ORDINANCE NO. 1176
AN ORDINANCE REGULATING WRECKED OR DISCARDED VEHICLES
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, ILLINOIS:
SECTION ONE: Chapter 25 of the Municipal Code of Mount Prospect
of 1957, as amended, is hereby further amended by adding thereto a new
Article, Article VI, and said new Article VI to be and read as follows:
SECTION 25.601: Definitions. The following definitions shall
apply in the interpretation and enforcement of this Ordinance:
(1) "Person" shall mean any person, firm, partnership,
association, corporation, company or organization of
any kind.
(2) "Vehicle" shall mean a machine propelled by power other
than human power designed to travel along the ground by
use of wheels, treads, runners, or slides and transport
persons or property or pull machinery and shall include,
without limitation, automobile, truck, trailer, motorcycle,
tractor, buggy and wagon.
(3) "Street or Highway" shall mean the entire width between
the boundary lines of every way publicly maintained when
any part thereof is open to the use of the public for
purposes of vehicular travel.
(4) "Property" shall mean any real property wi thin the Village
of Mount Prospect which is not a street or highway.
SECTION 25.602: Abandonment of Vehicles. No person shall abandon
any vehicle within the Village of Mount Prospect and no person shall leave
illlY vehicle at any place within the Village of Mount Prospect for such time
and under such circumstances as to cause such vehicle reasonably to appear
to have been abandoned.
SECTION 25.603: Leaving of Wrecked, Non-Operating Vehicle on
Street. No person shall leave any partially dismantled, non-operating,
wrecked, or junked vehicle on any street or highway within the Village of
Mount Prospect.
SECTION 25.604: Disposition of Wrecked or Discarded Vehicles.
No person in charge or control of any property within the Village of Mount
Prospect, whether as owner, tenant, occupant, lessee, or otherwise, shall
allow any partially dismantled, non-operating, wrecked, junked, or discarded
vehicle to remain on such property longer than 72 hours; and no person shall
leave any such vehicle on any property within the Village for longer time
than 72 hours; ex.cept that this Ordinance shall not apply with regard to a
vehicle in an enclosed building; a vehicle on the premises of a business
enterprise operated in a lawful place and manner, when necessary to the
operation of such business enterprise; or a vehicle in an appropriate
storage place or depository maintained in a lawful place and manner by
the Village.

:1 SECTION 25.605: Impounding. The Chief of Police or any member

of his Departnent designated by him is hereby authorized to remove or have
removed any vehicle left at any place wi thin the Village of Haunt Prospect
which reasonably appears to be in violation of this Ordinance, or lost,
stolen, or unclaimed. Such vehicle shall be impounded until lawfully
claimed or disposed of in accordance with Chapter 95-1/2, Illinois Revised
Statutes 1965, paragraphs 42-49.
l, SECTION 25.606: Penalties. Any person violating any of the
, provisions of this Ordinance shall be deemed guilty of a misdemeanor and

Ii upon conviction thereof shall be fined in an amount not ex.ceeding $500.00.
Ii Each day such violation is committed or permitted to continue shall constitute
:1 a separate offense and shall be punishable as such hereunder.

SECTION TWO: This Ordinance shall be in full force and effect
after its passage, approval, and publication in the manner
by laH.
