AN ORDINANCE G&\NTING A VARIATION FROM THE
REAR YARD REQUIREMENTS OF THE
MOUNT PROSPECT ZONING ORDINANCE
WHEREAS, the Board of Appeals of the Village of Mount Prospect
has heretofore on January 28, 1966, conducted a public hearing on a re-
quest for a variation from the rear yard requirements in a B-3 Business
District for the property located at 23, 25, and 31 South Main Street in
Mount Prospect, Illinois; and
WHEREAS, the property hereinafter described is improved with
three buildings having a rear yard set-back of 5.5 feet at the northern-
most end of said buildings and a rear yard set-back of 6.3 feet at the
southernmost end of said buildings; and
WHEREAS, the aforesaid rear yard set-back does not comply with
the rear yard set-back required in a B-3 Business District pursuant to
the Mount Prospect Ordinance; and
WHEREAS, the owner of the property hereinafter described desires
to improve and alter structurally the three buildings located on such pro-
perty so that after such improvement and structural alteration the three
buildings would be a single building; and
WHEREAS, a notice of the aforesaid public hearing was given in the
manner provided by law; and
WHEREAS, the Board of Appeals has determined that the said
structural alterations and the proposed variation from the rear yard re-
quirements would in no way be detrimental to the safety, welfare or l';' 11
being of the residents of the Village of Mount Prospect; and

WHEREAS, the Board of Appeals of the Village of Mount Prospect
has recommended that the variation be granted and the President and Board
of Trustees of the Village of Mount Prospect have considered the s"':
recommendation and believe that the granting of such variation would be
in the best interest of the said V:llage.
NOW, nlEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS.
SECTION ONE: That a variation from the Zoning Ordinance be and it
is hereby granted to p~rmit the improvement and structural alteration of the
existing building on the property descirbed as:
The North 68 feet of Lot 13 in Block 4 in Busse and Wille's
Resubdivision in Mount Prospect, in the W 1/2 of Section 12,
Township 41 North, Range 11 East of the Third Principal Mer-
idian, in Cook County, Illinois.
with a rear yard set-back of 5.5 feet at the northernmost end of said build-
ings and a rear yard set-back of 6.3 feet on the southernmost end of said
building.
SECTION TWO: That the Superintendent of Buildings of the Village
of Mount Prospect is hereby directed to issue a building permit in accordance
with the variation hereinabove granted upon proper application therefore,
provided, that such building permit shows that the improvement and structural
alteration of the existing buildings on the above desc"ibed property will,
when such improvement and alteration has been completed, result in one build-
ing replacing the present three buildings.
SECTION THREE: That the variation granted by this ordinance shall
become null and void and of no force and effect whatsoever unless an application
for a building permit pursuant to such variation is made and the construction
commenced within one year from the date such ordinance becomes effective.
SECTION FOUR: This ordinance shall be in full force and effect
from and after its passage and approval in the manner provided by law.
