REQUEST FOR CHANGE OF OWNERSHIP
SUBJECT:
On Monday, January 29, 2007 the Village Manager met with applicant Ms. Michelle Kim and Mr.
Man Ho Hong, her interpreter, regarding Ms. Kim's request to assume ownership at the above
noted restaurant. Chungkiwa Restaurant currently posses a Class "R" license which provides
for the service of alcoholic beverages at dining tables only. The restaurant has been in
continuous operation at this location since at least 1997. Chungkiwa serves Korean style
cuisine.
Ms. Kim currently has a purchase contract pending which is contingent upon approval of the
change in ownership of the liquor license. As explained to the Village Manager, Ms. Kim is
purchasing the restaurant as an investment and plans to have the current owner continue on as
the day to day manager of the business. All current staff will also continue on in their present
positions. Ms. Kim plans no changes to the menu, decor or name of the restaurant. To the
average customer the transaction would appear transparent. Ms. Kim has no previous
experience in owning or operating a restaurant, nor does she have any experience in the
service of alcoholic beverages. As such, the Village Manager's recommendation includes the
requirement that Ms. Kim complete a certified liquor server's course as a condition of her
request.
The Village Manager also discussed at length with Ms. Kim through Mr. Hong the requirements
of the liquor code. Ms. Kim indicated that she understood the rules and requirements of same.
The Village Manager particularly stressed the importance of being vigilant regarding service to
minors and over service to clearly intoxicated patrons. The Village's Fight Ordinance was also
discussed at length.
A completed application along with required fees and most documentation have been
submitted. Ms. Kim has submitted to the required background check and fingerprinting. As
stated previously it is the Village Manager's recommendation that proof of completion of a
certified liquor server's course be a contingent part of granting the request. Should the Village
Board view the application favorably a motion to approve a change in ownership would be
appropriate.
