AN ORDINANCE GRANTING AN 18 FT. VARIATION FROM THE LOT LINE LOCATED
AT 1407 SOUTH CIRCLE DRIVE. MOUNT PROSPECT. ILLINOIS
WHEREAS, the Board of Appeals of the Village of Mount Prospect
did meet on the 23rd day of June, 1967 at the hour of 8:00 P.M, at the Village
Hall of the Village of Mount Prospect, and did hear Case No. 67-22A, pursuant
to legal notice published in the Mount Prospect Herald on June 9, 1967; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect
did hear a petition requesting an 18 ft. variation from the lot line in
order that the petitioner may erect a two-car garage on the property legally
described herein; and
WHEREAS, the Board of Appeals did determine that a hardship existed
on the petitioner if said variation was not granted; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees of the Village of Mount
Prospect, by a vote of 6-0, to grant the request of the petitioner in
allowing the variation; and
WHEREAS, the Judiciary Committee of the Board of Trustees of the
Village of Mount Prospect did meet and consider Case No. 67-22A and recommend
to the President and Board of Trustees their concurrence with the recommend-
ation of the Board of Appeals; and
WHEREAS, the President and Board of Trustees do believe that a
hardship for the petitioner does exist if said request is not granted and that
the best interests of the residents of the Village of Mount Prospect will not
be subserved by the granting of this variation;
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1. That the property being the subject matter of Case
No. 67-22A, being legally described as follows:
Lot 253 in Block "D" in Elk Ridge Villa Unit 115,
commonly known as 1407 South Circle Drive, Mount
Prospect, Cook County, Illinois
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-A (single family residence) which zoning classification shall remain
subject to the variation granted herein:
(a) That a garage may be erected along a line not less
than 2 ft. south of the northerly lot line of the above
legally described lot.
(b) That said garage may be erected not less than 5 ft.
from the rear lot line of said above described lot.
SECTION 2, That all requirements of the Mount Prospect Building and
Zoning Codes shall be applicable except those variations noted in Section 1
heretofore mentioned.
SECTION 3. That the Director of Building and Zoning of the Village
of Mount Prospect is hereby authorized to issue a building permit for the
erection and construction of a garage in accordance with the variations
hereinbefore mentioned.

SECTION 4. That the variation granted by this Ordinance shall be
null and void and of no force and effect whatsoever unless an application for
a building permit pursuant to such variations is made and construction
commenced within one year of the date said Ordinance becomes effective.
SECTION S. This Ordinance shall be in full force and effect from
and after its passage and approval in the manner provided by law.
