A. Recognize the winners of the Holiday Decorating Contest
B. 1st reading of AN ORDINANCE AMENDING CHAPTER 13
OF THE VILLAGE CODE
This Ordinance creates a Mass "S" liquor license for Marion's 11, a
restaurant that will occupy the space formerly used by Swenson's
Ice Crum Parlor and more recently Al's Diner in the Colony Shopping
Center at Oakton & Elmhurst Toad (Exhibit A)
C. 1st reading of AN ORDINANCE AMENDING CHAPTER 13
OF THE VILLAGE CODE
This Ordinance deletes the Class "T" currently held by Tdwardo's
at 1904 S. Elmhurst Road and creates a Class "S" license for the
new restaurant to be known as Pap's frill and Bar. (Exhibit B)

VIII. OLD BUSINESS
A. 1st reading of AN ORDINANCE AMENDING CHAPTER 18
(TRAFFIC CODE)
This Ordinance amends the Traffic Code to provide for a STOP
sign on Wille Street, north and southbound, at Thayer Street. (Exhibit C)
B. 2nd reading of AN ORDINANCE AMENDING CHAPTER 8 OF
THE VILLAGE CODE OF MOUNT PROSPECT
Consideration of this Ordinance, establishing procedures for
the recall of elected officials, has been deferred In order to
obtain additional legal opinions.
IX. NEW BUSINESS
A. 1st reading of AN ORDINANCE AUTHORIZING THE SALE
OF PERSONAL PROPERTY OWNED BY THE VILLAGE
This Ordinance authorizes the sale of certain turn -out gear
(protective outer wear) no longer necessary to the Fire Department. (Exhibit D)
B. 1st reading of AN ORDINANCE AMENDING CHAPTER 10
ENTITLED "LICENSES AND PERMITS" OF THE VILLAGE
CODE
This Ordinance establishes requirements that all outstanding
items, such as payment of fines, penalties, legal action, etc.
must be up-to-date in order to obtain a license from the Village. (Exhibit E)
C. 1st reading of AN ORDINANCE AMENDING CHAPTER 25
OF THE VILLAGE CODE
This Ordinance amends that Section of the Village Code that
defines the construction of words to elaborate on the often
used phrases throughout the Code to include "person,
firm or corporation". (Exhibit F)

X. VILLAGE MANAGER'S REPORT
A. Bid result:
1. Remodel public bathroom facilities in the. Senior Citizen
Center, in compliance with the requirements of ADA
B. AN ORDINANCE AUTHORIZING THE ACQUISITION OF
PROPERTY FOR PUBLIC RIGHT-OF-WAY (LINNEMAN ROAD)
This Ordinance authorizes the Village to purchase property to
be used for public right-of-way in conjunction with the Linneman

Village Manager Janonis stated that while there had been
discussion that the requested STOP sign did not meet warrant]
it should be noted that two accidents occurred at this
intersection over the past weekend.

requested STOP sign for north and southbound traffic on Wille Street
at Thayer.

meeting of the Village Board.
An Ordinance was presented for first reading that would substitute AMEND CH. 5:
a member from Public Works as a voting member of the Safety SAFETY COM.
Commission, instead of the Traffic Engineer. The Safety
Commission recommended this amendment by a vote of 5-2 with
one abstention.

waive the rule requiring two readings of an Ordinance.

NEW BUSINESS
An Ordinance was presented for first reading that would establish RECALL
procedures for the recall of elected officials.
There was discussion as to whether the proposed Ordinance
would change the form of government, which would require a
referendum to determined if the voters of the Village support such
action. It was also suggested that the proposed Ordinance is
too broad and that specific reasons for recall should be adopted, i.e.
absences from meetings, questionable or bad decisions, conviction
of a felony.

A request was presented to waive the bidding procedure
and authorize the purchase of a replacement vehicle for the
Public Works Department as part of the State bid for vehicles.
Trustee Wilks, seconded by'Trustee Corcoran, moved to,waivc
the bidding procedure and authonize the purchase of aol,v6hible
for the Public Works Department as a part of the State bid.

A request was presented to authorize an increase in the contract
w ith Arrow Road Construction for additional work involved with

I -Oka Avenue/Sunset Road reconstruction project.
it was noted that the reconstruction project, I -Oka between
Lonnquist Blvd and Golf Road and on Sunset Avenue between
Elmhurst Road (Rt. 83) and Hi Lusi involved additional costs in
the amount of $12,888.36.
Trustee Skowron, seconded by Trustee Corcoran, moved to
increase the contract amount to Arrow Road Construction in
the amount of $12,888.36 for the I-Oka/Sunset reconstruction
project.

Village Manager Janonis presented a proposed settlement HEMPHILL
in the Hemphill vs Village law suit as it pertains to the SUIT:
development of the Village Commons development at SE I I I EMENT
Elm and Evergreen. Mr. Janonis stated that the proposed
settlement involved a dollar figure of $35,000 and recommended
accepting.
Trustee Corcoran, seconded by Trustee Clowes, moved to
authorize acceptance of the settlement in the Home by
Hemphill law suit as specified.

Trustee Hendricks stated that there had been some personnel INSPECTION
changes in Inspection Services, and asked the Mayor to SERVICES
establish a Committee to investigate. Mayor Farley stated
that the Manager had informed the Board of the changes and
that there was no need for a investigation.

Trustee Wilks stated that with Cook County doing roadway
improvements on Euclid Avenue in the near future, she asked the
Village Manager for a estimate on the cost for the Village to install
sidewalks on the south side of Euclid as needed. It was noted
that there are no sidewalks and it causes people to have to walk
in the street.
Trustee Wilks stated that while plowing, the snow from the plow is
deposited on sidewalks, specifically at central road and Owen
,street. It was noted that children cross at that intersection and
the snow on the sidewalk makes itdifficult to walk and asked what
could be done to keep the sidewalks dear of snow.
Trustee Willes and the Board congratulated David Jepson, Finance
Director on receiving yet another award for budget preparation and
presentation.

Trustee Willes, seconded by Trustee Hoefert, moved to go into
Closed Session for the purpose of discussing Property ,Acquisition.

SUBJECT: REQUEST FOR CLASS S LIQUOR LICENSE

On' Thursday, January 5,1995, the Village, Manager met with Mr. Jose Alvarez and Maria
Alvarez regarding their request for the creation of a Class S Liquor License. The License
will be used in conjunction with the operation of Marions 11 Restaurant The Class S
Liquor designation provides for the consumption of alcoholic beverages on site in
conjunction with a lounge.
The location of the restaurant is the last tenant space on the southwest comer of the
Colony Shopping Center located at South ElmhurstRoad and Oakton Street. The most
recent operation at this Site was Al's Diner, a restaurant, without a Liquor License. Prior
to that, it was once the site of a Swensen's Ice Cream facility.
Mr. Alvarez indicated that the restaurant would be operated without major redecorating
or renovation. The restaurant's theme and menu will be California -style Tex-Mex The
former customer counter will be converted into the bar area.
Mr. Alvarez stated that his family currently operates a similar restaurant named Marlons
in the area of Grand and Austin in Chicago. This restaurant has been in operation for
over 15years. 'The Chicago, location has had a Liquor License since its opening. The
Liquor License will be held by Saboricito, Inc. Mr. Alvarez has a lease for the space
which runs through October 1997.
As of this time, Mr. Alvarez has taken possession of the tenant space and will operate
the restaurant without service of alcohol.
The Village Manager discussed with Jose Alvarez and Maria Alvarez some of the
particulars of the Village's Liquor Ordinance and the general philosophy of the Village
regarding the sale and consumption of alcohol. Jose and Maria Alvarez indicated that
they understand the requirements of the Mount Prospect Liquor Code and are very
familiar with the operation of a restaurant that serves alcohol.
The required Liquor License application, supporting documents and fees have been
submitted to the Village and are in order. Appropriate background checks are currently
being conducted.
A representative from Marions 11 will be present to answer any questions that you may
have.

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTIQN ONE: That Subsection A of Section 13,107 of Chapter 13 of the Village Code
of Mount Prospect, as amended, be and the same is hereby further amended by
increasing the number of Class "S" liquor licenses by one (1) (Saboricito, Inc., d/b/a

The Village Manager discussed with Mr. Pappas some of the particulars of the Village's
Liquor Ordinance and the general philosophy of the Village regarding the sale and
consumption of alcohol—especially by underaged persons. Mr. Pappas indicated that he
understood fully the requirements of the Ordinance and would take all precautions
necessary to avoid any problems.
The required Liquor License application, supporting documents and fees have been
submitted to the Wage and are in order. Appropriate background checks are currently
being conducted.

SUBJECT: SURPLUS TURNOUT GEAR
Fire Department turnout gear (fire protective outerwear) is subject to wear
and tear in the normal performance of duty. Some years ago, we instituted a
replacement policy whereby the Fire Department purchases five to six sets of
gear on a regular basis. This has provided an inventory of worn turnout gear
consisting of 24 trousers and 18 coats that are at least seven years old. Due to
the age and condition, I recommend selling the turnout gear for a minimum
bid of $100. If we do not receive a bid over $100, 1 request permission to
dispose of as surplus.
Most of the gear was manufactured by the Janesville Corporation. It is to be
sold as is, FOB Mount Prospect Fire Department, 112 East Northwest
Highway. Successful bidder will be required to sign a hold harmless
agreement, indemnifying the Village of Mount Prospect.

AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN PERSONAL

WHEREAS, in the opinion of at least three-fourths of the corporate authorities of the
Village of Mount Prospect, Cook County, Illinois, it has been determined that it is no
longer necessary, useful, or in the best interest of the Village of Mount Prospect to retain
ownership of Fire Department turnout gear - trousers and coats; and
WHEREAS, it has been determined by the President and Board of Trustees of the Village
of Mount Prospect that the best interests of the Village would be served by the sale of
the personal property being the subject of this Ordinance to the highest bidder.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SEC'TI,O;N ONE: In accordance with the provisions of Section 65 5/11-76-4 of the Illinois
-Compiled Statutes, the corporate authorities of the Village of Mount Prospect find that the
items of personal property being the subject of this Ordinance owned by the Village of
Mount Prospect are no longer useful or necessary and the best interests of the Village
will be served by the sale of these items.
SECTION TW!2*, That the Village Clerk of the Village of Mount Prospect be and is hereby
directed to cause a public notice advertising for bids for such personal property to be
published in the Mount Prospect Herald, which notice shall be in substantially the same
form as indicated on Exhibit "A" attached hereto and hereto made a part hereof.
SECTION THREE: Bids received in response to said Notice shall be opened in the
Office of the Village Manager, 100 South Emerson Street, Mount Prospect, Illinois 60056,
at the hour of 10:00 A.M. on Tuesday, February 14, 1994.
SECTION FOUR: Within ten (10) days after the successful bid is accepted, the
successful bidder shall tender to the Village of Mount Prospect the consideration specified
in the bid accepted and upon receipt of such consideration, the Village Manager is hereby
authorized to transfer title of said personal property to the successful bidder. In the event
no bid is received for the items being the subject of this Ordinance, the Finance Director
of the Village has the authority to declare this property surplus and dispose of it in an

AMENDMENT TO CHAPTER 10 "LICENSES AND PERMITS"

Attached are two Ordinances amending the Village Code that are presented for
consideration by the Village Board.
The first Ordinance amends Chapter 10 to establish requirements that any and all
outstanding items must be satisfied prior to a license being issued.
Many times it is assumed that payment of the license fee will automatically result in
the issuance of a business license. However, there are incidents where a business,
landlord, property management company, etc. has an outstanding violation, such as:
a delinquent water bill for commercial property, which must be paid before a new
business license can be issued; an outstanding violation against multi -family property,
including a housing court matter, must be corrected and/or satisfied before a
Landlord/Tenant License can be issued; a citation issued to a restaurant and/or liquor
license holder would have to be corrected prior to a license being issued. Under the
current regulations in our Code the Village has no authority to deny the issuance of a
new or renewal license.
If adopted, the proposed amendments would give staff the enforcement power
necessary to obtain compliance with our laws.
The proposed amendment to Chapter 25 amends that Section of the Code, as
required by State Statute, that sets forth the construction of general terms used
throughout the Code, specifically "person, firm or corporation" and elaborates on that
term.

license application properly filled out on a form designated in

license contemplated under Section 10.101 of this Chapter for any period of time not
exceeding one year to any applicant applying therefor on a form provided by the said
Village Clerk, as specified in Article I of this Chapter, and upon payment by the
applicant of the appropriate fees and/or bond as may be required in this Village Code.,
Sec. 10.202. Investigation. The Director of Community Development shall
make or cause to be made an investigation in regard to such
business inspection certificates to be granted in connection with all fire prevention,
building and zoning matters.
Sec. 10.203. Applicability. This Chapter 10 shall apply to all licenses which
are required for the operation of any activity within the Village of
Mount Prospect, except for Village vehicle licenses and dog licenses. ,
Sec. 10.204. Signatures. Each such license contemplated in this Chapter shall
bear the signature of the Village President and the Village Clerk.

Sec. 10.301. Building and Premises. No license shall be issued for the conduct
of any business, occupation or activity if the premises and building
or vehicle, as the case may be, to be used for the purpose do not fully comply with all
applicable provisions of this Code and Village Ordinances, building Fire Prevention,
Building, Zoning, Fire and Health.
Sec. 10.302. Current Financial Obligation to the Village. No license shall be
issued or renewed for the conduct of any business if the applicant,
license holder, prior license holder for the same premises or any predecessor to the
business interest of the current license holder has not paid any fees, fines, judgments
or forfeitures due and owing to the Village of Mount Prospect.
Sec. 10.303. Change of Location. Except as other provided in the Village Code
of Mount Prospect, the location of any licensed business or
occupation may be changed provided ten (10) days' notice thereof is given to the
Village Clerk and that any increase in fees, as required by Article XXXIV of Chapter
11 of this Code, is paid.
Sec. 10.304. Non -transferability of License. No license issued under this
Chapter shall be transferred to assigned or used by any person other than the one to
whom it is issued, except as provided for under Article XXXIV of Chapter 11 of this
Code.
Sec. 10.304. License Term. Unless otherwise specified in this Village Code, all
annual licenses set forth in Chapter 11 of this Village Code issued
pursuant to this Chapter shall terminate on December 31 following such issuance. "
SECTION THREE: That Article IV entitled "Revocation or Denial" of Chapter 10 of the
Village Code, as amended, is hereby further amended by adding thereto Section
10.404 entitled "Operating Without A License; Penalty"; so that hereafter said Section
10.404 shall be and read as follows:
Sec. 10.404. Operating Without a License; Penalty. If any person operates a
business or other activity without a required license or after
renewal of license has been refused for any reason, that person shall be fined not less

Village Code of Mount Prospect, as amended, is hereby further amended by in
Section 25.102 entitled "Construction of Words"; so that hereby after said Section
25.102 shall be and read as follows:
If Sec. 25.102. Construction of Words. Whenever any word in any
section of this Code importing the plural number is used
in describing or referring to any matters, parties or persons, any single
matter, party or person shall be deemed to be included, although
distributive words may not have been used. When any subject matter,
party or person is referred to in this Code by words importing the
singular number only, or the masculine genders, several matters, parties
or persons and females as well as males and bodies corporate shall be
deemed to be included. The word person or the words "person, firm or
corporation" shall include an individual, organization, entity, corporation,
proprietorship, partnership, firm, association, trade union, trust, estate or
group as well as any parent or beneficiary of any of the foregoing
entities, whether or not operated for profit. Words in the present shall
include the future. The words "the ordinance" whenever used in this
Code, shall be held and taken to mean the entire Code, including each
and every Section thereof. The word "Village" whenever used in this

RESOLUTION NO.
WHEREI Richard N. Hendricks is a duly elected and sifting member of the Village of
Mount Prospect Board of Trustees. As such, the Mount Prospect Code of Ordinances
at Section 8.115 requires that elected officials conduct their personal and public lives in
a manner so as not to bring the office of trustee into disrepute. It is also incumbent on
a trustee to discharge the duties of office in a manner which does not unreasonably
expose the Village to liability; and A
WHEREAS, in invoking the name of his or her office of Trustee of the Village of Mount
Prospect in private circumstances, the trustee must only do so to serve the best interests
of the Village of Mount Prospect. Further, the name of the office should not be involved
by a trustee to avoid procedures applicable to the general public especially when the
trustee is engaged Ina, private matter that does not involve the discharge of a duty as a
trustee; and
WHEREASI further, itis recognized that, *irrespective of the trustee's actual motives, when
that trustee Identifies himself or herself as a trustee of the 'Village of Mount Prospect in
private circurn stances the suspicion 'I's raised that the trustee has done so for the purpose
of gaining a private advantage not available to other members of the public; and
WHEREAS, it is also recognized that the 'Village staffs retained for the purpose of
carrying out the policies established by the entire Village Board and to serve all of the
residents of the Village. Therefore,'a trustee should not make unreasonable demands
on the staff for the advancement of that trustee's personal agenda even if the trustee
sincerely believes that his or her agenda is based on the best interests of the Village; and
WHEREAS, it appears that based upon various communications received by the Village

and the personal observations of other elected of dials and the Village staff that
Richard N. Hendricks has engaged in the following activities:
1. On certain occasions when not on Village business and while pursuing
purely personal matters, Richard N. Hendnicks has chosen 'to gratuitously
identify himself to others as a trustee of the Village, of Mount Prospect. The
circumstances of those occasions were such that the Identification was
,apparently used to gain a personal advantage not available to other
citizens.
2. Richard N. Henddcks as caused private citize�ns to feel 'Intimidated b,,
using the prestige of his office as trustee to his own advantage whe'

3. Richard N. Heriddeks has inappropniately used a badige identify in himself

5. Richard N. Hendricks has consistently used his office to demand actions
from the Village staff that were not authorized by the full Village Board but
had the appearance of being matters of personal Importance to himself.

Department recommends that The Dubbs Company be awarded the contract for the Senior Center
Restroom Accessibility Project in the amount of $36,821.

RETIREE MEDICAL BENEFIT PROGRAM
Any employee of the Village of Mount Prospect (hereinafter referred to as "Village")
who retires (hereinafter referred to as "Retiree") from the Village of Mount Prospect
between May 1, 1994 and April 30, 1997 shall establish a Sick Leave Deferred
Payment Account (hereinafter referred to as "SLDPA") with the Village. The SLDPA
shall be funded with the value of the Retiree's accumulated sick leave hours up to a
maximum of that number of sick leave hours granted to that employee over a five-year
period. The value of the Retiree's eligible sick leave hours shall be determined by
multiplying the number of eligible sick leave hours by the Retiree's regular hourly rate
at the date of his/her retirement. The Village shall establish and shall fund the SLDPA
with the value so determined on the first day of the Retiree's retirement.
The amount established in each Retiree's SLDPA shall be distributed to the Retiree in
forty-eight (48) consecutive monthly installments commencing on the last day of the
month of retirement. Subsequent installments shall be paid on the last day of each
-month thereafter. Each Retiree with an active SLDPA shall receive an annual
statement of account from the Village.
Any Retiree with a balance in her/her SLDPA shall be eligible to participate in the
Village's Section 125 Flexible Compensation Plan (hereinafter referred to as "Flex
Comp Plan") for the payment of qualified medical expenses on a pre-tax basis. The
Retiree has the option of designating any or all of his/her SLDPA monthly installment
as his/her contribution to a Medical Spending Account in the Flex Comp Plan. The
balance of any monthly installment not designated for the Flex Comp Plan shall be
subject to all applicable taxes. When the Retiree's SLDPA is depleted, the Retiree
shall no longer be eligible to participate in the Village's Flex Comp Plan.
The Medical Spending Account (hereinafter referred to as "MSA") may be used for the
payment of medical insurance premiums of the Village's Medical Insurance Plan or
any other qualified medical expenditures. Reimbursements to the Retiree from the
MSA will be made pursuant to provisions of the Flex Comp Plan. If the portion of a
Retiree's SLDPA monthly installment designated as a contribution to the Flex Comp
Plan is not sufficient to pay the Retiree's medical insurance premium, the balance
shall be paid from the Retiree's pension.
If there is a balance in the SLDPA at the time of death of a Retiree, the Retiree's
beneficiary(s) shall have the option of receiving the balance in the SLDPA in a lump
sum or continue to receive the remaining monthly installments. A deceased Retiree's
spouse or eligible dependents may continue as participants in the Village's Medial
Insurance Plan, but will not be eligible to participate in the Village's Flex Comp Plan.

WHEREAS, the Village of Mount Prospect (hereinafter referred to as Employer) has
employees rendering valuable services; and
WHEREAS, the establishment of a money purchase retirement plan benefits
employees by providing funds for retirement and funds for their beneficiaries in the
event of death; and
WHEREAS, the Employer desires that its money purchase retirement plan be
administered by the ICMA Retirement Corporation and that the funds held under such
plan be invested in the ICMA Retirement Trust, a trust established by public
employers for the collective investment of funds held under their retirement and
deferred compensation plans.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTIQN ONE., That the Mayor and Board of Trustees of the Village of Mount
Prospect hereby establish a money purchase retirement plan (hereinafter referred to
as "the Plan") in the form of The ICMA Retirement Corporation Prototype Money
Purchase Plan and Trust, pursuant to the specific provisions of the Adoption
Agreement. The Plan shall be maintained for the exclusive benefit of eligible
employees and their beneficiaries.
SECTION G The Employer hereby executes the Declaration of Trust of the ICMA
Retirement Trust, intending this execution to be operative with respect to any
retirement or deferred compensation plan subsequently established by the Employer, if
the assets of the Plan are to be invested in the ICMA Retirement Trust.

SECTION THREE,-. That the Finance Director of the Employer shall be the coordinator
for the Plan, and as such shall receive necessary reports, notices, etc. from the ICMA
Retirement Corporation or the ICMA Retirement Trust and shall cast, on behalf of the
Employer any required votes under the ICMA Retirement Trust. The Finance Director
may delegate any administrative duties relating to the Plan to appropriate parties.
SECTION FO That the Employer hereby authorizes the Mayor of the Village of
Mount Prospect to execute all necessary agreements with the ICMA Retirement
Corporation incidental to the administration of the Plan.
