OF THE VILLAGE CODE OF MOUNT PROSPECT
This Ordinance amends the tent of the Zoning Code. (Exhib:t A)
B. End reading of AN ORDINANCE AMENDING THE OFFICIAL
ZONING MAP OF THE VILLAGE
This Ordinance amends the Official Zoning Map to include the B-5 and
B -5C (Central Business/Core *District) zoning classifications. (Exhibit B)

C. 2nd reading of AN ORDINANCE AMENDING THE OFFICIAL
COMPREHENSIVE PLAN OF THE VILLAGE OF MOUNT PROSPECT
This Ordinance amends the Comprehensive Plan and Generalized
Land Use Map to include the Central Business District. (Exhibit C)
D. 2nd reading of AN ORDINANCE AMENDING CHAPTER 16 ENTITLED
"DEVELOPMENT CODE" OF THE VILLAGE OF MOUNT PROSPECT
IN ITS ENTIRETY
This Ordinance amends Chapter 16 (Development Code) of the Village (Exhibit D)
Code in its entirety.
IX. NEW BUSINESS
A. TBA 3-V-95, 505 Go Wando
The Petitioner is requesting variations to allow front yard setback of
approximately 22.5 feet, instead of the required 30' in order to add an
addition to the existing garage, and to allow an interior side yard
setback of approximately 2 feet for a room addition and 35 for the
addition to the garage, instead of the required 5'. The Zoning Board
of Appeals recommended granting these requests by a vote of 4-0.
A RESOLUTION APPROPRIATING MOTOR FUEL TAX FUNDS
This Resolution appropriates $700,000 for the 1995 resurfacing (Exhibit E)
program.
C. 1st reading of AN ORDINANCE AMENDING ARTICLE 11 ENTITLED
"RULES OF ORDER" OF CHAPTER 2 OF THE VILLAGE CODE
This Ordinance deletes that section of the Village Board agenda (Exhibit F)
entitled "Trustee Comments".
D. 1st reading of AN ORDINANCE AMENDING CHAPTER 8 OF THE
VILLAGE CODE
This Ordinance addresses the power of arrest and deletes the
reference to elected officials being conservators of the peace. (Exhibit G)
E. Presentation of preliminary technical report for Tele-Communications
Inc. (TCI) physical plant and related Cable T.V. performance.

NEW OWNERS Trustee Wilks, seconded by Trustee Corcoran, moved to allow the
now owners of Mt. Prospect Liquors to continue operation of the
business with a Class "C" liquor license with the condons that
they complete a Liquor Servers Course and operike the business
under the direction of the previous manager for six months; these
conditions were required due to the fact that the new owners ave
no prior experience in operating a packaged goods business.

Mayor Farley gave a summary of his January 25 trip to the 62nd
U.S. Conference of Mayors which was held in Washington, D.C.
OLD BUSINESS
An Ordinance was presented which would establish procedures for
the recall of elected officials. This item was deferred until this meeting
to allow more time to obtain legal opinions from the Illinois Municipal
League. Trustee Wilks stated that at a January 20 meeting with IML
attorneys, the Board was advised to address this matter by presenting
a referendum on the November ballot 1buresiden'to, vote upon. It was

After a lengthy discussion, it was determined that the properties at
19 and 21 South Emerson Street, the Village Commons Development
(Hemphill) and the Central Plaza should not be rezoned. It was also
determined that the maximum building height in the Central Commercial -
Core district should remain at 70 feet.
Trustee Corcoran, seconded by Trustee Wilks, moved to concur with the
Zoning Board of Appeals and amend the text of the Zoning Ordinance
text and map, as amended.

Trustee Hendricks attempted to further discuss the Resolution of
Admonishment by the Village Board presented and approved at
the January 17, 1995 meeting.
Mayor Farley stated that this subject had been discussed
on more than one occasion and did not allow Trustee Hendricks
to continue his explanation relative to the matter of the
Cumberland Baptist Church, which was, orae of the several subjects
itemized in the Resolution of Admortishm ent.
Trustee Hendricks asked for statusraports, re ardi gparking,at,

and all award recipients, and thanked everyone who participated in CELEBRATION

Trustee Hoefert requested that a limit be placed on the number of

member of the Village Board member ' suggesting 25 copies a
week may be an appropriate number. Trustee Hoefert noted
that Trustee Hendricks makes hundreds of copies each week,
many of which are copies of items already distributed to Boa
members or newspaper articles. Trustee Hoefert suggested
using Village equipment in this manner is inappropriate use of
Village facilities.

the minutes of the regular meeting of February 7, 1995. MINUTES
Inasmuch as Trustee Hendricks had several proposed amendments
to the minutes, Trustee Wilks withdrew her motion and Trustee
iowes withdrew his second on the motion in order to defer action
on accepting the minutes to the next regular me ing � the Village
Board in order for the Village Clerk to verify the proposed
amendments.

and to waive any fees that may be associated with conducting this Fair.

Village Manager Michael E. Janonis stated that the budget hearings BUDGET
will be held at the Committee of the Whole meetings beginning HEARINGS
February 28, March 14 and March 28th. The budget for the 8 month
period of 1995, allowing for the calendar year budget to begin
January 1, 1996, will be presented in Ordinance form in April.
TRUSTEE COMMENTS
Trustee Wilks stated that "disparaging" remarks were recently made
by a Village Trustee relative to local business and she expressed
her support for local business and their valuable contributions to the
community. Trustee Hoefert expressed his concurrence with
these statements made by Trustee Wilks.
Trustee Skowron asked that the Village Board consider reducing the MINUTES
amount of text in the Village Board minutes as it pertains to "Trustee
Comments", noting that more text is included In that portion of the
minutes than other matters of importance that take place throughout
the meeting.
There was general discussion on what should be included In the
minutes and this item was referred to a future Committee of the
Whole agenda for further discussion.
Trustee Clowes complimented the Northwest Municipal Conference NEW AREA
for their support in opposing the creation of a 630 new area code for CODE
telephone users.

Members of the Village Board expressed opposition to the requests
of Trustee Hendricks, to the fact that Trustee Hendricks has set up

given to an elected official and also suggested that Trustee

WHEREAS, the tornado season is imminent, putting human lives and property
in danger; and
WHEREAS, the State of Illinois is especially vulnerable due to its location at
the northeast edge of the most tornado -prone region in the world; and
WHEREAS, Illinois ranks ninth in the nation in tornado frequency and seventh
in tornado fatalities; and
WHEREAS, tornadoes and related phenomena are the most devastating
natural disasters that regularly affect our State; and
WHEREAS, the Illinois Emergency Management Agency, the National
Weather Service, and Mount Prospect Emergency Services and Disaster
Agency have combined efforts to implement emergency planning to combat the
deadly effects of tornadoes; and
WHEREAS, the Emergency Services and Disaster Agency of the Village of
Mount Prospect encourages residents to plan ahead and establish a plan for
emergency action in the event a tornado warning is activated in the Village.
NOW, THEREFORE, 1, Gerald L. Farley, Mayor of the Village of Mount
Prospect do hereby proclaim March 5 - 11, 1995, as TORNADO
PREPAREDNESS WEEK in the Village of Mount Prospect. I strongly urge
residents to become familiar with the hazards of tornadoes and to formulate or
refine preparedness plans in order to minimize deaths and/or injuries from the
devastating effects of tornadoes.

WHEREAS, the Village of Mount Prospect, through its administration, (hereinafter
referred to as "Petitioner"), has filed an application for text amendments to specified
Sections of Chapter 14 entitled "Zoning Ordinance"; and
WHEREAS, Petitioner proposes the text amendments as follows:
A. Section 14.1904. CONDITIONAL USES
Add the following uses:
1. Animal Hospital
2. Automobile Garage
3. Drive-through and Drive-in establishments
B. Section 14.1905.B. MINIMUM BUILDING SETBACKS
Add the following:
"However, where lots comprising 401Dib or more of the frontage between
two intersecting streets are developed with buildings having front yard
setbacks, the average of such front yard setbacks shall establish the
minimum front yard setback for the entire frontage. In no case shall a
front yard setback of more than thirty (30) feet be required."
C. Section 14.1905.F. TRANSITIONAL SETBACKS
Replace current wording to read as follows:
wWherever a lot in the B-5 District abuts any single family residential
zoning district, all buildings shall be set back a distance equal to the
height of the building in the B-5 District. Such setback shall be
landscaped as required in Article 14.2301, Landscape Regulations of this

determined that a need exists to amend the Official Comprehensive Plan of 1994 to
include the following narrative relative to Central Commercial Area:
Cental Com mercial Area should accommodate retail and specialty shops,
businesses, professional offices, multi -family residential uses above the first
floor and civic uses that are characteristic of a traditional downtown area.
The emphasis should focus on businesses that provide consumer goods
and services that are easily accessible by pedestrians, public transportation
and motor vehicles. Businesses, professional offices and governmental
offices should be encouraged to be located at the periphery of this area
since the primary focus is to attract high levels of pedestrian activity for
retail, service and specialty shops. Special attention should be paid to
existing high traffic movement, intensity of development and the role of the
downtown as a center of the Village in future developments. "

Road corridors. Several functional and operational problems are present
in these three corridors. Small pockets of residential uses still exist within
the commercial strips and are not compatible with surrounding uses.
Residential uses also abut the rear of commercial properties along each
corridor. Land for commercial development or expansion is quite limited.
Many commercial uses provide small on-site parking lots which result in
numerous curb -cuts along heavily traveled streets and promote conflicts
between through traffic and vehicles using the small parking areas. The
Plan strives to correct a number of these problem conditions, and
strengthen and improve existing commercial corridors in the future. The
General Commercial/Office development category is consistent with the B-1
B-2 and B-4 Zoning Districts of the Village Zoning Ordinance.
Rand Road would continue to accommodate a wide range of commercial,
office, and business service activities, as well as several important public
land uses. The Plan calls for eventual development and redevelopment of
several currently vacant and under-utilized land parcels scattered along the
street. In general, land use recommendations tend to reinforce I and
strengthen the commercial and office function of the corridor, while
maintaining sound clusters of residential development and public uses in
certain locations. In addition, the Plan strives to ensure a compatible
relationship between commercial activities and adjacent residential areas.
Elmhurst Road, south of Golf Road, is a major corridor for highway oriented
commercial uses. Plan recommendations tend to reinforce this function,
and several vacant land areas south of Dempster in Lake Center Plaza are
designated for general business, industrial and office research development
in the future. The scale and intensity of development should be similar to
uses already existing along Elmhurst Road, and new uses which are related
to and supportive of existing activities should be encouraged. Development
areas are of sufficient size to allow for several larger, freestanding facilities,
or the clustering of numerous smaller buildings. Commercial development
should be guided by an overall site plan to ensure coordinated development
of buildings, access drives, internal circulation, and parking facilities.
Screening and buffering should be provided, between this area and
residential development recommended to the west.

During the February 21 st Village Board meeting, the Trustees requested staff to review a number
of items. Listed below is a summary of those items:
1. The definition of "damage" and in particular the term "Act of God" was reviewed by the
Village Attorney. He feels that this term is well understood by the courts and is acceptable.
2. The term "net acre" has been added to the Definitions Section and is defined as "the total
land area remaining on a development site after all rights-of-way are dedicated."
3. The term "Zoning Ordinance, as amended" has been removed from the Development Code
and replaced simply with the term "Zoning Ordinance."
4. The reference to the Metropolitan Water Reclamation District has been replaced throughout
the Development Code by M.W.R.D. which is the acronym for this Agency.
Please forward this memorandum to the Village Board for the review and consideration at their
March 7th meeting. Staff will be present at the meeting to further discuss this matter.

The Zoning Board of Appeals transmits for your consideration a variation request submitted by
Thomas and Mary Kay McMahon. Specifically, the petitioners are seeking variations from Section
14.1005.B.1 as follows:
I To allow a front yard setback of approximately 22.5 feet instead of the minimum
required 30 feet in order to construct an addition to the existing garage; and
2. To allow an interior sideyard setback of approximately 2 feet for a room addition and
3 1/2 feet for the garage addition instead of the minimum required 5 feet.
The request was reviewed by the Zoning Board of Appeals at their regular meeting of February 23,
1995. At the meeting, Mr. and Mrs. McMahon presented their case. Mr. McMahon indicated that
the location of the existing structure, the odd -shaped lot and the curvilinear nature of the street
created a hardship for them. He indicated that they explored many options in adding additions
which met the restrictions of the Zoning Ordinance. He indicated that he would be doing most of
the work on the addition with an estimated cost of approximately $75,000. He concluded that they
and their families are long-time residents.of Mount Prospect and would like to stay in their existing
home. Mrs. McMahon presented a letter from Mr. and Mrs. Scott, the adjacent property owners,
which indicated their support. She also presented an elevation of the proposed addition as well as
photos of the existing conditions.
Ray Forsythe, Planner, summarized the staff report. He indicated that this area of Mount Prospect
has a variety of lot sins and housing types. He stated that the subject lot was odd -shaped and fronts
on a curved street. He indicated that the Zoning Board of Appeals would need to determine if the
lot dimensions actually create a hardship that warrants approving the requested variations. Mr.
Forsythe indicated that staff is always concerned with variation requests and their potential impact
on the surrounding properties.

The Zoning Board of Appeals discussed the requests. The members discussed the shape and size
of the lot and determined that there was a hardship established. They discussed the proposed
additions with the property owners to determine the value of the additions and the need for the
additions in the proposed locations.
By a vote of 44, the Zoning Board of Appeals recommends approval of the requested variations to

connect to the family room, Mr. McMahon. stated ,t his family has been in the house
ten years and the proposed additions would provide quite beneficial for their

site plan along with a petition
to their neighbors and had received no objections to his
proposedc property hWovements. He fin-ther stated that their property is on a curved portion
of the street which affects the building line of the house.
Chairman Basnik made reference to a lettere of support from. Bill and Judy Scott, property
owners of 507 o-Wa ,do He noted that from the application and the print that this would
be an attractive addition to the home which would improve the neighborhood.
Mr. McMahon further noted that there _ is a Swale between the properties which he feels
would not be affected by the addition. Mrs. McMahon presented the petition to the Zoning
Board of Appeals as well as photographs indicating the current conditions of the size.
Chairman Basnik asked the age of the residence. In response, Mr. McMahon said the house
was built in 1'941.
Village Planner Ray Forsythe then summarized the staff`' report for the Zoning Board of
.appeals. Mr. Forsythe noted that the petitioners are seeking front and sideyard variations
in order to construct an addition to the exis ..ting garage and kitchen areas. This area of Mount
Prospect has a variety of lot sines and house styles. He presented. a1 79 aerial photograph
ofthe neighborhood. Mr. Forsythe further noted that this area was developed under a prior
Zoning Ordinance which permitted reduced exterior side and setbacks of 10 feet or 10% of
the lot width. Also, because of the curvilinear nature of this ,area, lot sues and setbacks Crary.
Mr. Forsythe indicated that staff is always concerned with variations and their impact on
neighborhoods. Mr. Forsythe asked the petitioners to explain now the additions were
designed and why confo* to the required setbacks was not possible. r. Mc alahon
indicated that they have tried several times to came up with a plan which meets the
requirements and it is not feasible. He indicated the shape of the lot prohibits them from a
plan which meets the Mode.
In response to fir. Floros' tlaestien regarding the costs of the additions, Mr. McMahon stated
they plan to invest approximately $75,000.00.

The petitioners are requesting variations from Section 14.1005.B.1 as follows:

Summary of Application: The application indicates that the petitioners are looking to construct
an additional garage stall with living space above. Also indicated is that a room addition is
requested in the rear which would enlare the kitchen and family room. The application indicates
the lot is small, unusually shaped and, is located on a curved street. The petitioners indicated their
desire to, stay in this, neighborhood, due to,family commitments and their fondness of the home and
Mount Prospect.
Impact on Surrounding Properties: This area of Mount, Prospect is charactenized by a mix of
housing styles and sizes. There are many homes which encroach into the required setbacks. This
area was, developed under a prior Zording Ordinance which permitted reduced exterior sideyard
setbacks of 10, feet or 1 0%, of the lotVAidth. There have also been two variation's granted within the•
last several years whichl, permitted exterior sideyard setbacks of 16.5 feet and 17 feet instead of the
mmm= allowed 20 feet. Attached to this report is a, site plan which indicates the subject property
as well as the adjacent, property which would be most affected. It 'indicates that the adjacent
property is a mirurnum, of 14'-4" from the common sideyard setback.

As with all variations, a hardship must be established. In this case the property is in an area which
contains lots on awed streets which create odd shaped lots. The subject lot is pie -shaped and is the
smallest lot on the block. Wile the shape of the lot and the existing location of the house on the
lot may provide for a hardship, the Zoning Board will need to establish to what extent the hardship
es, the requested variations. The petitioners should be prepared to discuss, their proposed plans.
Specifically, the petitioners should investigate whether alternative designs could be used to eliminate
the encroachments. I
Engineering indicated that an 18" overhang will bring the roofline to within I foot of the property
line on the kitchen addition. Also indicated is that drainage is from the back of the property to the
front and it may be difficult to maintain an adequate swale with a reduced setback in this area.

Attached is a Resolution for Improvements by Municipality under the Illinois Highway
Code for $700,,000 for this years resurfacing program. This Resolution is required by the Illinois'
Department of Transportation before the Village can use motor fuel tax funds for this project.
The entire project is estimated to cost $900,000, however, the Village plans to use $700,000 of
motor fuel tax funds and $200,000 of general funds. This Resolution covers the motor fuel tax
portion of the project costs. The bid opening for this project is scheduled for March 28, 1995.
I recommend that the Village Board of Trustees adopt this Resolution at the March 7,
1995 Board Meeting.

Village staff have begun preparations for the upcoming franchise renewal process and required
14 year performance evaluation of our current cable television operator - Telenois/TCI.' One of
the components necessary to completing both tasks is an evaluation of the physical condition
of the cable system and the cable operator's technical performance.
During the period of August 15-23,1994.. the Village's technical advisor, Jonathan Kramer of
Communications Support Corporation (CSC}, attempted to conduct a comprehensive technical
evaluation of the cable television system in Mount Prospect. As Mr. Kramer reported to the
Village Board at the August 23, 1994 Committee of the Whole meeting, the system was not
meeting specifications in preliminary tests and testing was stopped at that point. All parties,
including Mr. Kramer, Village staff, and Telenois/TCI staff, agreed that repairs and modifications
were necessary before technical testing could be completed. It was also agreed upon that the
information and preliminary test results from all parties would be shared so that identified
problems could be addressed immediately.
Mr. Kramer gave a verbal report to the Village Board on August 23 and followed up with a
written report in mid-October., 1994. Copies of the report and the accompanying pictorial
evidence were given to Telenois/TCI staff shortly thereafter. Since that time., there have been
numerous telephone conference calls and follow-up conversations between all parties as to the
status of the system, and the time frame in which the system would be ready for testing.
Scheduling conflicts have delayed this process until now. Mr. Kramer will be returning and
testing Will be attempted again the week of March 6-10.
At the March 7 Village Board meeting, Mr. Kramer Will officially present his written report on the
preliminary testing done last August, and will update the Board on his observations to -date
during the follow-up testing he Will be conducting that week. Village staff will be present during
all testing and will also be available at the March 7 meeting. Telenois/TCI representatives have
also been invited to attend.

Sealed bids were opened on March 1, 1995 for the 1995 Turf Mow-
ing Contract. Bid results are attached.
Bidders were asked to provide prices for an initial two-year
contract (1995 and 1996). The bid stipulates that we could ex-
tend the contract for an additional one or two years, if prices
and quality of work were favorable.
The contract includes the mowing of 68 "Improved Areas" total-
ling 31 acres, that will be mowed weekly with a fine cut.
(These include public buildings, traffic medians, and the rail-
road right-of-way) The contract also includes 13 selected
"Rights -of -Way" that we maintain. The rights-of-way total rough-
ly 2.2 acres and will be mowed every 3 weeks with a rough cut.
There is $34,290.013 requested in the upcoming 1995 budget for
turf mowing (Acct. #015202-540685 - $28,765.00, #015202-540690 -
$21025-00F #615503-540685 - $3,500.00). The low bidder,
Lundstrom's Nursery, has held our turf mowing contract for sever-
al years and has done an excellent job.
I recommend award of the first year of a two year contract in an
amount not to exceed $34,290.00, to Lundstrom's Nursery.

The unit was purchased in March, 1986 at a cost of $23,052. The

On January 10, 1995, sealed bids were opened for furnishing of 1-1/21,
trees for Spring 1995. Bid results are shown on Attachment A. This
bid was for a planting program partially funded by a Small Business
Administration (SB) Grant and thus only small businesses were eligible
to bid. Because an SBA goal is to increase business opportunities for
as many firms as possible, we were obliged to divide the work into two
separate bids. This bid was for tree furnishing only; planting will
be handled under a separate contract. (See accompanying memo.) The
Village will pay all project costs up front, but we will be later
reimbursed for 50%.
Attachment B compares the total bid price for the species and quanti-
ties we propose to order.A total of $64,232.18 remains in the 1,994-95

I recommend award of a contract to BC Landscape, Inc. in an
amount not to exceed $16,896.00.
