AND APPENDIX A, DIVISION 111,
OF THE VILLAGE CODE, OF MOUNT PROSPECT
Section 23.103: CANNABIS:
A. For purposes of this section, the term "cannabis" shall include marijuana,
hashish, and other substances which are identified as including any part of the plant
Cannabis Sativa, whether growing or not; the seeds thereof; the resin extracted from anj
part of such plant; and any compound, manufacture, salt, derivative, mixture or preparation
of such plant, its seeds or resin, including tetrahydrocannabinol (THC) and all other
cannabinol derivatives, including its naturally occurring or synthetically produced
ingredients, whether produced directly or indirectly by extraction, or independently bj,
rneans of chemical synthesis or by a combination of extraction and chemical synthesis.
However, this term shall not include the mature stalks of such plant; fiber produced from
such stalks; oil or cake made from the seeds of such plant; any other compoundl
manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin
extracted therefrom); fiber, oil cake; or the sterilized seed of such plant which is incapable of

the Industrial Hemp Act. "Cannabis" also means cannabis flower, concentrate, and

B. It shall be unlawful for any person to knowingly possess cannabis within the
limits of the Village, except as otherwise permitted by the Compassionate Use of Medical
Cannabis Program Act (410 ILC S 130/1 et seq.) or the Cannabis Regulation and Tax Act
(410 1 LC S 70511-1, et seq.). This section shall not be construed as conflicting with or limiting
enforcement of the Illinois Cannabis Control Act, 720 ILCS 550/, as amended from time to
time.
C. Prohibited Use of Cannabis in Any Form. It shall be unlawful to use cannabis
in any form in:
1 (1) any public place, such as streets or parks;
(2) in any motor vehicle;
(3) on school grounds, with the exception of medical users;
(4) a private residence that is used at any time to provide licensed child care;
(5) close proximity to minors under twenty-one years of age; and
(6) close proximity of an on -duty school bus driver, police officer, firefighter, or
corrections officer
Any person, business, or landlord can prohibit use on private property.
D. Any person who violates this section with respect to not more than thirty grams
(30 g) of marijuana shall be fined as set forth in appendix A, division III of this Code.
E. It shall be unlawful for any person, regardless of relationship, age, or
circumstances, to deliver any cannabis to any underage person.
F. It shall be unlawful for any person to knowingly permit or to knowingly or
negligently fail to immediately prevent or stop, on premises under his or her control, the
consumption of cannabis by an underage person. This section shall apply to residential,
public and commercial premises and to the private and regulated service of cannabis. For
purposes of this section, if a person over twenty one (21) years of age is in a residence

where underage consumption of cannabis is occurring, negligence in either permitting or
failing to prevent the consumption shall be presumed and the burden of proving that such
person was not negligent shall fall on such person.
G. Any person violating any of the provisions of this chapter shall be punished by
a fine as set forth in appendix A, division III of this code.
SECTION 2: Article IX, "Mass Gatherings," of Chapter 23, General Offenses, of the
Mount Prospect Village Code shall be amended as follows:
Section 23.901 "Definitions" of Article IX, "Mass Gatherings" of Chapter 23, General
Offenses, of the Mount Prospect Village Code shall be amended to change the definition of
"MASS GATHERING" as follows:
MASS GATHERING: Within the corporate limits of the village, any public gathering
of people numbering fifty (50 or more), whether such gathering is indoors or outdoors, or a
combination of both.
Section 23.902 "Permit Required; Exemptions:" of Article IX, "Mass Gatherings" of
Chapter 23, General Offenses, of the Mount Prospect Village Code shall be amended by
deleting the first sentence in its entirety and replacing it with the following: "Except as
otherwise provided in this article, no mass gatherings may be set up, held or promoted
unless a written permit has been obtained from the Village by such organizer(s) at least five
(5) days In advance. If it is not possible to provide at least five (5) days of advance notice,
the organizers shall provide as much notice as possible."
Section 23.903 "Application for Permit" of Article IX, "Mass Gatherings" of Chapter
23, General Offenses, of the Mount Prospect Village Code shall be amended to delete
subsection B in its entirety.

Section 23.904 "Review of Application" of Article IX, "Mass Gatherings" of Chapter
23, General Offenses, of the Mount Prospect Village Code shall be amended to delete
subsection B. in its entirety and replace it with the following:
B. Denial of Permit; Appeal. The Village Manager shall act upon the application for
a permit for a mass gathering within three (3) days after the filing thereof. If the Village
Manager disapproves the application, he shall mail to the applicant within three (3) days
after the date upon which the application was filed a notice of the action, stating the reasons
for denial of the permit. Any person aggrieved shall have the right to appeal the denial of a
permit to hold a mass gathering to the Village President and Board of Trustees of the
Village. The appeal shall be taken within three (3) days after notice of rejection. The
Village President and Board of Trustees shall act upon the appeal at the next regular
meeting of the Village President and Board of Trustees.
SECTION 3:, Section 23.2302 "Offense of Retail Theft" of Article XXIII "Retail Theft"
of Chapter 23, General Offenses, of the Mount Prospect Village Code shall be amended by
deleting subsection A in its entirety and replacing it with new subsection A and new
subsection A.1 as follows:
"A. Takes possession of, carries away, transfers or causes to be carried away or
transferred, any merchandise displayed, held, stored or offered for sale in a retail mercantile
establishment with the intention of retaining such merchandise or with the intention of
depriving the merchant permanently of the possession, use or benefit of such merchandise
without paying the full retail value of such merchandise. Retail theft of items with a total
value of under $300.00 shall be subject to a fine of $200, as set forth in Appendix A,
Division III of this Code of Ordinances.

A.1 Retail Theft of items with a value of $300.00 of value and over shall be subject
to a fine of $500.00, as set forth in Appendix A, Division III of this Code of Ordinances.
SECTION 4: Section 23.202 "Indecent Conduct" of Article 11, "Indecent, Immoral
and Obscene Related Offenses" of Chapter 23, General Offenses, of the Mount Prospect
Village Code shall be deleted in its entirety and amended as follows:
"23.202 INDECENT CONDUCT:
It shall be unlawful for any person to commit any indecent or immoral act; or to
appear in any public place not properly or decently garbed."
SECTION 5: A new Section 23.120 "Negligent or Distracted Driving" of Article 1
"General Offenses" of Chapter 23, Offenses and Miscellaneous Regulations of the Mount
I
Prospect Village Code shall be added. Section 23.120 shall read as follows:
Section 23.120 — NEGLIGENT OR DISTRACTED DRIVING
A. For the purpose of this section, the following definitions shall apply unless the
context clearly indicates or requires a different meaning:
DISTRACTED: To disregard road conditions and other vehicular and pedestrian
traffic by not paying full attention to the operation of a motor vehicle while
operating on a public highway.
NEGLIGENT.- Without due care and caution, or without due regard to the width,
grade, curves, corners, traffic and other attendant conditions of streets, highway,
roads, or other ways used for vehicular traffic within the village limits.
VEHICLE: Every device in, upon, or by which any person or property is or may
be transported or drawn upon a highway, except devices moved by human power
or used exclusively upon stationary rails or tracks.

B. It shall be unlawful for any person to operate a vehicle in a negligent or distracted
manner within the village limits. Persons committing this offense shall be subject
to the penalty set forth in Appendix A, Division 111, of this Code.
SECTION 6: Appendix A, Division 111, "Penalties and Fines" shall be amended by
adding pre -pay amounts as set forth in the Appendix A to this Ordinance to the following
Chapters as designated therein: Chapter 9; "Public Utilities, Pavement and Tree
Regulations;" Chapter 11; "Merchants, Businesses, Occupations and Amusements;"
Chapter 13 "Alcoholic Liquors;" and Chapter 23; "Offenses and Miscellaneous Regulations."
Each Section shall be amended to show the pre -pay fine in the following manner: Pre -Pay
Fine I (as set forth in Column D, Pre -Pay Fine, of Exhibit "A"). Nothing in this
Section shall be construed to make pre -pay fines mandatory or to pre-empt the discretion of
the issuer of any violation.
SECTION 7: That this ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law,,,
