HomeMy WebLinkAbout1868_001STATE OF ILLINOIS COUNTY OF COOK ORGANIZATION AND INCUMBENCY CERTIFICATE We, the undersigned, do hereby certify that we are the duly qualified and acting President and Village Clerk, respectively, of the Village of Mount Prospect, Cook County, Illinois, and as such officials we do further certify as follows,: 1. That said Village was organized and incorporated as a Village under the laws of the State of Illinois in the year 1917, and has; continuously since its incorporation operated under the General Laws of the State of Illinois, and since July 1, 1971,* pursuant to §6(a) of Art. VII of the Illinois Constitution of 1970,as a Village governed by a President and Board of Trustees and has never changed its form of government and that said Village is now operating under its authority as a home rule unit and the provisions of the Illinois Municipal Code, as amended, and is not now operating under the provisions of any special act or special charter. 2. That said Village has not adopted and is not now operating under the provisions of Article 4 of said Illinois Municipal Code, said Article providing for The Commission Form of Municipal Government, that said Village has adopted and is now operating under the provisions of Article 5 of said Illinois Municipal Code, said Article providing for The Managerial Form of Municipal Government, that said Village has not adopted and is not now operating 2 - under the provisions of Articles 6, 14- and 18 of The Election Code of the State of Illinois, as amended, said Articles being known as the City Election Law and that said Village has not elected by referendum not to become a home rule unit under the provisions of the 1970 Constitu- tion of the State of Illinois. 3. That The Herald is a newspaper published in and with a general circulation within said Village and is the only newspaper, radio or television station and other news media that has filed a request for notice of the meet- ings of the President and Board of Trustees of said Village pursuant to "AN ACT in relation to meetings," approved July 11, 1957, as amended. 6. That regular meetings of the President and Board of Trustees of said Village are held on the lst and 3rd Tuesday of each month at 8:00 o'clock P.M. at 100 South Emerson Street, Mount Prospect, within said Village and "IF - 3 - that said President and Board of Trustees gave public" notice of said schedule of regular -meetings stating the regular dates, times and places of said meetings at the beginning of each calendar or fiscal year by posting a copy of said public notice at the principal office of said President and Board of Trustees and by supplying copies of said public notice to all of the newspapers, radio or television stations and other news media that have filed a request for such notice and made said schedule available to the public. 7. That the population of said Village is 52,634 and pursuant to Section 6(a) of Article VII of the 1970 Constitution of the State of Illinois, said Village is a duly organized home rule unit. 8. That no petition has been filed or is now pend- ing praying the disconnection of any territory from the present corporate limits of said Village. 9. That there is no litigation or controversy pending or threatened and there are no tax objections pend- ing or threatened questioning or affecting in any manner whatsoever the corporate existence of said Village, the boundaries thereof, the right of said Village to levy taxes for municipal purposes or the title of any of its present officials to their respective offices. There is a tie bid for work relating to the Share the Cost Program with no legitimate reason for preferring one contractor over the other. Both firms have adequate financial resources and equipment capability. A conference was held with representatives of both firms, Paolo and G & V Construction, to resolve this unique situation. The extent and nature of this improvement is defined in the engineering/landscape architectural proposal which is sub- mitted independently at this time. Construction engineering is divided into four phases and these phases are (1) construction stake -out, (2) resident inspection, (3) general construction administration, and (4) material testing. Baxter & Woodman, I ' nc. will provide any and all of the above which are described as follows: 1. Construction stake -out would include setting the necessary line and grade stakes as may be required for the contractor's construction schedule. 2. President and Board of Trustees May 12,'1981 Village of Mount- Prospect, Page Three PAYMENT SCHEDULE Baxter & Woodman, Inc. will submit monthly statements to the Village for progress payments based on actual time expended -for the construction engineering services at the included schedules of hourly rates and travel costs. Such statements shall be sup- plemented by appropriate time records and other supporting data as may be required by the Village. The total amount to be paid to Baxter & Woodman,, Inc. -for the construction and engineering services will not exceed $25,000. Should the project be. abandoned or 'should our agreement for ser- vices be terminated at any time after any part of the construction engineering services have begun and prior to completion of such services ^ , the Village will reimburse Baxter & Woodman, Inc. for all costs at the hourly rates set forth above up to the time of notification in writing by the Village of such abandonment or termination.
