The recommendat-lon of the Safety Commission coming

from their October 5th meeting was presented.

moved to concur with the recommendation of the
Safety Commission to amend Chapter 18 by deleting
the No Parking restriction on Gregory Street
Between Elm and William Streets. (Schedule IX)

SEMAR'S SUB.

(Map 11-S) had submitted a request to the Planning
Commission to grant variations from their proposed
development and from various sections' of the
Development Code.
The Planning Commission recommended the following-,
1. Public sidewalks be installed on Lots 3,
4, 5, and , except for a reasonable
driveway area in order t,o facilitate
access for trucks and Cather 'eq' U ipment
during construction.

Mr. Burghard announced that representatives from
P.,W. RODEO
the Village's Public Works Department participated
in the Ist Annual Public Works Rodeo, held at the
Arlington Race Track. The contest was to determine
accuracy, including It being a timed event, of the
snow plow operators. Forty-three communities
participated in this eon est and the Village of
Mount Prospect placed 4th.
ANY OTHER BUSINESS
Mayor Krause reminded the Board members that a
MEETINGS:
meeting is scheduled for November 19th at the
INGOVERNMENTAL
Senior Citizen with various elected boards from
park districts, school districts, etc.
The Northwest Municipal Conference will hold a
SOLID WASTE
meeting to discuss solid waste on November 24th.
It was announced that the RTA has reinstated
RTA ROUTE 332
Route 332, which travel from Sandhurst on Elmhurst Rd.
to Bensenville and back.
It was also announced that the Governor has approv-ed
the homestead exemption from $3,000 to $4,500.

''RESOLUTION STATING MUNICIPAL POLICY
--REGARDING PALWAUKEE AIRPORT
WHEREAS, the communities of Wheeling and Prospect Heights are
consi ening currently the public issue of the future development
and direction of Palwaukee Airport; and
WHEREAS, this issue has significant impact upon the residents
and neighborhoods of the northeast section of the Village of
Mount Prospect; and
WHEREAS, the Mayor and Board of Trustees of the Village of
Mount Prospect have received a petition from its residents
which states in part "... While we do not oppose the airport
as it currently exists, we do strongly oppose the potential
expansion of operations."; and
WHEREAS, the Village of Mount Prospect did sponsor an information
exchange regarding Palwaukee Airport inviting representatives
of the Airport, the Consulting Engineer, and interested citizens;
and
WHEREAS, the information and ideas discussed at this meeting,
together with reference material produced by the Airport study,
highlight certain considerations of safety and the future
enjoyment of life and property for residents and business
in the area.
NOW3 THEREFORE,, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUY,ILLINOIS:
SECTION ONE: That after due and deliberate consideration of
the facts and opinions of all interests:
1. The Village of Mount Prospect, Illinois, opposes any
expansion of the Palwaukee facility, including the
extension of any runway of any other physical improvement
that would permit flight capability for any type of
aircraft larger than present operations.
2. The Village of Mount Prospect, Illinois, recommends that
Palwaukee Airport, its owners, and any supervising agency
implement effective and enforceable noise control
measures; including the immediate prohibition of additional
turbo -jet operations; the requirement that existing
turbo -let owners retrofit their aircraft by 1984 to
utilize the more fuel efficient and quieter turbo -fan
engines; and that an operations curfew be established
between the hours of 11:30 P.M. and 6:30 A.M.
3. The Village of Mount Prospect, Illinois, urges the
Federal Aviation Administration to establish and enforce
air control activities prohibiting flight patterns near
schools and other population concentrations so as to
reduce the risk of a castastrophic incident.
SECTION TWO: That copies of this Resolution be submitted to
the Village of Wheeling, the City of Prospect Heights, the
Northwest Municipal Conference, the Federal Aviation Administration,
and our area Congressional Representatives and Senators.
SECTION THREE: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.

RE: XYTEL CORPORATION
DATE: NOVEMBER 25, 1981
Attached is Xytel Corporations "Five Year Projection of Funds Provided
and Used for Years 1982-1986." Basically the bottom line indicates
Xytel's cash and certificates balances on January 31 for the years
1982 to and including 1986.
A review of Xytel's financial statements for the six months ended July
31, 1981 indicates:
- Customer deposits of $492,920 exceeds Xytels offsetting cash
($406,462) -'and inventory ($35,480) by $50,978 which would seem to
indicate that deposits received from newer orders were used to
complete older jobs;
Six months sales of $880,517 with accounts receivable of $458,671
indicates sales are laying in accounts receivable for about 94 days
before being collected.
Financial statements cannot be added forward from the January 31, 1981
year end federal income tax return. This possibly could cause some
problems when Xytel is to file the federal income tax return for
year ended January 31, 1982. It may explain the increase of
approximately $90,000 in income tai liabilities for the six months
ended July 31, 1981 on taxable income of $95,333.

THIS MEMORANDUM OF AGREE14ENT, made and entered into this
day of 1981, by and between THE
VILLAGE OF MOUNT PROSPECT, a municipality in Cook County, Illinois
(the "Issuer") and XYTEL CORPORATION,. an Illinois corporation (the
"Corporation").
W I T N E S S E T H:
WHEREAS, the Issuer is authorized under its home rule
powers as set forth in the 1970 Consititution of the State of
Illinois, Article VII, Section 6, and the provisions of Ordinance
No. 2925, adopted by Issuer on July 17, 1979 as from time to tiTJe
supplemented and amended Cthe "Ordinance") to issue economic
development revenue bonds for the

or in part, the cost of the acquisition, purchase, construction,
reconstruction, improvement, equipi-ng, betterment or extension of
any economic development project in order to relieve conditions
of unemployment, and to encourage the economic development of
the municipality and to provide for the increased welfare and
prosperity of th.e residents of the municipality; and
VTHEREAS, pursuant to said Ordinance the Issuer is willing
to issue its economic development revenue bonds, in accordance with
the provisions of the Ordinance, and to make the bond proceeds
available to the Corporation or its designee, to finance the cost -
of acquiring the necessary land and of constructing and equipinq
an industrial building (said land acquisition, building construction
and equipment to be hereinafter referred to as the "Project") to be
located on a site within the corporate limits of the Issuer, in an

area commonly known as Rauenhorst Industrial Develop-.-t-ient Area and

legally described as follows:
Lot 206 and the North 24 feet of Lot 311 in Kensington
Center Phase Three A, being a subdivision and re -sub-
division in part of the Northwest Quarter and the
Northeast Quarter of Section 35, Township 42 North,
Range 11 East of the third Principal Meridian in
Cook County, Illinois.
Pursuant to a Loan Agreement to be entered into between the Issuer
and the Corporation and subject to the conditions set forth belowo
and
WHEREAS, the Corporation wishes to locate the Project
within the territorial limits of the Issuer and wishes to obtain
satisfactory assurance from the Issuer that the proceeds of the
sale of the Issuer's revenue bonds would be made available to the
Corporation or its designee to finance the cost of the Project:
NOW, THEREFORE., in consideration of the premises and of
the mutual undertakings herein expressed, the parties hereto
recognize and agree as follows:
A. The Issuer represents and agrees:
1. That the Issuer will, subject in all
respects to the conditions contained
herein, to the provisions and require-
ments of the Ordinance and of all
applicable laws and to the sale of
the bonds and terms satisfactory to
the Issuer in its sole judgment reasonably
exercised, authorize, issue, sell and
deliver its economic development revenue
bonds (the "Bonds") in a principal
amount not to exceed $2,000,000.00 and
apply the proceeds therefrom to
finance the cost of the Project, provided
that prior to the issuance and delivery
of such Bonds:
(a) There shall have been entered into
between the Issuer and the Corporation
a Loan Agreement which will comply
with the provisions of the Ordinance
and which will provide for loan re-
payments by the Corporation sufficient
to pay to the principal of and interest
on such Bonds as and when the same
become due, and which will otherwise
contain terms and conditions sat-
isfactory to the Issuer and its
counsel.

(b) There shall have been entered into
by Surjit S. Randhava and Sarabjit
S. Randhava a written, personal and
unconditional guarantee guaranteeing
to the Issuer and the bond holders,
or a nominee thereof, 'the payment
of principal and interest on the
Bonds so long as they or any
portion of said Bonds shall be
outstanding, together with all costs
and expenses incur red in the coll-ection
thereof, which guarantee shall be
satisfactory in form and substance
to the Issuer and its counsel; and
(c) There shall have been entered into
by the Corporation, or its nominee
or nominees holding title to the
said described real estate a first
mortgage lien on the real estate
and building comprising the Project,
securing to the Issuer and the bond
holders or their nominee, the pay-
ment of said Bonds and the principal
and interest thereon as the same
shall be so long as such Bonds or
any part thereof shall be outstanding,
together with all costs and expenses
incurred in the collection thereof,
which mortgage document shall contain
terms and conditions satisfactory to
the Issuer and its counsel; and
(d) The Corporation shall furnish to Issuer
an ALTA form of Lender's Title Insurance
issued by the Chicago Title Insurance
Company or, in the case of land regis-
tration, a Mortgagees Duplicate
Certificate of Title issued by the
Registrar of Torrens Titles in the
amount of $2,000,000.00 insuring or
otherwise certifying to the registration
of the said mortgage upon the land and
building comprising the Project to be
free from mechanic liens, other mortgages
or security interests, judgments or tax
liens other than general taxes for the
current year, and from any other claims
or encumbrances which would adversely
affect the said mortgage and subject
only to easements, covenants, restric-
tions, and in building setback lines
of record; and
(e) The Corporation shall execute and furnish
to Issuer and bond holders or their
nominees such UCC security statements
covering the equipment which comprises
part of the Project covering any beneficial
interest of the Corporation or its
principals in or to the land, building
and equipment comprising the Project,
as may be deemed necessary by the Issuer,
the bond holders or their nominees; and

(f) The Corporation shall furnish the
Issuer with a written ooinion of
a bonding counsel as to the validity
of the power, authority and actions
of the Issuer regarding the issuance
and sale of the Bonds, the exemption
of interest paid on said Bonds from
Federal income taxation, and the
compli,ance by :rssuer with al,l 'Flederal,
State and Local laws pertaiin,ing to
the s,ub*ect bond issue, whi p

shall ;be sati'sfactory in form and
content to the Issuer and its counsel;
and
(9) The Corporation shall furnish Issuer
with a written opinion of the Corporation's
counsel that the Loan Agreementr Mortgage,
personal guarantee and other documents
executed by the Corporation are valid
and legally enforceable obligations of
the Corporation duly authorized by
proper corporate action, and, with
respect to personal guarantee, that
such is a legally binding and enforceable
obligation of the persons executing the
same; and
(h) The Corporation shall have paid any and
all costs, fees and expenses charged or
incurred by the Issuer and its counsel
in connection with the Project, the
review, processing and preparation of
the pertinent documents required for the
issuance of the Bonds herein, and the
financing of the Corporation's Project,
including costs and expenses of attorneys,
fees, financial consultants' fees for
opinions of counsel, and any or all other
.costs and expenses of the Issuer incurred
in connection with the Tiro ject and the
issuance of Bonds to finance the same; and
(i) The corporation shall furnish Issuer with a
fire and extended coverage insurance policy
insuring the Project and the Issuer's mortgage
interest therein during the entire period when
Bonds are outstanding; and
(j) The Corporation shall further furnish the
Issuer with such audits or other financial
data of the Corporation certified to by a
certified public accountant, as may be
required by the Issuerf and the Corporation
shall furnish all other documentation which
may be required pursuant to this Memorandum
of Agreement and all documentation relating
to the issuance and sale of the Bonds as may
be required by the bond holders or bond counsel.
2. That the Issuer will, at the proper time and subject
in all respects to the prior advice, consent and
approval of the Corporation, and in response to the
completion, by the Corporation of the undertakings
so specified for it in this Agreement, adopt, or
cause to be adopted, such proceedings and authorize
the execution of such documents as may be necessary
and advisable for the authorization, issuance, and
sale of the Bonds and the land acquisition, con-
struction and equiping of the Project, as aforesaid,

and the payment by the Corporation or its designee
to or on behalf of the Issuer of sums sufficient
to pay the principal and interest and redemption
premium, if any, on the Bonds as and when the
same become due and payable.
The Corporation represents and agrees:
1. That the Project will result in increased employment
and will increase the economic development within
the municipality.
2. That it will use all reasonableefforts to -find
purchasers for the Bonds.
3,. That if the Proposed Bonds (including the rate
of interest thereon) of the Issuer are satisfactory
to the Corporation, that it will, upon delivery
of the Bonds, enter into an Agreement with the
Issuer upon terms which will be sufficient to
enable the Corporation to pay the costs of the
Project as evidenced by the B,ond,s to be issued
for the account of the project, whereby the
Corporation will obligate itself to pay to
the Issuer sums sufficient in the aggregate to
pay the principal and interest and redemption
premium, if any, on the Bonds, as and when the
same shall be due and payable.
4. That it Will 'accomplish the undertakings set
forth in Section A 1 (a) through ( j ) hereof
prior to the issuance and delivery of any
such Bonds by the Issuer.
C- It is further generally provided, recognized and
agreed between the Issuer and the Corporation as
follows:
3. That all commitments of the Issuer under Section
1 hereof and of the Corporation under Section 2
hereof are subject to the condition that on
or before 365 days from the date hereof (or
such other date as shall be mutually satis-
factory to the Issuer and the Corporation),
the Issuer and the Corporation shall have
agreed to mutually acceptable terms and
conditions of the Loan Agreement and of the
Bonds and the other documents or proceedings
provided for herein or otherwise relating
to the Bonds. The decision not to approve
or agree to any term or condition of any
document or not to take any action prior
to issuance of Bonds shall rest solely within
the complete discretion of the parties to
this Agreement.
2. If the events described above in paragraph 1
of this Section do not take place within the
time set forth or any extension thereof and
the Bonds in -the amount of approximately
the amount stated above are not sold within
such time, the Corporation agrees that it
will reimburse the Issuer for all reasonable
and necessary, direct out-of-pocket expenses
which the Issuer may incur at the Corporation's
request or as a result of or arising out of
the execution of this Agreement pursuant to
the adoption of a Resolution authorizing the
same, including as such expenses, but not
limited thereto, the payment of attorney
and other consultant fees arising from
the preparation and excution of this
Agreement and the Issuer's performance of
its obligations hereunder; and this
Agreement shall thereupon be terminated.
3. The Bonds to be issued by the Issuer shall
never constitute n indebtedness of the Issuer
or a loan of credit thereof within the mea
of any constitut-ional, or sta,tutory provisions'n ing
,j,
and such facts sha,l,l be plainly stated on the
face of each of said Bonds., No 'holder of any
of said Bonds shall ever have the right to compel
any exercise of the taxing pot-ier of the Issuer
to pay said Bonds or the interest thereon.
4. If for any reason the Bonds are not issued,
the Issuer shall in no way be liable in
damages or otherwise, to any party for
such failure of cons uliimation of the financing,
and no -reedy, whether legal or equitable,
shall be instlituted hereunder or under any
other Agreement relating thereto.
5. This Agreement shall inure to the benefit
of the Issuer and .the Corporation, - and this
Agreement may not be assigned of otherwise
transferred by the Corporation.

We enclose herein two Ordinances which amend the tax levy
section's of Village Ordinances3143 and 3144, which Ordinances
were the Bond issue Ordinances with respect to Special Service
Area No. 3 and No. 4.
The reason for this amendment is that subsequent to the
adoption of these Ordinances Dick Houpt and I paid a personal
visit to Art Solomon the head of the Map Department in the Cook
County Clerk's Office. Mr. Solomon is in charge of taking the
properties which are described, by Ordinance, as comprising a
Special Service Area and adding them to the tax roll -s for Special
Service Area tax purposes. ordinarily such Special Service Areas
do not come into effect on the tax rolls until the tax year
following the year in which they are established. However, after
much personal discussion with Mr. Solomon, particularly in
reli'ance upon the fact that the Mount Prosp"e'ct Special Service
Areas comprise only a small number of taxable properties, we were
able to prevail upon him to spread the Special Service Areas for
the 1981 tax year.
Accordingly we are now submitting the enclosed Ordinances
to amend the tax levy provisions of the original Bond Sale Ordinances
to provide for the County Clerk to levy a tax for the 1981 tax year.
Would you please see that these two Ordinances are added to
the agenda for the meeting of December 1, 1981 with our request

In the event that by reason of a delay in the collection
of taxes in said Village, proceeds of taxes hereby levied
are not available in time to meet any payments of principal
and interest upon said bonds, then the fiscal officers
of the Village are hereby directed to make such payments
from any current funds of the Village that are available

taxes herein levied and when the proceeds of such taxes
herein levied are received said funds shall be reimbursed.

Re. Supervision as an Alternative Penalty
in Ordinance Violations
Dear Terry:
A recent Illinois Appellate case has indicated that
supervision as provided for in the Illinois Statutes is an
inaApr opriate sentence in ordinance violation cases. The judges

of the Third District have continued to grant supervision in
"inance cases 'in spite of that decision. As the Village
ora
prosecutor, I ami, placed in 'the position of eltber insisting upon
adherence to the Appellate Ccur,�,-- ruling or continuing to "go
along with" the supervision orders. The first opt,ion, is not
very satisfactory because I fear that the judges will then
simply make findings of not guilty to avoid having the
consequences of conviction visited upon the defendant. The
second option is 13".'kewise unsatisfactory becau,se. eventually a
class action suit will be filed, based upon the improper order of
supe.rvision. The suit will undoubtedly request a refund of c-11
fines collected under such improper orders. A third alternative
would be for the Village of Mount Prospect to adopt an ordinance
which permits supervision as an alternative penalty. This
ordinance would be similar to the Illinois Statute which permits
supervision for state offenses. I have enclosed a draft of such
an ordinance for your consideration. Also, please find enclosed
a copy of a memo which I submitted to Jerry Bratcher a nuri-,,ber of

years ago with regard to supervision. As you can surmise from
the tenor of that memo, I am less than satisf ied with the way
supervision is presently handled. Our ordinance would address
some of the problems. For instance,, except in very unusual
circum stances, a Person would be subject to a minimum $25.00
fine, exclusive of court costs if a supervisory order is
entered, Further, if the court is considering supervision as an
alternative sentence, the defendant would be required to testify
under oath as to his or her past record.

for a supervision order. I have reviewed the correspondence supporting
this Ordinance amendment, and I am quite familiar with the problems
which are discussed, and I know that they exist and do create an un-
comfortable situation.
Accordingly, it is my view that this Ordinance is proper, and
is a valid exercise of the Village's Home Rule powers. It is my rec-
ommendation that the Village Code be amended to provide for the use
of supervision in Ordinance Violation cases. By so doing, the judges
of the Circuit Court of Cook County would be allowed to legally carry
on the practice of extending supervision in these kinds of cases.

AN ORDINANCE AMENDING CHAPTER 24, ARTICLE I OF
THE VILLAGE CODE OF THE VILLAGE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS. -
SECTION ONE: That the Village Code of the Village of Mount
Prospect, Illinois,, as amended, be and the same is hereby
further amended by adding a new subsection "C" to Article I
of Chapter 24, which new subsection 24.104.C. shall be and
read as follows:
"C.In any case involving a charge of violation of an
ordinance of the Village of Mount Prospect, upon:
1. A plea of guilty;
2. A stipulation by the defendant to the facts
supporting the charge; or
3. A finding of guilt after trial
the Court, in its sole discretion, may defer further
proceedings and the imposition of a sentence, and enter
an order for supervision of the defendant.
In determining whether supervision is appropriate,
the Court shall consider the circumstances of the
offense and the history, character and condition of
the defendant. Supervision shall be ordered if the
Court is of the opinion that:
1. The defendant is not likely to commit further
ordinance violations or crimes-,
2. The defendant and the public would best be served
if the offense were not on the defendant's record-,
or
3. In the best interests of justice an order of
supervision is more appropriate than a sentence
otherwise permitted under the Village Code of
Mount Prospect.
No order of Supervision shall be entered in any matter
where the defendant has previously been placed on
supervision by any Court for any ordinance or statute
violation committed less than twelve (12) months prior
to the date of the instant offense. Under no
circumstances shall any person be placed on supervision
for violation of the Village Code of Mount Prospect if
such person has been previously placed on supervision
for any offenses two or more times.
For violation of any traffic offesne under the
Village Code of Mount Prospect, the Court shall consult
an available abstract of the driving record of the
defendant, or shall question the defendant under oath
w
ith regard to his past driving history. The Court shall

consider the statement of the prosecuting authority

SUBJECT: TAX LEVY AND AUDITOR'S REPORT
The Commission makes no recommendation for reducing the 1981
Tax Levy.
2. AUDITOR'S REPORT
The Commission met with three members of Lester Witte and
Company, the Village aditors, to review the contents of the
management letter prepared in conjunction with the annual
audit. Following are the Commission's comments and recommenda-
tions relating to the report.
The Commission noted that the report does not contain a
qualified opinion which had been included in the report last
year. This was due to the cooperation of Library personnel
and removes an unnecessary, undesirable comment.
The very late completion of the Audit was discussed by the
Commission and there was agreement that this was largely due
to delays by the Village in providing necessary information
because of problems caused by the failure to promptly reconcile
bank accounts. At a Commission meeting three years ago, it
had been.-..7generally agreed that the audit should be available
around September I each year in order to more fully serve
its intended purpose.
Action has reportedly already been taken to correct some of
the weaknesses in procedures outlined by the auditor and one
or two of the comments seemed to be of relatively minor
significance. The Commission did, however, strongly support
the auditor's recommendations regarding the following:
A. ACCOUNT RECONCILIATION
The accountants considered the failure to promptly
reconcile bank accounts to be an important matter.
The Commission concurs with this view and repeats
this recommendation contained in a report to the
Board last October.
The Commission agrees with the accountant's
recommendation that reconciliations be done promptly.
The Commission recommends that arrangements be made
with the bank to provide a sort and listing of checks
for all higher volume accounts in order to reduce the
amount of staff time required and speed up the process.
This can be secured at minimal cost and eliminates
considerable activity which can better be done by
machines.

The Commission agrees with the auditor's views about
the desirability of prompt deposit of cash and checks
received by the Village and repeats the following
recommendation contained in its report to the Board
last October.
The Commission strongly endorses the accountant's
recommendation that the one -day delay in depositing
of receipts be eliminated. Aside from good accounting,
the desirability of increasing the investable funds
is obvious. This also applied to the comment regarding
depositing vehicle and liquor license receipts when
received rather than waiting until the beginning of
the fiscal year. -These simple procedures could increase
investment yield by several hundred dollars annually.
We believe that they should be implemented promptly
without waiting for the completion of the installation
of the computer system.
C. CONTRACTORS' SURETY FUND AND ESCROW DEPOSIT FUND
The auditors reported as follows:
"Numerous old deposits held in trust in both the
contractors' surety fund and the escrow deposit fund
should be reviewed to determine if any amounts should
be refunded.,"
The Commission suggests expanding this recommendation
to include making a special effort to refund these
deposits, changing the present ordinance to enable
any unclaimed deposits to be deposited in the General
Fund after a reasonable time has elapsed and, if
legal and otherwise feasible, immediately transfer
the 'very old, unclaimed funds into the General Fund.

MINUTES CF THE MOUNT PROSPECT FINANCE COMMISSION
NOVEMBER 24, 1981
The Finance Commission meeting was called to order at 8:02 P.M.
Commission"members present: Chairman Ronchetto, Commissioners
Bachhumber, Hallman, Holloway,
and Smilanic. Commissioner
Coventry arrived during the
meeting.
Also present: Village Manager Burghard, Director
of Management Services John Hedstrom,
Village Comptroller Jesse,
Assistant to the Director of
Management Services Tanker, and
Messrs Sa'lasche, Lyons and
Gambrel from Lester Witte and
Company
The first item discussed was the Village's Management Letter
The Commissioners,, staff and auditors discussed all of the
points of the letter, with special emphasis given as follows
1. Bank ReconcIlliations: The Commission noted disappointment
that this was once again mentioned in the Letter. The
staff and auditors stated that the problem was largely
due to the conversion from a manual accounting system to
a computerized one, and that it will not be an Iftem
on the next Letter.
2. Cash Collections: The staff noted that they are
currently making two deposits daily so as to comply
with the intent of the'Management Letter. The
Commission expressed their concern that the days'receipts
were not deposited by 2:30, thus missing the interest
cut-off. Thea staff pointed out various logistic problems
in closing out early enough to meet that deadline, but
nonetheless offered to study the matter further.
3. A general discussion of the Village's purchasing and
approval procedures was held regarding this point. The,
auditors concluded by' stating that all checks (vis-a-vis
the check registers) should be checked and approved one
last time before they are released as a precautionary
measure. The Commission concurred with this recommendatiow.
4., Purchasing: This was discussed as part of
the above item, and the Commission had no particular
comment or recommendation 'regarding this point.

5 & 6 were noted as minor housekeeping items.
7. The staff stated that they did review the old contractor's
surety, and trust deposits but said that it was difficult
to refund the money becausethe contractors are hard to
find, and/or it is difficult to determine in many cases
whether or not the work has been. completed. The
Commission recommended and the staff and auditors
concurred that there should be a clause written into
future contracts enabling, the Village to take over these
funds if they are not claimed within a suitable period
of time. Further, the staff recommended that. the Board
adopt a policy or ordinance enabling the. Village to take
over all of the old deposits currently outstanding.

said had been completed.
10. The Commission felt that good inventory procedures are
important, so as to prevent possible defalcation. The
staff concurred with this assessment.
The final item was explained as another housekeeping item that
was not a very high priority.
After the discussion of these paints, the following motion
was made by Commissioner Hallman, seconded by Commissioner
Holloway:
"To express appreciation that there were no qualifications
to the audit this year; and that bank reconcilliations,
pre--cut--off deposits of daily receipts, signing Gaff on
check registers prior to releasing checks, clarifying
policy on old deposits and a good water parts inventory
were high priority items that should receive immediate.
attention."
Motion was passed unanimously.
The second item of discussion was the computer audit.
The Village Manager explained that,th"e audit was done so as
to catch procedural weaknesses at the very beginning of the
system, before they could cause serious problems.
A general discussion of the computer then ensued, with the
Commission requesting a progress report at some point in
the future.
The last item discussed _was the tax levy.
The. Village Manager explained the fax levy cycle, and the
projections of the Village's estimated cash balance at
year-end. 1982. After a lenthly discussion of the Manager's

comments and the recent history of the tax levy and its
abatement, the Commission requested that the staff provide
them with further information on the tax cycle and its effect
on cash balances for their study.
Commissioner Ronchetto ended the discussion by stating that
they had no recommendation' to abate taxes.
The meeting was adjourned at 10:30 P.M.

Mr. Paul McCall of the Hill Street Development requested
relief from the requirements of Section 16.204 of the
Development Code* This section would require installation
of all sidewalks in the development before the next
Certificate of Occupancy could be issued. Currently, three
buildings have been built in the 18 lot subdivision
although none have had Certificates of Occupancy issued.
The Plan Commission at its November 18, 1981 meeting
recommended that sidewalks be installed upon issuance of
Certificates of Occupancy to 50% of the lots in the
subdivision. All sidewalks would then be required throughout
the subdivision with the exception that a drive opening of a
reasonable width could be graveled so that construction
trucks would not damage the sidewalk,
The Engineering Division of the Public Works Department in
their memo to the Plan Commission stated they would be
willing to abide by any decision of policy by the Plan
Commission and the Village Board. No specific recommendation
was given. Copies of plat of subdivision, Engineering report,
and Plan Commission minutes are attached.

CALL TO ORDER
The Regular Meeting of the Mount Prospect Planning
Commission was held on November 18, 1981, at the
Village Hall, 100 South Emerson Street, Mount Prospect,
Illinois. Chairman Ross called the meeting to order
at 8.-00 P.M.
ROLL CALL
Members present for the roll call were:
Art Brescia, Marie Caylor, Dee Corr, Lynn Kloster,
Tom McGovern, Harold Ross, Louis Velasco, Don Weibel
Absent: Tom Borrelli
Chairman Ross declared a quorum.
Steve Park, Village Planner, was also present.
APPROVAL OF MINUTES
Marie Caylor's motion to approve the minutes of the
November 4, 1981 meeting was seconded by Lynn Kloster
and approved by a unanimous" vote.
SUBDIVISIONS
HILL STREET DEVELOPMENT
Petitioner requests reflief from provisions of the
Development Code requiring completion of sidewalks
on all lots of the subdivision before a temporary
occupancy permit can be issued -for any of the houses.
Art Brescia moved that petitioner be granted a variation
from Section 16.204 requiring all sidewalks in the subdivision
be installed before certificates of occupancy are issued, so
as to authorize installation of sidewalks in the entire
sdbdivision when 50% of the 18 lots -involved have been
completed. Also, that authorization is given for a gravelled
or concreted area of reasonable width be allowed for access
for construction equipment on those lots where construction
has not begun or been completed. This motion was seconded
by Marie Caylor and approved by an 8-0 vote.
COMMITTEE REPORTS
None. Steve Park indicated that he would provide some
suggest changes to the Text Amendment Committee.
