ORDINANCE NO. 2023
AN ORDINANCE GRANTING A SPECIAL USE PERMIT
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
hold a Public Hearing on July 1, 1965 pursuant to proper legal notice at the
Village Hall of the Village of Mount Prospect under Case No. 65-15, wherein
the applicant, Jemo Industries, Inc., requested a special use to permit the
installation of a swimming pool on certain property between Kensington and
Rand Roads, commonly known as the "Old Stanton" property; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
hear testimony on said petition under Case No. 65-15, and recommended the
approval of an application for a special use to permit the petitioner to
construct a swimming pool on its property; and
WHEREAS, said special use was contingent upon the erection of a
structure to be known as "Holiday Inn" on the subject property; and
I HHEREAS, construction for the erection of the "Holiday Inn" building
I has commenced; and
WHEREAS, the Judiciary Committee of the Board of Trustees of the
Village of Mount Prospect did recommend at the regular meeting of the Board
of Trustees held on August 1, 1967 that a special use for the installation
of a swimming pool be granted for the subject property; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have considered the application for a special use permit and
have determined that granting such a special use permit at the hereindescribed
location would be in the best interests of the Village of Mqunt Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That a special use permit be and is hereby granted to
allow Jemo Industries, Inc., or their assignee, to construct a swimming pool
on the following described property:
Parcel A: The W 210 ft. of the E 490 ft. of
the N 300 ft. of that part of the NW 1/4 of the
NE 1/4 of Section 34, Township 42 N, R 11, E 3rd
P.M. lying northeast of Rand Road, and
Parcel B: That part lying N of Rand Rd. of the
W 210 ft. of the E 490 ft. of the NW 1/4 of the
NE 1/4 of Section 34, Township 42 N, R 11,
E 3rd P.M. (except the N 300 ft.) all in Cook
County.
SECTION TWO: That the Director of Building and Zoning of the Village
of Mount Prospect is hereby authorized to issue, upon proper application, such
permit and certificate of occupancy as are required to utilize the said
premises or portion thereof for the construction and installation of a
swimming pool as a special use.
SECTION THREE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in the manner provided
by law.
