ORDINANCE NO. 2025
AN ORDINANCE AMENDING MAP 39S OF THE MOUNT PROSPECT
ZONING ORDINANCE
WHEREAS, the Plan Commission of the Village of Mount Prospect
heretofore on October 29, 1965 under Case No. 65-13 and on May 22, 1967
under Case No. 67-llP conducted public hearings on a request for a zoning
classification change from B-2 (Business - Office District) to R-4 (Planned
Residential Development District) of said property hereinafter described; and
WHEREAS, the Plan Commission has determined as a result of the
hearing held on May 22, 1967 under Case No. 67-llP that a zoning change is in
accord with the overall plan in that area and it would in no way be detrimental
to the Village of Mount Prospect; and
WHEREAS, the Plan Commission of the Village of Mount Prospect has
recommended that a zoning change be granted; and
WHEREAS, the Judiciary Committee of the Board of Trustees of the
Village of Mount Prospect did meet and review Case No. 67-IIP and have
determined that the said recommendation of the Plan Commission would be in the
best interests of the Village of Mount Prospect; and
WHEREAS, the petitioners have stated that upon the rezoning of the
subject property they would dismiss their pending lawsuit regarding the
subject property now pending before the Circuit Court of Cook County as
Cause No. 66CH4l59; and
WHEREAS, the petitioners have stated that they are the owners of a
parcel of property immediately east of the subject property known as the
Sans Souci Apartments and will petition to the Village of Mount Prospect for
annexation to the Village of said property improved with structures known as
Sans Souci Apartments; and
WHEREAS, the petitioners have submitted to the Plan Commission and
the Judiciary Committee of the Board of Trustees a certain exhibit dated
April, 1967 prepared by Albert Osran, Architect, describing the improvements
to be constructed on the subject property; and
WHEREAS, said improvements indicate two buildings on the subject
property comprising eight (8) one-bedroom units and twenty-two (22) two-bedroom
units with parking facilities for fifty-nine (59) automobiles, resulting in a
floor area ration of .417.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1. That Map 39S of the Zoning Ordinance of the Village of
Mount Prospect, as amended, be and is hereby further amended by reclassifying
from B-2 (Business - Office District) to the R-4 (Planned Residential Develop-
ment District) the following legally described property:
That part of Lot 1 in Friedrich Busse Jr. Division
of land in Section 23, Township 41 North, Range 11
East of the Third Principal Meridian, as per plat
recorded February 20, 1911, as per Document
Number 4709799, described as follows:
Commencing at a point in the West line of said Lot I,
448.65 feet South of the Northwest corner thereof; thence
East on the South line of the North 448.65 feet of Lot 1,
200.0 feet; thence South parallel to the West line of
Lot 1, 426.34 feet to the Southerly line of Lot 1, being
the centerline of Algonquin Road, as laid out in Friedrich
Busse Jr. Division of land; thence Northwesterly along
the Southerly line of Lot 1, 224.70 feet to the Southwest
corner of said Lot 1; thence North of the West line of
Lot I, 321.24 feet to the place of beginning, in Cook
County, Illinois.
SECTION 2. That the development of the herein described property
shall be in conformity with the standards set forth by Albert Osran, Architect,
dated April. 1967, and are as follows:
(a) Two (2) buildings consisting of a total of eight (8)
one-bedroom units and twenty-two (22) two-bedroom units.
(b) Parking facilities for fifty-nine (59) automobiles.
(c) Floor area ratio of .417.
(d) Building area (all floors) 28,032 square feet.
SECTION 3. That this Ordinance shall be in full force and effect
from and after its passage, approval and publication in the manner provided
by law.
