PRO CLMAT ION
WHEREAS, the Mount Prospect Midget Football Association
will be celebrating its Silver Anniversary in 1981; and
WHEREAS, youngsters between the ages of 8 and 13 have
benefited from participation in the Mount Prospect Midget
Football Association for the past 25 years, developing
their awareness of sportsmanship as well as learning the
various aspects of the sport of football and
WHEREAS, apart from registration fees, this Association
is supported entirely by contributions, raised for the
most part by the annual sale of candy; and
WHEREAS, many of our residents donate their time, skills
and belief in our youth by being involved with this
Football Association.
NOW, THEREFORE, I, Carolyn H. Krause, Mayor of the

to the'Mou-fit Prospect Midget Football Association on their
Silver Anniversary and extend our appreciation for the
guidance extended to our young folks by the many
volunteers in this Association.

AN ORDINANCE AUTHORIZING A SPECIAL USE PERMIT
FOR A DAY CARE HOME AT 1904 CHOLO LANE
WHEREAS,, GAY HEWGLY WRIGHT (hereinafter referred to as "Petitioner")
has requested a special use permit to operate a day care home at
a single family dwelling at 1904 Cholo Lane, Mount Prospect,
Illinois (hereinafter referred to as the "Subject Property"); and
WHEREAS, the Subject Property is located in the R-1 Single
Family Residence District acid is legally described as follows:
Lot Thirty Seven (37) in Kusubdivision of Lots 1 to 1.29,
inclusive (except 1,ot 87) in Forest Manor Unit No. 4,
being a Subdivision in the South West Quarter (1/4) and
the South East Quarter (1/4) of Section 25, Township 42
North, Range 11, East of the Third Principal Meridian,
according to Plat of said Resubdivision registered in
the Office of the Registrar of Titles of Cook County,
Illinois, on September 14, 1962, as Document No. 2055506,
in Cook County, Ill.inois; -ind
WHEREAS, Section 14.1101 G of the Zujiing Ordinantl-e of the
Village Code of Mount Prospect provides that a day care home
is a special use in the R-1 Single Family Residence District; and
WHEREAS, a public hearing was held on Petitioners request for
a special use permit to operate a day care home on the Subject
Property, which request is known as ZBA 19 -SU -81, before the
Zoning Board of Appeals of the Village of Mount Prospect on
September 24, 1981, pursuant to proper legal notice published
in the Mount Prospect Herald on April 6, 1981- and
WHEREAS, the Zoning Board of Appeals has recommended to the
President and Board of Trustees of the Village of Mount Prospect
that Petitioners request for the aforesaid special use permit,
ZBA 19 -SU -81, be granted; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that with respect to the
Petitioners request for a spec, ial use permit to operate a day
care home on the Subject Property, that Petitioner has satisfied
the standards for the grant of a special use permit set forth
in Section 14.704 of Article VII of the Zoning Ordinance of
the Village of Mount Prospect and find that it would be in the
best interest of the Village of Mount Prospect to grant
Petitioners said special use permit provided Petitioners operate
such day care home in accordance with any requiremunts of the
State of Illinois for such day care homes and further provided
that Petitioner is licensed to operate such day care home by
the State of Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS.,
SECTION ONE: The recitals set forth hereinabove ave incorporated
as though fully set forth.
SECTION TWO, "The President and Board of Trustees of the Village
of Rount Prospect hereby authorize the issuance of a special use
permit to Petitioners to operate a day care home on the Subject
Property subject to Petiti.eners compliance with the following
conditions:
1. Petitioner must be licensed by the State of Illinois

2. Petitioner shall operate such day care home
I n accordance with any requirements imposed
by the State of Illinois for such day care homes.
3. Petitioner shall operate such day care home in

improved property located at 302 East Northwest Highway in the
Village of Mount Prospect, Illinois (hereinafter referred to as

AN ORDINANCE GRANTING SPECIFIED VARATION FOR
PROPERTY AT 710 DRESSER DRIVE
WHEREAS, Garlene and Douglas Lamb (hereinafter referred to
as "Petitioner") are the owners of a certain parcel of residentially
improved property located at 710 Dresser Drive in Mount Prospect,
Cook County, Illinois (hereinafter referred to as "Subject
Property"); and
WHEREAS, the Subject Property is located in the R-1 Single
Family Residence District and is legally described as follows:
Lot 9 in Town Development Company We -Go Unit No. 1,
being a subdivision of the West Half of the Northeast
fractional quarter of Section 11, Township 41 North,

Each Community Service Officer shall take an oath of office.
Sec. 4.807 Tra i n i ng Requ i red.
Community Service Officers, prior to entering upon any of their duties, shall
receive such a course of training in the use of materials and other police
procedures as shall be appropriate in the exercise of the powers conferred
upon them under this Article. Said course of training shall be developed
and provided by the Chief of Police.
Sec. 4.808 Duties.
a) Community Service Officers shall be assigned, except as specified in
paragraph (b) of this Section, to perform the following duties in the
Police Department, it's units or divisions:
1. Complaint Desk:
Community Service Officers will man the Complaint Desk and perform
their tasks after sufficient training. Including:
a) Answering telephone lines.
b) Assisting the public with questions and complaints.
c) Typing, filing or obtaining police reports and records as needed.
2. Field Operations Division:
A Community Service Officer may, at the discretion of the Watch
Commander or Supervisor and after sufficient training:
a) Complete accident reports of a minor nature.
b) Complete routine reports of a non-critical nature, such as vandal -
ism reports, theft reports with no known suspects, or lost and
found reports.
c) Provide traffic control assistance as requested for accident scenes,
social functions in the Village, and similar situations.
d) Replace school crossing guards or Perform other office duties
that may be. necessary and requested by the Supervisor.
e) Enforce Fire Lanes, overtime, meters, Village license I

3. Animal Control:
In this function, the Community Service Officer shall:
a) Handle inhum.ane animal complaints, bite reports, sick or injured
anim,als, and animal confinement calls.
b) Transport, as needed, impounded or biting animals to the pound

c) Apprehend, where pass ible, stray dogs.

d) Maintain and update a list of all lost and found animals.
e) Perform tasks relating to animal control which are assigned
by appropriate supervisory personnel.
f) Issue citations as necessary to enforce animal control ordinances.
4: Miscellaneous Assignments:
Community Service Officers will perform other tasks in support of
the Police Department within the Village of Mount Prospect. These
will include, but are not limited to:
a) Recovery of found property.
b) Recovery of identified stolen property.
c) Assisting patrol officers upon request.
d) Maintaining a log of recovered bicycles in storage.
e) Serve summons and subpoenas.

Sec. 4.809 Power to Enforce Ordinances.
Community Service Officers shall have the power and duty to enforce the terms
and provisions of the Code of Ordinances of the Village. This power shall be
exercised in confirmity with Rules and Regulations of the Police Department
promulgated by the Chief of Police governing the funcit-ibris of Community
Service Officers.
Sec. 4.810 Promulgation of Rules and Reaulation,s,,.,
The ChiefofPolice shall promulgate Rules and Regulations of the Police
Department governing the functions of Community Service Officers. Said
Rules and Regulations shall establish specific guidelines and procedures
respect to the enforcefnent of the Code of Ordinances of the Village
by Ccmitinity I Service Officers, the performance of those duties delineated
under Section 4.808 the exercise of discretion by the Wa1,cb-('n.-.7,Jander or
Supervilsir in-lbe assiqnt-gent of' duties pursuant to Sect i09 4.808 and such
matters as may be appropriate.
Sec. 4.811
'Duty of, Community Service Officers -10 Appear as Witnesses.
All Community Service Officers issuing citations for the violation of an

ordinance of the Village shall attend as witnesses before the courts where
the trial may be had, and shall procure all necessary evidence in their
power, and furnish a list of witnesses to the court and the Village Attorney.
No Community Service Officer shall be entitled to any witness fees to be
taxed against the Village in any action for the violation of an ordinance
where the Village is plaintiff.
Sec. 4.812 Uniforms.
Community Service Officers shall wear the uniform designated by Police
Department rules, regulations, and general orders. A uniform allowance, as
determined by Village Board through fiscal budget appropriation, may be
provided.
9ec. 4.813 Dbedience to Police Regulations.
Community Service Officers shall be, in addition to Village Rules and Regula-
tions, subject to the Rules and Regulations of the Police. Department in the
same manner as the regular police officers.
Sec. 4.814. Compensation and Benefits.
The President and Board of Trustees of the Village shall determine
through its annual budget, the compensation for Corrmunity Service
Officers, Benefits for Community Service Officers are determined by
the sections set forth in the Personnel Policy Manual. It

Mount Prospect which are in conflict with the provisions of this Ordinance
are hereby repealed to the extent of the conflict.
SECTION THREE: If any sect -ion, subsection, sentence, clause, or phrase of

not affect the validity of any remaining portion of this Ordinance.

Adopted by the Board of Fire and Police Commissioners of the Village
of Mount Prospecit, Cook County, Illinois on
CHAPTER I: ADMINISTRATION
Section]-. Source of Authority.
The Board of Fire and Police Commissioners of the Village of Mt.
Prospect derives its power and authority from an act of the
General Assembly, Division 2.1 of Article 10 of Chapter 24 of
the Illinois Revised Statutes entitled "Board of Fire and
Police Commissioners", as amended, and the ordinances of the
Village of Mount Prospect, Cook County, Illinois, a home rule
municipality under the provisions of Article 7, Section 6 of
the Illinois Constitution of 1970.
Section 2: Definitions.
(a) The word "Board" whenever used, shall mean the Board of
Fire and Police Commissioners of the Village of Mount
Prospect.
(b) The word "Officer" whenever used, shall mean any individ-
ual holding a permanent office as a full time sworn
member of the Fire and Police Departments of the Village
of Mount Prospect as described under the provisions of
the code of Ordinances of the Village of Mount Prospect,
Cook County Illinois, as amended.
(c) The masculine noun or pronoun shall include the feminine,
and the singular shall include the plural.
Section 3: Officers of the Board.
The Board shall annually, at its first meeting in May, elect a
chairperson and a secretary. Said chairperson and secretary
shall hold office for one full year and until their successors
are duly elected and qualified. The chairperson shall be the
presiding officer at all meetings. The secretary shall keep
the minutes of all meetings of the Board in a permanent record
book and shall be the custodian of all forms, papers, books,
records and completed examinations of the Board.

Section 4: Duties of the Board.
The Board shall, in accordance with these rules and regulations
appoint all Officers of the Fire and Police Departments of the
Village through and including:
-I. Police Department: Sergeant --Lieutenant
2. Fire Department: Lieutenant
All positions not indicated above shall, after the effective date
hereof, be exempt from these rules. The Board shall conduct
competitive examinations for original appointment and promotion
in accordance with these rules and regulations and the Board
shall conduct all hearings on charges of a disciplinary nature
against any Officer.
Section 5: Meetings.
(a) Regular meetings shall beheld on the second Monday of each
month, at 7:30 p.m. at the Board Room, 2nd Floor, Public
Safety Building, 112 E. Northwest Highway, Mount Prospect.
(b) Special meetings may be held on the call of the chairperson
or any two Board members, and notice of the date and time
of sa i d meet i ng sha 1 1 be f i I ed in wr i ting wil th the secretary
of the Board and signed by either the chairperson or any two
members thereof, and shall be given to each member of the
Board at least twenty-four (24) hours, prior to such meeting.
The notice shall contain a brief statement of the business
to be submitted for consideration by the Board at such
special meeting, and no other business shall be considered
at such meeting unless by unanimous consent of all members
of the Board.
;ection 6: Quorum.
Two members of 'the Board shall constitute a quorum for the trans-
action of business at any regular or special meeting.
Section 7: Order of Business.
The order of business at any meeting shall be as follows:
I. Approval of the minutes
2. Communications
3. Unfinished business
4. New business
5. Adjournment
Section 8: Rules of Procedure.
The chairperson shall decide all questions of order and in all
cases not specifically provided for by these rules and regulations,
the Board shall be guided by parliamentary law as prescribed in
"Roberts Rules of Order, Newly Revised".
COMMENTS:
Section 9: Motions.
Motions may be made orally by any member of the Board and shall
be recorded in the minutes together with the action taken thereon.
Section 10: Amendments.
Amendments to these rules and regulations, except those provided
by home rule authority of the Mayor and Board*of Trustees, may
be made at any meeting of the Board. All such amendments shall
be printed for distribution and notice shall be given of the
place or places where said rules may be obtained. Such notice
shall be published in a newspaper of general circulation in the
Village of Mount Prospect and shall specify the date, not less
than ten (10) days subsequent to the date of such publication,
when such rules shall go into effect. I
,Section 11: Annual Report and Budget.
The Board-shallsubmit during the month of March, an annual
report of i,ts activities and a budget request for the ensuing
year to the Mayor and Board of Trustees of the Village.-- In said
report, the Board may make any suggestions which it believes will
result in greater efficiency in the Fire and Police Departments.
CHAPTER APPLICATIONS - ORIGINAL APPOINTMENTS
Section 1: Residence.
All members and officers of both the Fire Department and Police
Department shall comply with the following rules of residency from
the time of their original appointment to the Departments until
leaving same:
(a) All probationary firemen of the Mount Prospect Fire Department
and all probationary patrolmen of the Mount Prospect Police
Department shall establish residency within the following
boundaries of the corporate limits of the Village within six
(6) months after receiving their probationary appointment:
Ill. Rte. 64 on the south, the Wisconsin state line on
the north, Ill Rte. 47 on the west, est'. and U.S. Rte. 41 to
.the east until it becomes Ill. Rte. 50, south to Ill.
Rte. 64.
(b) For those members and officers of the Fire Department and
Police Department residing outside the above-described
residency limits, their acceptance into the respective
Departments shall be predicated on the Commission's approval
of the existing residency. The Commission shall reserve
its approval until it has received the advice and consent
of the respective Chiefs and the Village Manager.

Section 2: Application Blanks.
The Board shall furnish application blanks for positions on the
Fire and Police Departments. Application blanks may be obtained
from 4 the Village Hall or by requesting the same in writing from
any member of the Board. The applicant shall furnish, with his
application, a copy of his military_ service record and discharge
papers, if any, together with certified copies of his birth
certificate and transcript of grades.'
COMMENTS:
Section 3: Filing of Applications.
All applicants must file their application with the Board prior
to the taking of the examination for the position for which
application has been made. Applications shall be addressed to
the Board and filed with the secretary or any other person
designated by the Board. The secretary or the designate shall
endorse thereon the date the application was received. All
applications shall be typed or hand printed and signed by the
applicant. Any applicant knowingly making false statements in
an application shall be rejected by the Board, and the applicant
shall be notified of such action. Further, the Board shall
remove any person certified to a position in the Fire and Police
Departments upon learning that false statements have been made
or that material facts have been misrepresented and/or omitted to
the Board.
Section 4: Disqualification.
The Board may refuse to examine or, after examination, to certify
as eligible,, any applicant whom the Board determines:
1. to be physically unable to perform the duties for the
position to which the applicant seeks appointment;
2. to be addicted to the habitual use of intoxicating
beverages;
3. to have been convicted of a felony or any misdemeanor
involving moral turpitude;
4 to have been dismissed from any public service for good
cause;
5. to have pract i ced any decept i on or f raud . i n the appl i cant's
application;
6. to have unsatisfactory character or employment references;
7. to have failed to attend an applicant orientation meeting
as directed by the Board;
8. to have failed to fulfill any of the requirements for
applicants which are set forth in these rules and
regulations;
9. to have suffered the loss of any or any substantial part
of any limb;
10. to be a user of narcotics,, Cannabis Sativa or other
dangerous drugs' as defined in Chapter 56' of the Illinois
Revised Statutes, not legally prescribed to the applicant
by a licensed physician;
11. to have been classified by the local Selective Service
Draft Board as a conscientious objector, or who has ever
been so classified;
COMMENTS:
1'2. to be otherwise unqualified for service in the Police
Department.
Any applicant disqualified hereunder shall be notified by the
Board of such disqualification, and upon written request made
by the applicant within five (5) days of the giving of such
notice, shall be afforded an opportunity to be heard thereon.
Thereafter, the Board shall make a determination and shall notify
the applicant accordingly. All determinations by the Board in
this regard shall be final.
Section 5: Defective Applications.
Applications found by the Board to be defective or incomplete
shall be returned to the applicant for correction or completion,
provided the applicant appears qualified for the position sought
from the face of the application. Such application shall be
corrected or completed and returned to the Board within five
(5) days after the return to the applicant by the Board.
Section 6: Physical Requirements.
(a) Applicants must satisfy the health and physical apptitude
requirements of the physical agility test and medical
examination hereinafter provided.
(b) Applicants must have 20/40 binocular vision, corrective
to 20/20, and shall not be color blind. Contact lenses
for correction are not acceptable for service in the
Fire and Police Departments.
Sect ion 7: Age Requiremen-ts.
All applicants must have attained the age of -21 years., but
shall be under 35 years of age at the time of the last date for
filing applications, except as otherwise provided by the
Statutes of the State of Illinois.
-Section 8: Education.
Applicants for original appointment to the Fire and Police Depart-
ments must possess a high school diploma or its equivalent.
CHAPTER 3: EXAMINATIONS - ORIGINAL APPOINTMENTS
Section I: Release of Liability.
All applicants shall execute and deliver to the Board, a release
in favor of the Village of Mount Prospect, and each of its

officers, agents and employees, relative to all liability, loss
damage or expense that may arise as a result of or in connection
with the applicants participation in a physical agility test
said release to be in the form prescribed by the Board.
Section 2-: Vacancies.
The Board shall fill] vacancies in the Fire and Police Departments
for the class of service under its jurisdiction by competitive
examination and shall as necessary and appropriate prepare and
publish a list of applicants eligible to fill such vacancies.
Section 3: Notice of Acceptance of Application.
The secretary of the Board will notify all applicants whose
applications have been accepted by the Board to present them. -
selves for examination together w1th a licensed physician's
executed certificate attesting that he is physically capable
of participating in a strenuous physical agility test.
Section 4: Notice of Examination.
Examinations shall be held on dates fixed by the Board, and the
date of said examinations shall be advertised in a newspaper
as required by the Statutes of the State of Illinois. Examina-
tions may be postponed by order of the Board. In that event,
said order shall state the reason for the postponement and shall
designate a new date for the conduct of the examination. All
applicants shall be notified of a postponement and of the new
date fixed for the examination.
Section 5: .Phases of Examinations.
All applicants for original appointment as Officers in the Fire
and Police Departments shall participate in ihe following
examination phases:
(a) Written Examination: The subject matter of written
examination shall be such as will fairly test the
capacity of the applicant to discharge the duties of
the position to which the applicant seeks appointment.
No examination shall contain questions regarding the
applicant's political or religious opinions or
affiliations.
I COMMENTS:
(b) Oral Examination: Questions asked of applicants on oral
examination will be such as will enable Board members to
evaluate and grade the applicants on voice, speech,
appearance, alertness, ability to present ideas, judgment,
emotional stability, self-confidence, friendliness and
personal fitness for the position. Each of the criteria
hereinbefore set forth will be graded on a point bas ils of
I to 10 points.
(c) Backaround Investigation: Each eligible applicant shall
submit to fingerprinting by the Police Department of the
Village, and shall provide signed waivers for access to
such records as may be required by the Board to conduct a
complete background investigation in order to certify the
applicant for appointment under the provisions of Chapter
2 Section 4 hereof, prior to certification for appointment.
(d) Physical Agility Test: The physical agility test required
of each applicant as herein provided shall be conducted as
the -Board may direct and shall be uniformly and consistently
applied.
(e) Medical Psychological Examinations: Applicants for original
appointment shall be required, upon notification of pending
appointment, to submit to and pass, (i) a medical examination
by a licensed physician, and, (ii) a psychological
examination by a licensed psychological testing service,
both approved by the Board. Failure to pass either
examination shall result in the elimination of the applicant
from the Eligibility Register and from further consideration.
These examinations shall be conducted within 60 days of
certification for appointment.
(f) Polygraph Examination: Each applicant shall be required to
submit to a polygraph examination. The examination shall be
conducted by a testing service, licensed by the State of
Illinois,'and selected by the Board.
COMMENTS:
Section'6: Minimum Grades.
All applicants for original appointment as police officers or fire-
fighters in the Police and Fire Departments must attain the
minimum passing grade set forth below:
(a) Written and Oral Examinations.
Applicants must first attain a minimum score of not
less than 80 points based upon a maximum obtainable
number of grade points of 100 on the �-jritten
examination phase of the examination process. Said
minimum score shall be exclusive of Veteran and Community
Service Officer (hereinafter referred to as C.S.O.)
preference points as hereinafter provided. The failure
of an applicant to achieve the minimum passing grade as
aforesaid shall disqualify the applicant from
participation in the remainder of the examination
process.
(ii) In addition, all applicants must successfully complete
the following examination phases which shall be graded
on a pass or fail basis:
1. Background Investigation
2. Physical Agility Test
3. Medical Examination
4. Psychological Examination
S. Polygraph Examination
(iii) In addition to the foregoing, all applicants must
achieve a sufficient score on the oral examination
phase of the examination process, which, when averaged
with their grade score on the written examination, will
yield an average grade of not less than 80 points,
exclusive of Veteran and C.S.O. preference points as
herei-nafter provided.
(b) An applicant's final point score shall be the sum total of
the average of his written and oral examinations, plus the
Veteran and C.S.O. preference points, if any, to which the
applicant is entitled as provided by these rules and
regulations.
COMMENTS:
Section 7: Written Examination Procedure.
Each applicant will be assigned a numbered envelope and a card
which shall contain the same number as the envelope and on which
the applicant will write his name and address. At the conclusion
of the written examination the applicant will place the completed
papers and the card in the envelope, sea] the envelope and deliver
it to the secretary or his designate. No signature shall be
placed upon any examination papers. No marks of identification
tending to disclose the identity of the competitors in the
examination shall be placed on the examination papers. Papers of
any applicant violating this rule shall be marked with the
notation "REJECTED UPON ORDER OF THE BOARD''. Applicants who fail
to achieve a grade of 80 points on the written examination will
be eliminated from all further consideration and will be so
notified by the Board.
Section 8: .Finality.
All examination papers shall become the property of the Board and
the grading thereof shall be final and conclusive and not subject
to review by any other board or tribunal of any kind or description.
Section 9: Oral Examination Procedure.
In no event shall fewer than two Board members conduct an oral
examination, and the number of Board members conducting the oral
examination shall be uniform throughout the oral examination
phase of any particular original appointment examination
administered by the Board. Upon completion of each oral inter-
view each Board member who conducted the interview wi I I evaluate
the applicant on each of the factors set forth in Section 5(b)
of this chapter, and will then grade the applicant on the grade
point basis hereinbefore provided. The applicant's final grade
wi I I be the average of the grade point totals given to him by
each of the Board members who conducted the interview.
Section 10: Eligibility Register - Original Appointments.
Within 60 days after each examination, the Board will prepare,
certify and post a list of eligible applicants who have
successfully passed all examinations as herein provided, (said
list shall hereinafter be referred to as an "Eligibility
Register"). Applicants shall take the rank u,pon the Eligibility
Register in the order of their relative excellence as determined
by their point score on the written and oral examinations
determined in the manner hereinbefore provided. The Eligibility
Register will be posted and applicants who are deemed eligible
shall be notified of the posting thereof. Applicants who are
eligible for Veterans orC.S.C.preference consideration shall
make a claim 'to the Board in writing within 10 days after the
posting of the Eligibility Register or such claims shall be
deemed waived. Thereafter, preference considerations will be
dealt with in accordance with the Statutes of the State of
Illinois and these rules and regulations. Thereafter, a
subsequent Eligibility Register, which shall include requested
Veterans andC.S.O.preference points will be prepared, certified
and posted. Applicants will again be ranked in the order of
their relative excellence including in that determination the
additional preference points as hereinbefore provided. This
Eligibility Register shall remain in effect for a period of two
years from the date of posting or until said Eligibility Register
is exhausted. Vacancies in the Fire & Police Departments under the
jurisdiction of the Board shall be filled by applicants listed
on the Eligibility Register.
Section 11: versCadets Preferences.
(a) Applicants for original appointment who were engaged in the
military or naval service of the United States for a period
of at least one (1) year and who were honorably discharged
therefrom, or who are or were on inactive or reserve duty
-in such military or naval service (not including, however,
persons who were convicted by courtmartial or other legal
process for disobedience of orders where such disobedience
consisted of a refusal to perform military service or its
equivalent) shall be preferred for appointment as Officers
in the Fire or Police Departments of the Village.
COMMENTS:
(b) Applicants who are or were employed in the Village Of Mount
Prospect Police Department and are known as C.S.O., and who
have been so employed for not less than 4,160 hours of actual
salaried service within a three year period, shall also be
entitled to preference in original appointments.
(c) Applicants who are 18 years of age and who have successfully
completed two years of study in fire techniques, amounting to
a total of four high school credits, within the Fire Cadet
Program of the Village of Mount Prospect.
Section 121: .0riginal Appointment Preferences and Limitations.
The Board shall give preference in original appointments to those
applicants described in Sectionll hereof, whose names appear
in any register of eligible applicants resulting from an
examination for original appointment as Officers in the Fire and
Police Departments of the Village under the jurisdiction of the
Board, by adding five points to the final grade average that they
obtain as a result of the examination held for original appoint-
ment; provided, however, that an applicant shall be entitled to
the addition of such preference points only once regardless of
whether he qualifies under more than one category of applicants
entitled to preference points as described in Sectionli hereof.
The numerical result thus obtained shall be applied by the
Board in determining the position of each such applicant on any
Eligibility Register which has been prepared as the result of
an examination for original appointment.
Section 13: Appointment of Members.
The Fire Chief or Police Chief shall appoint all officers and
members of the Fire and Police Departments on the basis of a
list of certified eligibles provided by the Fire and Police
Board. The appointments should be made by the selection of
a person who ranks within the top one-third among those eligible
on the list for appointment except when five or fewer names
remain on the list, all five (or fewer) names become eligible
for appointment. The Board shall establish consistent procedures
for updating and renewing the list of certified eligibles,
including the periods of time such lists shall remain in effect.
The Board shall issue certificates of appointment to members and
officers of the Fire and Police Departments vacancies in the
respective departments. Only candidates who shall have passed
the examination established by the Board shallbe certified to
the Fire or Police Chief for appointment. These candidates will
be appointed according to the rules and regulations of the Board.
Upon the successful completion of any prescribed probationary
period, the Board shall place the member or officer of the '
department on a record of certified employees maintained by the
Board. Any person's name shall be stricken from the eligibility
list upon attainment of the age of 36 years as an applicant as
a Fireman/Paramedic and no person shall be appointed as a Fireman/
Paramedic after have attained the age of 36 years*, except as
otherwise provided in this ordinance. Any person's name shall
be stricken from the eligibility list upon attaining the age of
36 years as an applicant as Police Officer, and no person shall
be appointed as a Police Officer after having attained the age of
36 years, except as otherwise provided in this ordinance.
Section 14: Probation.
All original appointees to the Fire and Police Departments shall
be appointed on a probationary basis. The term of each appointee's
probationary status shall commence on the date of the appointee's
original appointment to the Fire and Police Departments and shall
continue for a period of two (2) years from and after the date
of the appointee's certification as hereinafter provided.
COMMENTS:
Section 15: Certification.
(a) Certification of probationary Police Officer status shall
be made by the Board upon an applicant's successful
completion of the basic training program as provided by the
Illinois Governmental Law Enforcement Officers Training
Board within six (6) months of the applicant's original
appointment. The failure of an applicant to successfully
complete said course within said time shall result in his
dismissal.
Final certification of 'probationary firemen/paramedics shall
be subject to successful completion of the Certified Fire-
fighter Basic Training Course, Emergency Medical Technician
and Paramedic programs, as prescribed by the Illinois Fire
Protection Personnel Standard and Education Commission within
the prescribed probationary period. Applicants shall be
dismissed if unable to successfully complete these courses.
Section 16: Offer of Appointment.
Any candidate eligible for appointment under these rules may one
time decline an appointment tendered upon giving reasons in
writing satisfactory to the Commission, without losing his position
in the Register of Eligibles except to give way to the next
eligible. If the reasons assigned are not satisfactory to the
Commission or, if no reason be given and the eligible does not
accept appointment within seven (7) days after it is tendered to
him, then his name shall be removed from the Register of Eligibles.
Section 17-. Emergency Appointments.
The Commission may make such temporary appointments as it shall
deem necessary to protect the health, safety and welfare of
Mount Prospect when it determines an emergency need exists. In
the case of a strike, walk -out "blue -flu" or similar job
interference, such appointments shall extend for sixty (60)
days with such'thirty (30) day renewals as the Commission, upon
convening the Board, shall determine to be necessary.
Section 18: Oath of Office.
Prior to commencing duty as an Officer in the Fire and Police
Departments, an applicant shall take such oath and enter into
such bond as is prescribed by the Ordinances of the Village and
the Statutes of the State of Illinois.
CHAPTER 4: EXAMINATIONS - PROMOTIONS
Section I Establishment of Examinations.
The Board shall in accordance with these rules and regulations
provide for promotions in the Fire and Police Departments on
the basis of ascertained merit and examination, and shall provide
in all cases wherein the Board retains jurisdiction, that
vacancies (other than in cases of original appointments) shall be
filled by promotional examination. All examinations for promotion shall

le be competitive among such Officers as desire to submit themselves
to such examination. In the event that the Board determines that
no Officer participating in the examination process is qualified
for promotion under the standards hereinafter provided, or in the
event, that no Officer elects to participate in said promotional
examination, then in that event the Board shall have the option
of extending the examination process to the general public,
provided however, that all Officers who desire to submit them-
selves to said examination shall again be provided an opportunity
to participate in said examination. All candidates for promotional
examination shall conform to the application and qualification
reauirements, heretofore provided for original appointments in
Chapter 2 hereof, as pertinent.
Section 2: Notice of Examination.
Promotional examinations shall be held on dates fixed by the Board,
and the date of said examinations shall be advertised in a
newspaper as required by the Statutes of the State of Illinois.
Examinations may be postponed by order of the Board, in which
event, said order shall state the reason for the postponement
and shall designate a new date for the conduct of the examination.
All candidates shall be notified of a postponement and of the new
date fixed for the examination.
Section 3: Examination Grading Process.
In order to be eligible for promotion, candidates must first attain
a minimum passing grade of 80 points on a written examination
(based upon a grade point system of up to a maximum of 100 points).
Any candidate who fails this pre-screening test will not be allowed
to continue in the testing process. In order to be eligible for
promotion, succesful candidates must then attain an average
minimum passing grade of 80 grade points on a written and an oral
examination. (Assessment Center Process)
Promotional candidates shall then be graded in accordance with the
following weighted formula:
I. Written Examination Score: Raw score multiplied by 40%.
2. Oral Examination Score: Raw score multiplied by 30%.
3. Departmental Merit and Efficiency Rating as determined by the
departmental evaluation system of the Fire or Police Departments
of the Village. (Based upon a grade point system of up to a
maximum of 100 points): Raw score multiplied by 30%.
In the event the Board deems it necessary to extend the
examination process to the general public, then said examination
shall be administered as hereinbefore provided, except that those
members of the general public participating in said examination
process shall not be entitled to consideration for Departmental
Merit and Efficiency, as hereinbefore provided.
COMMENTS:
Section 4. : Written Examination.

which the candidate seeks promotion. No examination shall
contain questions regarding the candidate's political or

(a) Content of Oral Examination
Questions asked of candidates on oral examinations will be
such as will enable Board Members and/or their designee(s)
to evaluate and grade the candidates on the following
criterion:
1. Leadership ability;
2. Administrative skills;
3. Commun'ication skills;
4. Ability to function satisfactorily in emergency situations;
and
5. Ability to supervise subordinates and to perform duties
and fynctions in conformance with the established goals
of the Fire or Police Departments.
Each of these criteria will be graded on a point basis of 1 to 20
points.
(b) Oral Examination Procedure
Upon completion of each oral interview each Board member and/
or their designee(s) who conducted the interview will evaluate
the candidate on each of the criteria set forth in Section 5(a)
of this Chapter, and will then grade the candidate on the
grade point basis set forth in said Section. The applicant's
f inal grade wi 11 be the average of the sum total of the grade
point totals given to him by each of the Board members and/
or their designee(s) who conducted the interview.
COliMENTS:
Section 6: Service Requirements for Taking Promotional Examination.
All examinations for promotion shall be competitive among such
Officers of the Fire and Police Departments who shall have
completed their probationary period as hereinbefore provided in
Section 14 of Chapter 3, prior to the date on which the examination
i's conducted, a,nd shall have completed one full year of service
in 'therank held after completing said probationary period.
Provided, howeve'r. that said limitation shall not apply to those
Officers of the Fire and Police Departments cert if i ed by the Board
as full time Fi rent en/Paramed i cs and Police Officers prior to
the effective.date of these rules and regulations.
'Section 7: Eligibility Register - Promotions.
Within 60 days after each such promotional examination, the Board
shall prepare, certify and post an Eligibility Register of
candidates who shall be ranked in the order of their relative
excellence, as determined by the examination process and the
application of Departmental Merit and Efficiency considerations
if any, as hereinbefore provided. An average grade of 80 points
on the oral and written examinations shall be required for listing
on said Register. The Eligibility Register shall be posted and
candidates %.jho are deemed eligible shall be notified thereof.
Thereupon, veterans preference considerations will be applied in
accordance with the Statutes of the State of Illinois. Thereafter,
a subsequent Eligibility Register including requested veterans
preference points, will be prepared and posted and the same shall
remain in effect for a period of two years from the date of posting,
unless said Eligibility Register is exhausted prior thereto. The
Board shall certify a list of eligible candidates for promotion
to the Fire or Police Chief upon their request. The Commission
shall establish consistent procedures for updating and renewing
the list of certified eligibles, including the periods of times
such lists shall remain in effect. The Fire or Police Chief shall
appoint a candidate from the list of eligibles. All promotions
shall be made from the three (3) candidates having the highest
ranking on the Eligibility Register as then construed. -
Section 8: Probationary Period.
Any candidate promoted by virtue of the examination process -shall
be classified as on probationary status for a period of one (1)
year following his promotion. The probationary period will
terminate automatically at the expiration of said one (1) year
period, unless the Fire or Police Chief certifies to. the Board
that the probationary officer has not performed his duties
satisfactorily during that period. In that event, the Board shall
be governed by the procedures for demotion as set forth in
Chapter 5 hereof.
COMMENTS:
CHAPTER 5: DISCIPLINE

Section 1: Demotion.
(a) Upon certification by the Fire or Police Chief to the Board
that a promoted Officer has not performed his duties in a
satisfactory manner, said Officer shall be notified in writing
by registered mail or personal service of such certification
and shall be requested to appear before the Board at a specified
time and place for a hearing relative to said certification.
The time for the hearing on said certification shall be set
by the Boa rd wi th i n 30 days of the t i me of the f i I i ng of such
certification with the Board by the Fire or Police Chief.
An Officer so certified shall be given an opportunity to be
heard in his own defense at said hearing.
(b) The Board may demote any Officer previously promoted from a
lower rank with reduction in compensation to a rate not
exceeding the maximum rate of such lower rank, upon a finding,
after hearing, that said Officer is deficient in the
performance of his duties in any one or more of the following
areas:
1. Leadership ability
2. Administrative ski I Is
3. Communication skills
4. Ability to function in a satisfactory manner in emergency
situations
5. Ability to supervise subordinates
6. Ability to perform duties and functions in conformance
with the established goals of the Department.
(c) Any Officer of the Fire or Police Department, probationary or
otherwise, may request and/or consent to a demotion to a lower
rank subject, however, to the concurrence of the Board.
Demotion shall result also in a reduction in compensation to
a rate not exceeding the maximum rate of such lower rank.
Section 2: Suspension.
The Fire or Police Chief may suspend without pay any Officer of the
Department for a period not to exceed five (5) days. The Board shall
be notified in writing of all such suspensions. Any Officer so
suspended may appeal in writing to the Board for a review of the
suspension within 24 hours after such suspension. Upon such an
appeal, the Board may sustain the action of the Chief. may reverse
said action with instructions that the Officer receive his pay for
the period involved, may suspend the Officer for an additional
period of not more than 30 dayt, or may discharge the Officer, as the
Board may in its discretion determine.
,Section 3: Discharge.
An Officer holding a position in the Fire and Police Departments shall be
removed and discharged from service in the following manner:
COMIMENTS:
(a) The Board may suspend any Officer against whom charges have
been preferred pending investigation of the charges by the
Board, said suspension not to exceed 30 days without pay at
any one time.
(b) Charges shall be preferred in writing and signed by the party
making the same, and shall be filed with the secretary of the
Board. The charges shall specify the nature of the infractions
alleged and shall designate the time and place the alleged
infractions occurred.
(c) The Officer so charged shall be notified in writing by
registered mail or personal service of the charges and shall
be requested to appear before the Board for a hearing on the
charges at a specified time and place. An Officer so charged
shall be given an opporutnity to obtain counsel and to be
heard in his own defense at a public hearing to be conducted
by the Board.
(d) The Board shall within 15 days after said hearing is completed,
enter its findings and orders on the record, post the same in
a conspicuous place and notify each interested party by
certified mail.
(e) In the event the Officer shall be found guilty of the charges
preferred against him after investigation by the Board and a
hearing on the same all as herein provided, he may be censured
by the Board, suspended for an additional period not exceeding
30 days without pay, or discharged.
CHAPTER 6: GENERAL
Sect ion 1. Rules.
All Officers of the Fire and Police Departments shat I be governed by
these rules and regulations and the rules and regulations of the
Fire and Police' Departments. Any conflict between these rules and
regulations and the rules and regulations of the Fire and -Police
Departments shall be resolved by the application of these rules
and regulations. Each rule passed by the Board of Fire and Police
Commissioners and each section thereof is an independent rule. The
holding of any rule or section to be void, invalid or ineffective
for any reason does not affect the validity of any other rule or
section,

iect ion 2: Political Contributions.
No Office of the Fire or Police Department shall be under any
obligation to contribute to any fund or to render any political
service or be removed or otherwise prejudiced for refusing to do
so. No member of the Fire or Police Department shall discharge,
promote or reduce, or in any manner change the official rank or
compensation of any other Officer is such service, or promise or
threaten to do so, for withholding or refusing to make any
contribution of money or service or any other valuable thing for
any political purpose, or in any other manner directly or indirectly
use his official authority or influence to compel assessment,
subscription, contribution or service for such purposes.

Section : Political Activities.
No Officer holding a position in the Fire or Police Department of
the Village shall use his official authority or influence to
coerce the political action of any person or body, or to interfere
with any election, or take any active part in a political campaign,
or seek or accept nomination, election, or appointment as an
officer of a political club or organization or serve as a member
of a committee of such club or organization, or circulate or seek
signatures to any petition provided for by any primary or election
law, or act as a worker at the polls, or distribute badges, color
or indicia favoring or opposing a candidate for election or
nomination to a public office . , whether federal, state, county or
municipal. However, nothing in this Section shall be construed
to prohibit or prevent any such officer from becoming or continuing
to be a member of a political club or organization or from
attendance at political meetings, or from enjoying entire freedom
from all interference in casting his vote, or from expressing
privately his opinions on all political questions.
Section 4: Violation of Law.
Any violation of the laws of any municipality or state, or federal
law or of these rules and regulations, or the rules of the Fire or Police
Department, by any Officer of the Fire or Police Department shall
be cause for the filing of charges against said Officer, and for
disciplinary action as provided herein.
Section 5: Effect.
These Rules and Regulations supersede and replace all Rules and
Regulations previously issued by the Board of Fire and Police
Commissioners. These Rules and Regulations shall be in full force
and effect ten (10) days after their passage and publication as
herein provided.

home rule municipality under the provisions of Article 7 Section 6 of the
Illinois Constitution (1970); and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect find that the continuity of administration and management of the
Mount Prospect Fire and Police Departments is a matter concerning the local
government and affairs of the Village; and
WHEREAS, the President and Board of Trustees of the Village find that the
powers, authority and duties granted to the Board of Fire and Police
Commissioners of the Village of Mount Prospect pursuant to Division 2.1 of
Article 10 of Chapter 24 of the Illinois Revised Statutes are insufficient
to provide effective administration and management of the Mount Prospect
Fire and Police Departments, and
WHEREAS, the President and Board of Trustees find that the grant of
additional powers, authority and duties to the Board of Fire and Police
Commissioners will facilitate the effective administration and management
of the Mount Prospect Fire and Police Departments, and I
WHEREAS, the President and Board of Trustees deem the passage of this
Ordinance to be in the best interest and in furtherance of the health,
safety and general welfare of the Village of Mount Prospect and its citizens.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Mount Prospect, Cook County, Illinois, a home rule
municipality in the exercise of its home rule powers, that:
SECTION 1: The provisions of the preamble hereinbefore set forth are
hereby restated herein as though herein fully set forth.
,SECTION 2: Chapter 5, Article 7, Section 5-704 of the Code of Ordinances
of the Village of Mount Prospect, Cook County, Illinois, is hereby amended
and as amended shall add in full as follows:
Section 5-704. ADOPT AND PUBLISH RULES, REGULATIONS/POWER.
The Board of Fire and Police Commissioners shall have all
powers and authority granted under Division 10.2.1 of the
Illinois Municipal Code, as amended, and in addition thereto,
are hereby granted the authority to make such rules and
regulations as are necessary to implement the following
policies and standards:

a) the extension of the probationary time period for probationary
officers to periods in excess of six (6) months but not
longer than twenty-four (24) months from the date of the
officer's certification;
b) the establishment of minimum educational standards higher than
that currently provided by law for all original appointees to
the Police Department;
c) the establishment of a preference point system for appointment
to office in the Police Department for Community Service
Officer, in addition to the preference point system currently
provided by law for Veterans on original appointments;
d) the establishment of a minimum level of work experience for
officers as a condition precedent for eligibility to take
promotional examinations;
e) the establishment of a probationary time period for all officers
promoted from a lower rank;
f) the establishment of a demotion procedure whereby the Board
shall have the authority to demote to a lower rank those
officers who in the determination of the Board have not met
the standards of the Fire and Police Departments;
g) the establishment of a pre-test screening procedure for
promotional examinations;
h) the establishment of a selection procedure giving the Fire
Chief or Police Chief the authority to select candidates for
officer and. promotion different than that currently provided
by law;
i) elimination of the seniority point system for promotion;
except that the Board shall not have the power to appoint the Chief
of Police, the Deputy Chiefs of Police, Commanders, and Watch
Commanders, the Fire Chief, Deputy Fire Chiefs, Captains/Shift
Commanders. The Chief of Police and Chief of the Fire Department
shall be appointed by the Village Manager. Individuals may be
appointed by the Chief of Police with the advice and consent of
the Village Manager for appointment as Deputy Chief of Police,
Commander, and Watch Commander. Individuals may be appointed by
the Fire Chief with the advice and consent of the Village Manager
for appointment as Deputy Fire Chief, and/or Captain/Shift
Commander.
If a member of the Police Department is appointed as Deputy Chief,
Commander or Watch Commander prior to being eligible to retire
on pension he shall be considered as on furlough from the rank he
held immediately prior to his appointment. If he resigns or is
discharged as Deputy Chief, Commander, or Watch Commander prior
to attaining eligibility to retire on pension he shall revert to
and be established in Such prior rank, and thereafter be entitled
to all the benefits and emoluments of such prior rank, without
regard as to whether a vacancy then exists in such rank.

not affect the validity of any remaining portion of this Ordinance.

Attached is a memo from our Village Engineer requesting a new resolution
for Prospect Avenue reconstruction. Basically, the Village Board had
earlier passed a resolution in the amount of $400,000 for MFT resurfacing
work for fiscal year 1981. We are not adding to that resolution, but
we are taking a portion and calling it reconstruction versus resurfacing.
The reason for this being is we now understand that by removing the existing
roadway and replacing it with more suitable material, the addition of
storm sewers and curbing, is more than just a resurfacing project.
While we recognize that the contract to Milburn Brothers was approximately
$134,000 for reconstruction work, additional expenses would be incurred
for testing materials during the progress of the construction. This is
not a consulting engineer fee-.,--- all engineering services will be performed
by in-house staff. The difference between the contract price and the
resolution:: amount is only for concrete,, aggregate, and asphalt testing
which is a requirement of the State of Illinois for all MFT work. These
costs are never included as a part of the contractors responsibility.
I recommend this be placed on the next Village Board agenda for approval.

SUBJECT: CABLENET'S RESUBDIVISION
Attached is a memo from the Village's General Counsel analyzing
our Zoning Ordinance as it relates to the Cablenet development
in the Rauenhorst area. The Attorney substantiated the
administration's application of the Zoning Ordinance in
permitting Cablenet's location in the I-1 District and
allowing for its antenna/tower.
When Cablenet first approached the staff in its initial
efforts to find a location in the community, they were
exploring three sites, none of which had industrial zoning.
One site was eliminated because it could not meet Cablenet's
technical requirements; the other sites had significant
negative impact upon surrounding residential properties;
and, in the one case, Wedgewood Terrace, the Village recently
had denied a rezoning request and, therefore, I represented
to Cablenet that their attempt to locate there would be
contrary to stated Village policy. After meeting with some
residents of that area, Cablenet discovered for themselves
the degree of resistance in that neighborhood.
At a meeting attended by Mr. Schlickman, attorney for Cablenet,
Mr. Fritz and myself, we concluded that their operation and
the antenna would not be suitable for any commercial district
and the only allowable location would be in an industrial
district (warehousing, office and installation equipment).
An 1-2 District was never considered seriously because it is
clearly intended to be for railroad operations and the
Village would not consider rezoning the Rauenhorst property
to more intensive uses.
The question of the antenna appeared satisfied by the explicit
language exempting them from height restrictions in the I-1
District.
The question raised by the Planning Commission has been
phrased as one of interpretation and intent and in this
area, it is understandable that differing opinions arise. I
believe, however, that a close and comprehensive reading of
this Ordinance will confirm that the I-1 District does allow
the proposed antenna. This is substantiated by our Attorney.
The Zoning Ordinance may be defective in not being more
restrictive. Perhaps the Ordinance should have some limiting
factors upon its broad allowance for antennae in the industrial
districts. Nevertheless, the staff is hard pressed to
interpret the law as it should be as opposed to what it says
in fact.
In light of the Planning Commission's appeal to the Zoning
Board, the staff will withhold building permits for Cablenet
until the matter is officially resolved.

RE: Cablenet Antenna - Rauenhorst Industrial Development
Dear Terry:
We are in receipt of a copy of your Memorandum of October
22, 1981, relating to the above -captioned matter. This letter
is in response to your request that we review the appropriate
provisions of the Mount Prospect Zoning Ordinance to determine
whether Cablenet's,proposed 250 foot broadcast antenna to be
located on property in the Rauenhorst Industrial Development
would be violative of the height restriction applicable to
I-1 zoned property.
It is our opinion that the Ordinance does not impose any
height restriction on an antenna such as proposed by Cablenet.
We ground our opinion'primarily on the provisions of Section
14.2204, the pertinent provisions of which are as follows:
"A. In the I-1 Light Industrial District.
1. The maximum height of a building shall
not exceed thirty feet (30'); and
B.-' Flagpoles, chimneys, antennae and steeples
shall be excluded from the regulations con-
tained in this section.
It is our understanding that the proposed Cablenet facility
consists of a 250 foot tower with transmitting and receiving de-
vices located thereon. Antennae are defined in Webster's Unabridged
Dictionary as follows:

"In radio and television, a wire or set of
wires used in sending and receiving the
electromagnetic waves; aerial."
Aerial in turn is defined
"In radio and television a wire or set of
wires, often high in the air, for sending
or receiving the electromagnetic waves -
antenna."
It is our experience that antennae are commonly understood
as including not only the transmitting and receiving wires or
devices themselves but the towers or other structures on which
they are situated. That this was the intent of the drafters of
the Village Zoning Ordinance, as you note in your Memorandum,
is further supported by the provisions of Section 14.1104 re-
ferring to antenna towers and the definition of "structure"
found in Section 14.2602 which expressly cites "radio towers"
as an example of a structure and the definition of maximum
height which makes reference to "antenna towers" and "antenna
tower structures (including mast and antenna)".
It would appear clear, howeverr, that there is no applicable
height limitation on Cablenet's proposed antenna tower, irrespec-
tive of whether you attempt to distinguish between the tower and
the transmitting and receiving devices that are situated on the
tower. If the transmitting and receiving devices and the tower
are construed as "an antenna" then under the express exclusion
of "antennae" from the height limitation of Section 14.2204
Cablenet's proposed facility is clearly excluded from the thirty
foot height limitation. We find additional support for this con-
clusion from the fact that while flagpoles, chimneys and steeples
are also excluded from the height restrictions applicable to re-
sidential and business districts, antennae are included within
the exemption only in the I-1 and 1-2 districts. More importantly,
however, it must be noted that the thirty foot height limitation
of Section 14.2204 is applicable only to buildings. The Ordinance
imposes no height restriction on structures within the I-1 dis-
trict and therefore even if the tower is considered separate and
apart from the transmitting and receiving devices, it is clearly
a structure and not a building and therefore the proposed facility
would not be violative of any provision of the Ordinance.

IV. POLICE PURSUIT PROCEDUREJ,
Chief Pavlock reviewed with the Committee of the Whole
the general order he is distributing to his officers
regarding police pursuit procedures., The new language
defines those situations when pursuit is allowable
expresses the limits of that pursuit, and allows an
officer to discontinue pursuit for non -felony cases.
The Committee of the Whole accepted the report from
Chief Pavlock and it was -filed.

1. Cablenet. The Village Manager reported that Cablenet
Corporation whith is located at the northern end of
Westgate Road on the southern periphery of the Rauenhorst
properties. While Cablenet meets the zoning requirements
of the municipalitv, its Antenna is estimated to be
250' hilgh. Because of this height, there may be an impact
upon the residen�i al neighborhood and the Board was made
aware of this development. Additionally, Cablenet will
require a resubdiovisio,n inasmuch as they are purchasing
less land than the lot currently contains. In that
procedure, Cablen6t will have to appear before the
Planning Commission and subsequently, the Mayo r and
Board of Tr'ustees.

Trustee Mura'uskis 'Inquired as to the status of Well #17
and the Village Manager resp , onded that he was not sure
that the impellers had been installed as yet and could
not answer the question directly. (Asof the writing
of these Minutes the Well was put Into operation on
Wednesday, October 14 and 'is producin•g 1,000 gallons
per minute. At this point, there remains a residual
salt and sand content A. that was expected and that will
be pumped to waste before the Well is actually put on
li ne, )
Mayor Krause reviewed with the Committee of the Whole
the status of the various Deferred Items. The staff
is still preparing the Zoning Ordinance Administrative
Update and the Development Code Update. Capital Facilities
Plan is being prepared and there is a November target
date for its completion so that it can be 'incorporated
into the subsequent budget discussions. Mayor Krause
indicated that she would review the Liquor License
Code and the staff was instructed to schedule an
Intergovernmental meeting for some week night, preferably
a Wednesday or Thursday, early in November at the Senior
Center. The staff is to invite all Boards of governmental
agencies that provide services to our municipality including
schools, township, park districts. Also added to the
Deferred Items list were electronic games, youth and
vandalism and apartment improvements.
