MANAGER I S REPORT Village Manager Terrance Burghard presented a request LIBRARY BOARD from the Mount Prospect Public Library Board to advance REQUEST FOR LOAN funds in the amount of $45,,000. It was explained that the advance would be necessary to meet expenses until taxmonies are received from Cook County. Trustee Miller, seconded by Trustee Wattenberg . moved to authorize a loan to the Board of Directors of the Mount Prospect Public Library in the amount of $45 9, 000 t said d loan to be paid back when the tax moniesAn the first installment of the 1980 taxes are received next spring, with no interest to be charged *d an . on sal lo Upon roll call: Ayes: Farley Floros Miller Murauskiis Richardson 'Wattenberg Nays: None Motion carried. Mr. Burghard requested responses from representatives of LAKE BRIARWOOD the Lake Briarwood relative to the proposed stabilization of DRAINAGE PROBLEM certain banks with the Village to participate by incurring 50% of the bid amount, not to exceed $18,000. Since no representatives were present from Lake Briiarwood, the matter was continued to the January 6, 1981 Village Board meeting for final action. The Village Manager presented a leasebetween the Village V & G LEASE of Mount Prospect and V & G Printing for Village owned property at the northeast corner of Busse Avenue & Mami Street. Mr. Burghard noted that the proposed lease is for a 2 year peri0 d and that the rent will be increased 10% for 1981 and o I an additional 10% for 1982. Mr. Burghard announced that the traffic signal at Euclid and TRAFFIC: Wheeling Roads will be *installed with the costs to be divided Euclid & Wheeling between Prospebt-Heights at 25%. Mount Prospect 25% and Traffic Signal Cook County incurring 50% of the installation cost. Trustee Murauskis, seconded by Trustee Farley, moved to authorize the Mayor to sign and Clerk to attest her signature on an agreement for the installation of a traffic signal at Euclid and Wheeling Road with the Village incurring 25. -cif the cost of installation and 121% of the maintenance costs. The Village Manager presented an ordinance for second AMEND CH. 18 reading amending the Traffic Code to include "No Parking" at specified areas on Mount Prospect Road at Central Road. Trustee Richardson, seconded by Trustee Wattenberg . moved ORD. NO. 3074 for passage of Ordinance No. 3074 AN ORDINANC AMENDING THE MOUNT PROSPECT TRAFFIC CODE Upon roll call-. Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. Mr. Burghard presented an Agreement with the Forest FOREST RIVER FIRE River Fire Protection District for 1982 for consideration . PROTECTION DIST Trustee Richardson, seconded by Trustee Farley, moved RES. NO. 45-80 for passage of Resolution No. 45-80 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH FOREST RIVER FIRE PROTECTION DISTRICT 3_ roll call- Ayes. Ione Motion carried Mr. Burghard stated that the Mount Prospect Rural Fire MOUNT PROSPECT Protection District had been dissolved by court order and :RURAL FIRE therefore no agreement will be necessary. PROTECTION DIST. The Village Manager announced that the water allocations LAKE MICHIGAN had been: given by the Illinois Department of Transportation WATER. ALLOCATIOb stating that the allocation was between 500,000 to 1,000,000 gallons per day lower than 'requested,, the Director of Public works feels the allocation 1S sufficient. MAYOR'S REPORT , Maur Krause; prresented. a Resolution for Board consideration. RES. COMMITTEE REPORTS BUILDING COMMITTEE Mayor Krause called the Public Hearing relative to a request ANNEX. AGREEMEI" I to enter into an Annexation Agreement for property located REQUEST -- Kenneth at the eastern point of the Kenneth. Drive cul de sac to order. ;Drive It was announced by Trustee Floros that the request for such an Annexation Agreement had, been withdrawn by the petitioner. ZBA 50--Z-80 and ZBA 51-V-80, Kenneth Drive ZBA 50-Z-80 & Trustee Floros noted that the above stated cases had been ZBA '51* --80 -- wlthdrawn by the petitioner. FINANCE COMMITTEE Trustee Miller, seconded by Trustee Murauskis . moved AMEND CH. 13 for passage of Ordinance No. 3075 ORD. NO. 3075 AN ORDINANCE AMENDING SECTION 13.106.A OF CHAPTER 13 OF THE MOUNT PROSPECT MUNICIPAL CODE TO INCREASE LIQUOR LICENSE FEES Upon roll call: Ayes** Farley Miller Murauskis Richardson Krause Pays: Miller Wattenberg Motion carried. Trustee Miller presented the Finance Committee report on SECOND QUARTER the second quarter financial report. There was discussion FINANCIAL REPORT on the recommendation of the Finance Commission to reduce the present tax levy by 250 9 000 , however . the Finance Committee did not agree with that recommendation. Trustee Miller, seconded by Trustee Wattenberg, moved to TAX LEVY - 1980 concur with the recommendation of the Finance Committee to not abate the 1980 tax levy. Upon roll call: Ayes: Farley Miller Murauskis Richardson Wattenberg Nays.- Floros Motion carried, Trustee Miller gave a status report on various points raised by liquor license holders and those subjects will be discussed at a future Finance Committee meetings. FIRE AND POLICE COMMITTEE Trustee Murauskis presented the Fire and Police Committee MAPLE CREST - report relative to a request received from Citizens Utilites CITIZENS UTILITIES for an emergency cross connection in the water lines in the Maple Crest area. It was the opinion of the Committee that provii g such a cross connection would serve the need of in the residents. Trustee Murauskis presented the Committee report on the PUBLIC SAFETY DEPT study conducted,, on the feasibility of combining the Fire and Police Departments into a Public Safety Department noting -5 - such a consolidation would be extremely costly and the consensus of the Committee was to remove this charge from Committee. Trustee Murauskis, seconded by Trustee Farley , moved to concur With the recommendation of the Fire and Police Committee to table the sub*Iect of a Public Safety Department to an unspecified date in the future. Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. LEGISLATIVE /JUDICIARY COMMITTEE No report. PUBLIC HEALTH AND SAFETY COMMITTEE Trustee uraus is , seconded by Trustee Floros moved TRAFFIC : to waive the rule requiring two readings of an ordinance AMEND CH. 18 in order to take action on an ordinance authorizing 4` 4 -way STOP at the intersections of Busse Avenue & Owen and Henry & Prospect Manor. PUBLIC WORKS COMMITTEE Trustee Farley stated that a Special Meeting of the Public CABLE T.V. The exact reasons for the failure will not be known until the Well is taken apart and examined more closely. Well #11 is the only remaining major Well in production on the south side of Mount Prospect due to repairs on Well #16. Because of the critical need to maintain sufficient capability for fire protection and with concern that Well #16 will not be enough for this area's water needs following winter, I authorized Public Works Director Herb Weeks to proceed immediately with obtaining a contractor for repairs. The estimated cost of repairs is approximately $259000. The balance of the emergency Well repair account is presently $9,000, however, Mr. Weeks estimates that sufficient funds are remaining in other accounts so that budget transfers would be possible to make up the remaining dollars that is needed for the repairs. After discussing the matter with Mayor Krause, she requested that I bring this matter to the attention of the Village Board and request ratification of the actions to begin emergency repairs on Well #11. FRIVOLOUS SUIT Assistant Village Manager Geick presented the Committee information regarding how frivolous suits are handled in the cities of :Evanston and Des Plaines. These suits are most commonly seen with regards to Federal civil rights cases. Under the Civil .fights' Act, the Federal government has provided the means by which state and local government can seek reimbursement for those legal costs which they have expended in their defense. The most common types o civil rights cases involve police w th regard to the use of excessive force or obstruction of rights. Illinois State Statute's are not clear re `girding a : licipality's right to seek recovery of their defense costs regar, g suits. Ross, Hardie.s .has been working on this,. quest ion and *$ about to release a staff report. This report will be con,sl, dered by the Committee at a future meeting. Trustee watt erg suggested, and the Committee agreed, that the Northwest Municipal Conference should be contacted about this question. Assistant Village Manager Geick will contact the Conference to see what interest they may have in this matter. PENDING G LEG L The Committee reviewed the pending litigation report ,from attorney Marlin Smith of Ross, Ha:rdies O'Keefe, Babcock and Parsons dated. December 5, 1980. The Committee discussed various items in the report and the manner in which it was written.. The Committee recommends that additional information be included in future pending litigation reports to include . the number of continuances made on cases and who recommended those continuances, the hours spent by the firm on this case and that when appropriate, the report should include a dollar amount of the recovery that has been: requested. Committee was made'aware aware that Feder4l,'guidelines regarding the use of Community Development, ock Grant funds ,will not now permit the use of these funds in any area other than an established Neighborhood ood Strategy Area (NSA) which area is designated i -n. the Tillage's grant -application.This is a change from the information the Committee initially receivers from the staff regarding the use of Community Development Block grant fund's':. The Neighborhood Strategy Area covers an area. somewhat larger than the Village's present do�wntown see map attached). Based upon the information received, application for designation of rehabilitation areasby businesses outside of the: NSA. would have to be considered separately and would have to be funded with other than Community Development Block Grant funds. The Committee would like to obtain clarification or this information with regards to the presentwording in our ordinance from legal counsel and has directed the Assistant Village Manager to contact Ross, Hardlies for this information.. Mr. Fritz .also requested that some clarification regarding who is eligible to initiate the designation of rehabilitation areas be made by the Committee., Mr. Fritz recommends that the' staff and the Chamber of Commerce be eligible to initiate applications as well as single businesses or groups of businesses It is the staff's opinion that by allowing the Chamber or the staff to initiate application, it would greatly reduce the amount of time difficulty and confusion in theapplication process besides providing some greater incentive .for businesses to apply for loans since the rehab areas would already have been estabis'h.ed.. The rehabilitation, loan application process then would be shorter and quicker for businesses to use. The Committee recommended 3 -to o in favor of these recommendations. The Committee will consider at a future meeting further staff recommendations *regarding criteria for eligible rehabilitation activities . ' Committee members discussed the use of Community Development Black Grant funds by the Tillage in the future and suggested that a review of this program be conducted by the Village Beard or one of its committees sometime during the upcoming budget preparation. -4 - NEIGHBORHOOD PRESERVATION ACT The Committee received information from the Northwest Municipal Conference Government Information Center regarding the passage of Public Act 81-1218 which amends Senate Bill 244 that had been passed in 1979. Senate BI -11 244 provided for a ten-year property assessment freeze for single family detached dwellings built before the year 1939. Single family dwellings which qualified by date had to be located in a local or national preservation district in order to qualify under this legislation. At the present time', no such preservation districts exist in the Village. There are several homes ire. the Village which would qualify for inclusion under this Act, however, because of the condition and quality of housing in the Village, the Committee did not see a prevailing need to provide the means for these homes to become eligible for this program. Evanston is the only community thus far to opt out of the State's preservation/assessment freeze program. Governor Thompson, the National Trust for Historic Preservation and the Illinois Landmarks Preservation Council have recommended numerous changes in Senate Bill 244 and Public Act 81-1218 to make this legislation more equitable and easier to administer. Based upon this information and the small amount of property in the Village which would be eligible under this program, the Commitee recommended by a 3 to 0 vote in favor of passing an ordinance or resolutionwhIch would exclude the Village from the State's program. This meeting ,will be open to all of the Village Board members. Those legislators to be invited are: Donald L. Totten, Roland J. Meyer and Robert Kustra. In a related matter, Trustee Wattenberg suggested that the Dean from DePaul Law School be invited to attend and to address the Committee on the quest ' ion of frivolous suits. The other committee members agreed with Trustee Wattenberg's suggestion and recommended that Village Manager Burghard make an invitation to DePaul.
