THE COLONY -
As discussed at the Committee of the Whole meeing
BLDG. PERM I*T
held September 8th, a request w,as presented to
TIME EXTENSION
extend the building permits for the townhouses at
Old Orchard Colony. It was explained that due to
financial conditions, thebuilder was unable to
complete the specified project and inasmuch as
Village Codes state th'at building permits are valid
for a period of one year, the contractor has submitted
the request for a time extension. The contractor
also stated that as the existing units are sold, those
monies will be put into the partially completed
townhousesl being the subject of this request.
Trustee Arthur, seconded by Trustee Farley, moved to
authorl.ze the time period for building permits
for the townhouses at the Colony iin the Old Orchard
development for an additional year, to expire
September 15, 1982.

A resolution was presented that would authorize

an additional $4,325 for the previously approved
traffic signal at Council Trail and Elmhurst Road

w ith this additional expenditure, the Village's
TRAFFIC SIGNAL
share would total approximately $10,000 for this
pro3ect.

area of right-of-way at the intersection of
DUNKIN DONUT'S
Busse Avenue/Wille Street/Northwest Highway was
V,ACATION &
presented for first reading. This vacation, along
DEDICATION
w ith the dedication of an6ther small area of the
property known as the Dunkin' Donut property will
be presented October 6tb for approval. These actions
are a part of the Busse,/W'Ille improvement.
Also in connection with the Busse/Wille improvement,
WILLE'S RESUB
a small area at the southeast corner of the 'di'

building is to be dedicated to the Village. A plat
of re-subdivision of the Wille's Re-subdivision was
presented for Board approval. This plat provides
for the dedication of that area as well as reflecting
the to lines for that subdivision.

WHEREAS, Mount Prospect is made up of -many fine people
who work together and play together, contributing in
many ways; and
WHEREAS, CLARA DANKERT has been a resident of the
Village of Mount Prospect for the past 21 years; and

OF THE MUNICIPAL CODE OF THE
VILLAGE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE.- That subsection A.I. of Section 13.121 of Chapter 13
of the Municipal Code of the Village of Mount Prospect be amended by
substituting a new subsection A.1. therefor, so that Section 13.121.A.1
shall hereafter be and read as follows:
it 1. Subsection A of this Section shall not apply to
any persons under the age of twenty one (21)
years but at least nineteen (19) years of age
while, such person is performing the duties of
his employment as employee or agent of any
such licensee. 11
SECTION TWO,.- That subsection P . 2 . b . of Section 13.1,21 of Chapter 3-3
of the Municipal Code of the Village of Mount Prospect be amended by

SUBJECT: LIQUOR LICENSE REDUCTION
Previously, the Mayor and Board of Trustees adopted an
ordinance increasing the number of liquor licenses for Class
W that was earmarked for the Moloney's Restaurant. It has
subsequently closed and they are unsure whether they will
open again under the same corporation. In fact, the property
is for sale and we have talked to the real estate broker and
they are not claiming that there is an available liquor
license. According to policy, when a license is unused, it
shall automatically become terminated. While we have never
issued the Moloney's license, I have directed the Village
Clerk's office to prepare an ordinance reducing the number
of Class W licenses by one.

SUBJECT! LIQUOR LICENSE REQUEST - SIZZLER STEAK HOUSE,
RAND ROAD
On Wednesday, September 30, 1981, the Village Manager interviewed
Mr. Richard Grant, Executive Director of Operations for
Sizzler Family Steak House. They are applying for a Class
W, re.staurant-beer and wine, liquor license as Restaurant
Partners, Inc., d/b/a Sizzler Family Steak House, at 110
East Rand Road. They are filing as a corporation, Restaurant
Partners) Inc., with Mr. Roy Siemieniiak as President and
100% stockholder. All documents, insurance and lease papers
have been received and reviewed by the Village Manager's
Office and are in order. I have requested both the Health
Department and Code Enforcement to conduct a timely inspection
to determine if there are any outstanding violations.
Fingerprints are being submitted to the Police Department.
The former operator at Sizzler Steak House, Faire Bonne
Chere, Inc., conducted business there from January, 1979
until June, 1981 with a Class W liquor license. This operator
went out of business in June and the property reverted to
Mr. Roy Siemieniak. Prior to the Faire Bonne Chere operation,
the restaurant had a Class W liquor license from March, 1977
until it was reissued to Faire Bonne Chere. Mr. Siemien'iak
also was 100% stockholder in that corporation.
The corporation currently has liquor licenses in Hillside,
Franklin Park., Norridge, Crystal Lake, Oak Lawn and Homewood.
They are in the process of applying for a license in Niles.
I am having the Police Department contact these other cities
to see if there has been any difficulty with their licenses
there. Mr. Grant represents that there has been none.
When the Faire Bonne Chere restaurant closed, we reduced the
number of available Class W licenses and., therefore, if the
Mayor and Board of Trustees decide to grant a license for
Restaurant Partners, Inc., the ordinance will have to be
amended to provide for an additional Class W license.

WHEREAS, Robert W. Wilson (hereinafter referred to as the
"Petitioner") is the owner of a certain parcel of commercially
improved property located at 621 North Main Street in the Village
of Mount Prospect, Illinois (hereinafter referred to as the
"Subject Property") - and
WHEREAS, the Subject Property is legally described as follows;
Lot 1 in Olsen's Subdivision of the West 252.87 feet
of the North 177.54 feet of the South 636.08 feet of
the North West 1/4 of the North East 1/4 of Section

Board of Trustees of the Village of Mount Prospect that the Petitioner's
request for the aforesaid variations under ZBA 15-V-81 be granted; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that the Petitioner's variation requests
satisfy the standards set forth in Section 14.605 of Article VI of the
Zoning Ordinance, and further find that it would be in the best interest
of the Village to grant the Petitioner the requested variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE.: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees of the

OLD BUSINESS
Isabella/Maple Streets
'Request for a4 -Tay Stop Sign.
A motion was made by Art Coy, seconded by Dep8ty Police Chief
John Savage.
After considerable discussion, the' residents in attendance at
the meeting presented a case for excessive speeding and screeching
of tires at the intersection of Isabella and Maple Streets.
After reviewing the requests and the numerous existing Stop
Signs in the area and the present traffic counts at the intersection
provided by Dennis Valentine (Village Traffic Engineer} . The Safety
Commission requested that the Village Engineer take another traffic
count of the area, the Safety Commission also requested that Deputy
Police Chief, John Savage review any accident reports. It is
reported by residents that there are many drivers speeding down
Maple Street. Special attention should be placed on the speeders
The Safety Commission withheld action until the October meeting.

The Resolution and License Agreement are necessary to
correct an existing encroachment of the building at
19 West Busse Avenue. The North face of the structure
encroaches approximately one (1) foot on the first
floor and 1.5 feet on the second floor onto the public
right-of-way of Busse Avenue. This condition came to
our attention when surveying for the Busse/Wille
Improvements.
The Agreement would legitimize the encroachment and
require liability insurance and indemnification of the
Village. After approval of the Board, the property

A RESOLUTION TO APPROVE AND AUTHORIZE A LICENSE
AGREEMENT PERTAINING TO A BUILDING ENCROACHMENT
ON WEST BUSSE AVENUE IN THE VILLAGE OF MOUNT
PROSPECT r ILLINOIS
WHEREAS, Phyllis Starke of 19 West Busse Avenue, Mount
Prospect, Illinois is the Owner of a certain 1 1/2 story brick
and stucco building which is presently encroaching beyond the
Lot line and on to a portion of West Busse Avenue in the Village
of Mount Prospect, Illinois; and
WHEREAS, the Village is presently embarking upon an improve-
ment to West Busse Avenue, including that portion thereof which
abuts the property of Phyllis Starke; and
WHEREAS, a License Agreement (a copy of which is attached
hereto and made a part of this Resolution by reference) has been
submitted to this Board to allow the said Phyllis Starke permission
to continue to maintain the subject building within the area of its
encroachment upon West Busse Avenue until such time as the building
is removed; and
WHEREAS, it is deemed to be in the best public interest that
said License Agreement be approved and executed by this Village.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The said License Agreement between this Village
and Phyllis Starke regarding the building encroachment at 19 West
Busse Avenue, Mount Prospect, Illinois is hereby approved.
SECTION TWO: The Mayor and the Village Clerk are hereby
Ruthorized and directed to execute this License Agreement with
the Seal of this Village affixed thereto.
SECTION THREE: This Resolution shall be in full force and
effect upon its passage and approval in accordance with law.

and legally described as follows:

WHEREAS, there is constructed on said property a certain 1 1/2
story brick and stucco building, a portion of which presently extends
beyond the Lot line and encroaches on the public road right-of-way 'of
Busse Avenue (all as more particularly set out and shown on a Plat of
Survey dated January 28, 19.50, priepared by Valentine F. Weber, a
registered Illinois Land Surveyor, and attached hereto and made a
part of this Agreement by rrefeence)- and
WHEREAS, the Village is presently involved in an improvement of
Busse Avenue, and it is deemed to be in the best interest of the
parties hereto that a license be given to the 0-v;ner to permit the
subject building encroachment to remain on the Public right-of-way
for such time as the building is in existence.
NOW,, THEREFORE,, upon the stated considerations and for other
good and valuable considerations the parties hereto agr".ee as follows-.
1. That a license is hereby granted by the Village to
the Owner, and her successors and assigns in title
or interest to the subject real estate, to occupy,
maintain and utilize that part of the public right-
of-way of West Busse Avenue abutting the property
hereinbefore described for the purpose of allowing
the continuance of that portion of the buildina
located on said real estate which encroaches on"'
the public right-of-way.
2. That this license is granted to permit the
continued encroachment of a part of the present
1 1/2 story brick and stucco building situated on
the said described real estate for as long as such
building exists in its present location, and said
license shall terminate at such time as the present
building is demolished, destroyed, relocated or
otherwise removed.
3. That at such time as this license is terminated the
Owner, as grantee, shall cause to be removed such
part of the building, if any, situated within the
licensed area as described herein, and the Owner
shall restore the licensed area in accordance with
the requirements of the Village at the sole cost
of the Owner.
4. That this license shall not restrict, prohibit or
otherwise prevent the Village from otherwise using
the abutting public right-of-way area of West Busse
Avenue for public purposes.
5., That as a condition to the permission given herein
the Owner shall at all times during the term of
this license carry public liability insurance, at
Owners expense, insuring the Village against any
and all claims for damages to persons or property
resulting from or arising out of the use and main-
tenance by the Owner herein of the described
licensed area; and the Owner shall furnish the
Village with a certificate of such insurance
coverage.
6. That in addition to the foregoing the Owner shall
further indemnify and hold harmless the Village
from anv costs, damages, expenses, or Dudgements
rendered against the Village or any of its officials
as a result of and arising out of the use and main-
tenance by the Owner of the licensed area.

of services for each firm are described on the attached contracts.

Sealed bids were opened on September 29, 1981 for the proposed purchase of
4 truck chassis. Bid tabulations are attached.
The apparent low bidder Freeway Ford Truck Sales, Inc. have requested
to withdraw their bid for not meeting our minimal -specifications. These
included in part:
No full "C" channel frame reinforcement
Smaller size brakes than were specified
Lighter front axle than was specified
No stationary radiator grill (tilts w/hood)
The next lowest cost was on an alternate bid submitted by Lake County Truck
Sales and Service on a GMC chassis. This bid should be rejected for not
meeting the following minimal specifications:
No full "C" channel frame reinforcement
15x3 front brakes vs. 16-12-x5" as svecified
163-2x6 rear brakes vs. 16�2-x7' as specified
Wheelbase 149 in. vs. 151 in. min. specified
No restriction gauge on air cleaner
No pre -cleaner on air cleaner
Fuses vs. electrical circuit breaker as specified
No ampmeter
The main bid submitted by Lake County Truck Sales did meet specifications
but was substantially higher at $36,992.54 per unit.
The truck chassis being recommended for purchase will have an eight cubic
yard dump body installed on them and'will be used for plowing and salting
streets and heavy duty hauling. Each of our 9 trucks which currently are
assigned to salting intersections routinely are loaded with 8-10 yards
of salt which is normally an adequate amount to cover their assigned section
of the community without returning for a second load. With that type of
weight plus the stress which is applied while plowing snow a reinforced
frame is a necessity as well as the largest brakes available. Prior to
the "big" snow of 1967 our trucks did not have reinforced frames and we
were experiencing problems with twisted and broken frames and serious brak-
ing problems. When a truck is new the probability of failure may
be marginal, but as the trucks get to be a few years old, the flexing of
the steel brought on by weight factors or temperature extremes will cause
metal fatigue and subsequent failure of the frame. The trucks as specified
should give us a minimum. 10 year life.
Proposed funding for this expenditure can be found 'in the current budget
as shown below:

Hershberger Truck and Equipment Company in the amount of $125,500.00 for
for four (4) International Model 1954 trucks. These trucks meet all speci-
fications.

1. Sealed bids were publicly opened and read aloud
on October 1, 1981 at 10:00 A.M. by the Village
Manager in the Trustees' Room of the Village Hall.
2. The Proposal requested unit price's for approximately
1,500 square feet of concrete sidewalk to be remov-ed
and replaced. The summary bid tabulation follows:
