The Rise Up Academy, received approval fromVillageBoard on
January 21, 2020 for a conditional use to expand an existing non -conforming
gymnastics facility located at 3017-3035 Malmo Drive. The COVID-19 pandernic
interrupted ! . ! financial hardship and delaying the
Petitioner's expansion plans. The Petitioner currently occupies 3033 and 3035
Malmo Drive and has taken initial steps to meet applicable Village codes and
regulations in order to expand into 3031 Malmo Drive.
Per Section 14.203-11-A of the Village Code, "In any case where the construction
of an approved conditional use is not substantially under way, or if a use is not
established or commenced in the building within one year from the date of
granting thereof, and completed within eighteen (18) months, then, without
further action by the village board, the conditional use or authorization thereof
shall be null and • !
The Petitioner is requesting an extension of the conditional use approval to secure
a contractor for fire alarm installation at 3031 Malmo Drive and expects to have
all necessary equipment installed and fire inspections passed by June 30,, 2021.

I am writing to request an extension of Rise Up Academy's conditional use approval
The conditional use was first approved on January 21 st, 2020.
The reason for requesting the extension was the interruption of our business activitie
due to the Covid-1 9 pandemic which resulted in delay of all scheduled plans and
added financial hardship. I
The proposed additional space has been cleaned, carpeted and painted and
gymnastics equipment has been installed.
After our inspecti"on with the Fire Department inspector on January 6th, 2021, we were
advised to install a Fire Alarm in Addition to the existing Sprinkler System.

We are already contacting companies and after getting all the quotes, we plan to install
the system as soon as possible.
We are asking for an extension until June 30th, 2021 to make sure we have sufficient
time to complete all the requirements.

AN ORDINANCE GRANTING A CONDITIONAL
USE FOR A SPORTS TRAINING FACILITY FOR THE PROPERTY
LOCATED AT 301.7-3035 MALS O DRIVE, MOUNT PROSPECT,
ILLINOIS
WHEREAS, the petitioner, Rise Up Academy, is seeping a conditional use to expand
an existing non -conforming gymnastic school located at 3017-3035 Malmo Drive and
legally described as:
LOT 11 EXCEPT THE NORTH 115.37 FEET THEREOF, IN ELMHURST-ALGONQUIN
INDUSTRIAL PARD UNIT NO.11, BEING A RESUBDIVISION OF PART OF LOT
3 IN LIN N EMAN'S DIVISION IN SECTION 23, TOWNSHIP 41 NORTH, RANGE
11, EAST OF THE THIRD PRINCIPAL MERIDIAN
PIN: 08-23-202-034-0000; and
WHEREAS, a Public Hearing was held on the request for a conditional Use being the
subject of PZ -28-19 before the Planning and Zoning commission of the Village of
Mount Prospect on the 9th day of January, 2020 pursuant to proper legal notice
having been published in the Dail Herald Newspaper on December 25, 2019; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have
given consideration to the request herein and have determined that the request
meets the standards of the Village and that the granting of the conditional Use to
allow a gymnastics training facility would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That the recitals set forth hereinabove are incorporated herein as
findings of fact by the President and Board of Trustees of the Village of Mount
Prospect.
SECTION TWO: The Mayor and Board of Trustees of the Village of Mount Prospect
grant a Conditional Use permit to allow for a gymnastics training facility located at
3017--3035 Malmo Drive, Mount Prospect subject to the following conditions:
., "Submittal of architectural plans, including a building code analysis
reflecting existing and proposed conditions. All egress, uses, types of
construction, occupant load, and any necessary changes due to the change
in use group per the International Building code;
z. Provide two (2) additional accessible parking spaces measuring a minimum
of 16' wide, including an 8' wide diagonally striped access aisle, by 18' deep,
and equip them with the required U.S. Department of Transportation signs;
and

3. Compliance with all Development, Fire, Building, and other Village codes
and regulations."
SECTION THREE ' : This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law,

3.1 1st reading of an ORDINANCE AMENDING CHAPTER 13 (ALCOHOLIC LIQUORS) OF THE VILLAGE CODE OF MOUNT
PROSPECT.
This Ordinance will increase the number of Class "P-1" licenses by one (1) JENISHA INC. D/B/A JENNY'S LIQUORS located at
2316 S. Elmhurst Rd.
Mayor Juracek welcomed Ms. Nayna and Jay Goswami to Mount Prospect. Ms. Goswami has assumed ownership of Balzano
Liquors. Both were present to answer questions from the Board. Ms. Goswami stated that she intends to change the name of
the business to Jenny's Liquors. Ms. Goswami has completed the required training and understands the Village Liquor Code.
Motion to waive the rule requiring two readings of an ordinance.

3.2 1st reading of an ORDINANCE AMENDING CHAPTER 13 (ALCOHOLIC LIQUORS) OF THE VILLAGE CODE OF MOUNT
PROSPECT.
This Ordinance will increase the number of Class F -2-V licenses by (1) WILLKAIT LLC. d/b/a/JELLY CAFE and decrease the
number of Class F-2 licenses by one (1) WILLKAIT LLC. d/b/a/JELLY CAFE located at 1784 W. Golf Road, Mount Prospectf IL.
William Kretsch, the owner of Jelly Cafe and Matthew Monson, owner of Veteran Video Gamingf were present to answer
questions from the Board. Mr. Kretsch stated Jelly Cafe's current hours of operation are 6AM to 3PM. If the video gaming
license is approved by the Villagethey will extend their hours of operation and remain open until 10 PM and offer a full-service
menu. Mayor Juracek reminded Mr. Kretsch that the Village does not allow gaming cafe's and reinforced the importance of
maintaining a restaurant that is fully serviceable during the hours of operation. Mr. Kretsch stated he understands the Village
Code and will comply.

Director of Community Development Bill Cooney presented for Village Board approval, a conditional use for a gymnastics training
facility at 3017-3035 Malmo Drive. Mr. Cooney stated the petitioners,, Rise -Up Academy, are proposing to expand their
existing gymnastics training facility that has been in operation since 2014. The subject property was annexed into the Village in
