PRESENT COLORS Pack Master Maslanka and his Pack #41 from Robert Frost PRESENT School (North) presented the Colors and gave the Pledge of COLORS Allegiance to the Flag. INVOCATION APPROVAL OF MINUTES Trustee Wilks, seconded by Trustee Clowes, moved to APPROVE approve the minutes of the regular meeting of the Mayor MINUTES and Board of Trustees held November 1, 1994. MAYOR'S REPORT PRESENTATION: Mayor Farley and Fire Chief Cavello presented Plaques to Chavis HEROIC ACTIONS Zerback and Jay Peer for their heroic actions is alerting and helping to remove a family from their apartment, which was on fire. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD None. OLD BUSINESS ZBA 23-A-94 ZBA 23-A-94, Text Amendment (Eliminate Second Dwelling Units) AMEND CH. 14 An Ordinance was presented for first reading that would amend ELIMINATE 2ND Chapter 14 (Zoning) to provide for the gradual elimination of HOUSEKEEPING UNITS second housekeeping units in all single family residential districts. The Zoning Board of Appeals recommended granting the requested text amendment by a vote of 4-3. Trustee Hoefert arrived at the meeting at this point. Jon Porcher, 211 S. Wille, and other residents spoke in opposition to the proposed Ordinance. It was noted that this Ordinance would not apply to units built or converted prior to 1944 or to any unit that was officially sanctioned by the Village through Special Use or Variation. This Ordinance will be presented at the next meeting on December 6th for second reading. COMPREHENSIVE An Ordinance was presented for second reading that would PLAN amend the Official Comprehensive Plan for the Village, as recommended by the Plan Commission. ORD. Trustee Wilks also stated that while this Ordinan~ ~ Comprehensive Plan, she looks forward to r~7-[si~§~ the Official ~ Comprehensive Plan in its entirety~ ~' Ordinances were presenf, ed for second reading that would amend AMEND CH.1 ~1 Article XI of Chapter 11 relative to deregulating the fares charged DEREGULATE by taxi cabs. Two Ordinances were presented for consideration, TAXI CAB one that deregulated taxi cab fares and the other included wording FARES that would prohibit taxi cab companies from raising their rates more than once in a 12 month period. Trustee VVilks stated that while she presented the 2nd Ordinance on this subject, relative to raising rates no more than once in a 12 month period for Board consideration, there did not seem be support for that condition therefore she Withdrew that Ordinance from consideration. Trustee Clowes, seconded by Trustee Skowron, moved for passage ORD.NO. 4682 of Ordinance No. 4682 AN ORDINANCE AMENDING ARTICLE Xl OF CHAPTER 11 OF THE VILLAGE CODE ~ Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron Nays: Wilks Motion carried. NEW BUSINESS A Resolution was presented declaring the results of the November ELECTION 8th election as it relates to the Mount Prospect Public Library RESULTS: referendum question placed on the ballot. It was noted that a majority LIBRARY of vote were cast in the negative, therefore the question failed. REFERENDUM Trustee Hoefert, seconded by Trustee Hendricks, moved for passage RES.NO.37-94 of Resolution No. 37-94 A RESOLUTION DECLARING THE RESULTS OF THE REFERENDUM QUESTION FOR THE MOUNT PROSPECT PUBLIC LIBRARY ON THE NOVEMBER 8, 1994 BALLOT Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks .... Nays: None Motion carried. A Resolution was presented that would provide for the Village 1994/95 Board to determine the tax levy for the period May 1, 1994 through TAX LEVY April 30, 1995. ZBA 45-CU-94 ZBA 45-CU-94, 1738 East Kensington Road 1738 E.KENSlNGTON The Petitioner is requesting a Conditional Use to allow a day care center to operate within the Brentwood Shopping Center (Kensington & Wolf Roads): The Zoning Board of Appeals recommended granting this request by a vote of 6-0. Trustee Wilks, seconded by Trustee Hoefert, moved to concur with the recommendation of the Zoning Board of Appeals and grant the Conditional Use requested in ZBA 45-CU-94. EXERCISE Resolutions were presented that would begin the process EMINENT DOMAIN necessary to condemn specific property. Acquisition of the properties being the subject of these Resolutions is necessary to improve Linneman Road and the properties have never been dediCeted to the Village for roadway purposes. The Village has offered to purchase the properties, however, the owners have not accepted the fair market value offered. A Resolution was presented that would authorize the release RELEASE specific minutes of Executive Sessions from confidentiality. EXECUTIVE SESSION MINUTES Page 5 - November 15, 1994 RES:NO. 44-94 Trustee Wilks, seconded by Trustee Skowron, moved for passage of Resolution No. 44-94 A RESOLUTION REGARDING THE RELEASE OF EXECUTIVE SESSION MINUTES Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried. VILLAGE MANAGER'S REPORT CITIZENS UTILITIES Village Manager Michael E. Janonis asked the Board to consider RATE INCREASE intervening in the request pending before the Illinois Commerce Commission for a rate increase for Citizens Utilities Water Company. It was noted that the Village has intervened in the past, and his expectation is that the cost for such action would not exceed $3,000. CONSIDER ITEM Trustee Hendricks, seconded by Trustee Clowes, moved to NOT LISTED consider an item not listed on the agenda. AUTHORIZE Trustee Hendricks, seconded by Trustee Clowes, moved to EXPENDITURE authorize the Village Manager to retain legal counsel for the purpose of intervening in the Citizens Utilities Water Company rate increase request before the ICC at a cost not to exceed $3,000. CANCEL CTC MEETING Mr. Janonis noted that the Cultural Trust meeting scheduled for November 16 at 7:00 AM had been cancelled. TRUSTEE COMMENTS PARKING Trustee Henddcks asked for a status report about cars parked in the rear 0~ N~.~ $choo;F Str'eet PROSPECT HIGH Trustee Clowes congratulation the Marching Blue Knights Band on MARCHING BAND their successful 1994 Marching Season, noting all the accomplishments of the band. The Mayor and members of the Board asked staff to prepare a Resolution for presentation at the next Board meeting on December 6th. BOARD MEETING Trustee VVilks asked that the Board consider amending Chapter 2 ON ELECTION DAYS of the Village Code by establishing the provision that no Board meeting would take place on an election day. Trustee Wilks noted that 3 Trustees were involved with the November 8th election. ' Due to the fact that election begins at a very early hour and ends late, which means the Trustees are late to the meeting, it would be better if the meeting was held on the next day. Mayor Farley stated that the Code provides for meetings to be held on the next secular day and suggested the Board adopt the policy, rather than amending the Code, that the Village Board not meet on election days. TRAFFIC CONSULTANT Trustee Hendricks asked why the Village had a traffic consultant Page 6 - November 15, 1994 reparing recommendations for the Safety Commission. The Village Manager stated that the position of Traffic Engineer has not been filled and the consultant was being used until an employee is hired to fill that position.
