ROLL CALL
Mayor Krause called the meeting to order at 7:30 p.m.,
in the Public Safety Building, 112 East Northwest
Highway. Present at the meeting were: Mayor Carolyn
Krause, Trustees Ralph Arthur, Gerald Farley, Leo Florc
Edward Miller, Norma Murauskis and Theodore Wattenberg.
Also present at the meeting were: Village Manager
Terrance Burghard and Assistant Village Manager Jay Hec
Also present were approximately 35 persons in the audiE

The Minutes of the Committee of the Whole meeting of
October 26, 1982 were reviewed and accepted.

There being no citizens present at the meeting desiring
to make any presentation before the Committee of the
Whole the Mayor moved on to the next item of business.

IV., PUBLIC HEARING
Mayor Krause called the Public Hearing to order at 7:40 p.m.,
for the purpose of reviewing requests from the Courier 2000
Cab Company and American Taxi Cab Company to service the
Village of Mount Prospect. Mr. Randy Moss, Vice President of
American Taxi Company first testified to the fact that
his Company had submitted a request for twelve taxis to
be licensed in Mount Prospect. He indicated that they
are currently operating taxis in 17 other communities and
received 50-60 requests per week to service the Village
of Mount Prospect. Mr. Moss indicated that he feels there
is room for additional service in Mount Prospect and that
it would, in fact., increase citizens usav of taxis rather
than s3-mply deferring business from Birks existing company.
Durin,g,,,questioning by the Village Board, Mr.� Moss indicated
that in, all of the communities where they operate and
where senior citizen taxi programs exist, they participate
voluntarily. All 'of American Taxi's cabs are owner operated
and have individual contracts with American. These
contracts provide for disciplinary action for refusal of
service as well as other areas, and while he as Vice
President does not have the authority an owner would have
over a particular cab, .he does feel there is an adequate
mechanism for enforcement of rules.
Mr. Mass indicated that he felt this arrangement would
be adequate to provide the services required under our
Taxi Ordinance.

A consensus of the Board was not apparent and it was
agreed that Mr. Birks would be invited to attend the
Board meeting on November 16 to testify on this matter,
and the Board's decision would be postponed until that
time.
V. WATER AGENCY SUPPLY CONTRACT
Village Manager Burghard,referred to the contract which
had been distributed to Board members previous to the
meeting, and reviewed the process through which the
agreement had been presented to the Village Board and
requested Board consideration. A discussion -followed
among Board members, however,, no formal action was
required.
Mr. Burghard reviewed the schedule of Special Service
District #5 levies beginning in 1982 through 1988.
He indicated that in .following the Board's direction
to date to place 1CO% of the debt service for construct3i
of the pipeline on the Property Tax, the following levie
would be required:

Larry Armstrong, of the Rouse Corporation, spoke represe
Randhurst Shopping. Center and indicated that they had do
additional research projecting an impact of this .propose
financing method on Randhurst as well as property owners
Mr. Armstrong distributed worksheets indicating their
study. Randhurst-now projects that their impact will be
approximately X118,000 more if' the construction costs ar
placed on the Property Tax as opposed to the water rate.
Mr. Armstrong indicated that while they do feel an oblig;
to support the construction in some part through the
Property Tax, their position is that 100% is too high.
Their proposal is that 2510 of the construction costs be
placed on the Property Tax and the remainder on the water
rates.

Mrs. Hansen, of 15 North Elm, representing an organization
which has been distributing petitions opposing the creation
of the District spoke to the Board and answered questions
from various Board members.
Mrs. Markgraf pointed out the advantage to typical home-
owners by having a tax deduction to the Special Service
District as opposed to none at all by placing the greater
burden on the water rates.
Mr. Ken Reed indicated his support for the Randhurst
proposal and urged the Village Board to find some compromise
in terms of equity.
Mr. William Boltz inger indicated his support for the
Board's position of putting all of the capital costs on
the property tax.
A general discussion ensued among the Mayor and Board of
Trustees with Trustee Floros, Trustee Wattenberg, and
Trustee Miller suggesting that some 'compromise be found
for either a reduced rate or a phased -in Special Service
District system. Trustees Arthur., Murauskis and Mayor
Krause maintained a position that the Village should
proceed with the Special Service District. Trustee Farley
indicated that more information and time was necessary to
digest all of the issues and philosophies in question.
After some further general discussion regarding the last
dates available to make decisions in order to sell Bonds
and create the Special Service District, the Committee of
the Whole directed the Manager place this item on the
Agenda for the formal Board meeting of November 16. At
this meeting, the Village will take final action to give
direction to the staff to proceed and Iin what degree the
Special Service District -should be implemented.
VI. MANAGER'S REPORT
Assistant Village.Manager Hedges reported that the LANDLORD/
TENANT ORDINANCE would be available for review by the
Committee of the Whole on December 14. Mr. Hedges reported
that he conducted several meetings with landlords and
tenants and that consensus was developing upon the standards
and mechanics of the Ordinance.
The Village Manager reported that the VESTS for the
POLICE DEPARTMENT had been purchased and it is expected
that they will be available for our Officers by the close
of this calendar year. The vests are being purchased from
Kale Uniform, Inc. . and that company is del liver ing Point-
.
Blank vests at a unit cost . of $225. Based upon our Budget
limitation of $15,000, this purchase is consistent with
the direction of the Mayor and the Board previously.

The Village Manager reported to the Committee of the
Whale that back in August and September of this year,
the Village had employed the State Water Survey Division'
at no cost to the Village to perform an evaluation on
WELL #17. The Mate Water Survey Board has prescribed
several courses of action that are necessary in order t
complete' the Well and it was the Manager's recommendati n,
based upon the analy it p , cif the State Water Survey Divi s °on
that the Village move towards abandonment . of Well #17.
The estimated cast of this work was not to exceed $60,OCo.
After some ,general discussion) the Village Manager was
authorized to proceed with the necessary work on Well #17.

guards and the passible elimination of some of those

The Village Manager had nothing else to report.
NEW BUSINESS
1n line with the proposal to create the special service
district for financing the acquisition of Zak Michigan
water, the Village Manager was directed to offer
plan that would divide the cost's as :fairly as Possible
between the business and :resident ' al communities.
The ,Tillage Manager offer,red the proposal,; as attached
to these minutes in the form' of a memo dated
November 16, 1982y as a compromise to the original
financing schedule .

stating that the compromizse would be fairer to the
business community:

not to-exceed ten years. Subsequent Tax levies to fun
payments to the Water Agency shall be Funded through a
combination of water rate increases and gradually
increasing property taxes levied against Special Servi:
District No, 5 as described in the Village-Manager's
memorandum a.tta:ched hereto.

COMPANIES
This public hearing was ccn.tinu. d from the Committee of
the Whole me' eti n on November 9th. The purpose of the
Public Hearing vas to consider the applications of
two companies, American Taxi and courier 2000, to
operation taxi cabs within the Tillage.

Mr. Bob Bir , of Birks T.ra.n pr acti n., the only taxi
cab companyoperating within the Village at the present
time, addressed the Board on the quality of service
his company offers, including the .benefits to senior
ci izens.

warrants were not met to 3ustify STOP.
Trustee Farley stated that while he acknowledged the PALM &,ROBERT
study put into this matter by the Safety Commission, he
felt STOP signs were more effective as traffic control
signs, more so than YIELD,
'Trustee Farley, seconded by Trustee Miller, moved to
authorize an amendment to" the Traffic Code to place
STOP signs at the 4 -way intersection of Palm Drive and
Robert Drive.

Centennial Drive from 30 MPH to 20 MPH.

WHEREASr EDWARD J. ]NILLER has devoted his time, experience,
knowledge and dedication to the position of serving in the
elected office of Village Trustee of the Village of
Mount Prospect from May,, 1979 to November, 1982; and
WHEREAS, EDWARD J. MILLER served unselfishly and diligently
on the Board of Fire and Police Commissioners, and served as

SUBJECT: LIQUOR LICENSE APPLICATION
The current owner of Balzamo Liquors, located at the Colony
Square Shopping Center at Oakton and Elmhurst, is in the
process of selling his business. A new corporation, Shreena,
Inc., is in the process of acquiring the assets, inventory
and fixtures of Balzamo Liquors and, therefore, a change in
the license assignment is required.
On Tuesday, November 30, 1982, the Village Manager interviewed
the two principals of Shreena, Inc.; Mr. Prakash M. Amin and
Mr. Harish P. Pathak. Mr. Amin is a medical doctor and has
no prior experience in owning or operating a liquor establish-
ment. Mr. Pathak, a resident of Hoffman Estates, will be
the full-time manager of the establishment and conduct the
day to day operations. During the interview with these
gentlemen, the Village Manager expressed the 'importance of
running a liquor establishment properly and the requirement
to pay special emphasis on guarding against the sale of
alcoholic beverages to minors.
The Village Manager's office has contacted the current owner
of Balzamo, Liquors and received a letter from his attorney
confirming that the sale is taking place and requesting that
the license not be transferred until the time of closing.
Closing is scheduled for December 21. All the necessary
fees and documents have been submitted 'and the Village staff
finds no reason to recommend denial. No Ordinance has to be
created and this matter is brought to you in compliance with
our standard policy of notifying the Board that an ownership
change is taking place. The principals of Shreena, Inc.,
have been invited to attend the meet-inz.

WHEREAS, due and timely notice of the proposed annexa-
tion has been given to the Board of Trustees of the Elk Grove
Rural Fire Protection District, the Highway Commissioner of Elk
Grove Township and the Board of Auditors of Elk Grove Township
in the manner and form required by statute as appears from the
copies of such notices attached hereto, respectively, as
Exhibit H; and
WHEREAS, no library district has jurisdiction of the
Subject Property; and
WHEREAS, the corporate autho\rities of the Village' after
due and careful consideration, have - concluded that the annex-
ation of the Subject Property to the Village on the terms
and conditions herein set forth will enhance and promote the
general welfare of the Village; and
WHEREAS, following zhe aforesaid public hearings, the
corporate authorities did adopt a Resolution on
1982, by a vote of two-thirds (2/3) of the corporate authorities
then holding office, approving this Agreement and directing
the President to execute and the Village - Clerk to attest
the same on behalf of the Village; and
WHEREAS, Owner has executed all petitions and other
documents that are necessary to accomplish the annexation of
the Subject Property to the Village.
NOW.. THEREFORE, for and in consideration of the mutual
covenants herein made and pursuant to the provisions of
Chapter 24, Article ll , Section 15.1-1, et seg. Ill . R.ev .Stat_

to further allow variations, where necessary, from the reg-
ulations in the I-1 Light Industrial .District for the purpose
of bringing the existing operation, buildings and structures
on the Subject Property into conformity.
In this regard, it is hereby acknowledged by all the
parties to this Agreement that it is the intent of these
Ordinances to approve and -authorize the continuation of all
existing operations, buildings, structures and areas being
currently utilized on the Subjeco 'Property, including the
use thereof for rock crushing, concrete mixing and maintenance
of a stone hill -quarry where such uses are accessory to the
existing asphalt manufacture or refining operation; to
approve the Subject Property as a planned unit development
pursuant to the Plat thereof, attached hereto as Exhibit 3
and to 'spring all existing buildings and structures and use
areas on the Subject Property into conformity with Village
Ordinances and regulations pertaining thereto; to provide
for additional development or redevelopment of the Subject
Property as part of the planned unit development for uses
Permitted in the I-1 Light Industrial District, or for
uses listed in the at -1 --ached Exhibit I, provided that such
uses are in compliance with all other Village Ordinances
and regulations* and to allow the erection of an outdoor
advertising sign on a portion of the Subject Property in
close proximity to the Northwest Tollway provided such sign
complies with County, State and Federal regulations pertain'
ing
thereto.
It is further intended by the Parties hereto that the
uses listed in Exhibit I, or any of them., may be undertaken
on the Subject Property as part of the planned unit development
without the necessity of filing a further application with
the Village and submitting such uses to the Zoning Board of
Appeals for public hearing and recommendation and subsequent
approval of the Village Board, so long as such additional
development complies with all other zoning regulations and
Village Ordinances. To the extent that any uses listed In
Exhibit I are presently excluded from the I-1 Light Industrial
District, the Village will, upon its own application, under-
take the necessary zoning text amendments to provide for
such uses to be proper legal uses within. the planned unit
development of the Subject PropertY\.
SECTION FIVE: DEvelolpm,ent and Use of the Sud "ect Pray Pertv.
Owners agree that the use and development of the Subject
Property shall be in. accordance with the provisions of this
Agreement and the applicable zoning ordinances. However,
except as hereinafter specifically provided, any amendments
or changes to building, housing, subdivision, maintenance,
fire protection, manning of facilities, zoning or similar
ordinances of the Village and including all ordinance changes
or administrative regulations or interpretations which relate
to or which seek to regulate any further construction upon
or operations of the PUD on the Subject Property shall not
apply to the Subject Property without the consent of the
Owner for the term of this Agreement, unless -such amendments

or changes apply uniformly to all properties similarly de-

veloped throughout the. Village and thereafter such amendments
or changes shall apply in the same manner as to other uses
existing at the time of the adoption, enactment or announcement
of any such ordinance regulation or interpretation.
This shall not be construed to restrict application of
future a-miendments of regulations set forth in the National
Fire Codes promulgated by the National Fire Protection
Association (NFPA) or the Building Officials Conference of
American (BOCA) Building and Fire Prevention Codes, which
amendments as promulgated by these national organizations
shall apply to the Subject Property to the extent that such
amendments are adopted by the Village.

corrective action necessary to be taken. by the Owners and

SECTION SIX: Fees,, Contributions and Costs. The Owners
shall not be obligated to pay to the Village any fee, con-
tribution or cost by virtue of this annexation *Including
the cost of the recording of documents necessary to accomplish
the annexation of the Subject. Property. Except as hereinafter
specifically provided with regard to water tap -on charges,
the Owners and the Village expressly "agree that Owners shall
pay any and all costs, expenses and fees normally charged
by the Village to other Village residents for building permits,

SECTION SEVEN: Taxes. During the term of this Annex tion
.Agreement, no ad valorem or other property tax or any other

SECTION EIGHT: Public
c zm rcavemen.ts . The Village currently
plans to extend its water distribution system. past, the Busse,
Road frontage of Subject Property within two years from the
date of this Agreement. The Village agrees, to provide two
twelve -inch (12") connection paints to the Owners at locati

selected by them and to waive any water connection fee on
account of the initial connections of the improvements on t,he
Subject Property to the Village water system. The Owners
shall grant to the Village or to the Northwest Suburban .sun - cip al
Joint Action Water Agency a permanent easement (Easement A)
in, to and through the westerly fifteen feet (151) of the
Subject Property between the north right--of-way line of the

Northwest Tollway on the south and the north property line
of the Subject Property, as more particularly described on
Exhibit K. Easement A shall be for the sole purpose of
installing a water main and related appurtenances.
The Owners shall also grant to'the Village or Water Agency
a permanent easement (Easement B) in, to and through that
property located at'the southwest corner of the Subject
Property adjacent to the east right-of-way line of Busse Road
and the Northwest Tollway, as more particularly described
in Exhibit L. Easement B shall be for the exclusive purpose
of constructing and maintaining a below ground control/
receiving point for a supplemental water , s,P
u ply to, the Village
Easem'ents--,A and 13 shall, at the reguest of the V'illage r be
granted by plat. The Village shall furni-s1h, at its expensef
at the time easements are granted, drawings certified to
and stamped by a Registered Engineer. The Owners shall grant
Easements A and B within thirty (30) days after the adoption
of the ordinances described in Section ' Two ll Three and Four,

The Owners shall also grant to the Village or water
Agency an easement (Easement C) in and to that property ad-
jacent to Easement B. as more particularly described on Exhibit
M. Easement C shall begin fourteen (14) days of the Village
or Water Agency has served the Owners with written notice of
its intent to enter upon the Subject Property for the purpose
of constructing the aforementioned water line and/or control/
receiving point and shall continue for a period of 180 days
thereafter, at which time the easement shall terminate. The
Village or Water Agency shall use Easement C solely for Cie
construction of the a -forementioned improvements in n Easements
A and B.
After installation of the water Main and construction on of
the control /receiving point, the Village or Water Agency shall
restore all grounds or other appurtenances to the same condition
they were in prior to construction. The Village or Water
Agency shall, after obtaining approval of Arrow Road,provide
landscape screening around the control structure at the
southwest corner of the Subject Property.
Within one year after completion of theconstruction of
the water main in Easement A, the Owners shall guarantee the
installation and completion of a water system on their I'll prop-
erty, in accordance with Village specifications, complete
with a minimum of one fire hydrant at the end of water* main
extensions or every 300 feet of' -water main.
The Owners shall install a water distribution system
upon the Subject Property so as to receive a minimum of
2,500 gallons per minute at each fire hydrant or dead end
i
main. In no case/ however, shall the Owner be required to
install pipe with mare than a twelve -inch (12") dianie-L-er.
Upon completion of the Owner's on-site water distribution
system, the Village shall permit the Owners to connect into
the existing Village water main without 'Charge. The two
connection points shall be located in the easement -.along
the Owners' Busse Road frontage at points mutually agreed
upon by the Village and the Owners.
SECTION NINE: Mis,�-,ellaneous.
The Owners shall, during the life of this Agree-
ment, be allowed to continue to use any and all
septic systems currently existing upon the
Subject Property. The Owners may, at their ex-
Pense, connect to any available sanitary sewer
system providing they receive the proper permit
from the regulating agency.
2. The Owners may use existing on-site wells to
furnish water for muses other than drinking and
domestic uses including, but not limited to,
landscape watering. Once the Owners connect
into the water distribution system of the Village,
no inter -connection between theprivate well
and the public system. shall be permitted.
3. All provisions, conditions and regulations set
forth in this Agreement and the exhibits attached
hereto shall supersede all Village ordinancesr
codes o -r regulations -that are in conflict here-
with as they may apply to the Subject PropertY.
The terms of this Agreement shall bind the owner,
its successor owners of record, heirs and assigns,
the Subject Property, the Village, the Village's
Corporate Officials, and their successors lin
office. Nothing herein shall in any way prevent
the alienation or sale of the Subject Property
or portion thereof except that such alienation
or sale shall be subject to the provisions hereof,,
and any new Owner shall be both benefited and
bound by the conditions and restrictions herein
expressed.
SECTIONTEN-
Severability.
If any provision, covenant
agreement or Portion of this Agreement or its application
to any person, entity or property is held invalid, such in-
validity shall not affect the application or validity or other

provisions
r covenants, agreements or portions of this AgLee-
ment which can be given effect without the invalid provi,sions
or applications, and to this end, the provisions, cove; a.: is
and agreements in this Agreement are declared to be sever -able.
SECTION ELEVEN Term. This Agreement shall be in Cull
force and effect from and after the date of its executioll
for a period of ten ( 10 ) years.

and with the standards, set forth in Section 14.2503 of said
Chapter 14 regarding a planned unit development, and the

tain proposed additional uses to .be made of the undeveloped

FOR PROPERTY COMMONLY KNOWN AS THE ARROW
ROAD CONSTRUCTION COMPANY PROPERTY IN THE
,VIL..LAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS., pursuant to an Annexation Agreement, the Central
National Bank and Trust Company, as trustee under a Trust
Agreement dated May 18, 1977, and known as Trust No. 22461,
and Arrow Road Construction Company, sole beneficiary unser
said Trust, the owner and beneficial owner, respectively, of
certain property hereinafter described, located at 3401 South
Busse Road, in the Village of Mount Prospect, Illinois, have
filed an application seeking variations from certain regula-
tions contained in Article XXII of Chapter 14 of the Village
Code of 14ount Prospect, Illinois; and
WHEREAS, the subject property is described as follows
That part of the Southwest 1/4 of Section 23 r Township 41 North
Range 11 East of the Third Principal Meridian described as
follows: Commencing at a point on the West line of Section 23
in said Township and Range, that is 1242.6 feet North of the
South-v7est corner thereof; thence North along said West line of
Section 23, 228.1 feet; thence East along a line that I's 1470,7
feet North of and parallel with the South line of said Section
23, a distance of 586.91 feet thence Soutb on a ` line that is
2051.50 feet West of and parallel with the East line of said
Southwest 1/4 a distance of 800 _f et; thence West on a line
that is 670.7 feet North of and parallel with said South line o:
Section 23, a distance of 24.55 feet; thence Northwesterly
791.6 feet along a line which makes a left deflection of 133
degrees 45 minutes 00 seconds with the last described course to
the point of beginning, all in Cook County, Illinois. and
lying West of a line parallel with and distant 76 feet East
West line of Section 23, all in Cook County, 111"linois.
WHEREAS, the subject property was recently annexed to the
Village of Mount Prospect and was thereafter zoned and classified
in the I-1 Light Industrial District, and granted a Special Use
and planned unit development approval to allow the continuation
of an existing asphalt manufacture or refining operation on the
subject property from the existing buildings ,.structures and
other areas where such operation is presently being conducted;
and
WHEREAS, Applicants seek variations hereinafter set forth
from the regulations contained in Article XXII of Chapter 14,
of the said Village Code to bring such existing operations' into
conformity with Village requirements; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-33-V-82) before the Zoning Board
of Appeals of the Village of Mount Prospect, Illinois, on the
second day of September, 1982, pursuant to due and proper
notice thereof published in the Mount Prospect-, Herald on
August 16, 1982; and

WHEREAS, the Zoning Board of Appeals has recommended that
the President and Board of Trustees of the Village of Mount
Prospect grant the requested variations, as hereinafter set
forth; and
WHEREAS, the President and Board, of Trustees of the,Village
Of Mount Prospect have determined that the, requested va.r,1'LatJ'.ons
satisfy the standards set forth in, Section 14.,605 of Artcle VI
of Chapter 14, and further find that it would be in the best
interests of the Village to grant to Applicants the requested
variations.
NOWt THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOA -RD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS. -
SECTION ONE,: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect, Illinois.
SECTION TWO,- The President and Board Of Trustees do hereby de-
termine the structures and uses currently existing upon the
subject, property are in conformance with the Village Ordinance
requirements and Zoning Regulations, and to obtain such con-

14 OF THE VILLAGE CODE OF MOUNT PROSPECT,
ILLINOIS ,REGARDING RADIO AND TELEVISION ANTENNAS
WHEREAS, the Community Development Department of the
Village of Mount Prospect has submitted an application for
text amendment to Article XXII of Chapter 14 of the Village
Code of Mount Prospect, Illinois; and
WHEREAS, said text amendmentis for the purpose of pro,--
v *ding height regulations for radio and television antennas
i
erected within said I-1 Light Industrial District; and
WHEREAS, a public hearing was held on said zoning text
amendment.application (designated as Case No. ZBA-37-A-82)
before the Zoning Board of Appeals of the Village of Mount
Prospect on the 23rd day of September, 1982, pursuant to proper
publication of due notice thereof in the Mount Pro�!pect Herald,,
on September 7, 1982; and
WHEREAS, the Zoning Board of Appeals has forwarded its
finding and recommendation to the Board of Trustees of the
Village that -the requested text amendment be approved to
provide for certain height regulations regarding radio and
television antennas; and
WHEREAS, it is deemed to be 'in the best interests of the
Village of Mount Prospect that said text amendment be adoptedl
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOAR

This Agreement made and entered into this - - day

WHEREAS., the Village is concerned about the availability
of transportation in the Tillage for senior citizens of the
Village; and
WHEREAS, the President and Board of Trustees of the
Village wish to assist senior citizens by establishing taxic,b
fares for senior citizens for taxicab rides within the Village
and providing a Village subsidy to senior citizens for such
taxicab rides.
NOW., THEREFORE., for and in consideration of the mutual
covenants herein made, the parties do hereby enter into the
following Agreement:
SECTION ONE: Fare Established.

SECTION THREE: Procedure.

A. A senior citizen who is eligible shall be issued Up,
an identification card by the Village. Anytime a senior
citizen wishes to obtain the senior citizen fare established
in Section One of this Agreement, such senior citizen shall:
1. Present to the taxicab driver at the inception
of the taxicab ride, the senior citizen's identification
card issued by the Village; and
2. Sign his or her name and record the senior
citizen's identification card number on a form
(hereinafter referred to as the "Passenger Tickets")
to be provided by the taxicab driver 'to the senior
citizen; and
3. For rides other than to Holy Family Hospital
and Northwest Community Hospital, pay the taxicab
driver seventy-five cents ($.75) for the taxicab ride,
except as provided in Section Five hereinafter.

taxicab driver one dollar and sixty-five cents ($1.65)
and for rides to Northwest Community

taxicab driver two dollars and fifteen cents ($2.15).
B.
1. Submit Passenger Tickets to the Village
w *thin seven days after the close of each calendar
month; and
2. Provide the Village with Passenger Tickets
for each senior citizen taxicab ride for which
. ..... is requesting the subsidy established
by Section Two hereinabove, which Passenger Tickets
shall show the signature of the senior citizen., the
identification card number of the senior citizen, the
date of the taxicab rilde and the addresses or locations
where such taxicab ride began and ended.
C. The Village shall:
1. Review such Passenger Tickets and determine
whether they comply with the provisions of this Section
and
by Section Two hereinabove for each senior citizen taxi ab
ride provided the Passenger Tickets
submits to the Village are properly completed.
SECTION FOUR: Service to Senior Citizens.

AN ORDINANCE providing for the issue of

of Special Service Area No. 5 of the
Village of Mount Prospect, Cook County,
Illinois., and the levy of a direct annual
tax sufficient to pay the principal and
interest on said bonds.
WHEREAS, pursuant to the provisions of Section 6(l) of
Article VII of the 1970 Constitution of the State of Illinois
and "AN ACT to provide the manner of levying or imposing taxes
for the provision of special services to areas within the boundaries
of home rule units and non. -home rule municipalities and counties,"
approved September 21, 1973, as amended, the Village of Mount
Prospect, Gook County, Illinois (the "Village"), is authorized to
create special service areas within. the Village, issue bonds
,secured by the full faith and credit of such areas for providing
special services to such areas and levy taxes against the property
Included in such area to pay the principal and interest on said
bonds; and
WHEREAS, the President and Board of Trustees of the
Village (the "Board") by ordinance adopted on the 7th day of
September, 19821, dial propose the establishment of Special Service
Area No. 5 of the Village (the "Area") and the issuance of bonds
of the Area (the "Bonds") in not to exceed the amount of $1,900,000,
bearing interest at a rate of not to exceed 12% per annum and
maturing within 10 years from the issuance thereof and did call
a public hearing thereon for the 29th day of September, 3982
(the "Hearing"); and
WHEREAS, proper notice was given of the Hearing and at
the Hearing held on the 29th day of September, 1982, all interested
persons affected by the Area were allowed to file written ob jecti
thereto and to be heard orally thereon; and
WHEREAS, the Board by ordinance adopted on the 30th
day of November, 1982, did establish the Area; and
WHEREAS, the Area is contiguous and is totally within
the corporate limits of the village; and
WHEREAS, the Area will benefit specially from the muni
services to be provided (the "Services"), and the Services are
unique and In addition to municipal services provided to the Vil
as a whole; and
WHEREAS, no legally sufficient petition has been filed
objecting to the creation of the Area, the levy or imposition
of a tax or the issuance of the Bonds, the Board is authorized
to issue the Bonds and levy a. direct annual tax against all of
the taxable property included in the Area sufficient to pay the
principal and interest on the Bonds; and
WHEREAS, the. .Board has determined and does hereby
determine that it is advisable, necessary and in the best intere
of the Village and the Area to provide for the construction and
installation of the necessary water distribution mains and pumpi
stations to provide Lake Michigan Water to the Area (the "Project
all such construction to be on existing or to be acquired.public
property; and
WHEREAS, it has heretofore been and it is hereby estim
that the cost of the Project will exceed $1,900,000; and
WHEREAS, it is in the public interest to issue Bonds
in the amount of $1,900,000 to pay part of the cost of the Proje
and
WHER.�AS, the proceeds of the Bonds shall be used solely
and only for improvements for which the Village Is authorized ung

levy taxes or special assessments or to appropriate the .funds of

NOW, THEREFORE, Be It Ordained by the President and
Board of Trustees of the Village of Mount Prospect, Cook County,
Illinois, as follows:
Section 1. That it is hereby found and determined that
by and at the proceedings hereinabove described in the preambles
of this ordinance, the Villla.ge was authorized to issue Bonds in
the amount of $1,9003000 payable solely and only from ad valorem
property taxes levied against all of the taxable property included
In the Area for the purpose of paying, part of the cost of the
Project.
Section
2. That in order to raise the sum of $1, goo, 0Co
presently needed for the purpose ai oresaid, there be borrowed on
behalf of the Area the sum of $1,900,000 and that the Bonds,
'payable solely and only from ad valorem taxes levied against all
of the taxable property in the Area, without limit as to rate or
amount, be issued in said amount, the Bonds to be known as
"Special Service Area No. 5 Unlimited Ad Valorem Tax Bonds,"
be dated December 1, 1982, be of the denomination of $5,000 each,
be numbered 1 to 380, inclusive, become due serially on December 1
of each of the ,years and in the amounts and bearing interest at
the rates per annum as follows:

such interest to be payable on December 1. 1983, and semiannually
thereafter on the first days of June and December in each year
until the Bonds are paid, which said interest payments to date
of maturity shall be evidenced by proper interest coupons attached
to each Band and maturing on the dates provided herein.
That the seal of the Village shall be affixed to each of
the Bands and the Bands shall be signed by the President and.
attested by the Village Clerk of the Tillage; and said coupons
shall be signed by said officials, respectively, by their
respective facsimile signatures, and said officials, by the
execution of the Bands, shall adopt as and for their own proper
signatures their respective facsimile signatures appearing on
said coupons; and that the Bends be payable in lawful money of
the United States of America at the
Illinois.
That the Bonds shall be payable to bearer, provided,
however, that the Bonds may be subject to registration as to prir_ci
pal in the name of the holder on the books of the Village Treasurer
of the Village, such registration to be evidenced by notation of
said 'Treasurer upon the back of the Bands so registered, No
Brand so registered shall be subject to transfer except upon such
books and similarly noted on the back thereof, unless the last
registration thereof ,shall have been to bearer. Such registration
of any of the Bonds shall not, however, affect the negotiability
of the coupons attached to the Bands, but such coupons shall
continue transf era.ble by delivery merely. r

of special services to areas within the boundaries of home rule
units and non --home rule municipalities and counties," approved
September 211 1973, as amended, and in compliance with an ordinance
duly passed by the President and Board of Trustees of said Villa e
and published, in all respects as by law required.
It is hereby certified and recited that all conditions,
acts and thine required by the Constitution and laws of the
Mate of Illinois, to exist or to be done precedent to and in
the issuance of this bond did exist, have happened, been properly
done and performed in regular and due farm and time as required by
law; that the indebtedness of said Village, represented by this
band and.the issue of which it is a part, and including all
other indebtedness of said Village, howsoever evidenced and
incurred, does not exceed any limitation imposed by law and that
provision has been made for the collecti

all the taxable property within the Area a direct annual tax for
each of the years while the Bonds or any of them are outstanding
in amounts sufficient for that purpose, and that there be and

Section 6. That forthwith as soon as this ordinance
becomes effective, the Village Clerk of said Village be and is
hereby directed to file a copy of said ordinance with the County
Clerk of Cook County, Illinois, and it shall be the duty of said
County Clerk in and for each of the years 1982 to 1991, inclusive
to ascertain the rate percent required to produce the aggregate
tax hereinbefore levied, and extend the same for collection on
the tax books against all of the taxable property within the
Area in addition to other taxes levied in each of said ,years In
the Area in order to raise the respective amounts levied aforesa' d

and such tax shall be computed, extended and collected In the
same manner as now or hereafter provided by law for the computation,
extension and collection of taxes for general corporate purposes
of the Village, and when collected, the tax hereby levied shall
be placed to the credit of a special fund to be designated and
known as "Village of Mount Prospect Special Service Area No. 5
Bond and Interest Fund of 1982" (the "Bond Fund"), and the Bond
Fund is hereby irrevocably pledged to and shall be used only for
the purpose of paying the principal of and Interest on the Bonds
or if it is not needed for such purpose, for repaying an loans

made to the Bond Fund for the purpose of paying the principal of
and interest on the Bonds.
Section 7. That the funds derived from such levy be
and the same are hereby appropriated and set aside for the sale
and only purpose of paying principal of and interest on the
Bonds when and as the same become due. That the funds derived
from the sale of the Bonds be and they are hereby appropriated
and set aside for the purpose herein set out.
That the accrued interest and any premium received on
the sale of the Bonds shall be credited to and deposited by the
Village Treasurer of the Village in the Bond Fund, and an amount,
equal to the Maximum Annual Debt Service on the Bonds shall be
credited to and deposited by said 'treasurer In a fund to be

designated and known as "Village of Mount Prospect Special Servi
Area No. 5 Bond Reserve Fund" (the "Reserve Fund"). For purpose11
of this ordinance and with respect to the issuance of the Bonds,,
the phrase "Maximum Annual Debt Service" means an amount of mone
equal to the highest future principal and interest requirement
on all of the outstanding Bonds required to be paid in any fisca;
year of the Village, including and subsequent to the fiscal year
in which the computation is made. The money In the Reserve Fund
shall be used to pay principal of or interest on the Bonds at
any time when there are insufficient funds available in the Bond
Fund to pay the same, in which case said money shall be loaned
to the Bond Fund. At any time that the amount credited to the
Reserve Fund exceeds the Maximum Annual Debt Service on the
Bonds, the excess shall be transferred to the Bond Fund and used
to abate taxes accordingly. At such time as the amount credited
to the Reserve Fund equals or exceeds the aggregate principal
and interest remaining to be paid on all of the outstanding
Bonds, all of the money in the Reserve Fund shall be transferred
to the Bond Fund and used to abate taxes accordingly.
- That the balance of the proceeds of the Bonds shall be
credited to and deposited by said Treasurer in a fund to be
designated and mown as 'Village of Mount Prospect Special Serv1
Area No. 5 Construction Fund" ("the Construction Fund"), and the
Construction Fund shall be held in trust for the benefit of the
property owners, residents, ta.x'payers and voters of the Area and
for the purchasers and holders from time to time of the Bonds.
That the money in the Construction Fund shall be used solely and
only as follows: first, for paying the costs of the Project;
and second, for paying the principal of and interest on the
Bonds if there are not sufficient funds on hand in the Bond

Fund or Reserve Fund therefc,r, in which case said money shall be
loaned to the Bond Fund.
That prier to the expenditure of any of the money in
the Reserve Fund or the Construction Fund as provided herein,
the same shall be invested in bonds, notes, certificates of
indebtedness, treasury bills or other securities now or hereafter
issued, which are guaranteed by the full faith and credit of the
United States of America as to principal and interest. Interest
earned on, or increment to, the money in the Reserve Fund shall
be transferred to the Bond Fund and shall be used to abate taxes
accordingly. Interest earned on, or any .increment to, the money
in the Construction Fund shall be retained in the Construction
Fund. After the Project has been completed, any money remaining
in the Construction Fund shall be transferred to the Band Fund
and used to abate taxes accordingly.
Section 8. That the principal proceeds of the sale of
the Bonds ' be devoted to and used with due diligence for the com-
pletion of the Project, and that the Beard covenants, represents
and certifies as follows
(l) TThat the Village has incurred, or within six
months after, the delivery of the Bonds expects to
incur, substantial binding obligations with respect to
e Project, ,said bind,ng obligations comprising con -
'tracts requiring the expenditure of Bond proceeds for
the construction of the Project in the amount of not
less than $1,00,000, said amount being not less than
21..2 olf that porti.on of- the cost of the Project to
be financed with the proceeds of the Bonds.
(2) That the Village expects that all of the
money derived from the sale of the Bands and deposited
in the Construction Fund, which is the fund. from
which the cast of the Project is to be paid, will be
expended on or before December 11, 1985, for the purpose
of paying the cost of the Project, said date being
within three (3) gears following the date of issue of
the Bands.
(3) Z`hat the foregoing is based upon consultation
with the consultants employed by the Village in connec-
tion with. the Project.

(4 ) That work on the Project is expected to pro-
ceed with due diligence to completion.
(5) That the Project has not been and is not
expected to be sold or otherwise disposed of in whole
or in part prior to the last maturity of the Bonds.
(b) That all of the proceeds of sale of the
Bonds and investment earnings thereon are needed for
the purpose for which the Bonds are issued, including
expenses incidental to such purpose and to the issuance
of the Bonds.
(7) That accrued interest received upon the sale
of the Bonds will be applied to the first interest due
thereon., and that the balance of the proceeds of sale
of the Bonds will be deposited as provided in Section 7
hereof.
(8 ) That except for the Bond Fund and for the
Reserve Fund established hereunder, the Village has
not created or established any debt service fund,
redemption fund, reserve fund, replacement fund, or
any similar fund to pay principal or interest on the
Bonds.
(9) That amounts deposited in the Bond Fund will
be expended within a 13 -month period beginning on the
date of deposit, said fund will be depleted at least
once annually to an amount not greater than 1/12 of the
then current annual debt service on the Bonds, and any
amounts received from investment of money in said fund
will be expended within a one year period beginning,
on the date of receipt.
(10) That the Reserve Fund is to be established
from Bond proceeds in an amount equal to the Maximum
Annual Debt Service on the Bonds, a necessary require-
ment in order to make the Bonds salable at an acceptable
Interest rate, as evidenced by the opinion of R. V.
Norene, the independent financial advisor to the Village,
and to the extent that the amount to the credit of the
Reserve Fund exceeds the maximum amount permitted under
Section 103(c) of the Internal Revenue Code of 1954, as
amended, and any Lawful regulations promulgated thereunder,
for investment without restriction as to yield, appropriate
restrictions as to investment of the Reserve Fund are hereby
authorized and directed.
(11) That although money in the Construction Fund
may be required to be used to pay principal and interest
on the Bonds to prevent or remedy a default, such amounts
are not expected to be so used, and there is no assurance
(due to necessity of using such money to pay for the
Project within three ( 3 ) years of the Issuance of the
Bonds) that such money will be available to pay principal
and interest on the Bonds even if all other sources of
payment are exhausted.
(12) That if at any time after the third anniversary
of the date of issuance of the Bands, the aggregate amount
of money in the Construction Fund and the Reserve Fund
equals or exceeds 15% of the par amount of the Bonds or
15% of the proceeds of the Bonds if they were sold at a
discount greater than 2% (the "Minor Portion"), the
money in the Construction Fund and the Reserve Fund in
excess of the Minor Portion shall not be invested at a
yield "materially higher" (within the meaning of Treas.
Reg. §1.103-13(b) (5) (1970) than the ,yield on the Bonds
unless the Village receives an opinion of an attorney at
law or a firm of attorneys of nationally recognized
standing in matters pertaining to the tax-exempt status
of interest on bonds issued by states and their political
subdivisions and duly admitted to the practice of law
before the highest court in any state or of the United
States of America to the effect that investment of such
moneys in the Construction Fund and the Reserve Fund in
excess of the Minor Portion at a yield materially higher
than the yield on the Bonds will not result in the
inclusion of interest on the Bonds in ,gross income for
federal .income tax purposes. (As used herein, the term
"yield" means that yield which when used in computing
the present worth of all payments or principal and
interest on an obligation produces an amount equal to
the purchase price.)
(13) That in valuing the moneys on deposit in the
Construction Fund and the Reserve Fund at any time for
the purpose of compling with paragraph (12) of section
8 hereof, investments will be taken into account at
purchase price with the following exception: if an
Investment is purchased at a discount or results in
Interest payments for any annual period In excess of
Interest payments for any preceding annual period
( reflecting the annual reinvestment of accrued interest
as to principal) the amount of such discount or excess
interest (not discounted to present value) shall be
added to the purchase price ratably each year over the
term of the investment. The yield on such investment
shall be calculated on the basis of the actual payments
received from and the price paid for such investment.
(14) That in restricting the yield can the moneys
on deposit in the Construction Fund and the Reserve Fund
at any time for the purpose of compling with paragraph (12 )
of section 8 hereof, the yield on and market price of
investments will be determined in accordance with Treas.
Reg. 1.1 Q3-13 (c) (1) (Iii) (1979) notwithstanding that
the Bonds are not refunding bonds.
(15) That the Bonds are not being issued to pay any
principal or interest on any other issue of governmental
obligations of the Village,
(16) That at least once a year, the Village will
cause all of the funds referred to in this ordinance to
be audited by independent certified public accountants,
and such audit shall include a statement regarding the
compliance by the Village with the various requirements
of this Section. If such audit shows that the Village
is not in compliance with such requirements in any respect,
the Village shall immediately act to remedy such non-
compliance.
(17) The Village has not been notified of any
disqualification or proposed disqualification of it by the
Internal Revenue Service as a bond issuer which may not
certify bond issues under Treas . Reg. §1 .103--13 (a.) (2) (i i )
(1979) .
(18) That to the best of the knowledge and belief of
the Board, there are no facts, estimates or circumstances
that would materially change the conclusions and representa-
tions set out in this Section and the expectations set
out in this Section are reasonable.
The Beard also certifies and further covenants with the purchasers
and holders of the Bands from time to time outstanding, that so
long as any of the Bonds remain outstanding, moneys on deposit
in any fund or account in connection with the Bonds, whether or
not such moneys were derived from the proceeds of the sale of
the Bonds or from any other sources, will not be used in a manner
which will cause the Bonds to be "arbitrage bonds” within the
meaning of Section 103(c) of the Internal Revenue Cade of 19543
as amended, and any lawful regulations promulgated or proposed
thereunder, including Treas . Reg. Sections 1.103-23, 1.103-14
and 1.103--15, as the same presently exist, or may from time to
time hereafter be amended, supplemented or revised. The Board
reserves the right, however, to make any investment of such
moneys permitted by Illinois law if, when and to the extent that
,said Section 103(c) or regulations promulgated thereunder shall -
be repealed or relaxed or shall be held void by final decision
of a court of competent jurisdiction, but only if any investment
made by ` virtue of such repeal, relaxation or decision would not,
in the opinion of counsel of recognized competence in such matters,
result in making the interest on the Bands subject to federal
Income taxation.
Section 9. That this ordinance be published once wit
thirty (30) days after adoption in the Mount Prospect Herald,
the same being a newspaper published in and with a general
circulation within the Village.
Section 14# That all ordinances,, resolutions and order
or parts thereof, in conflict herewith, be and the same are
hereby repealed and this ordinance be in full farce and effect
Immediately and forthwith upon its adoption, approval and
publication.
