AN ORDINANCE CONSENTING TO THE ADDITION OF THE VILLAGES OF HANOVER PARK AND STREAMWOOD TO THE NORTHWEST SUBURBAN WATER SYSTEM BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECTr COOK COUNTYr ILLINOIS, AS FOLLOWS: SECTION ONE: It is found and declared by the President and Board of Trustees (-Ehe "Board") of the Village of Mount Prospect (the "Village" as follows: I A. The Village is a member of the Northwest Suburban Water System Venture (the "Venture"), which Venture was established and is governed by the Northwest Suburban Water System Agreement. B. The Agreement provides for additional municipalities to become a member of the Venture. C. The Villages of Hanover Park and Streamwood have executed the Agreement and agreed to the conditions established for membership by the Board of Directors of the Venture. D. It is in the best interests of the Venture and of the Village that the Villages of Hanover Park and Streamwood become members of the Venture. E. Section 3(a) of the Agreement provides that all the then municipalities in the Venture must consent to any new member and that such consent be authorized by ordinance adopted by the corporate authorities of the member municipalities. F. The Village desires to consent to the membership of the Villages of Hanover Park and Streamwood. SECTION TWO: The Village consents to the Villages of Hanover Park and Streamwood becoming members of the Northwest Suburban System Venture and authorizes and directs its Village President dent to execute on its behalf the Consent to the Villages of Hanover" Park and Streamwood joining the Northwest Suburban Water Sys tem—Ven-t;ur,er-. a- COPY- of- whi-ch Consent is attached hereto as Exhibit A and incorporated herein by this reference. Through the first 18 months of that contract there have been many complaints to the company relative to condition of the processed garments when they were returned as well as shortages on the count of garments being returned vs. garments picked up. Al- though numerous attempts were made to resolve our differences the problems were never eliminated. A condition of the original bid was that these conditions would be cause for discontinuance of service. This company has been sent a certified letter that service will be stopped October 15, 1984. (6 months prior to normal expiration date). I have rebid a uniform rental service contract with the tabulations as shown on the attached sheet. I recommend entering into a two year agree- ment with the lowest bidder, Stiener Corporation, commencing October 15, 1980. The new contract even though its lower on the current bid, it is slightly higher than the 1979 bid of Uniform Rental Systems. There will be an increase of 24 cents per man per week on a 2 changes a week service and 30 cents per man per week on a 3 change per week service. There is sufficient funds allocated in the current budget for this uniform service. erbert L. All other bidders did comply. 6. There was a specific form that each bidder was instructed to use which would enable us to evaluate the bidders truck components against our speci- fications. Hoskins Chevrolet did not use that form even though all other bidders did comply with this requirement, 7. The specifications called for a minimum gross vehicle weight rating of 34,000 lbs; Hoskins Chevrolet propose.to furnish units with a 33,200 GVWR. (By upgrading some of the components the 34,000 GVWR could have been met). 8. Hoskins Chevrolet proposes to furnish a 22,000 lb. rear axle vs. 23,000 lbs. as specified. 9. So that there be the proper gear ratio the units were specified to meet a minimum 50 MPH road speed and not to exceed 55 MPH. Hoskins Chevrolet pro- poses to furnish a maximum geared road speed of 64 NPH which is not acceptable. 10., The specifications stated there shall be a two groove 5/8 inch crank pulley so that we could install our dump body hydraulic system. Hoskins Chevrolet took exception to that important item and stated they would not furnish it. (All other bidders did comply). 11. Other miscellaneous but important items which Hoskins Chevrolet takes exception to are: A. No pre -cleaner or restriction gauge an air cleaner B. No luberfiner available on oil filter C. Temperature gauge not available as specified D. No heavy duty starter available E. No circuit breaker available F. Volt meter not available 12. On the Hoskins Chevrolet bid it is not clear what size tires are being furnished, what weight springs are being furnished, and what weight front axle is being supplied. All other bids met or exceeded the basic specifications and I therefore recommend acceptance of the next lowest base bid of $84,073.00 as submitted by Northside International Inc. on an International Model 1854 Truck. There were 16 invitational bids sent out on the pro- posed purchase. These trucks are replacement units for three existing 1968 trucks. On the sealed bid form, Northside International would allow $2,100.00 trade in for all our three'unwLts. BURGHARD, VILLAGE MANAGER DATE : August 28, 1980 SUBJECT : Senior Citizen Fare Reimbursement At the last board meeting subsequent to the action of the majority of the Board in adopting the resolution authorizing an increased subsidy for the senior taxi program I was asked C) -to explore whether or not the Board's action required a budget amendment. A budget amendment -requires the consent -of two -third's of the Mayor and Board of Trustees. In 1972, the Mayor and Board of Trustees adopted the budget officer system of finance. In general that allows the Village to appropriate its funds for the fiscal year by adopting a budget rather than an extensive appropriation ordinance. Additionally as reiterated in the State Statute this budget system allows for a manager to appoint.a budget officer who has the authority to approve changes in the budget during the fiscal year as long as revenues are available to meet the expenses., I have declined to appoint a budget officer because (a) the organization is not large enough that the elected officials and Village Manager cannot maintain participation in that process and (b) the relationship between expenses and determining service levels is most appropriately vested operationally with the department directors. Therefore, when utilizing the program budget format I have allowed the department directors to manage their program budgets within the confines of the total appropriation for that program. That is, if the department director determines during the year that he needs less for office expenses but,more for electrical supplies as an example, I allow them to make that transfer as long as the total expenses in that program do not exceed the total appropriation for that program. They must stay within the bottom line. Exceptions to this do occur. For instance, we may find that additional salt must be purchased during the snow season or because of some major item, overtime could drive Memo t c yor & Board of Trustees August 28, 1980 Page 2 up the program over the budget. These kinds of occurrences are revised near year-end when we adopt the overall ordinance revising the budget. If unplanned and un - budgeted expenditures are foreseen that may in my C> interpretation depart from the policy established by the Mayor and Board of Trustees, those matters must be brought to the attention of the elected officials prior to the expenditures. In summary then, I delegate to the department directors authority and responsibility to deliver their service within flexible administration of their program budget consistent with the policy of the Board and where divergences occur or appear to occur it is brought to the attention of the elected officials. In the past, the motion to pursue that divergence in the program has served as the authority to expend funds until the year-end budget transfer ordinances. In returning to the original ordinance, my policy may not be consistent with our local ordinance. While the original ordinance, No. 2342, delegates certain authority for making changes to the budget it also adds language that such delegation is "... subject to such limitation or requirement ... as the Mayor and Board of Trustees then holding office upon a two -third's vote, may establish." In the next section of the ordinance it says: a. By a vote of two -third's of the members of the Mayor and Board of Trustee�s then holding office, the amount budgeted for the Municipality may be revised by deleting, adding or changing budgeted items. Therefore, while it appears to be the intent of the ordinance to delegate certain kinds of budget changes the subsequent "limitation or requirement" makes it necessary that any change be brought back to the Mayor and Board for a two -third's vote. In my opinion that kind of broad limitation effectively negates any delegation to the administration. To further complicate matters the Board adopted a line item budget this year and while administratively we do work with the original program format and account for our expenditures within that format, the effective adoption of the line item budget negates further the so-called program categories. It would appear to me that with the limitation of our local ordinance and our adopted budget format, the potential increase for the senior subsidy program will require a two- Memo to Mayor & Board of Trustees August 28, 1980 Page 3 third's vote of the Mayor and Board of Trustees -- five affirmative votes. To the best of my determination the new agreement will expend $4,000 more than the current base subsidy for the remainder of the fiscal year. The review of the preliminary data of existing expenditure trends would indicate that the net effect of the new contract would be to exceed our current line item appropriation by an estimated $2,000. A nine hole golf course will surround the residential units' There will be a circulating loop road within the residential area. Attached single family units (duplexes) will be located on the outside of the circulating loop road. Townhomes and condominiums will be located within the circulating loop road. I voiced the Village's concern as stated in Mayor Krause!s letter to Mayor Wolf - namely - provide a buffer between the 'commercial development and the Mount Prospect residents. The original installation was very basic and consisted of two low horsepower minimal capacity pumps set into a 25 ft. deep concrete basin and the effluent was pumped through a force main to the MSD interceptor. When the Colony Apartment project was being reviewed, the Village had no sewer lines in the area and the Metropolitan Sanitary District had just be- gun the deep tunnel project and the new MSD sewage treatment plant in Des Plaines had not been constructed. Further annexations and developments were subsequently planned for the watershed area north of this lift station and in anticipation of a substantial increase in the flow of sewage to this lift station, three larger pumps and a new electrical control panel were purchased. With the MSD O'Hare treatment plant now complete, I have been able to divert the effluent to a new MSD interceptor sewer by gravity flow thus eliminating the need for the lift station. This action will save us money for electri- cal energy and telephone control line charges for our master control panel. Further, I recommend that the new pumps and control panel, which were purchased in 1974, be declared surplus and advertise for their sale.
