AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 52 NORTH ALBERT STREET
WHEREAS, the Diane M. Chlopek (hereinafter referred to as Petitioner) has filed an
application for variations from Chapter 14 of the Village Code of Mount Prospect, Illinois,
for property commonly located at 52 North Albert Street (hereinafter referred to as Subject
Property), legally described as:
The South 19.50 feet of the north 236.105 feet of Lot One, both as measured on
the west line of said Lot One; the north line and the south line of said tract taken
at dght angles to said west line of Lot One in Resubdivision of Lot One, in Frank
Serafine's Third Addition, a Subdivision in the southwest quarter (1/4) of Section
35, Township 42 North, Range 11, East of the Third Principal Meridian, according
to Plat of said Resubdivision registered in the Office of the Registrar of Titles of
Cook County, Illinois, On October 21, 1958, as Document No. 1824555
which property is zone R-3, Low Density Residence District; and
WHEREAS, Petitioner seeks a variation from Section 14.1205.C to allow a maximum lot
coverage of fifty-seven percent (57%), instead of the permitted maximum of 50%, and a
variation from Section 14.1205.B to allow an existing parking area to be located ten feet
(10') from the rear property line, instead of the required 25 feet; and
WHEREAS, a public hearing was held on the requested variations, being the subject of
ZBA Case No. 12-V-95, before the Zoning Board of Appeals of the Village of Mount
Prospect on the 26th day of October, 1995, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 6th day of October, 1995; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation
to the President and Board of Trustees of the Village of Mount Prospect and the
President and Board of Trustees of the Village have determined that the best interest of
the Village would be served by granting the variations being the subject of ZBA 12-V-95.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
hereby grant the following:
1. A variation from Section 14.1205.C to allow a maximum land coverage of 57%,
rather than the permitted maximum of 50%.
2. A variation from Section 14.1205.B to allow an existing parking area to be located
ten feet (10') from the rear property line, rather than the required 25 feet.
SECTION THREE: Except for the variations granted herein, all other applicable Village

of Mount Prospect Ordinances and regulations shall remain in full force and effect as to
the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.203 of Chapter 14 of
the Village Code, the variations granted herein shall be null and void unless permits are
issued and construction begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
