ROLL CALL Mayer Krause celled the meeting; to order at p.m., 1.n the Public Safety Building, 112 East Northwest Highway. Present at the meeting were: Mayor Krause, Trustees Ralph Arch. r Gerald Farley, Leo F'loros , Edward Miller, Norma. I" urau kis and Theodore Wattenberg. Also present at the meeting were: village Manager Terrance ° u.rghard Village Attorney David Newman, Financial Advisor Ron Norene and approximately atel seven persons in the audience MINUTES The Minutes of the Committee of the Whole,,,meeting of April 1 , 1982 were :accepted and filed` faith the following amendment: On page 2, at the anal of paragraph three, add the followinglanguage - "Trustees Floros and Murau'skis indicated their willingness to increase the combined water and sewer bil.. to $1.50 per thousand and +apposed. the increase to $1.53 per..:. thusand. , III. VENTURE WATER COSTS Mayor Krause 'introduced this matter as a continuation of the discussion initiated at the .April 13, 1982 Committee of the Whole meeting. Drawing ' attention to the Nuveen report, the Magor painted out that the Cash Flora needs to pay .Agency costs would require that either the Village establish a Special Service District and its commensurate Tax Levy by September of 1982, cr in the alternative, to delay the installation of a Special Service District until the subsequent year. If the Special Service District and its Levy is not created by September of this year, then the Village's share of Venture costs, estimated to be $48,000, will have to come from the fiscal 1982-1983 water and sewer budget. The Mayor pointed out that the hoard had included this $48,000 in the Forthcoming budget. ,After some general discussion clarifying the budget procedure and the Tax Levy timing, it was the consensus of the Mayor and the Berard that given thedifficulties of creating a: Special Service District and the fact that the village had already budgeted the $48,000 payment to Venture out of the forthcoming budget, that the actual implementation of a Special Service District could be delayed until the subsequent year. Mr. Ron Norene of Ron Norene and Associates financial consultants, addressed the ,Co mmittee of the Whole and indicated in substance that the utilization of a Special Service District to p,.,ay all or a . portl on ou f the Ventre , water costs would be a feasible project. Mr. Norene discussed the notice of provisions to those residents in our community who would be part of the Service District and subsequently receive Lake water and indicated that that notice provision would need t,o bel doneonly # iitially in establishing the Special Servic I e District. ni 1 Subsequent notifications could be avoided if In seeking the initial creation of the Special Service District the Village establishes an authority to levy a',tax rate as opp�osed to a fixed dollar amount. 'For example, if the needs of the Special "nt Service District to pay Veure costs are 11 x ty then it would be in the Village's interest to seek an authority to levy a tax rate,of say "2x." In this way, subsequent fluctuations and/or changes in the amount owed to Venture in the next 40 years could be p id al from increasing the amount levied each year as long as the authority granted by the initial Special Service District is not exceeded. Mr. Norene also pointed out that in order t.o handle the cash flow needs of the Special Service District, because of 'irregular tax payments, incomplete tax payments, or any other cash need that might arise in paying apps pr Venture costs, it would be advisable for the Village iin its creation of' the Special Service District, to establish a and issue together with a tax rate to cover loperation , and maintenance expenses. This front-end bond issue would,theme. give the Village sufficient cash that when it is invested could take care of the cash flow needs of the Special Service District and the cash balance would be subsequently replenished when tax payments are made in'the spring and fall of each year '. Assuming that the Village creates a Special Service D-listrict.lissues some Bonds for necessary cash flow purposes and establishes the authority of A tax rate sufficient to meet the needs of future years, then the subsequent operating levy is filed automatically by the Village as part of its regular tax levy and no re -notice to the ty i communi is rye ces,sary. Dave Newman, Village Attorney, reported about his diiscussions with Chapman and Cutler, Bond Counsel, that it i,s no longer a pure requirement on the municipality that its Special Service District be created by the normal riling of a tax levy in early Sep'tember'. Legiisla- tion was introduced in Springfield Last year that permits the County to add to the municipal tax rate any ,speclal service district created by the end f December of any one calendar year. Both Mr. Newman and Mr. Norene indicated that the creation: of,a master list for 'o ntification could be accomplished either by a computer program from the County or by using some outside service to compile the necessary data. d -2- I a, - - - - - - - --------- A general discussion ensued among the members of the Board, Mr. Norene and Mr. Neuman. Various elements of the Nuveen Cash Flow Analysis and Tax Impact Study were reviewed by the Committee of the Whole looking at different impact circumstances for various elements of property owners and income groups. After some further general discussion', it was suggested by Trustee Miller that the Village look at placing the capital costs I of Venture on the property tax and any and all operational costs including Venture and the local system on the water bill. In this way, the entire community which benefits from the physical construction of the c ital facility would pay for that benefit and future api protection through the property tax and all operational expenses; i.e., consumption expenses, would still be placed on the water bill, therefore, maintaining a level of equity. Trustee Wattenberg inquired of Mr. Norene as to the costs of creating the Special Service District and the initial Bond issue. Mr. Norene estimated that the basic costs for the Bond issue and the creation of the Special Service District would be in the vicinity of $25,000 and that the necessary research to complete the tabulation of 18,000 properties, if done by an outside firm, would approach $N,000. Therefore, the total costs of creating the Special Service District, as envisioned in these early stages would range somewhere between $40,000 and $50,000. Mr. Norene also pointed out that these costs to create the Special Service District are reimbursable and/or recoverable on the part of the municipality through the Special Service District tax. That is, none of the expense would have to be funded by the General Fund, but could be reimbursed by the tax payer benefiting from the Special Service District. Mr. Newman reported that Chapman and Cutler has advised the Village that the Special Service District would haee no impact on any State debt limitations as the law is presently structured, nor is it anticipated that any changes would occur since it is not part of the regular I ided by the municipality. This addressed services provi 1 1 1 one of the questions ralf-sed in the Nuveen Report. After some further general discussion, Ms. Irene Steffen of 218 South Weller, presented the Committee of the Whole w ith a petition of 110 signatures. Of the 110 people i signing the petition, 109 were against the concept of placing the costs of water against the property tax. These petitions were accepted by Mayor Krause and the discussion ensued between various members of the audience and the Committee of the Whole. The Commitee of the Whole clarified for members of the audience that the costs to be placed against their property tax were the ital costs 1 1 capi and that a water bill would st'll ex'st and through that water bill, people would pay according to their consumption. It was the expressed fear of -3- some of the audience members that persons on fixed income and Persons with _' very light consumption would pay a disproportionate share of the costs of water if the matter were simply placed on the property tax. Mayor Krause responded and indicated that the administra- tion shoul ' d review recent State legislation that allows a municipality to give a discount and/or a tax rebate to senior citizens. it is thought t ' hat this rebate might 'be apportioned against the water bill or in some other, form. This position was supported by Trustee Wattenberg. The administration was requested to keep this matter under advisement and to report to the Board at a later date. Ms. Steffen also requested to be advised of the future Board meetings and CommInittee meetings where these matters were discussed so that sh e and some of her friends might attend. After some further general discussion, it was t -ie direction on the part of the Commifttee,of the Whole that the Village administration proceed, where necessary, in continued examination of the creation of a Special Service District and to refine the cost es] -mates and water bill estimates as time goes on. The Village Manager was ins,tructed to prepare these estimates based upon the concept that the c *tal costs of Venture - pi be placed upon the property tax and the remaining expense against the water bill. Trustee Farley proposed that since the costs at this time are s o nebulous and will remain estimates until after construction and the s,ale of Bonds, that the Village s *Imply decide to split the cost differential on a 50/50 basis. That is, 50% of the Venture costs to go on the property tax through 'the Special Service District and the remaining 50% on the water bills. Trustee Miller said he could agree with that proposal and it was the consensus of the Committee of the Whole that that matter be studied further and be brought back to the Committee at a later date. Trustees Murauskis, Arthur and Floros indicated their support of the concept. Mayor Krause and Trustee Wattenberg expressed their continued reservations. Trustees Wattenberg and Floros inquired as to the status of Venture engineering and the negotiations with the CI*ty,of Chicago. The Village Manager responded by informing the Committee of the Whole that as a,member of the negotiating team with the City of Chicago, that he expected a written contract to be presented to the Mayor and the Board within three of four weeks., The engineering negotiating committee has spent a considerable amoun-,_ of time on various technical details and -in certain areas where it is necessary to change the policy of the City of Chicago. The Village Manager reviewed the routing and schedule of the Venture system and presented to the Committee of the Whole the final contract documents and contract drawings as prepared by Metcalf and Eddy for the Mount Prospect segment of the line. These plans had been promised to the Village by April 15 and were actually delivered to the Village on April 19. Trustee Floros stated that in his opinion the engineers through their own omission have not progressed as far in the project as he thought was necessary at this time. Trustee Floros reviewed minutes of various Venture 4 - meetings and Executive Commllt�-ee meetings indicating that the time schedu] - e had been changed on numerous occasions and that in his opinion there were substantial delays in preparation of these documents and the completion 7 of a contract with the City oF Chicago and that we could expect construction delays in the field similar to those 'th other construction pro'ects. General we see wi J discussion ensued comparing the progress in the Northwest Water Commission pipeline versus the Venture pipeline and the 12.5% interest rates that the Commission has bought with its 20 -year Bond -1-ssue. The Village Manager indicated that the Venture group has interim financing at 10.5% and our schedule for permanent financing indicates it will be entering the market sometime in 1983-1984 when interest rates should be lower than they are presently. Trustee Arthur also indicated his support of Trustee Floros' position and expressed his concern that the delays w ith the contract with the City of Chicago and engineering documents are costing the municipality money. Mayor Krause responded that some of the delays caused in the Venture group stemmed from the Village of Mount Prospect's attempt to have the Citizens' Utilities area serviced by the Venture and that in fact the Venture groups had spent some $100,000 in various engineering and technical services in order to have Citizens' Utilities Join the Venture group. IV. MANAGER'S REPORT 1. The Village Manager reported that the WATER STORAGE TANK painting contract was on schedule and that in fact the contractor is working some weekends and early i evenings. 2. AN ORDINANCE GRANTING SPECIFIED VARIATIONS AND A SPECIAL USE FOR CERTAIN PROPERTY COMMONLY KNOWN AS MC DONALD'S PROPERTY AT 100 WEST RAND ROAD, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, McDonald's Corporation (hereinafter referred to as the "Petitioner") is the owner of a certain tract of property, commonly known as the McDonald's property and located at the intersections of Rand and Elmhurst Roads (100 West Rand Road) in the Village of Mount Prospect, Illinois; and WHEREAS, the subject property is legally described as follows: Lots 1 and 2 in Mc Donald's Rand -Elmhurst Subdivision, being,.a part of the East Half of the Southwest Quarter of Section 27, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois WHEREAS, Petitioner has filed an application requesting a variation from Sections 14.2102.c,, and 14-2602.B.24 and B.52 -in order'to legalize an existing encroachment of the bu,11ding structure located on the property in question in the required rear yard, to permit a truck loading IAM o)f 10 feet by 31 feet rather than the required 10 feet by 510 feet, and to permi , _t, the truck space and drive -up laneto jointly occupy the required rear yard; and WHEREAS, the Petitioner has also filed an application seeking a special use for the purpose of adding a drive -up window to the existing premises; and WHEREAS, a public hearing was held on Petitioner's re- quest for the aforesaid variations (designated as case No. ZBA-3-V-82) and on the Petitioner's request for the aforesaid special use (designated as case No. ZBA '2 -SU -82) before the Zoning Board of Appeals of the Village of Mount Prospect on the 25th day of March, 1982, pursuant to due and proper notice thereof published in the Mount ProsPect Herald, on March 8, 1982; and WHEREAS, the Zoning Board of Appeals has recommended to the Board of Trustees of the Village of Mount Prospect that the Petitioner's request for the aforesaid variations under ZBA 3-V-82 and Petitioner's request for a special use under ZBA 2 -SU -82 be granted in accordance with the Petitioner's Site Plan attached hereto as Exhibit "A", subject to the conditions set forth, hereinbelow, to wit. 1. That in the event following a trial period of at least one year, the Village determines, upon the traffic information obtained during said period, to prohibit left turns onto Rand Road from the southerly driveway of the property, then, upon request, such left turn restriction will be enacted. I I/30/82 - Page �4 2. Three parking spaces shall be eliminated from the subject property because of the limited maneuver- ability or use of the public right-of-way. 3. Lighting requirements for a commercial roadway, following state policy, shall be followed and shall apply to both Rand and Elmhurst Roads, and shall contain specifications and details which will include use of 400 -watt high pressure sodium lamps on a 40 -foot pole with a maximum spacing of 130 feet. 4. A landscape design for the property including the planting of parkway trees on both Rand and Elmhurst Roads shall be submitted to and approved by the Community Development Department of the Village, together with Petitioner's guarantee regarding the planting of 12 parkway trees by the Department of Public Works. 5. That restrictions shall be added to the plat of subdivision of the subject property to provide that no additional direct access other than the existing joint driveway access on the subject property shall be allowd to Rand Road or Route 83 from Lot 2 of Mc Donald's Rand -Elmhurst Subdivision; that Lot 2 of said Subdivision, when developed, will provide detention for both Lots 1 and 2 in said Subdivision, and that no variations will be sought from the provisions of the Zoning Ordinance of this Village with respect to the development of Lot 2; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the Petitioner's variation requests satisfy the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code of Mount Prospect, and that the Petitioner's special use request satisfies the standards set forth in Section 14.704 of Article VII of the said Chapter 14 of the Village Code of Mount Prospect, Illinois, and does further find that it would be in the best interest of the Village to grant to the Petitioner the requested variations and special use. The minutes should state that "the motion'fai1ed by a vote of 4-2 (5 -affirmative votes needed for passage). Chairman Ross requested that his vote be changed from Nay to Aye and declared the motion carried by a vote of 5-1. Tom Borrelli also voted Nay." Marie Caylor's motion to approve the corrected minutes was seconded by Louis Velasco, and unanimously approved. As a result of the legal questions that arose in the discussion of this request with,, the developer, Counsel for the developer, and the owner of Lot 6, the Commission '.requested that Ken Fritz obtain the Village' Attorney's opinion and carried this subdivision over to the next regular meeting. COMMITTEE REPORTS Comprehensive Plan Commission. Marie Caylor advised that the meeting scheduled for April 18 could not be held for lack of a quorum. This meeting has been rescheduled for Wednesday, April 28 at .0 00 P.M. in, the staff lounge of the Village Hall The first 20 pages of the 1981 Comprehensive Plan will be the subject of the meeting. OLD BUSINESS Special Sign Committee Tom Borrelli reported that the meeting held on April 12 included a constructive discussion of the proposed revisions to the sign. Ordinance, especially in regard to the tapes of signs permitted and to the proposal to relate the provisions to land use rather than Zoning classifications. The next meeting is scheduled for Monday, April 26 at 8:00 P.M. at the Village Hall. NEW BUSINESS SIMONSEN ' S NURSERY PROPERTY Marie Caylor requested a briefing on the proposed development of the Simonsen' s Nursery property. Ken Fritz provided a. description ,anad advised that the Zoning Board of Appeals is holding a public hearing Thursday, April 22 at 8:00 P.M. at the Public Safety Building. ZONING ORDINANCE - ANTENNAS Chairman Ross requested clarification of Ken Fritz recent letter to the Village Manager on this subject. He also recalled the commitment of the Village Manager to restrict the building permit for Cablenet's antenna' and ,Attorney Newman' s commitment to revise the zoning Ordinance to establish better control over such antennas.
