SUBJECT: LIQUOR LICENSE APPLICATION
On Tuesday, April 9, the Village Manager interviewed Mr. Younan
David, of the Seagull Grill, Inc., who submitted a Class S Liquor
License application to do business as the Seagull Grill at 253
East Rand Road. This building formerly housed Le Bistroquet
which closed its doors for business some eight weeks ago. Le
Bistroquet was previously issued a Class S Liquor License.
As the name suggests, the restaurant will be oriented towards
fresh fish entrees and they expect to price their dinners in the
$9.00 to $12.00 range. According to the owner, Mr. Younan David,
after they become established, they will open up for lunch and a
Sunday brunch. They plan on presenting live entertainment in the
lounge'on Friday and Saturday evenings and if the business grows,
they will provide live entertainment Tuesdays through Saturdays.
They are prepared to open immediately and their lease is contin-
gent upon their ability to achieve the local Liquor License.
Their lease contains a provision to purchase the property within
four years,
Mr. David, President and 100% stockholder had experience as the
Assistant Food and Beverage Director for the Hilton Hotels from
1974-1981 ...In 1981 he moved to the Radisson Hotels in Chicago
and is Director of Food and Beverages. He and his brother own
Christy' -s Restaurant and Cocktail Lounge in Glenview. They have
been the Owners and operators of that establishment for the last
four years,
The necessary fees and documents have been submitted and reviewed
by the administrative staff. Inquiries with the Village of
Glenview validates the operation of Christy's Restaurant in that
community without operational problems,,
No Ordinance is necessary should the Board decide to proceed in
this matter. It is brought to your attention consistent with our
policy*

ORDINANCE NO.
AN ORDINANCE TO TERMINATE VARIATIONS PREVIOUSLY
GRANTED FOR PROPERTY AT 701 EAST PROSPECT AVENUE
IN THE VILLAGE OF MOUNT PROSPECTL -ILLINOIS
WHEREAS, on November 5, 1980 this Board adopted Village
Ordinance No. 3065 to grant certain variations to property known as
701 East Prospect Avenue in the Village of Mount Prospect, Illinois;
WHEREAS, among the variations granted by Village Ordinance No.
3065 was a variation to permit the elimination of required loading
spaces and the reduction of required off-street parking spaces on
the Subject Property to 48; and
WHEREAS, said variations were granted pursuant to a public
hearing at which Petitioner Raymond G. Hoven, the owner of the
Subject Property submitted testimony and evidence indicating that
his business use of the Subject Property located in the 1-1 Light
Industrial District under the provisions of the Zoning Ordinance of
the Village would be such that the elimination of required on-site
loading spaces and reduction of parking spaces would not adversely
affect the supply of parking within the immediate area or
substantially increase congestion in the public streets; and
WHEREAS, following the granting of said variations the
Petitioner's business has increased in scope' and number of employees
so that adequate parking is no longer available on the Subject
Property; and
WHEREAS, employee parking has spilled over onto the public
streets serving adjacent residential areas of the Village and such
parking has created congestion of public streets and has adverseiy
affected the supply of parking within the- immediate area, and has
had an adverse effect on the residential character of adjoinihg
properties; and
WHEREAS, the Zoning Board of Appeals of this Viiiage conducted a
public hearing, upon the publication of due notice thereof and the
President and Board of Trustees of this Viiiage has received further
public comment regarding the congested parking situation and has
determined that the circumstances upon which the above stated
variations were given in 1980 are no longer in effect and that the
Petitioner's business activities have expanded to such an extent
that employee parking can no longer be adequately provided for or
contained within the Subject Property; and
WHEREAS, it is the determination of the President and board oar
Trustees of this Village that the variations no longer meet tne
standards set forth in Section 14.605 of Article YX of the Zoning
Ordinance of the Village of Mount Prospect and therefore such
variations should be terminated.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILIjINOIS, AS
FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are incorporates
herein as findings of fact by the President and Board of Trustees of
the Village of Mount Prospect.
SECTION TWO: The following variations heretofore granted to the
property commonly known as 701 East Prospect Avenue in the Village
C
of Mount Prospect, Illinois pursuant to Village Ordinance No. 3065,
are hereby terminated, to wit:
1. A variation from Section 14*2205-A-1 of Article XXII of the
Zoning Ordinance to reduce the total number of required
off-street parking spaces to 48.
2. A variation from Section 14,2205,B.l,b of Article XX11 of
the Zoning Ordinance to permit the elimination of required
loading spaces*
SECTION THREE: This Ordinance shall be in full torce and etfect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.

AN ORDINANCE ANNEXING TO THE VILLAGE OF MOUNT PROSPECT
LAND LYING IN SECTION 22, TOWNSHIP 41 NORTH, RANGE 11,
EAST OF THE THIRD PRINCIPAL MERIDIAN COOK COUNTY, ILLINOIS
WHEREAS, a written petition under oath signed by the owners
of record of the land hereinatter described, as well as the electors
residing on said land, has been tiled with the Village Clerk of the
Village of Mount Prospect requesting that said land be annexed to
the Village of Mount Prospect; and,
WHEREAS, said land is not within the corporate limits of
any municipality, but is contiguous to the Village of Mount
Prospect; and
WHEREAS, due and timely notice of the proposed annexation
has been given to the Board of Trustees of the Elk Grove Rural Fire
Protection District, to the Highway Commissioner and the Board of
Town Auditors of Elk Grove Township, in the manner and Corm as
required by stature -9 and
WHEREAS, no portion of said property is located within any
library district; and
WHEREAS, the President and Board of Trustees of the Village
of Mount Prospect, Illinois, tind and believe it to be in the best
interest of the Village of Mount Prospect that the said land be
annexed to the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That all land and territory legally described
as tollows, to wit.
Lot 13 (except that part thereot described as
tollows: Beginning at the Southeast corner of
Lot 13: thence Northwesterly along the
Southwesterly line thereot; a distance of 34.0
Leet; thence Northerly 145.54 Leet to a point on
the Northeasterly line of said Lot 13, 6.50 Leet,
chord measure, Westerly of the Northeasterly
corner thereot; thence Easterly 6.50 teet to the

A RESOLUTION DECLARING THE RESULTS OF THE
GENERAL CONSOLIDATED ELECTION HELD APRIL 2, 1985
WHEREAS, a regular election was held in and for the Village of
Mount Prospect, Cook County, Illinois, on Tuesday, April 2. 1985,
for the purpose of electing one (1) Village President (four
year term), three (3) Village Trustees (four year terms), and
two (2) Library Board Directors (6 year terms); and
WHEREAS, the Local Canvassing Board has conducted the official
canvass and presented the results as follows; and
WHEREAS, the Mayor and Board of Trustees of the Village of
Mount Prospect do hereby declare the results of the April 2. 1995
election for said Village.
NOWr THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

Hesper Kim Choi, presented this request for a variation for a
24-12- foot wide driveway. Mrs. Choi explained that this is the
first home she and her husband ever owned and that they were
unaware of the regulations. When the home was built an 18 foot
wide driveway was installed, however, when the builder was in
the process of building the home next door the Choi's asked the
builder if he would widen'their driveway to its present width
which would allow them the necessary space to park their vehi"cles.
The petitioner had appeared before the Zoning Board of Appeals
several months ago with this request, however the demensions were
not accurate and therefore the Zoning Board could only consider
the request as presented. The petitioner chose to refile the
case.
While,the Zoning,Boa*d of Appeals stated the property owner should bi
aware of local regulations, they did discuss the fact that the
contractors do know the regulations and suggested that sanctions
should be taken against'the contractors that perform work without
acquiring permits.
The Zoning Board of Appeals also felt that the petitioner would,
incur a hardship if required to remove the 6h feet of driveway.

DATE: APRIL 10, 1985
The petitioner is requesting a variation from Section 14.116,C.
to allow for a 24 1/2 foot driveway instead of the normally
allowed 18 foot wide drive. The driveway was installed in
violation of the ordinance and without benefit of a permit. The
Zoning Board of Appeals considered the case at their March 28,
1985 public hearing and voted 3-2 in favor of the applicant.
Because of this vote, in order to approve the petition, four of
the six Trustees must vote in favor of the request. The
Community Development staff questioned the hardship of the
petitioner in relationship to any other homeowner in the Village
and felt that this was a convenience rather than a hardship.

The petitioner is requesting a variation from the requirements of
the Zoning ordinance in order to allow a larger truck, 8,000 lb.
gross vehicle weight, instead of the normally permitted 1 1/2 ton
truck. The petitioner was cited by the Code Enforcement Depart-
ment as having a truck in excess of the requirements. This is
evidently a commercial vehicle that is also used as the
petitioner's personal vehicle. The Community Development staff
raised the question of whether commercial vehicles should be en-
couraged in residential areas. The Zoning Board of Appeals
recommended 6-0 in favor of the applicant at their March 28, 1985
public hearing.

his case stating that he owns his own landscaping business

Mrs. Meier has an automobile but uses it for her transportation.
Mr. Meier stated that he has parked the truck in his garage
every night, however, a neighbor called to complain about his
vehicles, requiring this hearing.
Mr. Meier stated that there are several others trucks in the
area and that in his opinion his hardship would be the lass of
his personal vehicle used for transportation,to and from his
place of employment.
Mr. Petrucelli, seconded by Mr. Cassidy, moved to grant the
variation requested provided that the petitioner parks the
truck in his garage every night.

Mr. Paul Meinhardt, attorney for Mr. Marks, presented the.
petitioners case.
It was noted that the subject property is located just west of
Franks Nursery and completely surrounded by I-1 zoning district
uses.
With reference to the parking spaces requested, it was noted that
if the same standards were applied as granted the Kensington Center
the petitioner would meet the parking requlrements. Mr.,Meinhardt
explained that the business proposing to be located on -this

vacant lot is a specialized business dealing in the fabrication
of metal using very high technical processing.
It was noted that since the petition was submitted the site plan
has been revised eliminating the need for the rear yard variation.
A lbtter from a neighboring business was received stating that
they had no objection but hoped the Village,would be aware of
a possible noise level problem.
Mr. Green, seconded by Mr. Brettrager, moved to grant the
request for a one acre parcel in this zoning district and to
recommend a reduction in the numberof parking spaces from the

Mr. Szachowicz presented his case stating that he and his
wife had originally begun negotiatiozns'for this.parcel last

year, prior to the newly adopted regulations governing floor
area rdtio.
It was explaiined that the subject property is one of 3 lots
that were originally set aside,by Mr. Catino' as detention areas
for that.subdivision, however, the Village Board., at the request
of Mr. Catino and on the recommendation of the Village Engineer
released the -a lots -for detention --purposes a year or'so ago due
to improved 8tbrm sewers in the area.
The petitioner stated that he plans to build a 2 story single
family -home -on the land and that since the garage area is now
calculated Into the total floor area ratio the request for
variation is now necessary. If the garage was not included,
no such varic-ition would be necessary.
Those ' neighbors vo ' icing their opinions on the proposal were
concerned with flooding of their homes. It was explained that
a developed parcel -of land causes less flooding.problems than,
undeveloped land. Asthe land stands now, the clay bottom has
retained water for thes6 years and that when thd land is filled
and developed this will not be the 'case,

Mr. Robert Moore, attorney for the petitioner, presented the
request.
Mr. Moore explained that this 7.4 acre site was annexed to the
Village some 6 years ago and when property is annexed it
automatically becomes R -X zoning. The former property owner
has passed away and Mr. Md Kone has purchase the site and had
proposed a subdivision of 21 lots.
The property is located immediately east of Weller Creek and
abutts R-1, single family, zoning on the east and north. Across
the street on the south is the Mount Prospect Park District Golf
Course.
Mr. Moore noted that the plan to build 21 lots has been amended
at the recommendation of the Plan Commission and the development
is now planned to have 19 single family homes which would sell
in the area of $200,000. The subdivision proposes that Bobby Lane
will be extended through to Lincoln Street and 3 homes would be
located on the cul de sac at Weller Lane. Mr. Moore also noted
that the Comprehensive Plan of the Village proposes this land
for single family homes.

for the resurfacing of various village streets. This Resolution
which is required by IDOT, allows the Village to expend the
monies from MFS' funds. This Resolution does not, however,
obligate the Village to spend the funds. I recommend that the
Mayor and Board of 'Trustees approve this Resolution at the April.
16, 1985 Board Meeting.
This project will be paid for with funds from Account Number
22-074-08-8505 from the proposed 1985-86 fiscal budget.

AN ORDINANCE ADOPTING AN ANNUAL BUDGET FOR THE
VILLAGE OF MOUNT PROSPECT FOR THE FISCAL YEAR
COMMENCING MAY 1, 1985 TO APRIL 30, 1986 IN
LIEU OF PASSAGE OF AN APPROPRIATION ORDINANCE.
WHEREAS, the President and the Board of Trustees of the Village
of Mount Prospect in accordance with Statutes, have provided for the
preparation and adoption of an annual budget in lieu of passage of an
appropriation ordinance for the fiscal year commencing May 1,, 1985 to
April 30, 1986; and
WHEREAS, the Tentative Annual Budget for the Village of Mount
Prospect for the fiscal year beginning May 1, 1985 and ending April 30,
1985, as prepared by the Budget Officer for the Village and submitted
to the President and Board of Trustees, was placed on file in the
office of the Village Clerk on April 4, 1985, for public inspection,
as provided by statute; and
WHEREAS, pursuant to notice duly published on April 4. 1985, a
public hearing was held by the President and Board of Trustees on said
Tentative Annual Budget on April 16, 1985, as provided by statute and
resolution; and
WHEREAS, following said public hearing, said Tentative Annual
Budget was reviewed by the President and Board of Trustees and a copy
of said Tentative Annual Budget is attached hereto and made a part
hereof and is before the President and Board of Trustees for conside-
ration and adoption.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION ONE: The Tentative Annual Budget for the Village of
Mount Prospect beginning May 1, 1985 and ending April 30, 1986, a copy
of which is attached hereto and made a part hereof, is hereby approved
and adopted as the Annual Budget for the Village of Mount Prospect for
said fiscal year.
SECTION T,WO-. Within thirty (30) days following the adoption of
this Ordinance there shall be filed with the County Clerk of Cook
County a copy thereof duly certified by the Village Clerk and an Esti-
mate of Revenues by source anticipated to be received by the Village

Attached is a schedule which lists the changes to the. 1985/86 budget that
were approved during the recent budget hearings. The changes are summa-
rized below:
1. Revenues will be increased $11,000 in the General Fund
because of the revision to the Forest River Fire Protection
Agreement, and $30,515 in the CDBG Fund because of the
increase in expected expenditures. Additionally, Library
revenues of $1,415,400 have been added. The total increase
in revenue changes is $1,456,915 and will raise total budget

2. An appropriation of $30,515 has been added to the Community
Development Department as a reimbursement to the River
Trails Park District for construction of a park in the
Boxwood area.
3. In the Street Division budget, $15,000 has been added for
participation in a solid waste study.
4. Under Community ty and Civic Services, $3,000 has been added as
a contribution to Omni House and the contribution to the
Mount Prospect Historical Society has been increased from
$1,250 to $2,500.
5. Library budget requests of $1,415,400 have been added.
6. Total expenditure changes of $1,465,165 will increase the
proposed budget of $23,785,510 to a tentative budget of
$25,250,675.

The above amounts appear in the notice for the public hearing on April 16, 1985
of Proposed Revenue Sharing ,Ex'p'enditures.
Questions over the future of the Federal Revenue Sharing Program were expressed
during the budget hearings and during the budget review by the Finance
Commission. The concerns were over how long Revenue Sharing would continue to
be funded by the Federal Government and how the funds would be replaced by the
Village, if and when they are eliminated.
In response to the first question, it appears that the current level of funding
will continue through September 30, 1986. Previous legislation had extended
theprogram through this date, but the President has requested that funding be
terminated as of September 30, 1985. There has been strong resistance to this
request and based upon the latest information from the Governmental Finance
Officers Association, the indication is that funding will be continued through
September 30, 1986. However, it appears at that time, the program will either
be eliminated or substantially reduced.
The Village's 1985/86 budget was prepared in anticipation that funding would
be received through September 30, 1986.. The following schedule shows the
shortage of available funds to finance 1985/86 proposed Revenue Sharing expen-
ditures if the program is terminated as of Se tember 30, 19 5, or the estimated
funds that will be available for the 1986/87 budget if funding is continued
through September 30, 1986.

If Revenue nue Sharing is terminated on 9/30/35, there will be a shortfall of
$69,000 in the 1985/86 budget, but if funding continues through 9/30/86 there
will be approximately $231,000 available for financing the 1986/87 budget.
In response to the concern of how we will replace Revenue Sharing monies if
and when the program is eliminated, it appears that an increase in property
taxes will be required. We would be able to finance the possible 1985/86
shortfall from the cash balance of the General Fund, but we viould not be able
to continue that practice for more than one year.
At this time, I think we should wait until we receive definite information as
to what will happen to the Revenue Sharing Program. We should know before
the 1985 tax levy ordinance is prepared, and we can then respond accordingly.

small, 25 foot wide, lots into a single lot of record. The
location is the home of the Precision Automotive Sales and
Service approved by the Village Board earlier this year. The
resubdivision was a requirement of the Zoning Ordinance for the
rezoning and variations granted. The Plan Commission voted
unanimously to approve the resubdivision at their April 3, 1985
meeting,
