In order to facilitate this change in the most cost effective manner, the existing parking "meter" system was replaced with a master collection box system. At first this new system caused some confusion but this has now passed and the collection box is working most satisfactorily. As a result, I have the following used meters which were taken out of the commuter lots: 13 Single Head Units 211 Side -by -Side Units 47 Back to Back Units These meters have 13 hour time limits, 10 cents per hour or 12 hours for fifty cents; they will accept nickels, dimes, and quarters. I have talked to the manufacturer, Duncan Meter Co., regarding selling them back and they are definitely not interested. Also after making several phone calls to neighboring towns, there seems to be a very poor resale value to these meters, if any. There is however, one possible solution in which to dispose of these meters and recapture some of our investment. The Public Works Open House is scheduled for Saturday, May 16, 1981 and I would suggest we offer these meters for sale, at a set minimum value, back to the citizens. People could use them as a conversation piece, install one in their driveway, make a lamp or bank out of one, etc. This would also act as a drawing card for people to attend and I will also have some conversion examples on exhibit. Therefore, I recommend the Village Board pass the attached ordinance declaring these meters surplus and available for sale at our Public Works Open House on Saturday May 16, 1981. I still have 23 single head meters in service at the center railroad commuter parking lot plus an adequate supply of replacement meters and parts which I intend to hold. Glen R. Another con- cern would be the cost of adapting our emergency light bars designed for the mid-size car to the full size car. I would like to mention that Chevrolet dealers were unable to bid due to an unexpected cut-off date of March 20, 1981 for police ve- hicles. Prior to soliciting bids we were advised that their cut- off would be mid-April. It has been indicated by the dealers submitting bids that the cut- off date for ordering 1981 vehicles is approximately April 15, 1981. Although the he Budget for Fiscal year '81 --'82 has not officially been passed by the Village Board, a sum of $76,500.00 was authorized for the purchase of nine (9) squad cars at the Police Budget hearing on March 9, 1981 Budget Account 21-041-06-80013. 1 therefore request permission to proceed with placing an order for said vehicles which would have an expected delivery date of July, 1981. In considering the bids submitted, it is my opinion that the bid of SchaumburgDodge for the 1981 Dodge Diplomat is the most advantageous for the_Village,even though Lesly Motors bid with rebate considered is $669.00 less. My reasoning is as follows: 1) Lesly Motors is a considerable distance from Mount Prospect. Even though warrantywork could be accomplished at any Ford agency, it is common knowledge that service is better at the agency where the vehicle is purchased. Mr. Terrance L. WHEREAS , the Subject Property is` located in the B-3 Business - Retail and Service District under the provisions of the Zoning Ordinance of the Village of Mount Prospect (hereinafter referred to as "Zoning Ordinance"); and IMEREAS, Petitioner has hereto filed an application seeking the following varations from the provisions of the Zoning Ordinance. - 1. A variation from Section 14.101.F of Article I of the Zoning Ordinance to allow three main uses on the Subject Property instead of the permitted single use. 2. PROGRAM The staff presented the proposed guidelines for the Residential Re- habilitation Program proposed to be funded by the Community Develop- ment Black Grant. Trustee Richardson requested staff to investigate whether property maintenance code violations could be covered by this program and also what sources of income are included to determine eligibility. The provisions of this Article shall apply to all persons, firms or corporations which engage in the business of buying, selling, trading or exchanging any gold or silver objects within the Village of Mount Prospect. Sec. 11.3202. License Rte!juired. It shall be unlawful for any person, firm or corporation, including any person, firm or corporation located on the premises of an otherwise licensed business, to engage in the business of buying, selling, trading or exchanging any gold or silver objects within the Village of Mount Prospect without first obtaining a license therefor, provided, however, that any person, firm or corporation which is otherwise licensed to do business by the Village of Mount Prospect need not obtain a separate license for the business of buying, selling, trading, or exchanging gold .or silver. Sec. 11.3203.Application. An application for a license as required by this Article shall be filed with the Village Clerk, shall be accompanied by a nonrefundable application fee of $15.00 and shall contain the f4ollowing information: A. Name of the applicant; B. Name, Village address and Village telephone number of the business for which a license is requested; C. Name, permanent address and permanent telephone number of the business for which a license is requested; D. If the merchant is an itinerant, the address and telephone number of the next location where such merchant plans to engage in the business of buying, selling, trading or exchanging any gold or silver objects and the name under which such merchant will be operating; E. A statement indicating whether the business is a sole proprietor- ship, partnership or corporation; � 2 - F. If the business is a sole proprietorship or partnership: 1. the name of the proprietor or the partners; 2. the address and telephone number of the proprietor or each partner; 3. a statement indicating whether the business is registered in Illinois under the Assumed Name Act; 4. a statement indicating whether the proprietor or any of the partners has been convicted of a felony within five years prior to the date of the application and if so, the details with regard to such conviction; G. If the business is a corporation: 1. the year of incorporation; 2. the state of incorporation; 3. if not incorporated in Illinois, a statement indicating whether the corporation is licensed to do business in Illinois as a foreign corporation; 4. a statement indicating whether any of the officers or directors of the corporation have been convicted of a felony within five years prior to the date of the application and if so, the details with regard to such conviction; H. If the applicant plans to do business within the Village of Mount Prospect for less than ninety (90) days, a statement indicating the dates applicant plans to conduct business in the Village; I. A statement indicating all the addresses and the names under which the applicant conducted a business as a gold and silver merchant at any time within one year prior to the date of the application. Sec. 11.3204. Grant or Denial of License. The Village Cler'k shall forward for review and investigation any completed application filed under the provisions of this Article to the Village Manager and Chief of Police within twenty four ( 24 ) hours after it is filed. The Village Manager shall grant or deny such license within five (5) days after it is filed. The Village Manager shall issue such license to any applicant of good character and reputation. No license shall be issued to any applicant if the sole proprietor, any partner or any officer or director has been convicted of receiving stolen goods, burglary, robbery, theft or any other felony in any Federal or state court at any time within five years prior to the date of the application. 3 Sec. 11.3205. Fee for License. Prior to the issuance of a Ilicense under this Article, the applicant shall pay the appropriate fee set forth below to the Village Clerk: Daily Fee $50 up to a maximum of $15.e Annual Fee $150 Sec. 11.3206. Duration of License and Renewal. A license issued under the provisions of this Article shall remain in full force and effect from May 1 to April 30 of each year unless earlier revoked or unless a shorter duration is specified on the Olicense. Annual licenses shall be renewable on or before April 30 of each year. Licenses shall only be issued for the period within which the applicant proposes to engage in the business of buying, selling, trading or exchanging gold or silver objects within the Village. A separate license shall be required for each period within which a person, firm or corporation engages in the business of buying, selling, trading or exchanging gold or silver objects within the Village. Sec. 11-3207. Records. Every person, firm or corporation engaged in the business of buying, selling, trading or exchanging gold or silver objects shall maintain a record containing the following information for each and every gold or silver object purchased, sold, traded or exchanged: A. The date of the transaction; B. The time of such transaction; C. The name, address and telephone number of the person with whom the gold or silver merchant transacted business; D. A complete and detailed description, including, but not limited to, the type of item, its brand name, the type of metal, a description of any inscriptions and other identifying marks, including identification numbers thereon, of the gold or silver objects purchased, sold, traded or exchanged to or with the merchant. Such record and any gold or silver objects in the possession of the gold and silver merchant shall, at all reasonable times, be available for inspection by the Village of Mount Prospect police. Such records of those merchants licensed for a period of less than one year shall be delivered to the office of the Chief of Police at the close of business on the date of expiration of such gold or silver merchant's license. The requirements of this Section may be satisfied by the maintenance of photo copies of receipts for gold and silver objects purchased, sold, exchanged or traded, provided that such -receipts contain the information required by this Section. 4 Sec. 11-3208. Purchase from Minors Prohibited. No person, firm or corporation engaged in the business of buying, selling, trading or exchanging gold or silver objects shall pur- chase, trade or exchange any gold or silver object offered to the merchant by a person who is less than eighteen (18) years of age unless such a person is accompanied by his or her parent orguardian who authorizes the transaction. Sec. 11.3209. Recei2t Of -Stolen Goods Prohibited. No person, firm, or corporation engaged in the business of buying, selling, trading or exchanging gold or silver shall knowingly accept or sell any gold or silver object which has been stolen. Every person, firm or corporation licensed under the provisions of this Article shall report to the Village of ..Mount Prospect police any gold or silver object received by or which is offered to such licensee by another if such licensee has reason to believe that such object was stolen or lost. Sec. 11.3210. Holdi'ng, Period Req_uire,d. No gold or silver merchant shall sell, trade, exchange or melt down any gold or silver object received within a forty-eight ( 48 ) hour period after its receipt. Sec. 11-3211. Revocation of License. Any license issued under the provisions of this Article may be revoked in accord- ance with the procedure set forth in Chapter 10, Article III of the Municipal Code of the Village of Mount Prospect for any violation of the provisions of this Article. Any license issued under the provisions of this Article shall be automatically revoked if the licensee ceases to operate at the address specified on the license. Sec. 11.3212. Penalties. Fritz, Director of Community Development SUBJECT: 'APPLICATION FEE FOR BUSINESS REHABILITATION LOAN PROGRAM DATE: March 10, 1981 According to ordinance No. 3060 which establishes the Business Rehabilitation Loan Fund, all applications for a Business Re- habilitation Loan must be accompanied by a non-refundable application fee of $25.00. Evidently when the Ordinance was passed, it was felt that this application fee would help to defray the Village's expenses in processing the application, and would convey the applicant's com.m.ittment to the Rehabili- tation Program, %_ Upon closer evaluation, it appears that this $25.00 application fee will be more trouble than it is worthft Jean Kleist, our HUD representative, has stated that charging such a fee is "highly unusual", and that all the expenses of processing the loan application can be covered with our Block Grant monies, Furthermore, if we do charge this fee it must be counted as - program income" under the Block Grant program. This will cause extra paperwork and be rather cumbersome in our annual application and. record-keeping. For the amount of income that the fee will produce (estimated at a maximum $250./year), I do not believe that it is worth this administrative effort. I would recommend that, if possible, Ordinance No. 3060 be amended to delete the statement in Section Eight which refers to this application fee. Please advise as to the course of action to be taken. ORDINANCE NO. AN ORDINANCE TO PROVIDE FOR LICENSING AND REGULATING CERTAIN GAMES OF CHANCE WHEREAS, The Illinois General Assembly has enacted Public Law 81.1365, authorizing the governing body of any county or municipality to establish a system for the licensing or organizations to operate raffles in accordance with the limitations and requirements set forth in said Act; and WHEREAS, The President and Board of Trustees of the Village of Mount Prospect find that it is in the best interests of the Village that such a system be established. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF.MOUNT PROSPECT, COOK COUNTY, ILLINOIS AS FOLLOWS: SECTION ONE: That Chapter 11 of the Municipal Code of the Village of Mount Prospect by renumbering Articles XXXI and XXXII as Articles XXXII and XXXIII and by renumbering the sections therein and by adding thereto a new Article XXXI, Raffles and Chances, which Article XXXI shall be and read as follows: ARTICLE XXXI RAFFLES Sec. 11.3101. DEFINITIONS. For the purpose of this Article, the terms "new proceeds" and `raffles" shall have the meanings given them under Section 1 of "An Act to provide for licensing and regulating certain games of chance", enacted by the 81st Illinois Gen- eral Assembly (hereinafter the "Act"), and the terms "non-profit", "charitable". "educational".. "religious", "fraternal", "veterans", and "labor" shall have the meanings given them under Section 2(b) of the Act. Sec. 11-3102. LICENSE REQUIRED. It shall be unlawful to conduct a raffle without having obtained a license therefore pursuant to this Article. Sec. 11.3103. ELIGIBILITY -FOR LICENSE. A. Licenses shall be issued only to bona fide religious., charitable, labor, fraternal, educational or veterans' organizations that-op-erate without profit to their members and have been in existence for a period of 5 years immedi- ately before making application for a license and which have had during the entire 5 year period a bona fide membership engaged in carrying out their objects. B. No license should be issued to any of those persons, firms, corporations, and organizations described in Section 3(5) of the Act, as it may be amended from time to time. Sec. 11.3104. APPLICATION FOR LICENSE, A. An application for a license to conduct a raffle pur- suant to this Article shall be made to the Village Treasurer on the forms provided by his off ice. Each application shall be in the form attached hereto as Appendix I and shall contain the following: 1. The names and address of the organization seeking the license. 2. The names and addresses of any, person who has a proprietary, equitable or credit interest in the firm or corporation seeking the license. 5. An affidavit that the applicant organization is not ineligible for a license under Section 3(5) of the Act, as it may be amended from time to time. 6. The name and address of the individual designated ..by the applicant organization to be the manager of the raffle. 70, A fidelity bond given by said manager in the amount. of $ 1"000 The terms of the bond shall provide that written notice shall be.given to the Village not less than 30 days prior to its cancellation. The President and Board of Trustees may waive this bond requirement for any given license provided they are presented with certification of a unanimous vote of the members of the applicant license that no bond be required. 8. Thearea-or,.areas within the Village in which raffle chanc,es will be sold or issued, the time period during which raffle chances will be-sold or issued, time of determination of winning.chances and the location or locations at which such winning chances will be determined. 9. The cost of each chance to win such raffle. 10. A sworn statement attesting to the not-for-profit : character of the applicant organization and to the fact that it has been in existence continuously for a period of 5 years immediately before making applica- tion for a license and that during that entire 5 year period, it has had a bona fide membership engaged in carrying out its objectives. C. A nonrefundable Ten Dollar ($10.00) application fee shall be paid at the time the application is submitted. No appli- cation shall be complete without the payment of such fee. D. The Village Treasurer shall act upon an application for a license within 30 days of receiving a complete application. Sec. 11.3105. LICENSES. A. Any license issued pursuant to this Article shall contain the following: 1. The name and address of the licensee. 2. The area or areas within the Village in which raffle chances will be sold or issued, the time period during which raffle chanceswill be sold or issued, the time of determination of winning chances and the location or locations at which winning chances will be determined. 3. If the bond requirement set forth in Sec. 11.3104. B.6. above has been waived, such waiver shall be noted on the license. B. Each license issued shall be valid for only one raffle. Sec. 11.3106. CONDUCT OF RAFFLES. The conduct of any raffle licensed pursuant to this Article is subject to the following restrictions: A. The aggregate value of all prizes or merchandise awarded in a single raffle shall be no 'greater than $25,000 B.' The maximum retail value of each prize awarded shall be 6 2550000 C. The price charged for each raffle chance issued or sold shall not exceed $ 200 D. Chances for a single raffle may not be issued or sold for more than 120 days. E. The entire net proceeds of any raffle must be exclusively devoted to the lawful purposes of the licensee organization. F. No person except a bona fide member of the licensee organization may participate -in the management or operation of the raffle. G. No person may receive any remuneration or profit for Participating in the management or operation of the raffle. H. A licensee may rent a premises on which to determine the winning chance or chances in a raffle only from an organization which is also licensed under the Act. I. Raffle chances -'M,,ay be sold or issued only -within the area specified on the license and winning chances may be determined only at those locations specifiedonthe license. J. No person under the age of 18 years may participate in the conduct of raffles or chances. A person under the age of 18 may be within the area where winning chances are being determined only when accompanied by his parent or guardian. K. All operation and conduct of a raffle shall be under the supervision of;the raffles manager designated in the application, for license. Sec. 11-3107. RECORD KEEPING. Each organization licensed pursuant to this. Article shall maintain records and make reports as required by Section 6 of the Act. Sec. 11.3108. REVOCATION AND SUSPENSION. A. The Village Treasurer may deny, suspend or revoke any license issued pursuant to this Article if he determines that: 1. The application contains any false, fraudulent, or misleading q1tatement;.or 2. The applicant,,licensee, or any officer or director of. the applicant or licensee has violated this Article, or any other ordinance of the Village of Mount Prospect. B. If any license issued pursuant to this Article is revoked, the licensee shall immediately refund all monies collected to the persons who purchased tickets or chances in the raffle authorized by the revoked license. 3 SECTION TWO: Paragraph 2 of Section 11.605-B or Article VI of Chapter 11 of the Municipal Code of the Village of Mount Prospect is amended by deleting said Paragraph 2 in its entirely and by substituting therefor a new Paragraph 2 to be and read as follows: 2. It is unlawful for any person or organization to establish, set up, maintain, carry on, and/or otherwise conduct a lottery or raffle in conjunction with any such carnival -:-or circus unl"ss a license to do so has been issued as provided in Article XXXI of this Chapter. SECTION THREE: Section 23.503 of Article V of Chapter 23 of the Municipal Code of the Village of Mount Prospect be and the same is hereby amended by inserting after the word "tickets" and before the period at the end of said Section the language ", except that the conduct of a raffle licensed pursuant to, and conducted in accordance with Article XVI of this Chapter shall not be prohibited" so said Section 23.503. shall hereafter be,and read as follows. - Sec. 23.503. Lotteries.
