NEW BUSINESS THE COLONY - As discussed at the Committee of the Whole meeing BLDG. PERM I*T held September 8th, a request w,as presented to TIME EXTENSION extend the building permits for the townhouses at Old Orchard Colony. It was explained that due to financial conditions, thebuilder was unable to complete the specified project and inasmuch as Village Codes state th'at building permits are valid for a period of one year, the contractor has submitted the request for a time extension. The contractor also stated that as the existing units are sold, those monies will be put into the partially completed townhousesl being the subject of this request. Trustee Arthur, seconded by Trustee Farley, moved to authorl.ze the time period for building permits for the townhouses at the Colony iin the Old Orchard development for an additional year, to expire September 15, 1982. Upon roll call: Ayes,: Arthur Farley Floros Miller Murauskis Wattenberg, Nays: None Motion carried. A resolution was presented that would authorize MFT FUNDS an additional $4,325 for the previously approved traffic signal at Council Trail and Elmhurst Road COUNCIL TRAIL & (Route 83) from MFT funds., It was stated that ELMHURST ROAD i w ith this additional expenditure, the Village's TRAFFIC SIGNAL share would total approximately $10,000 for this pro3ect. Trustee Floros, seconded by Trustee Farley, moved RES. NO. 34-81 for passage of Resolution No. 34-81 A RESOLUTION APPROPRIATING MFT FUNDS (Council Trail & Elmhurst,Road traffic signal) Upon roll call: Ayes: Arthur Farley Floros, Miller Murauskis Nays: Wattenberg Motion carried. ZBA 15-V-81, 621 or Main Street ZBA 15-V-81 The petitioner in this case has requested a 621 N. In variation to allow two uses on one lot of record and variati'ons from the number of parking spaces requIred along with a variation from the truck loading area requirement. Trustee Miller, seconded by Trustee Arthur, moved to concur with the recommendation of the Zoning Board ofAppe ' als and grant the requested, variations 0 in ZBA 15-V-81. An Ordinance will be drafted to reflect the variations granted and will be presented October 6th for first reading. An Ordinance authorizing the vacation of a sma,11 BUSSE/WILLE area of right-of-way at the intersection of DUNKIN DONUT'S Busse Avenue/Wille Street/Northwest Highway was V,ACATION & presented for first reading. This vacation, along DEDICATION w ith the dedication of an6ther small area of the property known as the Dunkin' Donut property will be presented October 6tb for approval. These actions are a part of the Busse,/W'Ille improvement. Also in connection with the Busse/Wille improvement, WILLE'S RESUB a small area at the southeast corner of the 'di' #2 building is to be dedicated to the Village. A plat of re-subdivision of the Wille's Re-subdivision was presented for Board approval. This plat provides for the dedication of that area as well as reflecting the to lines for that subdivision. Trustee Wattenberg, seconded by Trustee Arthur,, moved to authorize the Mayor to sign and Clerk "to attest her signature on the Wille's Plat of Re-subdivision #2, Upon roll call: Ayes.- Arthur Farley Floros Miller Murauski's Wattenberg Nays None Motion carried. W, A plat of subdivision was presented for the Kensington KENSINGTON Center development. It has subsequently closed and they are unsure whether they will open again under the same corporation. In fact, the property is for sale and we have talked to the real estate broker and they are not claiming that there is an available liquor license. According to policy, when a license is unused, it shall automatically become terminated. While we have never issued the Moloney's license, I have directed the Village Clerk's office to prepare an ordinance reducing the number of Class W licenses by one. TERRANCE L. LIQUOR LICENSE REQUEST - SIZZLER STEAK HOUSE, RAND ROAD On Wednesday, September 30, 1981, the Village Manager interviewed Mr. Richard Grant, Executive Director of Operations for Sizzler Family Steak House. They are applying for a Class W, re.staurant-beer and wine, liquor license as Restaurant Partners, Inc., d/b/a Sizzler Family Steak House, at 110 East Rand Road. They are filing as a corporation, Restaurant Partners) Inc., with Mr. Roy Siemieniiak as President and 100% stockholder. All documents, insurance and lease papers have been received and reviewed by the Village Manager's Office and are in order. I have requested both the Health Department and Code Enforcement to conduct a timely inspection to determine if there are any outstanding violations. Fingerprints are being submitted to the Police Department. The former operator at Sizzler Steak House, Faire Bonne Chere, Inc., conducted business there from January, 1979 until June, 1981 with a Class W liquor license. This operator went out of business in June and the property reverted to Mr. Roy Siemieniak. Prior to the Faire Bonne Chere operation, the restaurant had a Class W liquor license from March, 1977 until it was reissued to Faire Bonne Chere. Mr. Siemien'iak also was 100% stockholder in that corporation. The corporation currently has liquor licenses in Hillside, Franklin Park., Norridge, Crystal Lake, Oak Lawn and Homewood. They are in the process of applying for a license in Niles. I am having the Police Department contact these other cities to see if there has been any difficulty with their licenses there. Mr. Grant represents that there has been none. Wilson (hereinafter referred to as the "Petitioner") is the owner of a certain parcel of commercially improved property located at 621 North Main Street in the Village of Mount Prospect, Illinois (hereinafter referred to as the "Subject Property") - and WHEREAS, the Subject Property is legally described as follows; Lot 1 in Olsen's Subdivision of the West 252.87 feet of the North 177.54 feet of the South 636.08 feet of the North West 1/4 of the North East 1/4 of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, except for that part taken for public highway, in Cook County, Illinois; and WHEREAS, the Subject Property is located in the 8-3 Business Retail and Service District under the provisions of Chapter 14 entitled "Zoning" of the Village Code of Mount Prospect, Illinois (hereinafter referred to as the "Zoning Ordinance") and WHEREAS, the Petitioner has hereto filed an application seeking the following variations in the provisions of the Zoning Ordinance; 1. A variation from Section 14.101F to allow the property to be occupied by more than one main use, 2. A variation from Section 14.2002A to allow auto- mobile parking in the front yard area. 3. A variation from Section 14.2005A to allow a reduction of required off-street parking spaces from 36 to 35 spaces. 4. A variation from Section 14.20058 to allow a reduction of required truck loading spaces from 2 spaces to 1 space; and 1-;-HER-EAS, a public hearing was held on Petitioner's request for .4 the aforesaid variations {designated as case No. ZBA 15-V-81) before the Zoning Board of Appeals of the Village of 1.1ount. Prospect on the 27th day of August, 1981 pursuant to due and proper notice thereof published in the Mount Prospect Herald on August 3, 1981; and .0 WHEREAS, the Zoninq Board of Appeals has recommended to the Board of Trustees of the Village of Mount Prospect that the Petitioner's request for the aforesaid variations under ZBA 15-V-81 be granted; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the Petitioner's variation requests satisfy the standards set forth in Section 14.605 of Article VI of the Zoning Ordinance, and further find that it would be in the best interest of the Village to grant the Petitioner the requested variations. OLD BUSINESS Isabella/Maple Streets 'Request for a4 -Tay Stop Sign. A motion was made by Art Coy, seconded by Dep8ty Police Chief John Savage. After considerable discussion, the' residents in attendance at the meeting presented a case for excessive speeding and screeching of tires at the intersection of Isabella and Maple Streets. After reviewing the requests and the numerous existing Stop Signs in the area and the present traffic counts at the intersection provided by Dennis Valentine (Village Traffic Engineer} . The Safety Commission requested that the Village Engineer take another traffic count of the area, the Safety Commission also requested that Deputy Police Chief, John Savage review any accident reports. It is reported by residents that there are many drivers speeding down Maple Street. Special attention should be placed on the speeders The Safety Commission withheld action until the October meeting. -2- NEW BUSINESS Algonquin Road/Briarwood Drive -- Traffic Signal A request has been made or a traffic signal installation at the intersection of Algonquin Road and Br iarwood Drive. The truck chassis being recommended for purchase will have an eight cubic yard dump body installed on them and'will be used for plowing and salting streets and heavy duty hauling. Each of our 9 trucks which currently are assigned to salting intersections routinely are loaded with 8-10 yards of salt which is normally an adequate amount to cover their assigned section of the community without returning for a second load. With that type of weight plus the stress which is applied while plowing snow a reinforced frame is a necessity as well as the largest brakes available. Prior to the "big" snow of 1967 our trucks did not have reinforced frames and we were experiencing problems with twisted and broken frames and serious brak- ing problems. When a truck is new the probability of failure may be marginal, but as the trucks get to be a few years old, the flexing of the steel brought on by weight factors or temperature extremes will cause metal fatigue and subsequent failure of the frame. The trucks as specified should give us a minimum. 10 year life.
