SUBJECT: Work Permits in State Right -of -Way's.
The Illinois Department of Transportation (IDOT)
requires that any person, firm, or corporation.,
desiring to do any work on the State Right of Way.,
obtain a permit in writing from IDOT.
With each permit, a bond is required to guaranl(---ee
the State that the work shall be completed in accordance
with State Specifications and the cond'itions and restrictions
contained in said perinit.
For permit work to be undertaken by E-%rnplcyees of a
municipality, a resolution is acceptable in lieu of a bond.
In order to expedite our permits, a yearly resolution can
be submitted by the municipality.
Attached is a resolution that should be adopted by the
Village Board for the year 1980. 1 recommend that th,(--�

A RESOLUTION OF AGREEMENT WITH THE
ILLINOIS DEPARTMENT OF TRANSPORTATION
WHEREAS. the VILLAGE OF MOUNT PROSPECT, Cook County, Illinois desires
to undertake, in the year 1980, the location, construction, operation and
maintenance of driveways and street returns , watermains , sanitary and storm
sewers, street lights, traffic signals, sidewalks, landscaping, etc. , on State
highways, within the Village of Mount Prospect, which by law and/or agreement
come under the jurisdiction and control of the DEPARTMENT OF TRANSPORTATION
OF THE STATE OF ILLINOIS; and
WHEREAS, an individual working permit must be obtained from the Department
of Transportation prior to any of the aforesaid installations being constructed
either by the Village of Mount Prospect or by a private person or firm under

contract and supervision of the Village of Mount Prospect.
NOW v THEREFORE. BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY., ILLINOIS:
SECTION ONE: That the Village of Mount Prospect hereby pledges its good faith
and guarantees that all work shall be performed 'in accordance With the conditions
of the permit to be granted by the Department of Transportation-, and to hold the
State of Illinois harmless on account of any damaages that may occur to persons
or property during the prosecution of such work, and assume all liability for
damages to persons or property due to accidents or otherwise by reason of the
work which is to be performed under the provisions of said permit.
SECTION TWO: That all authorized officials of the Village of Mount Prospect are
hereby instructed and authorized to sign said working permit on behalf of the
Village of Mount Prospect,
SECTION THREE: That this Resolution shall be in full force and effect following
its passage and approval in the manner provided by law.

The Village Board, at their meeting of October 2, 1979, approved a
motion to concur with the recommendation of the Public Works
Committee to return $11,103.44 for the overs izzing of water mains
In the Pharoahs Subdivision (under the terms of the Annexation
Agreement with the Richmond Subdivision on south Bus -se Road)
with $751.00 to be excluded as payment for engineering fees.
The North Barrington Development Company, the developer, was
asked to provide the Village with a) a bill of sale for the water -
mains, b) as -built drawings of the development, and c) an easement
for the public utilities. These items lave now been received and
the payment can now be made.
The Grant of EaSzement, �-,rhich is an open -space easement, needs to
be signed by the Village and recorded with the County Clerk.

(6) We will advise you of the marketing procedures and specifi-
cally recommend the time, place and method of conducting the
bid opening and sale of the bonds.
(7) Whet a bond bid opening date has been established, we will:
(a) arrange for the publication (if applicable) of the
notice(s) of sale in the national financial press.
(b) make a recommendation relative to the advisability
of obtaining an investment rating and, if you elect
to request one, we shall make application on your
behalf including preparation of the necessary
information.
(c) distribute the Official Statement to a broad list
of prospective bidders, investment advisors and
investing institutions.
(8) We will attend the bid opening where we will check the bids
for accuracy and advise you of the acceptability of the best
bid received.
(9) We will assist in and coordinate all details leading up to
the delivery of the bonds, including the printing of the
bonds and calculating the amount due at delivery.
(10) Upon completion of the delivery -of your bonds we shall com-
pute a record of payments of principal and, interest and pro-
vide you with a convenient reference summary of the financ-
ing.
We shall have no interest in the purchase or resale of your obZi-
gations nor shaZZ we engage in any other activity which may constitute
a conflict of interest with performance of our services for you. We
will not obligate you for any expenses except with your approval.
You will be responsible for the fees of your attorneys, bond coun-
sel, en*gineers/architects and are to pay all of your ordinary expenses
including advertising, printing and distribution of Official Statements,
the purchase (if applicable) of a rating for the bonds, the purchase
(if applicable) of municipal bond insurance, and printing and delivery
of the bonds. We will assist you by arranging for the advertisement of
the sale in the national financial press and where applicable, will
obtain competitive bids on the necessary printing.
For our services we are to be paid a fee of $4,000 which shall in-
clude our own ordinary expenses, our necessary travel expenses between
Mount Prospect/Glenview/Chicago and our services in full which, in ad-
dition to those outlined in this agreement, shall include all necessary
and usual functions to complete the financing. Our fee is to be due at

the time of award of the low bond bid and payable upon receipt of the
proceeds of the issue. If for any reason, no bond bid award is made,

Four hearings are scheduled to be held with 'regard to this
Airport Noise Amendment. 'Two of the sie h,earii--igs are within
our local area, with orie bic,�ing 'held in Park Ridge on April 19
and the other being ',helid in. Des Plaines on April 10. Either -
an elected official or staff membler repriesenting the Village
of Mount Prospect should present a ciertified copy of the

A RESOLUTION IN FAVOR OF REGULATING THE NOISE
AT 01HARE AIRPORT
WHEREAS, the Village of Mount Prospect is a municipal corporate organization
chartered within the Mate of "Illinois and the County of Cook; and
WHEREAS, the public officials of the Village of Mount Prospect represent a
population of over 54,000 Illinois residents; and
WHEREAS, the Village of Mount Prospect has a particular interest In the
environmental effects of operations at O'Hare Airport; and
WHEREAS, the ongoing O'Hare/Midway Master Plan calls for an increase in
average airport operations per hour from 158 operations in 1980 to 198 operations
in 1995; and
WHEREAS , the Village of Mount Prospect feels such a dramatic increase in
operations without additional controls to limit or reduce noise pollution is
detrimental to its citizens and the surrounding environment.
NOW I THEREFORE , BE IT RESOLVED BY THE MAYOR AND BOARD(OF TRUSTEES,
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

A RESOLUTION IN FAVOR OF REGULATING THE NOISE
'AT O'HARE AIRPORT
WHEREAS, the Village of Mount Prospect is a municipal corporate organization
chartered within the State of Illinois and the County of Cook; and
WHEREAS , the public officials of the Village of Mount Prospect represent a
population of over 54,000 Illinois residents; and
WHEREAS , the Village of Mount Prospect has a particular interest in the
environ,,me ntal effects of operations at O'Hare Airport; and,
WHEREAS, the ongoing O'Hare/Midway Master Plan calls for an increase in
average aiort operations per hour from 158 operations in 1980 to 198 operations
in 1995; and,
WHEREAS, the Village of Mount Prospect feels such a dramatic increase in
operations without additional controls to limit or reduce noise pollution is
detrimental to its citizens and the surrounding environment.
NOW j THEREFORE , BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES ,
OF THE VILLAGE OF MOUNT PROSPECT t COOK COUNTY t ILLINOIS:
SECTION ONE: That the Village of Mount Prospect endorses the concept of
regulating and reducing the impact of airport noise.
S' C70N' TWO: That the Village of Mount Prospect requests the Illinois
P'011utlion Control Board to take immediate, action by approving the Airport Noise
Amendment R-77-4.
SE CTION THREE: That copies of this Resolution shall be forwarded to the
Illinois Pollution Control Baord, the Federal Aviation Administration, and the
Chicago Department of Aviation.
SECTION FOUR: That this Resolution shall be in full force and effect from

The two neighbors have agreed to divide the 20' strip
and to pay all administrative expenses. The Building
Committee voted 2--0 to recommend approval of the vacation.
The public hearing on this matter was then closed.

The meeting was called to order by Chairman Richardson at 8 p.m. In

-111,111-11'.. ,The Committee reviewed and discussed the staff`s recommendations for
amendments to the Condominium Conversion Ordinance. The staff's
recommendations were outlined in a memo from Ed Geick and Ken Frits
to the Village Manager on January la, 1980. That list of recommenda-
tions is attached and the Committee's action on each item is outlined
below:
Item 1 (Sec. 24-1302-mac) effective date of the Condominium Conversion
Ordinance was addressed at the Village Board meeting on January 15.
The effective date has been delayed by 30 days, or until February 14,
1980.
The Committee agreed:, by a vote of 2--0. to approve the staff re--
ommenda.tions to include a severability clause`(item 2); to maintain
Section 24.1304-7 (item 3) ; to delete from the Preliminary Property
Report the-requirement to submit a condominium declaration (item 4),-
and
);and to maintain Section 24.13014,--19 (item 5).-
On
) .On item 6 concerning Section 24.1304-20 of the Condominium Conversion
Ordinance, the Committee agreed fry a 2-0 vote to maintain' the require—
ment that final completion data on any new condominium project or any
conversion project be maintained in the ordinance, but that the section
requiring a list of "Remedies Available_" to purchasers if a project
completion date was `not met, be taken out of the ordinance because it
would appear to be unfair and similar protection was already being
provided in ether parts of the code or through the use of legal counsel
by the purchaser at the time of the sale.
The Committee discussed at length item 7 of the recommendations which";
.involves Section 24.1310 - e & f of the Condominium Conversion
Ordinance. The Committee,agreed that some language should be included
in the ordinance to reflect our concern for the rights of tenants,
but understands Attorney Baran's concern regarding the constitui.onality
of these' particular sections of the of inance. After reviewingseveral
ordinances from other communities, and discussing the alternatives
available, the Committee voted 1-1 on maintaining the present sub--

concurrence, then the Committee recommends to the full tcard the

alternative language comes from the City of'Evanston's Condominium
Conversion Ordinance.
"Sec. Tenant's R1ht;to Purchase.

(30) days after the condominium instruments have been filed
with the City, whichever is longer, the declarant shall offer
the tenant his unit. This offer shall be held open until tenant
acceptance or refusal, but in no event longer than the expiration
of either the one hundred twenty (120) day period or the thirty
(30) days after filing of the condominium instruments, whichever
is longer. Inaction by the tenant after she expiration of the
one hundred twenty (120) days or thirty (30) days shall constitute
a waiver of i
his right of first ,purchase. Said offer shall be
either a first-time offer to the tenant at a set price or the
right of first refusal to that tenant when a bonafide offer has
been submitted for that unit by ai third patty. Tinder either
procedure, the tenant,,shall have thirty (30) days to execute.

dominium if the boundaries of the converted unit to not sub-
stantially conform to the dimensions of the unit before
conversion; however, where it is available, another unit
si ilar to the preconversion dwelling must be offered to the

Section 24.1309 also received a recommendation for a change of l&ngugage
to incorporate further protection for senior citizens 62 yearsand
older, the blind, and the handicapped by allowing them ,additional time
in the Notice' of Intent to convert. The Committee voted 2-0 in favor
of changing the time period for those people named from 120 days to
180.,,.days. The appropriate language will be drafted by Attorney
Barbara Baran for amendment to the ordinance.

In section 24.1312-a (item 8,,),,, Attorney Baran pointed out that
language should be added to discern between conversion projects and
new construction of condominiums. This, language should not only
differentiate between the two types of condominium projects, but
should also supply the Village's present inspection fee schedule in
this ordinance and its building codes. The Committee agreed 2,-0
in favor of making these cha ' nges.. and has, asked Att,orney Baran to d -raft
the appropriate language in the amendment ordinance. In addition, I
the Committee discussed including language in this section to clarify
Legislative/, iclary Committee Meeting 1-17-80 'Page 3.
the time period in which all inspections of the condominiums and
common areas mint be completed.
Attorney Barbara Baran, pointed out during discussion of recommendation
#9 that in her initial draft of the ordinance she. deleted any =sections
permitting amendment of the Preliminary or Final Property Reports
that would allow developers or converters to update the information
contained in any report that they had submitted to the Village. The
Committee agreed unanimously to recommend to the Board that language
should be drafted and included 'in the Condominium Conversion Ordinance
to permit amendments to be made to the Preliminary and Final Property
Reports so that they may be maintained in an uptodate state with all
the necessary and proper information.
On -Street Solicitation:
The Committee discussed at length the State's new Statute regarding
on -street solicitation and Barbara Baran's legal opinion dated
December 3, 1979. Attorney Baran pointed out that there are some
conflicts in the present Village Municipal Code regarding pedestrian
safety restrictions and provisions for Tag Day solicitations. Con-,
s iderable discussion ensued regarding the intent of the State's new
law and whether enforcement of the restrictions on solicitations at
signalized intersections on either State or Village roads was actually
intended. The present language in the State Statute, as interpreted
by Barbara Baran would restrict solicitation at any intersection other
than those which have 4 -way stops as required by a stop sign. Solici-
tation on the roadways is not permitted at signalized intersections
under the present language of the State Statute.
It was determined that additional clarification of the State's Intent
in passing the new Statute and how it was going to be enforced was
needed. The staff was requested to contact the Northwest Municipal
Conference for clarification of the language in the Statutes and, if
necessary, to pursue passing an amendment to the Statutes to permit
solicitation at signalized intersections on State Highways.
The Committee voted 2-0 in favor of passing An ordinancO permitting
on -street solicitation as required by the State Statute. Attorney
Barbara Baran was requested to draft an appropriate ordinance for
submission to the Village Board.
Property Maintenance Code:
The Committee reviewed the first draft of;a Property Maintenance Code
as prepared by Attorney Barbara Baran. The conflicts with the`
present Municipal Code and additional amendments that may be necessary
were discussed, and direction was provided to Attorney Baran that
any such conflicts or amendments should be included with the new
ordinance so as to avoid problems in the future.
The Committee provided direction to Attorney Baran for certain changes
in language and substance of the ordinance. The staff will take the
second draft to be prepared by Attorney Baran and will review it in
house and report back to the Committee at its meeting in February.

'Downtown Rehabilitation ,Program-
Ross, Hardies has received the imaterial on the downtown rehabilitation
loan program that was requested of Bloomington, Illinois. This
material was distributed to the Committee and discussed briefly.
Assistant Village Manager Gelick was requested to contact Rick Martin
and provide him with a copy of the Bloomington material, and to
request that Mr. Martin attend the February meeting of the Committee.
In addition, Hal Predovich of the Downtown Development & Redevelopment
Comml*ss'1*6n will be invited to attend the February meeting in the
hopes that a formal down14:own reh"abillitesti on program may be finalized
and presented to the Village Board in the next Committee report.

AN ORDINANCE AMENDING CHAPTER 24
ARTICLE XIII OF THE MUNICIPAL
CODE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, subsequent to the passage and approval of ordinance
No. 2961 on November 20, 1979 which established regulations
on the sale of condominiums, several interested parties have
made recommendations for amendments to the regulations
established by said ordinance; and
WHEREAS, the Legislative/judiciary Committee of the Board of
Trustees of the Village of Mount Prospect has received said
recommended amendments and has reported such recommendations
to the President and Board of Trustees of the Village; and
WHEREAS, the President and Board of Trustees of the Village
find that it would be in the best interest of the Village to
amend specified provisions of the regulations on the sale of
condominiums.
A'Oftr THEREFOREf BE IT ORDAINED By THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECTr COOK COUNTY, ILLINOIS
AS FOLLOWS:
SECTI-ON ONE: Section 24.1304 cif. Article XIII of Chapter 24, of
the Municipal Code of the Village of Mount Prospect be, and
the same is hereby, amended by deleting therefrom the language,
"13. A preliminary draft of the Condominium Declaration" and
renumbering Section 24.1304 14 through 22, inclusive, as
respectively, Section 24.1304 13 through -21, inclusive.
SECTION TWO: Section 24-1304 of Article XIII of Chapter 24 of
the Municipal Code of the Village of Mount Prospect be, and the
same is hereby, amended by deleting the following language from
Section 24.1304 20 (renumbered as 19 in Section One herein-
above) "and a statement setting forth the consequences to a
purchaser and the remedies available to the purchaser against
the developer if the condominium project is not completed by
the projected date;" so said Section 24.1304 20 (renumbered 'as
19 in Section One hereinabove), shall hereinafter be and read
as follows:
"If the condominium project is under construction.,- the
projected date for completion of the condominium project-"
SECTION THREE: Section 24.1310A of Article XIII of Chapter 24
of the Municipal Code of the Village of Mount Prospect be, and
the same is hereby, amended by adding to said Section the
language "provided that any tenantwhois 62 years of age or
older, or who is deaf, blind or unable to wali without.
assistance shall have the right to additional tenancy on the
same terms and conditions and for the same rental for 180 days
following receipt of said notice of intent by giving notice as
aforesaid," so that said Section 24.1310A shall hereafter be
and read as follows:
A. Any tenant who was a tenant as of the date of the notice
of intent and whose tenancy expires, other than for
cause, prior to the expiration of 120 days from the
date on which a copy of the notice of intent was given
to the tenant shall have the right to extent his tenancy
on the same rental until the expiration of such 120 day
period by the giving of written notice thereof to the
developer within 30 days of the date upon which a copy
of the notice of intent was given to the tenant. by the
developer; provided that any tenant who is 62 years of
age or older, or who is deaf, blind or unable to walk
without assistance shall have the right to additional
tenancy on the same terms and conditions and for the
same rental for 180 days following &

SECTION FOUR: Section 24.1310 C of Article XIII of Chapter 24
of the Municipal Code of the Village of Mount Prospect be, and
the same is hereby, amended by deleting the present Section
24.1310 C and substituting therefor the following language, so
that said Section shall hereafter be and read as follows:
C. For a period of 120 days following his receipt of the
notice of intent orinthe case of a tenant who is 62
years of age or older or who is deaf, blind or unable
to walk without assistance for a period of 180 days,
any tenant who was a tenant on the date the notice of
intent. -was given- shall be givenn-the right to purchase
his unit on better or substantially the same terms . and
conditions as set forth in any duly,executed contract
to purchase the -unit, which contract shall conspicuously
disclose' the existence of, and -shall be subject to, the
right of first refusal. The developer shall notify the
tenant within five (5) days after execution by the
developer of any contract to purchase the unit during
the 120 day period or 180 day period in the case of a
tenant who is 62 years of age or older or who is deaf,,
blind or unable to walk without assistance. The tenant
may exercise the right of first refusal by giving notice
thereof t ' o the developer prior to the expiration of 30
days from the giving of notice by the developer to the
tenant of the execution of the contract to purchase
the unit.
-SECTION FIVE: Section 24.1312 of Article XIII of Chapter 24 of
the Municipal Code of the Village of Mount Prospect be, and the
same is hereby, amended by deleting the present Section 24.1312
in its entirety and substituting therefor the following language,
so that Section 24.1312 shall hereafter be and read as follows:
SECTION 2401312. Condominium Conversion's - Occu2ana
Certificates;, Inspections and Fees.
A. No unit in a building which is being converted to a con-
dominium shall be occupied unless and until an occupancy
certificate has been issued for such unit by the
Director of Community Development.
B. Before an occupancy certificate may be issued for a
unit in a building being converted to condominiums, the
common areas of such building and such unit must be
inspected by the Village of Moun't Prospect for com-
pliance with applicable Village ordinances. No occu-
pancy certificate shall be issued -by the Village for
any unit in a building being converted to condominiums
unless and until the common areas of such building
and such unit are in compliance with applicable Vil-
lage ordinances.,
C. The fees for inspection of a conversion condominium
project shall be as follows:
1. The fee for inspection of the common areas of a
conversion condominium project shall be $100-00 for
each ten condominium units or less which are a part
of a conversion condominium project, which fee shall
be payable on or before the date upon which the com-
mon--areas--of the conversion condominium project --are
inspected by the Village.
2 A fee of. $10.00 for the inspection of each- unit in
a conversion condominium -project shall- be'pa'yable
on or before the date upon which each such unit is
inspected by the Village.
D. The developer of a conversion condominium project shall
arrange the dates and times for the inspections required
by this Section with the Director of Community Develop-
ment.
SECTION SIX: Article XIII of Chapter 24 of, the Municipal Code of
,the Village of Mount Prospect be, and the same is hereby amended,
by adding thereto a new Section 24.1316, which said new Section
shall hereafter be and read as follows:
SECTION 24-1316. Severabijjt Clause.- If any provision or
part thereof of this Article is declared invalid and of no,
further force and effect, the other provisions of this
Article shall remain in full force and effect.
SECTION SEVEN: This ordinance shall be in full force and effect
from and after its passage, approval and publication in the manner
provided by law.

Chester 0sada representing Mount Prospect "Federal Savings & Loan Assoc anon, requested
a study regarding parking on Prospect Avenue, between Main Street & Emerson. Mrs. Osada
indicated the need for long and short term parking for the merchants in the area and
offered the following suggestions:
1. Change the present two-hour parking on the ,South Side of Prospect Avenue to
a cine-hour parking zone
2. Cut dawn the six to seven .taxi--cab parking spaces on the North Side of Prospect
Avenue to three spaces and make the remainder of the street atwo-three hour
zone,,

Mr. 0sada suggested that Mr. Birksof Blrka'- Transportation Company make the necessary

arrangements with the Chicago & Northwestern Railroad to allow attended tax's' to
stand in the center lot where the depot is located. That way, the cabs could shuttle
from the train station lot 'to the cab stand as a vacancy occurs and they would be
able to moire in the event a commuter wished to remove a vehicle from the lot.
3.Suggested un1form one-hour parking zones on the South & West of streets in the downtown
business area and zones of two or three hours on the opposite sides.
4.Secure an arrangement with :Sandhurst Cor ppration for commuter parking in their unsued
periphery lots coupled with a shuttle bus arrangement.
5.Increase the parking meter rates to encourage use of buses to the train depot.
A discussion ensued concerning the suggestions brought forth by Mr. Osada., and It was
decided: by the Committee that a traffic survey and study would be conducted when a new
'Traffic Engineer Is hired in the Village.
Pheasant Trail
"Chief Doney recommended that Pheasant Trail be changed from a 25 MPH zone to a 20 1APH
zone due to the fact that this is a school area and heavily used by children. The
Board approved thereduction n speed 3W-0 and instructed Ms. Baran to change the ordinance

accordingly so that it could be submitted to the full Board for their approval.
200 Block South Ioka
Chief money presented a report to the Committee which he received from the Village
Engineer, Mr* Ben Hemmeter recommending that the 200 block of South Iola be posted as
a two-hour parking zone due to residents in the area reporting that commuters have been
parking on an all day basis in the area. The Committee agreed unanimously usly to recommend
the posting of the two-hour zone to the Board for full approval, (attachments)
HANDICAPPED PARKING 11/29/79
Barbara Baran reported to -the committee that a municipality has no authority to regulate
parking on private property. Chief Doney recommended entering into agreements with pro-
perty owners to provide unl'foiftn enforcement. Barbara Baran to review existing private
contracts and report back at the February, 28,r 1980 meeting. (attachments)

The Committee suggested some changes to Barbara Baran for submission to the Committe
at the February meeting.
IRMA (Loss Prevention Action) 7/26/79
A reading of Mr. Gallagher', IRMA report regarding safety hazards in the Public Safety
Building took place. Chief Doney reported. that Public Works has already corrected some
of the problems and there is aprocess of securing a contract for roof repair in the works.
Trustee Wattenberg requested an update at the February meting concerning this problem.

Mr. Tom Kluzewski of Browning Ferris Industries requested a change in collection from
four days a week to two days. He requested that, collections be on Tuesdays and Fridays
only and cited economic reasons for the change. The Chicago & Northwestern Railroad
would be the dividing line and the North side would be a Tuesday collection ,and the
,South Side a Friday collection. In the event of a holiday, the collection would be made
the next day. Information tags will be placed at each residence as well as news articles
circulated to inform residents of the change at Browning Ferris Industries expense„
The collections for Palatine will be on Monday, and. Streamwood on Wednesday.
Trustee-Murauskis ob3ected to the Friday collection and suggested a Monday-Tuesday collection
Trustee Murauskis also suggested that bulk pick--up be made on both collections-at no extra
cost. Mr. Kluzewski indicated that would not be possible without additional charge.
A Vote was then taken to change the collegian days to Tuesdays and. Fridays. The Vete
