -a new Section 24.L316, which said new Section
shall hereafter be and read as follows. -
SECTION 24.1316. Severability Clause. If any provision or
part thereof off" this Article is declared invalid and of no
further force and effect, the other provisions of this
Article shall remain in full force and effect.
SECTION SEVEN: This ordinance shall beinfull force and effect
from and after its passage, app-roval and publication in the manner
provided by law.

E. Any tenant under a lease entered into subsequent to
.",1 1980 may, at its option, cancel and terminate
such lease by serving written notice on the developer by
personal delivery or by registered or certified mail, retur
receipt requested, within 60 days after the date tenant
receives the notice of intent to convert. The notice of
cancellation and termination of a lease shall specify
the-date--when-such lease '-shall-be considered terminated
and cancelled by tenant, which date shall be no earlier
than the date tenant vacates the premises.
SECTION TWO: This- Ordinance shall be in full force and effect
rcm and after its passage, approval and publication in the man-
ner provided by law.

AN ORDINANCE REGULATING THE SOLICITATION OF,
CONTRIBUTIONS ON STREETS AND HIGHWAYS WITH-
IN THE VILLAGE OF MOUNT PROSPECT- -
WHEREAS, the Illinois General Assembly has amended Section 11-
1006 of the Illinois Vehicle Code, Ill. Rev. Stat., 1977
ch. 95-1/2 §11-1006, which amendment was effective on
January 1,' 1980 to allow municipalitie-s- to permit on -street
solicitation for charitable contributions subject to specified
conditions; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect has determined that it would be in the best
interest of the Village of Mount Prospect to allow such on -
street solicitation of charitable contributions as are per-
mitted by the Illinois Vehicle Code.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE -OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS, AS FOLLOWS:,,
SECTION ONE: Section 18.1006E of Chapter 18 (the Traffic Code)
of the Municipal Code of the Village of Mount Prospect be, and
the same is hereby, amended by adding to said Section the
language, "Except as may be provided otherwise in the Munici-
pal Code of the Village of Mount Prospect," so that said Sec-
tion shall hereafter be and read as follows:
B. Except as may be provided otherwise in the Municipal
Code of the Village of Mount Prospect, outside a
business- or- residence district, no personshall stand
on or in the proximity of a roadway for the purpose of-_
soliciting employment, business or contributions from
the occupant of any vehicle.
SECTION TWO: Section 18.1007A of Chapter 18 -(the Traffic Code)
of the Municipal Code of the Village of Mount Prospect be, and
the same ishereby, amended by adding to said Section the
language, "Except as may be provided otherwise in the Munici-
Ral Code of the Village of Mount Prospect," so that said Sec-
tion shall hereafter be and read as follows:
A. Except as may be provided otherwise in the Municipal
Code of the Village of Mount Prospect, where a side-
walk is provided and its use is practicable, it shall
be unlawful for any pedestrian to walk along and upon
an adjacent roadway.
SECTION THREE: Section 18.1007B •of Chapter 18 (the Traffic
Code) of the Municipal Code of the Village of Mount Prospect be,
and-, the same- i -s hereby-, amended --by adding to saidS-ection th�e
language, "txcept as may be provided otherwise in the Municipal
Code of the Village of Mount Prospect," so that said Section
shall hereafter be and read as follows:-

B. Except as may be provided otherwise in the Municipal
Code of the Village of Mount Prospect, where a side-
walk is not available, any pedestrian walking along
and upon a highway shall walk only on a shoulder, as
far as practicable from the edge of the roadway.
SECTION FOUR: Section 18.10070 of Chapter 18 ,the Traffic
Code) of the Municipal Code of the Village of Mount Prospect be,
and the same is hereby, amended by adding to said Section the
language, "Except as may be provided otherwise in the Municipal
Code of the Village of Mount Prospect," so that said Section
shall hereafter be and read as follows:
C. Except as may be provided otherwise in the Municipal
Code of the Village of Mount Prospect, where neither a
sidewalk nor a shoulder is available, any pedestrian
walking along and upon a highway shall walk as near as
practicable to an outside edge of a roadway,, and, if -on
a two (2) way roadway, shall walk only on the left tide
of the roadway.
SECTION -FIVE:Article XV of Chapter 23 of the -Municipal Code
of the V1,11age of Mount Prospect be and the- same -71"s hereby
deleted in its entirety, and a new Article XV containing the
following language shall be substituted therefor, so that said
new Article XV shall hereafter be and read as follows:

Sec. 23-1501. Permit Re, aired. It shall be unlawful for any
person, firm or corporation to solicit contributions or sub-
scriptions for charitable, religious, educational or -other simi-
lar purposes without first obtaining a permit therefor as herein
provided.
Sec. -23.1502. Soli -citation on Streets and�as subject
to the- provisions- of Secti-on23.1501, .,any charitable organiza-
tion registered with the Attorney General in the manner provided
by law may stand upon the streets or highways within the Village
of Mount Prospect at any intersection where all traffic is
required to come to a full stop for the purpose of soliciting
contributions from the occupants of any vehicle as part of a
Statewide fund raising activity. -The charitable organization
shall be liable - for any injuries to any person or property
during -.-.the-- solicitation which- is causally- related - to an - act of
ordinary negligence of the -soliciting agency. Any person
engaged in the act of solicitation shall -be -at least sixteen
(16) years of age and shall wear. -a high -visibility vest.
Sec. 23.1503. Application. A written application verified
under oath for a tag day '.permit shall be filed with the Vil-
lage Clerk at least fourteen (14) days prior to * the date solici-
tation is to commence. -Such application shall contain the fol-
lowing information:
A. Name of applicant and name of organization of which
the permit is sought.
B. Residence and business address and telephone number
of applicant.
C. The day (s) and date (s) for which a tag day permit is
sought.

D. A statement as to whether the organization has been
granted in the past such a permit from the Village -
if none, then a statement as to permits granted by
other municipalities in Illinois within the preceding
two (2) year period; if no permits have been granted
in Illinois in the two (2) year period preceding the
application then a statement as to permits granted by
any stater other municipality, governing body or
licensing authority. Alsor
1. A list of such permits or licenses;
2. A statement of the date, place and by whom issued;
and
3. A statement as to whether any such authority has
ever revoked or refused to issue or renew such a
permit or license either, to the applicant or to-
the organization he represents and an accurate
statement as to the reasons for any such revoca-
tion or refusal.
E. A statement as to whether the applicant or the organiza-
tion seeking such -a permit has ever been convicted 6f
a violation of any law; and, if so, the nature of the
offense and the punishment or penalty assessed there-
for.
F. If the applicant wishes to solicit on streets and high-
ways within the Village, the applicant shall, in addi-
tion, provide. -the following:
1. Proof that the organization --is registered with the
attorney general;
2. A statement of the Statewide 'Lund raising activity
of which the local solicitation effort is a part;
3. A certificate of insurance showing whether the
organization is insured against any claims for
injuries -or damage to property which is causally
related to an act of ordinary negligence of the
soliciting agent acting on behalf of the organiza-
tion;
4. The location or locations at which approval to
solicit is being sought;
5
5., The times of days at which such solicitation is
proposed to take place;
6. The number of persons proposed to solicit at each
location.
Sec. 23.1504. Issuance or Denial of Permit. Upon receipt of a
fully completed application, the Village Clerk shall forward
such application to the Village Manager, who shall, within
seven. (7) days after the date said application is received,
approve or disapprove the issuance of a permit and shall notify
the applicant in writing of the decision within two ( 2 ) days
therealter. The Village Manager may refuse to issue such a
permit based upon any one or more of the following:
A. That the applicant is not an individual of good moral
character and business responsibility; or
B. That the application of the applicant contains any
false, fraudulent or misleading material statement;
or
C. That the applicant has made any false, fraudulent or
misleading statement in the course of soliciting in
the Village; or
D. That the applicant has violated any of the Statutes
of the State of Illinois or ordinances of the Village;
or
E. That the applicant or any memberoragent of the
organization holding such a permit has solicited in
any unlawful manner -or in such,a manner as to consti-
tute a breach of the peace or a menace to the health,
safety or general welfare of the public; or
F. That the applicant does not satisfy the -requirements
of this Article; or
G. That other matters specified by the Village Manager
render the applicant unfit.
Sec. 23.1505. Suspension or Revocation, of Per, -it. The Village
Manager, after affording a permit holder the opportunity to be
heard, may suspend or revoke a tag day permit based upon any
one or more of the standards set forth in Section 23.1504. The
Village Manager shall mail written notice of such suspension
or revocation to the permit holder within two (2) days after
the date of the decision.

Sec. 23.1506. 'Appeals. Any applicant or permit holder aggrieved
by the action of the Village Manager In refusing to issue such
permit or in suspending or revoking any such permit already
issued shall have the right to appeal to the President and Board
of Trustees of the Village.
A. Such appeal shall be taken by filing a written state-
ment setting forth fully the grounds of appeal with
the Village Clerk within ten (10) days after notice of
the action complained of has been mailed by the Village
Manager to such individual's last known address. -
B. The President and Board of Trustees shall set a time
and place for a hearing on such appeal, and notice of
such hearing shall be given to the appellant in
writing at his last known address at least (5) days
prior to the date set: for hearing.
C. The appellant shall have the right to be represented
at such hearing by counsel.
D. The -decision---and -order of the -President and Board of
Trustees --on such- appeal shall be final and conclusivIve.
Sec. 23.1507. Severability. If any provision or part thereof
of this Article is declared invalid and of no further force and
effect, the other provisions of this Article shall remain in
full force and effect.

A. A UISITICN OF TAKE MICHIGAN WATER
James Muldowney of Fletcher Engineering as consultant to the. Village of
Mount _P_rq-spect, gave a summary relative to water allocations involved stating
the . ta:t a of Illinois was researching various resources available to each
municipal"ity, such as-shallow wells, deep wells, and surfacewater supplies
including Lake Michigan. The State world compile that information and deter-
mine the cost„`involved with developing those resources. When Lake Michigan

wells, except in cases of emergencies.
Alternate methods of acquiring Lake Michigan water were discussed- from
Evanston; from the O'Hare plant;and from Ides Plaines which is presently
receiving Lake Michigan water from Chicago.
:fir. Fricke - General Manager of Citizen's Utilities, stated it was the
desire of Citizens Utilities to ,also acquire Lake water. However, member-
ship in the various study groups is limited to municipalities. It was noted
that a possible amendment to the. By-Laws could bemade to accomplish member-

It was stated numerous problems would have to be addressed within each
local system in order to accomodate the drastic temperature difference e-

necessary inhouse connections.

IN COOK COUNTY, ILLINOIS
WHEREAS, the following described real estate is not with -in the
corporate limits of any municipality and is contiguous to the
Village of Mount Prospect:
All of Lot 7 together with all that part of Euclid
Avenue lying South of the North line of the South-
west 1/4 of Section 27, Township 42 Northr Range 11
East of the Third Principal Meridian and lying West'
of the East line of Lot 7 extended North and lying
Easterly of the Southwesterly line' of Lot 7 extended
Northwesterly said Lot 7 being Lot 7 in Arlington
.Meadows, being a Subdivision of that part of the
West 1/2 of the Southwest 1/4 lying Northeasterly of
