Mr. Peter Downing, President of the Euclid/Lake Homeowners CITIZENS UTILITIES Association requested the Village to assist that areainthe RATE INCREASE recent" request by Citizens Utilities Water Company for a REQUEST rate lini-c rease before the Illinois Commerce Con. mission. Mr. Downing requested that the Village advise that Association, when the hearings are to take place and the legal procedure necessary for objections. The Village Manager noted that he would keep Mr. Downing informed of the proceedings, MANAGER'S REPORT Village Manager Terrance Burhard presented an ordinance AMEND CH. 13 for second reading that would reduce the number of Class "1111 CHANTICLEER REST. liquor licenses by one (deleting Chanticleer Restaurant). Trustee Richardson, seconded by Trustee Miller , moved for passage of Ordinance No. 3050 ORD. NO. 3050 AN ORDINANCE AMENDING CHAPTER 13 OF THE MUNICIPAL CODE Upon roll call: Ayes: Farley Floros Miller Murauskis Richardson Wattenberg Nays: None Motion carried. Mr. Burghard noted that the recent Agreement between BIRKS Birks Transportation and the Village, establishing a TRANSPORTATION specific taxi-cab fare for senior citizens, woun ld ivolve AGREEMENT approximately $2,000 over the amount budgeted stating Senior Citizen Fares that the Board could amend the exisiting budget, requiring a 2/3 vote of the corporate authorities, or a budget transfer could be made at a later date. The Village Manager presented a proposal received from AMENDMENT TO Birks Transportation that would establish a set fare for RIR, KS AGREEMENT senior citizens traveling between Holy Family Hospital Senior Citizen Fares and Northwest Community Hospital and the Village limits . -2- Mr. ; P' `-"ks' proposal would establish ..flat rate f $3.50 fi , 'v for a'w %.n or citizen to travel to Northwest Community Hospital - the °senior's share being $2.1.5,, and $3.00 to Holy Family Hospital " the senl.or's share being $1.65. Mr. Bur'g ar 3 presented an ordinance for first ;reading AMEND ORD .NO. 2923 that would amend Ordinance No. 2923 relative to the K -MART landscaping, lighting and various other requirements governing the R -Mart building under construction at the Mount Prospect ""Plaza. This, ordinance will be presented October 7th for ;.second reading. The Manager presented an ordinance for second reading that would comply with the requirements of IDO T relative AMEND CH. 24 to prohibiting sting s 'tart' waste to flow in the storm suers NORTHWEST HIGHWAY along Northwest Highway . Mr. Burghard also noted that since the traffic signal would benefit Prospect Heights, that community would participate in the east of the improvement. LEGISLATIVE /JUDICIARY COMMITTEE Trustee Richardson presented the minutes of the Committee STREET LIGHTING meeting held August 21, 19 80 . giving a status report on PROGRAM the lighting program throughout the Village. Trustee Richardson, seconded by Trustee Wattenberg , REHABILITATION LOAN moved to concur with the recommendation of the PROGRAM Lem slative/Judiciary' Committee to approve the proposed establishment of a Business Rehabilitation Loan Program. Village of Mount Prospect Dear Mayor Krause and Members of the Board of Trustees: On July 1 of this year the Village Board passed and the Mayor approved Ordinance No. 3021 amending the zoning map and approving a planned development for the property involved in the above case, which has also been referred to as the Brickman property. The stipulation to discontinue in this case, Which was previously approved by the Board, provides for the disposition of the litigation by the entry of a con- sent decree. A draft of such a consent decree was prepared by counsel for the plaintiff and submitted to us for our review. We made some suggestions for alterations and dele- tions in the draft which were accepted by counsel for the plaintiff. Attached to this letter is a draft of the pro- posed consent decree, the form of which has been agreed to by the plaintiff. BURGHARD , VILLAGE MANAGER, DATE October 3, 1980 SUBJECT Citizens Utility Rate Case At a. previous village Board Meeting -I was asked to prepare an analysis of the alternatives available in connection with the proposed rate increase b -V the Citizens Utility Company. I have reviewed the attorney's opinion and talked to another community who is in a simi lar position and, therefore, offer for your consideration the following discussion.. We are all well aware of the continued rate increases proposed over the years by Citizens Utility. Essentially two questions can be developed. a) Is there sufficient Municipal interest that, action should be taken? b) If sufficient Municipal interest exists what is the appropriate vehicle9a Citizens Utility has asked regularly for increases, most of which have been. ,granted in some form or another. It is clear that their rates currently are substantially in excess of that which is charged by the Municipality and their proposal would significantly widen that gap. On the average a typical family would face increases from. $26.64 a month. to $34.03 per month ^- a 27% increase. The above figures include both water and sewer service. A family on the Mount Prospect system could expect that for water service alone the approximate cast would be 14.00 per 'Month. Some complexities arise in direct comparison because of our current relationship with the Metropolitan Sanitary District but in any case we can see that the expense is much more significant for Citizens Utility users than for those persons on. the Mount Prospect system. We have also seen over the years periodic requests from residents in. the Citizens Utility area for improved To Mayor & Board of Trustees October 3, 1980 Page 2 service, i.e. reduced flooding, greater water pressure, and better water quality. Obviously Citizens Utility will take the position that improved service will require additional expense. *In some regards Citizens must pay more for the development and production of their water than the Municipality because of such things as differing rates for energy and the obvious tax situation. Residents in other areas not in Mount Prospect served by Citizens have for a number of years -intervened in the rate cases and apparently plan to do so again this year. Therefore based on the foregoing there does seem to be an ongoing interest th-11"It the Municipality should be concerned and in fact is concerned about the rate increase proposal. The Vill-age in fact has more than adequately assumed such responsibility over the years. Since 1975 the Village has expended more than $104,000 in matters directly related to rate increases and the potential acquisition of the Citizens Utility System. These funds have been paid from revenues -collected throughout the community and in any opinion can never be legally charged back to the residents of the Citizen's Utility area. While it has been the policy in the past for the Municipality to pick up the bills for that area I seriou ' sly question whether the Village is the appropriate vehicle to continue that burden. There are several other alternatives available to us. The Water Consumers Association has participated in ICC hearings for nearly 15 years according to Mr. Ellis Ballard., attorney for the Association. They intend to file an intervention and represent n1Xmerous homeowners associations and/or subdivisions in the metropolitan area charged by Citizens Utility. The Village of Bollingbrook retained the law firm of Moss & Bloomberg to formally intervene on the part of the Municipality. Bollingbrook's motivation stems from the fact that they are approaching acquisition of the system and are, therefore quite concerned as to the accounting for Citizens Utility as it may effect their eventual acquisition. The residents of the Citizens Utility area could also contact either one of these law firms or seek their own direct representation before the Interstate Co=-,erce Commission. This latter alternative may well be a duplicate and more costly than if our residents were to join the Water Consumers Association or work with the lawfirm of Moss & Bloomberg. Based upon the degree of expense of the Village of Mount Prospect previously, $104,000, and based upon existing To Mayor & Board of Trustees October 3, 1980 Page 3 alternatives with other groups I would recommend that the Mayor & Board take the following action: a) Adopt a resolution expressing,our-'-concern as to the degree of the increase and its basis. s. b) Assign a staff member to attend one of the ICC hearings to present the resolution and voice our concern for the extreme discrepancy between our ability to deliver water and that of Citizens Utility. c) Assist our residents in either joining with the Water Consumers Association or in working with the law firm .of Moss & Bloomberg. Such assistance could provide basic data and some basic coordination. d) If in the opinion of the Mayor & Board,, direct Municipal intervention is deemed appropriate then, I would recommend that the Village Manager be authorized to work with Boll'ingbrook and, use their law .firm, so that duplicate expenses are not incurred. The Plaintiff is an Illinois banking cor- poration with offices in the Village of Wheeling, County of Cook, State of Illinois, and is a party to this action not individually but as Trustee under Trust Agreement dated February 5, 1968, and known as Trust No. 625. 3. The Defendant is a municipal corporation in the County of Cook, State of Illinois. 4. The Intervenors are landowners of property in the general vicinity of the Subject Property legally described in Paragraph 5, herein. 5. This Consent Decree shall apply to and affect only the parties hereto, their successors in interest, and that' tract of land hereinafter referred to as the "Subject Property" and legally described on Exhibit "A," attached hereto and made a part hereof. 6. The corporate authorities of the Village of Mount Prospect have held, or caused to be held,'all public hearings required by law to be held in connection with a change in the zoning regulations applicable to theproperty described in Exhibit "A."' and the parties have otherwise ro complied with the terms and conditions of the Stipulation to Discontinue filed herein. 7. On July 1, 1980, the Defendant duly passed and approved Ordinance No. 3021, entitled "An Ordinance Zoning and Granting a Zoning Amendment and Planned Develop- ment Approval for Brickman Property," a copy of which is attached hereto as Exhibit "B," and made a part hereof. 8. Said Ordinance No. 3021 approved a site plan for the development of the Subject Property, a copy of which site plan is attached hereto as Exhibit "C," and by virtue of the said ordinance the Defendant has approved development of the Subject Property in substantial compliance with the said Exhibit 11C. 11 - 3 - 9. On July 15, 1980, the Defendant duly passed and approved a plat of resubdivision of the Subject Prop- erty, a copy of which is attached hereto as Exhibit "D," and made a part hereof. The parties have agreed that said Exhibit "D" shall be recorded with the Recorder of Deeds of Cook County, Illinois, by Defendant, within 30 days after the Defendant, the Village of Mount Prospect,, has approved final engineering plans for the development described in Exhibits "B" and "C" hereto. 10. The parties hereto have agreed that the Subject Property may be used and developed in substantial conformance with Exhibits "B" and "C" hereto. 11. It is understood by the parties hereto that final engineering plans have not been submitted by Plaintiff to Defendant, and that building permits for construction on the Subject Property will not be issued until such plans have been submitted and approved by the Defendant. NOW, THEREFORE, IT IS HEREBY ORDERED AS FOLLOWS: 1. That the agreements by and between the Plain- tiff, the Defendant and the Intervenors, set forth herein- above be, and they are hereby, approved. 2. No appeals shall be taken from this Decree by any of the parties to this cause. 3. None of the parties to this proceeding shall recover of and from any other party any costs which such party may have sustained in connection with this cause, but all such costs, having been paid, shall remain with and be taxed to the parties who shall heretofore have incurred costs. r 4 4. WHEREAS, a public hearing was held on the Petitioner's' request for the aforesaid variation, which request is known as ZBA-35-V-80, before the Zoning Board of Appeals of the Village of Mount Prospect on July 24,, 1980t pursuant to proper public notice published in the Mount sect Herald on July 8, 1980- a nd I WHEREAS, the Zoning Board of Appeals has recommended to the Building Committee of the Board of Trustees of -the Village of Mount Prospect that Petitioner's request for the aforesaid variation, ZBA-35-V-80, be granted; and WHEREAS., the President and Board of Trustees have considered the Petitioner's request and reviewed the recommendation of the Village of Mount Prospect Zoning'Board of AppealsinZBA,-35-V-80.- and WHEREAS,, the President and Board of Trustees of the Village of Mount Prospect have determined that with respect to the Peti- tioner's requested variation, that Pet,itioner has satisfied the standards for the grant of variations set for in Section 14.605 of Article VI of the Zoning Ordinance and find that it would be in the best interest of the Village of Mount Prospect to grant Petitioner the requested variation. - 2 - NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS as follows: SECTION ONE: The recitals set forth hereinabove are in- corporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the v3i-11age of Mount Prospect hereby grant the following variation: A variation from Section 14.1101.B.4 of Article XI of the Zoning Ordinance to permit the construction of a five bedroom home with an attached three -car garage, instead of the two -car garage permitted under said Section 14.1101.B.4, - for a parcel of real estate legally described as follows: Lot 1 in Semar Home Builders Resubdivision of Lots 1 and 21 in Busse County Estates, being a Subdivision of the West 25 acres of that part of the West half of the Northwest quarter of Section 14., Township 41 North; Range 11 East of the Third Principal Meridian, lying North of Seeger's Road, in Cook County, Illi- nois; SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect ordinances shall remain in full force and effect as to the Subject Property.
