BURGHARDo VILLAGE MANAGER FROM: KENNETH He FRITZJV COMMUNITY DEVELOPMENT DIRECTOR SUBJECT: REVISED DEVELOPMENT CODE DRAFT DATE: JANUARY 18, 1985 TheCommunity Development staff, together with staff members of Engineering, Public Works, and Code Enforcement have completed a draft of a proposed Development Code. The staff's approach in updating the Development Code was to use an entirely new format and compile the work already researched earlier by staff over the last several years, and combine those sections into a new comprehensive format consistent with up-to- date regulatory concepts, 0 0 0 V 1ft 9 a I M 111,11150111 '111!!''! 1111, Some of the major items that were added to the new Code or updated include: Procedures for application for development and the can of the required documents, (Article III* Procedures) 2. Design and construction standards for required public AN improvements were upgraded to include the latest technology and construction methods and materials. (Article IV Cons truct, ion,, Design and Installation Standards for Improvements 1.) 3. Landscaping standards (Section 16.408.B) were added for private property including maintenance requirements (ex- cludes single family residence). Terrance L. Burghard - Page Two January 18, 1985 4. Village Donation (Section 16-610) is a revision of the present standard for cash donation in lieu of land for recreational purposes and is a requirement of each development based on residential units. 5 0 Definitions (Article II) were added, as necessary, to help clarify the terminology contained in the Ordinance. 6 9 Erosion control and sedimentation standards (Section 16.402) were included for the first time, 79 Detention and Retention standards (Section 16.405.F) were updated and clarified. 8* Permit fees, subdivision improvement security and guarantees (Article VI) have been updated to include the latest Village requirements . 9 The time requirements (Section 16.606.A.3 and 4) for completion of public improvements have been strengthened in line with Board policy. 10. Condominium conversion procedures (Section 16.305) have been added to the Development Code for the first time. Since a great deal of the standards contained in the Development Code are engineering related, we relied very heavily upon Public Works Department, and more specifically Chuck Bencic, for his expertise in this particular area. Chuck's previous private practice background, including the review and drafting of subdivision regulations for development codes was most helpful and much appreciated. KHF: hg, Village of Mount Prospect�� Mount Prospect, Illinois ow,mo vrX77 INTEROFFICE MEMORANDUM . . ... .. �r �� � w G . . . . .. ..........�m TO: MAYOR CAROLYN H KRAUSE 0 FROM: TRUSTEE GERALD Le "SKIP" FARLEY DATE: JANUARY 3, 1985 SUBJECT: WAIVER OF RULE REQUIRING TWO READINGS OF AN ORDINANCE From time to time, different ones of us have expressed discomfort in the Board's apparent ready willingness to honor a request for waiver of a policy of two readings of an Ordinance In reality, an idea which is reduced to Ordinance form before it is enacted may receive three approvals from this body and may have been revi.ewed by one or more Boards, Commissions or Committees as well as staff. The first when we concur with a recommending body's report, the second when we first see it in Ordinance form. and the third when it is finallypassed. In an effort to secure more uniform agreement concerning this procedure and to get something on the table to discuss, I suggest consideration of the following points at a Committee of the Whole meeting to be held as soon as r',*easonably feasible. Other members may also wish to contribute recommendations: 1. Two readings of an Ordinance be observed unless a waiver is requested by staff, private citizen or businessman. (A request may be denied even then if request is deemed inappropriate). PI 2. Two readings be observed if insufficient publicity would result in an uninformed citizenry, 3. Two readings be observed if it might reasonably appear litigation could result from such passage. 4. Two readings be observed if an Ordinance is controversial on the part of staff, recommending body or Board of Trustees (two or more opposing), 5. Two readings be observed if additional research is necessary or helpful to fully clarify an intent and purpose of Ordinance, 6. Two readings be observed if petitioner is notpresent to respond to possible questions, 7. Two readings be observed if pending absent member of Board requests, prior to stated absence, that he/she wishes to be on record in voting, 0 In my opinion, we wish to expedite passage of helpful and necessary Ordinances and not create obstructions, but always keeping in mind that truth seems to plod along 'in walking shoes while error runs on winged shoes.
