AN ORDINANCE TO AMEND SECTION 4. 103
ENTITLED "POWERS AND DUTIES" PERTAINING
TO THE PURCHASING PO;iER OF THE VILLAGE
MANAGER, OF CHAPTER 41 ARTICLE 1 OF THE
VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Section 4.103 entitled "Powers and
Duties" of Chapter 4, Article 1 of the Village Code of Mount
Prospect, Illinois (1981) is hereby amended by amending
Sub -section H. thereof to read as follows:
"H. To purchase all mate -rials, supplies and equipment
for which funds are provided in the working budget;
provided, that he may award contracts for purchases
of more than four thousand ($4,000.00) to the
lowest qualified bidder; and provided further that
for such purchases of more than four thousand
dollars ($4,000.00) he shall be required to receive
sealed bids not less than seven (7) days after
placing an advertisement in any newspaper published
within the corporate limits of the Village or if
none is published within the Village, after placing
an advertisement in any newspaper having a cir-
culation within the corporate limits of the Village,
which advertisement shall state that such contract
shall be let to the lowest responsible bidder and
stating the place, time, and date such sealed bids
shall be opened.
1. Should such purchase be an amount in excess of
that provided in the working budget or should such
low bidder fail to be the lowest responsible bidder,
the Village Manager shall advise the Village Board
of Trustees as to whether or not the contract offeried
is desirable or which of several contracts offered
is most desirable for the Village.
2. In case of accidents or other circumstances
creating an emergency, the Village Manager may
award contracts, acquire services and make purchases
for the purpose of repairing damages caused by the
said accident or meeting said public emergency; but
he shall file promptly within fourteen (14) days
with the Village Board a certificate showing such
emergency and the necessity of such action, together
with an itemized account of all expenditures."
SECTION TWO.- This Ordinance shall be in full force and
effect upon its passage, approval and publication in pamphlet form
in accordance with law.

SUBJECT: PLATS OF DEDICATION, VACATION AND RE -SUBDIVISION
REGARDING PROPERTY LOCATED IN THE BUSSE/WILLE
IMPROVEMENT AREA
DATE: September 11, 1981
In accordance with direction from the Village Board, we have
prepared the necessary plats of vacation, dedication and re-
subdivision for the properties owned by G.S.W. Development
Co. (Aldi's) and Dunkin Donut located in the Busse/Wille im-
provment area.
In the case of Dunkin Donuts' property, a small portion of
land is tobe dedicated to the Village for public walkway area
and correspondingly, a portion of publicly dedicated right-of-
way is proposed to be vacated to allow for the expansion of
the private parking lot and sign relocation on Dunkin Donuts'
property,
In the case ofDevelopment Co. property, they are dedi-
cating the southernmost portion of their lot at the intersection
of Busse and 'Northwest, H lighway at Wille Street so that the
Village may incor'Porate public walkway and landscaping areas in
front of their building.will recall, they will be losing

area,
The action that should be requested is to authorize the Mayor to
sign and the Clerk to attest the vacation, dedication and re-
subdivision plats presented contingent on the completion of the
signatures from property owners, Village Plan Commission and
Mortgage Companies. IDOT is anxious to receive copies of executed
and recorded right-of-way for their records,

SUBJECT: BUSSE/WILLE REDEVELOPMENT
1. As part of the Busse/Wille Redevelopment, lands must be exchanged
between the Village and certain adjacent property owners,
specifically Dunkin Donuts, and Aldi's. Exhibit 1 shows schematically
those properties affected.
2. In Exhibit 2, the Aldi's property is shown graphically and includes
0.046 acres at the northwest corner of Northwest Highway and Wille
Street to be dedicated as public right-of-way.
3. In Exhibit 3, a 0.005 acre portion of the Dunkin Donut property
is shown as being dedicated to the Village as public right-of-way.
The property abuts Busse Avenue on the northerly side of Dunkin
Donut.
4. In Exhibit 4, a 0.014 acre portion of the Village property is
shown as being vacated and being transferred to Dunkin Donut.
5. All the preceeding exchanges are required to accomplish the
Busse/Wille Improvement and have been discussed in earlier meetings.
These exchanges are required to be completed and recorded by the
Illinois Department of Transportation prior to initiation of
any work in these particular areas.

V be approved by the Village Board. All utilities

part of Kensington Center -Phase II with only minor

AN ORDINANCE TO VACATE PART OF DEDICATED STREET
RIGHT-OF-WAY AT THE INTERSECTION OF SOUTH WILLE
STREET AND WEST BUSSE AVENUE IN THE VILLAGE OF
MOUNT PROSPECT, ILLINOIS
BE IT ORDAINED BY TH'E_A PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNITY, ILLINOIS:
SECTION 1,: It is the finding and determination of the
President and Board of Trustees of this Village, acting pursuant
to plans previously adopted by this Board for the roadway improve-
ment to the intersecting streets of South Wille Street and West
Busse Avenue, that the public interest will be subserved through
relief to the public from the further burden and responsibility
of road improvement and maintainence, by vacating the following
described portion of street right-of-way at the intersection of

P said named roads, located in this Village, to wit:
That part of dedicated street right-of-way at the intersection of South
Wille Street and West Busse Avenue in Mount Prospect, Illinois, as
dedicated in the Busse and Wille's Resubdivision per Document No. 3839591
and registered in the Torrens System as Document No. 3945, and as shown
on the Resubdivision of Lots 4 and 5 in John Meyn's Subdivision per
Document No.'LR 2505632, all in the Northwest Quarter of Section 12,
Township 41 North, Range 11 East of the Third P.M., and being more
particularly described as follows:
Commencing at the Southeast corner of Lot 1 in the aforesaid subdivision
of Lots 4 and 5 in John Meyn's Subdivision, thence North 58 degrees 16
minutes 32 seconds West --- 109.12 feet along the southwesterly line of
Lot 1 which is also the northerly right-of-way limit of Northwest Highway
to the point of beginning, thence continuing North 58 degrees 16 minutes
32 seconds West --- 8.00 feet along the northerly right-of-way limit of
Northwest Highway, thence 37.96 feet along a curve to the right whose
radius is 20.00 feet and whose long chord of 32.'51 feet bears North 03
degrees 54 .minutes 24 seconds West, thence North 00 degrees 02 minutes
25 seconds West --- 14-14 feet, 'thence North 89 degrees 57 minutes 35
seconds East --- 49.00 feet to the northerly line of said Lot 1, thence
32.05 feet along a curve to the left whose radius is 1.080;00 feet and
whose long chord of 32.05 feet bears South 81 degrees 30 minutes 32
seconds West to a point of compound curvature, thence 59.87 -feet along a
curve to the left whose radius is 25.00 feet and whose long chord of
46.55 feet bears South 10 degrees 25 minutes 26 seconds West,to the
point of beginning, containing 0.009 acres) more or less, all in Cook
County, Illinois.

Section 2: The said described portion of Dedicated Street
Right -Of -Way at the intersection,of South Wille Street and West

vacated.

directed to file a certified copy of this Ordinance with the attached
Plat of Vacation in the office of the Cook County Recorder of Deeds.
Section 4: This Ordinance shall be in full force and effect
upon its passage and approval in accordance with law.
