JANONIS, VILLAGE MANAGER DIRECTOR OF COMMUNITY DEVELOPMENT TO: DATE: MARCH 27, 2007 CONTRACT RENEWAL - RETAIL CONSULTANT SUBJECT: The Village hired Cathy Maloney in February of 2006 to supplement our economic development efforts, specifically in the area of recruiting retail establishments for the downtown and other commercial corridors. Attached to this memorandum is a Professional Services Contract with Ms. Maloney to provide retail recruitment efforts on behalf of the Village for an additional one-year period. Staff is recommending approval of this contract. Ms. Maloney has worked with Village staff laying the foundation for business recruitment throughout the Village over the past year. She initiated her efforts by posting a survey on our website to obtain input from residents regarding their retail needs. She has met with numerous businesses and commercial property owners to establish a rapport and to help promote local businesses. She has visited several successful shops in other communities to determine their interest in opening a second location in the Village. She has assisted Village staff in creating promotional materials for our recruiting efforts. All of these efforts have put the Village in a much greater position to recruit and attract businesses to our commercial corridors. It is critical that the Village continue its efforts to maintain viable commercial districts throughout the community. Competition from surrounding communities remains strong as each town vies for limited sales tax dollars. The success of a community's commercial base is one of several important factors that impact the image and perception of the community. Having a retail recruitment specialist working on our behalf strengthens our ability to remain competitive and attract quality retailers. The foundation has been laid for a successful retail recruitment strategy for the years to come. The reality is that this is a long-term process with very few short-term results. Recruiting retailers is a complicated process that takes many months, even years. Contacts made today may result in successful recruitment of a business several years from now. Staff strongly recommends that we continue our contract with Ms. Maloney for another 12 months to allow these recruitment efforts to bear fruit and enhance our commercial corridors. Please forward this memorandum and attachments to the Village Board for their review and consideration at their April 3rd meeting. Staff will be present to answer any questions related to this matter. UJl William J. VILLAGE OF MOUNT PROSPECT PROFESSIONAL SERVICES AGREEMENT FOR RETAIL RECRUITMENT CONSULTANT This agreement (hereinafter the "Agreement") is entered into this _ day of ,2007, by and between Cathy Maloney, 376 Cottage Hill Avenue, Elmhurst, Illinois 60126, (630) 832-7049, a retail recruitment specialist (hereinafter "Consultant"), and the Village of Mount Prospect, an Illinois home rule municipal corporation (hereinafter the "Village. ") For and in consideration of the mutual covenants and agreements herein contained, it is agreed by and between Consultant and Village as follows: 1. SCOPE OF WORK The Village has agreed to retain Consultant, on a consulting basis and as an independent contractor, to provide the following services (hereinafter the "Consulting Services"): A. Form focus groups with Village residents to determine the types of retail commodities that residents are purchasing outside of Mount Prospect and the types of retail businesses that should be attracted to Mount Prospect. B. Create surveys seeking the opinions of residents, as to community retail needs, which surveys shall be made available for distribution in the Village Newsletter and on the Village web site. C. Utilize the Village Newsletter, web site and local media to inform residents of the new focus on local business and to offer assistance from the Community Development Department to businesses interested in opening new shops or restaurants. D. Develop and implement signage to inform prospective tenants, who are looking to relocate, that they can call the Village for expert assistance in locating their shop, restaurant or entertainment venue in Mount Prospect. E. Conduct community visits to gather competitive information, obtain a vision for future developments and attract potential businesses that are interested in expanding. F. Meet formally and informally with real estate brokers and landlords to anticipate vacancies and assist in recruiting the right businesses for Mount Prospect. G. Maintain a monthly telephone/activity log to track all incoming/outgoing calls and meetings for the purpose of monitoring progress chronologically. iManaae:191574 1 H. Generate a monthly recruitment report listing all available properties in Mount Prospect by area, and including square footage, broker contacts, types of businesses "missing" from the area, prospective tenants and leads for available properties. I. On a monthly basis, or as otherwise determined by the Director of Community Development, meet with Village representatives, as designated by the Village's Director of Community Development, to review Consultant's progress. 2. PAYMENT: The Board hereby agrees to pay Consultant at a rate of seventy-five dollars ($75.00) per hour, not to exceed ten (10) hours per week, for Consulting Services. Additional work in excess of the ten (10) hours per week will be compensated, but only if requested in advance by Consultant, and approved in writing by the Village. Reasonable expenses will be reimbursed by the Village provided the Director of Community Development approves of such expenses in writing in advance (the "Reimbursable Expenses"). 3. TERM: The term of this Agreement shall begin on February 1, 2007, and end on January 31, 2008. 4. TERMINATION: The Village shall conduct performance reviews of Consultant's performance of the Consulting Services under the Agreement, and may, at its' sole option and at any time, terminate the Agreement immediately upon approval of the Village's Board of Trustees. 5. INDEPENDENT CONTRACTOR: The Consultant is retained by the Village only for the purposes and to the extent set forth in this Agreement, and her relation to the Village shall, during the term of this Agreement and the period of her services hereunder, be that of an independent contractor. The Consultant shall be free to use such time, energy and skill as she is obligated to devote hereunder to the Village, in such manner as she sees fit. The Consultant shall not be considered as having an employee status, nor shall the Village withhold any sums for the payment of income taxes, or FICA taxes, nor shall the Consultant be entitled to participate in any plans, arrangements, or distributions by the Village pertaining to or in connection with any pension or retirement plans, or any other benefits for the regular employees of the Village. iM~n~n.I'1Q1"74 1 6. COMPLIANCE WITH LAWS: In the performance of its obligations pursuant to this Agreement, the Consultant shall comply with all applicable provisions of federal, state and local law. 7. WARRANTY: Consultant warrants that she will perform all work in a professional, workmanlike manner. 8. RISK OF LOSS: Consultant assumes full responsibilities and holds the Village, its officers, employees, and agents, harmless from and against any and all loss, cost, liability and expense (including reasonable attorneys fees and court costs) paid or incurred by the Village arising from any claim or cause of action resulting from any act or omission of Vendor, its employees, agent, and sub-contractors, their agents, and employees, and all other persons performing any of the work under the Agreement. 9. NOTICE: Any notices required to be given under this Agreement shall be by personal service or certified mail, receipt requested, effective on the date of personal service or the date of receipt, respectively, at the respective addresses shown below or to such other party or address as either party may from time to time furnish to the other in writing: If to Consultant, to: Cathy Maloney, 376 Cottage Hill Avenue, Elmhurst, Illinois 60126, If to Village, to: Village Manager, Village of Mount Prospect, 50 S. Emerson Street, Mount Prospect, Illinois 60056 10. AMENDMENT OR MODIFICATION: Any amendment or modification of this Agreement must be in writing and executed by both parties to this Agreement. 11. NON-COMPETE CLAUSE Consultant shall not provide any services similar to those set forth in Section 1 for any other municipality, individual or entity within ten (10) miles of the corporate boundaries of the Village of Mount Prospect during the term of the Agreement. iManage:191574 1 '2 12. PAYMENT TERMS Consultant shall record actual hours of work performed and Reimbursable Expenses, and invoice the Village on a monthly basis. Payment is due Consultant within fourteen (14) calendar days of receipt of invoice by the Village. 13. ENFORCEABILITY: If any provision of this Agreement, or any paragraph, sentence, clause, phrase or word or the application thereof is held invalid, the remainder of this Agreement shall be construed as if such invalid part were never included and this Agreement shall be and remain valid and enforceable to the fullest extent permitted by law provided that the Agreement, in its entirety as so reconstituted, does not represent a material change to the rights or obligations of the parties. 14. JURISDICTION AND VENUE: This Agreement provides for services to be performed within the State of Illinois. Accordingly, this Agreement, and all questions of interpretation, construction and enforcement hereof, and all controversies hereunder, shall be governed by the applicable statutory and common law of the State of Illinois. The parties agree that for the purpose of any litigation relative to this Agreement and its enforcement, venue shall be in the Circuit Court of Cook County, Illinois and the parties consent to the in personam jurisdiction of said Court for any such action or proceeding. 15. CAPTIONS: The captions at the beginning of the several paragraphs, respectively, are for convenience in locating the context, but are not part of the context. 16. EFFECTIVE DATE: After this Agreement has been signed by the Consultant, this Agreement shall be deemed dated and become effective on the date that the Director of Community Development signs this Agreement which date shall be the date stated on the first page of this Agreement. JANONIS lab/~l~ &.\- .. 01 FROM: WATER/SEWER SUPERINTENDENT DATE: MARCH 27, 2007 BID RESULTS FOR SEWER LINE SPOT RELAYS ($209,465) SUBJ: Background In the current budget, staff requested funds to continue the combined sewer system repairs. These repairs were identified during the combined sewer system evaluation study (CSSES) completed in 2004. In total, almost $15 million worth of repair work has been slated. Some sewer pipe segments have significant structural defects that can only be effectively repaired by excavating and replacing segments of sewer main (spot relays). The majority of the sewer rehabilitation is being performed using the cured-in-place-pipe (CIPP) process. To facilitate this work, staff has prepared two (2) separate bid packages. The bid package was drafted to procure the services of a sewer excavation contractor capable of replacing structurally failed pipe. This proposed work, along with the rehabilitation work performed in 2005 and 2006, eliminates the worst defects (Category 5) and begins to address the Category 4 defects identified in the CSSES. Each year the Village also rehabilitates the separate sanitary sewer system. Some of this repair work also includes spot relays. This separate sanitary sewer work has been included in these bid packages. Distinct funds were appropriated in the budget for these improvements. This memorandum will present the results of bids for spot relay work. Bid results for the CIPP work will be presented via a separate document. The locations of the work planned for the proposed Sewer Line Spot Relays award is outlined in Attachment A. This year's proposed project features nine (9) point repairs, ten (10) new or replacement manholes and two (2) large replacements of 50 lineal feet of 12" and 70 lineal feet of 21" diameter sewers. Bid Results Prior to letting, seven (7) invitational bids were distributed to area contractors experienced in sewer construction. In addition, public notice was posted in a local newspaper as required. One (1) additional firm requested the bid package. Sealed bids were received until 10:00 AM Page 2 of 2 BID RESULTS FOR SEWER LINE SPOT RELAYS ($209,465) March 27, 2007 on Monday, March 26, 2007 at which time they were opened and read aloud. Three (3) bids were received. The bid results are as follows: i / Base Bid Suburban General $ 164,465 ALamp Concrete Contractors $ 177,800 Martam Construction Co. $ 219,700 Discussion Staff has evaluated all bids and determined that all bids received are responsive to the request. All bidders submitted the required bid security and appropriate references. The apparent low bidder for the proposed spot relay work is Suburban General Construction of La Grange Park, Illinois. Suburban General has worked for the Village of Mount Prospect in the past and has performed their work in a timely and professional manner with no outstanding issues. Staff recommends the inclusion of a contingency in the award for this proposed contract due to the fact that the bid quantities are estimates and actual field measurements will vary. Three of the repairs are under state highways and additional traffic control will be necessary. Also, if additional work is discovered during the CIPP, this contractor would be able to perform those spot repairs necessary to continue the progress with that endeavor. In this instance, staff is recommending adding a $45,000 contingency to the contract award. The total recommended award would be $209,465 ($164,465 base award plus a contingency of $45,000). Recommendation I recommend awarding a contract for the 2007 Sewer Line Spot Relays to Suburban General Construction, Inc. of LaGrange Park, Illinois in an amount not to exceed $209,465. JANONIS WA TERlSEWER SUPERINTENDENT TO: DATE: Background In the current budget, staff requested funds to continue the combined sewer system repairs. These repairs were identified during the combined sewer system evaluation study (CSSES) completed in 2004. In total, almost $15 million worth of repair work has been slated. This work primarily consists of rehabilitating existing sewer main pipes using a no-dig, cured-in- place-pipe (CIPP) process. However, some sewer pipe segments have significant structural defects that can only be effectively repaired by excavating and replacing segments of sewer main (spot relays). To facilitate this work, staff has prepared two (2) separate bid packages. One package was designed to secure interest in rehabilitating sewer mains using CIPP. The other bid package was drafted to procure the services of a sewer excavation contractor capable of replacing structurally failed pipe. Both of these bid packages are oriented towards repairing the remainder of the worst pipe defects, rated Category 5, and begins to address the Category 4 pipe defects identified in the CSSES. This proposed work, along with the rehabilitation work performed in 2005 and 2006 will result in the elimination of the worst defects (Category 5) and approximately 50% of the Category 4 defects in our combined sewer system. In addition, each year the Village also repairs a portion of the separate sanitary sewer system. This work also utilizes the CIPP process. This separate sanitary sewer work has also been included in these bid packages. Distinct funds were appropriated in the current budget for these improvements. This memorandum presents the results of the bids for CIPP work. Bid results for spot relays will be presented via a separate document. The locations of the work planned for the proposed CIPP award is outlined in Attachment A. This year's proposed project features 22,845 lineal feet of lining work in pipes ranging from 8" to 30" in diameter. Page 2 of 2\ BID RESULTS FOR SEWER REPAIRS USING CURED-IN-PLACE-PIPE (CIPP) PROCESS ($976,776.90) March 27, 2007 Bid Results Prior to letting, three (3) invitational bids were distributed to area contractors experienced in the CIPP process. In addition, public notice was posted in a local newspaper as required. No additional firms requested the bid package. Sealed bids were received until 10:00 AM on Monday, March 26, 2007 at which time they were opened and read aloud. Two (2) bids were received. The bid results are as follows: > .. Bid .... Insituform TechnoloQies, Lemont, IL $951,776.90 Visu-Sewer Clean & Seal, Pewaukee, WI $1,098,901.00 Discussion Staff has evaluated all bids and determined that all bids received are responsive to the request. All bidders submitted the required bid securities and appropriate references. The apparent low bidder for the proposed CIPP work is Insituform Technologies USA of Lemont, Illinois. Insituform Technologies USA has previously worked for the Village performing CIPP relining. The firm performed all work in a satisfactory manner. They have completed CIPP installations in 2003, 2004 and 2005. Furthermore, they have installed over 70,000 lineal feet of CIPP in the Village over the last 20 years. Staff is recommending a contingency of $25,000 be added to the contract to cover the difference between actual lineal footages and the estimates used to prepare the bid specifications, to address unforeseen sewer services that would need to be reinstated and to make any other small repairs needed to be performed prior to the lining of the sewer. The total recommended award would be $976,776.90 ($951,776.90 base award plus a contingency of $25,000). Recommendation I recommend awarding a contract for the 2007 combined and sanitary sewer repairs using the CIPP process project to Insituform Technologies USA, Inc. of Lemont, Illinois in an amount not to exceed $976,776.90. In total, almost $15 million worth of combined sewer repair work has been slated over the next several years. The Village is in the third year of the project. The CSSES was performed by consulting engineer, Baxter & Woodman of Crystal Lake, Illinois. Due to the scale of this project, literally a multi-million dollar, multi-year effort. r.tCJff is recommending the use of a consultant part-time to assist Village staff in the oversight of this program. The program for 2007 includes the 22,845 lineal feet of cured-in-place-pipe (CIPP) project and the spot relay repairs project. The total work in 2007 is estimated to cost $1,330,000. Discussion Baxter & Woodman prepared the initial study that provided the Village with detailed information about the integrity of the Village's combined sanitary sewer system. Their report recommended the formation of the rehabilitation program that is now in its third year. The firm is very familiar with the Village's infrastructure rehabilitation program and is attuned to our customer oriented work philosophies. Baxter & Woodman assisted the Village in 2006 with limited engineering assistance for the second year of the CIPP and Spot Relay project. Both projects were without incident and culminated in a satisfactory and timely completion. The ongoing CIPP program continues to be approximately three times larger in quantity than previous years and with the bid packages requiring additional materials testing and reporting; staff is recommending the use of consulting engineer, Baxter & Woodman on a part-time basis to assist with these projects. At staff's request, Baxter & Woodman has submitted a proposal to supply limited engineering assistance after contract award that includes half-time oversight of the CIPP project, 100% construction observation of the spot relay work and overall contract administration for both projects. Their proposal amounts to a not to exceed total of $95,800. Recommendation I recommend that the Village Board authorize a contract with Baxter & Woodman, Consulting Engineers of Crystal Lake, Illinois for engineering assistance with the Sewer Line Spot Relay Repairs and the Sewer Rehabilitation using CIPP Process projects in an amount not to exceed $95,800. JANONIS FROM: PROJECT ENGINEER DATE: MARCH 29, 2007 Back2round To date, the Engineering Staff with the assistance of a traffic consultant have completed a Neighborhood Traffic Study in three neighborhoods. Those neighborhoods are Zones 7,8 and 13 (refer to attached map). We are also at various stages of neighborhood studies in Zones 9, 12 and 15. With the anticipation of completing the three current studies this summer, the Engineering Staff has prepared a schedule to perform additional neighborhood studies over the next year. Two traffic programs are included in each neighborhood study. The first program, the Residential Speed Limit Program, involves reviewing all neighborhood streets to determine the appropriate speed limit. This program is being handled by the Engineering Staff and we will continue to do so. The other program, the Residential Intersection Traffic Control Program, involves reviewing neighborhood intersections to determine the proper traffic control and then evaluating previously studied neighborhoods through post-studies. Because of the complexity of this program, the Village has in the past retained the services of a traffic consultant to perform the intersection traffic control studies. In reviewing the work necessary to complete such studies, the Engineering Staff continues to believe it is necessary to hire a traffic consultant to complete additional studies in a reasonable amount of time. 2007 Study This year's work will once again include new traffic studies in neighborhoods not yet reviewed. In addition, the Engineering Staff will begin to perform post-studies in those neighborhoods previously studied. Traffic regulations in Zone 8 were improved in August 2006 and in Zones 7 and 13 this past January. The Engineering Staff agrees with the Village Board of Trustees that post-studies near the 6- month and 12-month marks after implementation are necessary to assure the changes have created a safe and efficient environment. KLOA Inc. of Rosemont, Illinois has provided consulting services for the Village since the beginning of the Neighborhood Traffic Study. The Engineering Staff, therefore, provided a Request for Proposal to KLOA Inc. to study the next set of neighborhoods as well as to perform post-studies in previously studied neighborhoods. For the new traffic studies, it was outlined that the scope of their services were to include data collection, analysis, recommendations and representation at various public meetings. With the completion of previous studies, a template has been established and a good working relationship created with the consultant where neighborhoods are studied efficiently. As part of this next contract, we are proposing to study five neighborhoods. They were chosen based on the Engineering Staffs knowledge of past and known traffic-related issues. Vehicle volume and speed data would be collected using traffic counters, accident data would be reviewed, and visual inspections would be made at each intersection. This information would then be compared to the data collected as part of the original traffic study in the neighborhood. Based on the results, the consultant would affirm the previous decisions or recommend further changes to the traffic regulations as necessary. Because of the sensitive nature of the original studies and the impact to the neighborhoods, multiple post-studies would be done in each neighborhood. This would allow the Village to closely monitor the traffic in those neighborhoods previously studied. For each neighborhood, the first post-study would be a comprehensive look at the entire neighborhood. Subsequent post-studies would focus only on locations that are considered to demand extra attention in the neighborhood. The table below shows the schedule to complete the post-studies associated with this contract. Their work has met the expectations of the Engineering Staff and been done in a professional manner. They have provided quality reports, met deadlines and represented the Village well at public meetings. KLOA Inc. has provided the Village a price of $90,800.00 to complete intersection traffic control studies for the next five neighborhoods. Comparing their price for the next five neighborhoods to their price for the previous five neighborhoods, they have lowered their price per intersection from $430 to $426. Their price includes data collection, analysis, recommendations and an implementation plan which would all be detailed in a report. It also includes various meetings with the Engineering Staff, attendance at Village Board Meetings and participation at Open Houses. This is the same services provided for the previous neighborhood studies. page 3 of3 Traffic Consultant Recommendation March 29, 2007 KLOA InC. has also provided the Village a price of $61,500.00 to complete post-studies for the previously studied neighborhoods. Two post-studies would be performed in Zones 7, 8 and 13, and three post-studies would be performed in Zone 12. The first post-study would review all intersections and streets in each neighborhood. In order to keep costs down while still being able to closely monitor the changes and providing a informative report, subsequent post-studies in each neighborhood will target up to 25% of the original study locations. The locations will be determined based on known sensitive areas and the results of the first post-study. Should additional work be necessary in a particular neighborhood, the Engineering Staff will consider negotiating a price with KLOA Inc. or performing the work ourselves. The price per intersection for the post studies is $258. KLOA Inc.'s price includes data collection, analysis and recommendations which would all be detailed in a report. It also includes various meetings with the Engineering Staff and attendance at Village Board Meetings. The combined price from KLOA Inc. for the new traffic studies and the post-studies is $152,300.00. With the Village Board of Trustees approval of this work, KLOA Inc. would begin immediately collecting data in Zones 14 and 17 as well as post-study data in Zones 7, 8 and 13. Analysis would take place over the spring and summer with public meetings held and final recommendations made per the schedule. Data collection for Zones 11, 16 and 18 as well as post-study data for Zone 12 would take place in the fall. Recommendation It is my recommendation that the proposal submitted by KLOA Inc. for traffic engineering services be accepted with a not to exceed amount of $152,300.00.
