HomeMy WebLinkAboutOrd 1185 12/13/1966 (', ~ " ORDINANCE NO. 1185 AN ORDINANCE DEFINING PUBLIC SWIMMING POOLS REGULATING THE INSPECTION OF SUCH ESTABLISHMENTS, THE REQUIREMENTS FOR SANITATION AND SAFETY. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS: SECTION ONE: Chapter 19 of the Municipal Code of Mount Prospect of 1957, as amended, is hereby further amended by adding thereto, after Article III, a new Article IV, the said added Article IV to be and read as follows: ARTICLE IV: Public Swimming Pool Regulation 19.501: Definitions: The following definitions shall apply in the interpretation and the enforcement of this Ordinance: A. "Swimming Pool" - as used in this Ordinance shall mean any indoor or outdoor pool of water and auxiliary structures, if present, including dresser and locker rooms, toilets, showers and other areas and enclosures that are intended for the use of persons using the pool, and shall include all swimming pools other than those operated for use by 3 families or less. B. "Health Inspector" shall mean the Health Inspecto~ of the Village of Mount Prospect, or any of his authorized representatives. C. "Person" shall mean any person, firm, corporation, partnership or other association. D. "Pool Area" shall mean the apron immediately adjacent to the pool extending to a minimum of 5 feet from the pool. 19.'502:: Inspection: Outdoor swimminr pools shall be inspected by the Health Inspector prior to opening each year and at least twice a month during the operating season. Indoor pools shall be inspected at least twice a month en a year round basis. In case the Health Inspector discovers the violation of any item of sanitation, he shall give written notice setting forth the specific violation indicating time period for compliance, no longer than 3 days. The second inspection shall be used as the basis for compliance with this Ordinance. Failure to comply may result in suspension of the permit by the Health Inspector and immediate closinp cf the pool. 19. 5p~: Construction: All swimminp pools constructed within the Village shall meet the construction requirements of the State of Illinois Department of Public Health and Villape of Mount Prospect Buildinp Department. All pools shall be inspected by the Health Inspector upon completion of construction. 19 .5U4:: Sanitation Requirements: All swimminr pocls shall have an attendant present during operation and o~erated so as to comply with the followinp items of sanitation: ....- 1. Personal Rer,ulations: (a) Admission to the pool shall be refused to all persons havinp, but not limited to, the followinp: venereal disease, contarious disease, infectious conditions such as colds, rinrworm, fevers, foot infections, skin lesions, carbuncles, inf1ammed eyes, ear discharres, or any other conditions which have the appearance of beinp infectious. Persons with excessive sunburn, abrasion which has not healed, cern plasters, bunion Dads, adhesive tape, rubber bandapes, or other bandares of any kind shall not be admitted. (b) No food, drink, rum or tobacco shall be allowed in the pool area. (c) All persons shall be required to take a nude shower with hand scap or deterrent and warm water before beinp allowed in the ::>oel area. If poolside showers are not available, private showers shall be used. (d) Women, pirls, and anyone desipnated by the pool attendant shall be required to wear caps while in the pool. (e) Only people in bathinr attire or attendants shall be allowed in the pool area. No animals shall be allowec in the peel area. (f) Personal conduct in the ~ool and bathhouses shall be such that the safety of self and others is not jeopardized. (r) Expectoration, spoutinp of water, rouphness and rowdyism, shall not be permitted. (h) Manapement may make necessary rules and repulations not inconsistent with the health and safety standards established by this Ordinance. 2. Swimminp Pool Maintenance: (a) The swimminp pcol and nuxiliary structures shall be well lifhtec and shall be ventilated sr as tc be reasonably free from odors anc condensation. (b) Walls, ceilings, doers and wincrws shall be washed as necessary to maintain a clean, attractive appearance, and mirrors shall be kert clean. (c) Lavatories, toilets and urinals shall be cleanec and disinfected at least twice daily by approved treatment methods. (d) Adequate waste receptacles shall be provided. (e) Floors of showers and dressinp rooms shall be thorouphly cleaned and disinfected at least twice daily, more often with heavy usuape, usinp procedures recommended in the State of Illinois Department of Public Health Circular No. N822, P.17, or its revision ('r re['lacement. Floor boards anc mats shall n0t be used. Divinp heard mats shell ~e disinfected daily. -. ~ 19 .50.5 ~ (a) (0 Pool walks and overflow troughs shall be maintained free from dirt, algae, oil, insects, cigarette butts, leaves, and other debris. (g) Water treatment and pool maintenance shall be done as prescribed by the State of Illinois Department of Public Health Circular No. N822 or its revision or replacement. Operation: The person in charge of a public swimming pool or a responsible person designated by him shall be well trained and capable of operating the puri- fication equipment, the water recirculating system, safety equipment, the pool and other appurtenances connected with the pool and shall be responsible for maintaining public health standards set forth in paragraph 19.404. (b) At least one unit of safety equipment shall be provided at every swimming pool. One unit of safety equipment shall consist of the following: A ring buoy not more than 15 inches in diemeter to which shall be attached a 60 foot length of three-sixteenth inch manila rope; a life pole or shepherd's crook type of pole having blunted ends with minimum length of 12 feet; a separate throwing line of one-quarter inch rope with length not less than 1-1/2 times the maximum width of the peol. This equipment shall be mounted in conspicious places, distributed around the swimming peol area, readily accessible, its functicn plainly marked, and kept in goC'd reT"'air and ready condition. No one shall use this equipment for any purpc.se ether than its intended use, or remove such equipment from its established location. (c) All public swimming pools shall be operated acc0rd- ine to the following restrictions: No child under fourteen years cf age shall be permitted within the pool area unless accompanied by a parent or an adult in responsible charp,e of the child. This anc other restrictions shall be posted in a conspicious place at the entrance to the pool area. 19.'5:06.: Report of Accidents: Within 24 hours after drowninp, or serious accident at a public swimming pool, the owner or person in charre shall report the incident to the Health Inspector and shall furnish such information as the Health Inspector may require. 19.5.07: (a) (b) Permits: No person shall operate or maintain a swimmin>; peol without a permit issued by the Villare of Mrunt Prospect. Before a permit is issuec for a swimminr pool, such poel shall be in compliance with all health, safety, and construction reruletions of the Villap,e of Mcunt Prospect. All permits issued hereunder shall be prominently displayec: anG shall expire on the 30th c~y !if each September, irrespective of the cate of issuance 2nr shall not be transferable. P. 3.. , Fees: Fees for Dermits shall be as determined by the Board of Trustees of the Villape of Mount Prospect. 19.508: (a) Enforcement: For the purpose of enforcement of this rerulation, the Health Inspector shall have the rirht to enter any swimminp pcol and all rcoms and places ccnnected therewith and no on~ shall interfere with him in discharre of his official duty. (b) All alterations to existinp ~cols shall comply with this Orcinance and all ether Villape Ordinances. (c) Should any secticn, rararranh, sentence, clause cr phrase of this Ordinance be declarec uncrnstitutional cr invalid f,-,r any reascn the remainder of si1id Ordinance shall net be affectec thereby. 19.509: Hearinp Upon Susrensicn Under Sectirn 19.402: A permit hclcer unGer this Ordinance shall be entitled to a hearinp, before the Boare of Health en decisions 0f the Health Inspectcr in reeard to sanitation and health standards. Apnlicatirn fcr such hearinp shall be made through the Villape Clerk's office, and the Beard of Health shall meet within five (5) cays to ccnsider an apDeal rf the suspension. Failure of the Beard of Health to rather 2 quorum shall result in autcmatic liftinp of the suspensicn until such time es the Board of Health meets and acts on the apneal. Permit holder sh?ll be allowed to introduoe evidence at this hearinp to support his pnsition as may the Health Inspector. The Board of Health shall have the newer to lift the suspension or recommend ccntinuin:-- suspension or revcci"'ticn to the Board of Trustees e.f the Villare rf Mount Prcsj)ect at the next recular meetinp of the Board of Trustees of the Villare cf Mcunt Prcsnect. 19.~10: Penalties: Any person who shall violate any provision cf this Orcin2nce and fails to comply with any of the requirements therecf, shall be puilty of a misdemeanor punishable by a fine of net less than $25.00 and not more than $500.00, and each day such vicl2ticn is permitted to exist shall constitute a se~arate offense. SECTION TWO: This Ordinance shall be in full force and effect from and after its passape, approval, and publication in the manner provided by law.
