SUBJECT: Office Lease - V & G Printers, Inc.
DATE: January 9, 1980
As mentioned in a previous Manager's Interim Report, the office
lease with V & G Printers expires on January 31, 1980. Sub-
sequent to our files revealing the pending termination, we contacted
V & G Printers and also surveyed the rental market in order to
discuss with representatives from V & G a lease extension and rental
increase.
A meeting was held with V & G Printers on Wednesday, January 9,
1980. At that meeting the Manager, Mr. Geick and -Mr. Jesse toured
the facility and examined the structure and operations, and dis-
cussed the extent of the lease with Mr. Wes Graser. Mr. Graser and
I have tentatively agreed to offer to the Mayor and Board of Trustees
a one year office lease at a monthly rental of $1,150.
The V & G Printers building, located at 31 S. Main Street, was
acquired by the municipality in -1975 When we bought the Village Hall
from the Mount Prospect State Bank. Previously the bank had used
the facility for their Data Processing Center, and when we acquired
the facility, together with the parking lot, it was the thinking of
the Board at that time to lease the -office space. While V & G
Printers does have its plant operation in a building immediately
adjacent to our office, there is no printing that takes place in
our structure.
There is approximately 2300 sq. ft. in the office and apparently in
July of 1975 or sooner a lease went into effect in the amount of
$4.17 per sq. ft. (Monthly rental, $800; annual, $9,600.). The
first lease was good until January 31, 1978. At that time the
Village offered a two year lease extention at a rental rate of
$4.69 per sq. ft. ($900 monthly rental, or $10,800 annual rental.)
This two year extension was a 12% rental increase.
In our discussion with Mr. Graser, I showed him our research and
told him that I would be recommending to the Mayor and Board of
Trustees that the rental rate be increased to $6 per sq. ft. (Monthly
rental of $1F150; annual rental of $13,800.) The $6 per sq. ft.

appears to be commensurate with the market conditions, and while
it is a sizable increase, a further increase may well drive
V & G Printers out of the downtown area, which would not be
advantageous to us with these current market conditions. Mr. Graser
agreed that while the increase -is relatively steep., it seemed
commensurate with the general market and some of the lease increases
he finds on his other building.
Prior to the meeting with V & G Printers, we contacted numerous
real estate offices here in Mount Prospect and they gave us rental
rates ranging from $6.50 per sq. ft. to $12.00 per sq. ft. The
range is broad to reflect location, building quality, utilities
and taxes. Our lease with V &-G Printer -is requires them to pay all
utilities and, of courser there are no taxes at this point on the
building to my knowledge. Additionally, a review of the rental
rates advertised in the local newspaper indiates rents from $5.86
per sq. ft. without utilities and taxes to $10.66 per sq. ft. with
utilities in some -outlying communities.
Therefore, based upon general commercial rates being asked for and
the sizable increase to be proposed to V & G Printers, the Manager
is of the opinion that $6 per sq. ft. is a suitable figure at this
time. Pursuant to earlier memos to the Mayor and Board of Trustees,
I also indicated that I would be recommending --that the lease be for
a one year period.
Inasmuch as this is a formal contract, it will need the action of
the Mayor and Board of Trustees, and I am placing the matter on
the agenda for Tuesday, January 15.

SUBJECT: Condominium Conversion Ordinance Administration

On Wednesday, January 9, 1980 there was a public information meeting
held at the Village Hall regarding the administration of the
Condominium Conversion Ordinance. The Village sent written in-
vitations to all developers, and to all apartment managers or
management companies, who have worked or are presently doing
business with the Village.
The meeting was very productive and not only provided useful informa-
tion to those who were invited, but also to the staff as well. The
staff pointed out that this ordinance covers conversions and new
construction alike. The reporting requirement procedures to be
followed and fee schedule were also discussed. The effective date
of this ordinance is -January 23, 1980, based upon the date of its
publication in the newspaper after its passage in November.
It became -apparent during the meeting that certain areas of the
ordinance posed considerable.hardship--upon those who -must meet -its
reporting requirements and that some language clarification may be
necessary. Those items which appeared to present problems to the
administration of this ordinance, and those that were questioned or
challenged by the developers and apartment managers are listed on
Attachment A.
Due to the importance of some of the questions raised to different
sections of the Condominium Conversion ordinance, it would be our
request and recommendation that enforcement of those sections in
question be held off for approximately thirty days or until the
Legislative/Judiciary Committee can consider the items and make
recommendations to the Village Board for any changes that may be
necessary. The ordinance would remain in force in this manner, but
deadlines for making the Preliminary Property Reports would be
extended thirty days to allow those affected to better meet the
requirements of the ordinance. During this interim period also the
staff would have additional time to better prepare for the administra-
tion of this ordinance so that it may more efficientllk.7 implement

ATTACHMENT "A"
1. Section 24.1302-c: Effective date upcoming on January 23 does
not provide sufficient time to meet the reporting requirements
of the ordinance.
2. A Severability Clause should be added so that if one part of
the ordinance is ruled unconstitutional or is no longer
proper, then the remaining parts of the ordinance may remain
enforceable.
3. Section 24.1304-7: This clause was considered very hard to
meet by the developers and apartment managers due to the widely
fluctuating interest rates for borrowers. The staff did not
agree and thought that this requirement could be met.
4. Section 24.1304-13: A Condomonium Declaration is provided at
the time of sale automatically. Title insurance companies
usually do not have their reports finished in time to prepare
the Condominium Declaration to meet the requirements of the
Preliminary Property Report. Having this only as part of the
final Property Repor-t would adequately meet the reporting
requirements intended by the ordinance. The staff would recommend
that this clause be included only in the final Property Report.
5. Section 24.1304-19: Some developers and apartment managers
objected to including a copy of the sales contract in the -report.
No substantial reasons were given for objecting to this clause
and the staff would recommend that -it be maintained.
6. Section 24.1304-20.- This clause was widely objected to by the
developers and apartment managers because it was almost im-
possible to name a final -completion date on a project under
present market conditions. Some projects are stage developments
or conversions and would require constant amendment of the
project completion date, based upon how construction proceeded
and how' sales were completed. In addition, the developers and
converters considered it unfair to list "remedies available"
to purchasers if the project completion dates were not met.
7. Section 24.1310-e & f: This was discussed in Committee prior
to passage of the ordinance as an item that could be challenged
legally. A tenant's lease is a contract and cannot be broken or
obstructed by Village ordinance, according to Attorney Barbara
Baran. The staff would recommend that this section of the
ordinance be eliminated so as to forego any challenge in the
courts on this particular section.
8. Section 24.1312-a: This section should be changed to discern
better between a conversion project and new construction. Under
the Village's present codes, building permit fees are charged
to cover the cost of all inspections required. In its present
wording this clause would require payment of double inspection -
fees in some cases. Clarification is needed.

Each of us is keenly aware of the importance to our community's
future of the Rauenhorst development for the remaining 270 acres.
Inasmuch as this is one of the major remaining parcels of land to
be developed in our community, we should make every effort to
incorporate a complete planning review and analysis of the proposal
together with maximum public discussion and public notice. The
decisions we will be making this spring relative to their annexation
request may well be irreversible in the future, and we cannot deny
that our time and effort to be spent in this area is of high priority..
I will be recommending at Tuesday's Village Board meeting that we
consider employing professional expertise to assist the staff and
ourselves in reviewing the concept plan and annexation request of
Rauenhorst. The Village Manager informs me that the staff will just
not have sufficient time to thoroughly assess the proposals in the
detail that is necessary for an effective Board decision. Therefore,
I will request that the Board authorize the staff to seek the
assistance.of a competent consulting firm. I further am of the
opinion that the fee for such a consulting firm should be paid for
by the Rauenhorst Corporation. The Manager informs me that the
cost of such a review could be between $8,000 and $15,000.
We cannot stress too greatly the importance of a step by step
analysis of the Rauenhorst proposals, and complete public parti-
cipation to identify the issue and to adjust Rauenhorst's proposal
to fit the community interest.

Mount Prospect a properly signed and acknowledged resolu-
tion from each of the homeowners associations, which
resolution has been passed and approved by the 'same per-
centage of condominium owners as is required under the
By -Laws of each such association to approve special
assessments. The form and contents of such Resolution
shall be submitted to the Director of Community Develop-
ment and Village Attorney for review and approval.
B. The Petitioner or each homeowners association shall exe-
cute an agreement approved by the Director of Community
Development and Village attorney to indemnify and save
and hold harmless the Village if any person asserts or
attempts to assert any claim against the Village arising
out of the Village's approval of amendments to Ordinance
No. 2346 approved by this Ordinance.

AN ORDINANCE AMENDING SPECIFIED
SECTIONS OF THE ZONING ORDINANCE
ON NOTICE
WHEREAS,, it has been proposed that Sections 14.603, 14.703 and
14.804 of the Village of Mount Prospect Zoning Ordinance be
amended to reduce the size of signs and the letters thereon
and eliminate specified information on signs which are required
to be posted on property which are the subject of, respectively,
requests for variations, special uses and amendments to the
Zoning Ordinance; and
WHEREAS, a public hearing was held on such propose'd amendments
before the Zoning Board of Appeals on November 15, 1979 pursuant
to notice duly published in the Mount Prospect Herald on
October 31, 1979; and
WHEREAS, the Zoning Board of Appeals recommended approval of the
proposed amendments to the Zoning Ordinance to the President and
Board of Trustees of the Village; and
WHEREAS, the President and Board of Trustees of,the Village find
that it would be in the best interest of the Village to approve
the proposed amendments to the Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
AS FOLLOWS. -
SECTION ONE: Section 14.603B3b of Chapter 14 of the Municipal
Village of Mount Prospect (the Zoning Ordinance) be
and the same is hereby amended by deleting the language "32" x 481111
and "3/8" wide by 2-1/2" as they appear in scald Section and sub-
stlituting therefor, respectively, 1130" X 30"' and "2"" and deleting
Section 14.603B3b(3) in its entirety, so that said Section

Please be advised that pursuant to Article XIII of the By -Laws of the
Northwest Municipal Data System . the Village of Mount Prospect hereby serves
written notice of withdrawal from participation in the Northwest Municipal
Data System.
As you know, Article XIII provides that if withdrawal results in a reduction
in the number of municipalities -participating in the Northwest Municipal Data
system below the original number, such withdrawal triggers a dissolution of
the Joint Computer Systems Agreement. The Village's withdrawal reduces the
number of participating municipalities to three, one less that the original four.
Accordingly, the Joint Computer Systems Agreement is dissolved.
Article XIII further provides that upon dissolution. the assets and liabilities
are to be distributed, based upon each municipalities proportionate share of
Class Two payments,, as that term is defined in Article XD of the Agreement,
over the previous three year period.
We would like to arrange a meeting on Thursday, January 24, 1980
at 10: 00 A.M. here at Village Hall to discuss the most expeditious
procedure for implementing the dissolution of the Joint Computer Systems
Agreement and arranging for the distribution of the assets and -liabilities of
the system. Please let me know whether you will be able to attend the

Ms. Barbara Baran, Legal Counsel for the Village, presented results of an
investigation relative to eas'*ements, Ms, Baran expressed the opinion
that perhaps the Village of Elk Grove and the Illinois Toll Road
authorities would have a large share of the rezpons*1,,b,il,1ty for the
maintenance of the drainage ditch between llots� 35 and 36. It was
suggested by Counsel that a meeting be arranged betweentheVillage of
it Prospect and the variou's authorities (Tollway authorl*ti6s,, E lk
Grove Village, and the Homeowner's Association) to address the problem
as under Illinois law they share some accountabj!litv. Chairman Farley
stated that the administrative staff should schedule and arrange a
meeting as quickly as possible and bring it ba,6k to the Committee at
a future date for disposition,
A resolution is being requested by the Cook County Highway Department
and an indemnification statementrelative to three trees -planted on'the
south side of Camp McDonald Road west oftheintersection of Route 83.
The County takes the position a,,re.solution J s, required to absolve them
of any future maintenance problem. Trustee Farlev and Trustee Miller
agreed with the staffls recommendation,

The Public Works Committee was given a list of all meters and charges
made. to residents since 1960 for installation of remote reading registers.
The Committee was informed that there is onlymarginalsudcess on a
straight postcard program and that the.administration is requesting
additional time for evaluation. Chairman Farley and Trustee Miller
concurred on -holding this matter over for a future Committee meetinq.,
BLACKHAWK SUB-rN WATER SUPPLY
The Committee was advised that there has been initial action taken by
the residents of the Blackhawk Sub -division to install a water distribu-
tion system. There 'is strong interest in setting up a Special Service
District as a means of financing the project, Chairman FdVley and
Trustee Miller concurred with the concept,
