PROPERTY COMMONLY KNOWN AS 114 NORTH MAIN STREET
This Ordinance grants a variation to allow a 10'x 13' driveway
turn -around to the rear of the home adjacent to a 20' wide driveway,
The Zoning Board of Appeals recommended granting this request (Exhibit C)
by a vote of 4-0.
B. ZBX 54-951 1742 Indigo Court
1st reading of AN ORDINANCE GRANTING A VARIATION
FOR PROPERTY COMMONLY KNOWN AS 1742 INDIGO COURT
This Ordinance grants a variation to allow a 12'x 16'
(192 square foot) shed in the rear yard. The Zoning Board
recommended granting the request by a vote of 4-0. (Exhibit D)
IX. NEW BUSINESS
A. 1st reading of AN ORDINANCE AUTHORIZING THE SALE OF
CERTAIN PERSONAL PROPERTY OWNED BY THE
VILLAGE OF MOUNT PROSPECT
This Ordinance authorizes the sale of the Fire Department ladder
truck for $100,000. (Exhibit E)
B. 1st reading of AN ORDINANCE AMENDING CHAPTER 5
OF THE VILLAGE CODE
This Ordinance amends Chapter 5 by eliminating the Board of
Health, the Board of Local Improvements, the Electrical
Commission and the Architectural Commission. (Exhibit F)
C. 1st reading of AN ORDINANCE AMENDING CHAPTERS I AND
2 OF THE VILLAGE CODE
This Ordinance amends the functions of the Village Trustees
to encompass all areas authorized by Home Rule authority as
well as providing for the Mayor and Board of Trustees to seat as
members of the Board of Local Improvements. (Exhibit G)
D. A RESOLUTION AUTHORIZING EXECUTION OF AN
AGREEMENT WITH THE COOK COUNTY HIGHWAY
DEPARTMENT RELATIVE TO THE SIGNALIZATION OF
CAMP MC DONALD AND SCHOENBECK ROADS
This Resolution authorizes an agreement to share the cost to
install Opticom and maintenance and energy costs
associated with the traffic signal at Camp McDonald and

E. 1st reading of AN ORDINANCE AMENDING CHAPTER 18
(TRAFFIC CODE) OF THE VILLAGE CODE
This Ordinance amends the Traffic Code to include traffic
regulations on the 200 block of north Louis Street. (Exhibit J)
F. 1st reading of AN ORDINANCE AUTHORIZING A REFERENDUM
QUESTION TO BE PLACED ON THE BALLOT OF THE
NOVEMBER 7, 1995 ELECTION
This Ordinance authorizes the question of whether the Village
should establish procedures to permit the Recall of officials elected

Trustee Hoefert, seconded by Trustee Skowron, moved to concur
with the recommendation of the Zoning Board of Appeals and
grant the variation requested in ZBA 44-95.

The Petitioner is requesting a variation to allow a 12'x 16' (192
square foot) shed in the rear yard. The Zoning Board of Appeals
recommended granting this request by a vote of 4-0.
There was discussion among members of the Board relative to the
criteria used to determine the size of a shed. It was decided that
this subject would take place at aluture date and not effect tisb
,SBA case. Trustee Skowron also asked that discussion be
scheduled at a future Committee of the Whole meeting relative to
4 -car garages.
Trustee Skowron, seconded by Trustee Clowes, moved to concur
with the recommendation of the Zoning Board of Appeals and
grant the variation requested in ZETA 5-V-95.

WELLER CREEK,
The subject of Weller Creek was brought up, noting that it is
AD HOC CITIZENS
recommended that a Weller Creek Ad Hoc Committee," with the
COMMITTEE
membership comprised of residents abutting Weller Creek, be
established to work with the consultant who will be studying the
problems pertaining to Weller Creek.

Some of the areas involving the Committee are.
Work closely with the consultant to identify areas
of concern and provide input as to the contemplated
solutions
Assist in educational efforts of area residents to
minimize further erosion and improve the overall
quality of the creek.
Provide input into possible funding options available
for consideration by the Board
Review study and recommendations of consultant
relative to the jurisdiction of the creek and information
necessary to consolidate authority, if desired
Continuemonitoring and reporting conditions of the
creek until disbanded by the Village' Board
The following residents would be appointed to the Weller Creek
Ad Hoc Committee.

the proposal submitted by Rust Environment & Infrastructure 1n
the amount of $55,650 to preparelthe Weller Creek Erosion Study,
which includes working with the Citizens Ad Hoc Committee
created earlier in this meeting.

CRACK SEALING
The Northwest Municipal Conference had requested bids as a
MATERIAL
multi -community, joint purchase program for crack sealing
materials, of which Mount Prospect is a member. The low bid for
that p 'r0iect was received from Bohm Pavement Maintenance at a
cost of $1.098 per pound.

MAINTENANCE
with the recommendation of the admlnistration and accept the low
qualified bid submitted to the Northwest Municipal Conference by
Behm Pavement Maintenance in 9-n amount not to exceed
$29,000.

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13
of the Village Code of Mount Prospect, as amended, the Corporate Authorities shall

The Zoning Board of Appeals transmits for your consideration their recommendation on a request
for a variation from Section 14.2215.A.3 to allow a 10'X 13' driveway turn -around to the rear of the
home adjacent to a 20 foot wide driveway.
The request was reviewed by the Zoning Board of Appeals at a special meeting of June 8, 1995. At
the meeting, Mr. Daus presented his case. He indicated that he is seeking the turn -around so that
he will be able to avoid backing onto Route 83 as he leave's his property. He added he had
considered placing the tum -around in the front yard but felt a rear yard turn -around would be less
intrusive and would allow him to maintain a pleasant appearance in his front yard.
Michael Sims, Planner, summarized the staff report. He noted that the applicant's hardship is that
the property is in an area which contains narrow lots and whose sole access point is onto a major
arterial (Route 83). Without a turn -around the owner would have to back his vehicle onto Route 83,
in order to leave the property. Mr. Sims added that staff believes the proposed turn -around will
improve vehicular and pedestrian safety at this location. Mr. Sims reported that the only
departmental comment was from the Engineering Division that stated that the turn -around must be
installed at the existing elevation so that drainage is not altered. He added that the applicant
indicated he was willing to comply with this comment. Mr. Sims concluded that staff would
recommend approval of the applicant's request for a 10' x 13 )' turn -around as noted on the attached
site plan, provided that all engineering issues relating to stormwater run-off are met.
The Zoning Board of Appeals discussed the request. The members noted that the turn -around could
be used as a patio and that this would not pose a problem. They also noted that the turn -around is
of a minimum size.
By a vote of 4-0, the Zoning Board of Appeals recommends approval of a variation to allow a
13'x x 10' turn -around in the rear yard adjacent to a 20 foot driveway with the condition that it be
installed at the existing elevation so that drainage is not altered. -

Chairman Basnik introduced case ZBA-4-V-95 being a request for a variation to Section

he lives on a busy street and it would be much easier to pull out of the drive instead of
backing out. He further noted that he has seen many turn around driveways in the front of
the property and feels it would be more aesthetically pleasing to install it in the back of the
house.
Village Planner Michael Sims then summarized the staff report for the Zoning Board of
Appeals. Mr. Sims presented two pictures of the petitioners property with regards to the
proposed request. Mr. Sims stated that the homes in this area of Mount Prospect are on

Summary of Application: The applicant has applied for and received a permit for the
construction of a garage and 20 foot wide driveway in the rear yard. The applicant is requesting a
variation to construct 10'x 13' turn -around paved area in the rear yard. The applicant indicates he
is requesting the extension so that he can turn his vehicle around in the back yard and therefore
avoid backing onto Route 83.
Impact on Surrounding Properties: This area of Mount Prospect is characterized by small two
story homes on narrow 55 foot wide lots. The lots on Main Street are slightly deeper than normal,
approximately 141 feet in depth, which produces a little more green space than normal. The turn-
around will be approximately 6 feet from the house and should have no more impact than a patio
being built at the same location. The south border of the turn -around will be approximately 19 feet
from the south side property line.
As with all variations,, a hardship must be established. In this case, the property is in an area which
contains narrow lots and whose sole access point is onto a major arterial, Route 83. The narrow
width of the lot only permits a 21 foot wide driveway. Without a turn -around the owner would have
to back his vehicle onto Route 83 in order to leave the property.
Engineering Division states that the drive turn -around must be installed at the existing elevation so'
that drainage is not altered.

The petitioner is seeking a driveway width variation in order to provide a 13' x 10' tum -around in
the rear yard. The turn -around will allow drivers to access Route 83 moving forward onto Route
83. Staff would recommend approval of the applicant's request for a 10' x 13' turn -around as noted
on the attached site plan provided that all engineering issues related to stormwater runoff are met.

COMMONLY KNOWN AS 114 NORTH MAIN STREET
WHEREAS, Phillip Daus (hereinafter referred to as Petitioner) has filed an application for
a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property
commonly known as 114 North Main Street (hereinafter referred to as Subject Property),
legally described as:
Lot 4 in Block 9 in Hillcrest, being a subdivision of the Northeast quarter of
the Southwest Quarter (except the North 2-7/8 acres thereof) of Section 34,
township 42 North, Range 11, East of the Third Principal Meridian, and the
North 23.5 acres of the Southeast Quarter of the Southwest Quarter (except
the West 295.1 feet of the South 295.1 feet lying North of the South 543
feet of the East Half of the Southwest Quarter of said Section 34) in Cook
County, Illinois
WHEREAS, Petitioner has submitted a request for a variation from Section 14.2215.A.3
to allow a 10'x 13' driveway turn -around in the rear of the home, which turn -around is
adjacent to the existing 20 feet wide driveway; and
WHEREAS, a public hearing was held on the variation requested, being the subject of
ZBA Case No. 4-V-95 before the Zoning Board of Appeals of the Village of Mount
Prospect on the 8th day of June, 1995, pursuant to due and proper notice thereof
published in the Journal Topics on the 19th day of May, 1995; and
WHEREAS, the Zoning Board of Appeals did consider the request stated herein and have
forwarded their recommendation to the President and Board of Trustees of the Village of
Mount Prospect and the President and Board of Trustees have given further consideration
to the variation requested and have determined that the best interests of the Village
would be served by granting the variation requested.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
hereby grant a variation from Section 14.2215.A.3 to allow a 10' x 13' turn -around
adjacent to the existing driveway, rather than the maximum driveway width of 21', as
shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit A.
SECTION THREE: Except for the variation granted herein all other applicable Village of
Mount Prospect Ordinances and regulations shall remain in full force and effect as to the
Subject Property.

Zoning Board members. He stated the new shed will replace an existing 8'x 8' shed and will be
located at the same location. The proposed shed will be approximately 2 1/2 feet taller, 4 feet wider
and double the depth of the current shed. Mr. Sims added that, as with all variations, a hardship
must be established. Mr. Sims noted the owners have not indicated how they intend to use the shed,
what they intend to store in the shed, and why they need a shed that large. Mr. Sims asked the
petitioner to further demonstrate their hardship. He concluded his remarks stating that staff would
recommend denial of the request and recommend that the petitioner construct a shed that is within
the requirements of the Zoning Code. Mr. Sims noted that the only departmental comment was that
the Police Department suggested that the shed be locked and not store valuable items.
The Zoning Board of Appeals then discussed the request. They noted that the size of the lot is
16,635 square feet. The members discussed the need for storage on large lots.'
By a vote of 4-0, the Zoning Board of Appeals recommended approval of the requested variation
to allow a 12' x 16' shed to be constructed in an approved location.

The petitioners are requesting a variation from Section 14.306.B. I to allow a 12' X 16' ( 192 square

Summary of Application: The application indicates that the petitioner is wishing to construct a
12' x 16' shed in an approved location in the back yard. The petitioner has indicated that the Village
requirements on size of accessory structures is too small to accommodate all of his storage needs.
The new shed would be built at the same location as, his existing deteriorated shed. Staff would also
note the applicant incorrectly requested a shed height variation. Although the height of the shed to
its peak is 12 feet, the Zoning Ordinance measures height as the mid -point to the roof. This makes
the height of the structure 8'-8".
Impact on Surrounding Properties: The site is surrounded on the northeast and south by other
single family residential uses. To the west is the rear alley and delivery area of the Ascot Shopping
Center. The store closest to the site and shed is the rear of the Golden Scissors Repair Shop at 9
Wolf Road. The home is located on a cul-de-sac bulb and the shed will be easily visible from the
street. The existing shed is 8' x 8', and approximately 7 feet in height. The proposed shed will be
approximately 2-1/2 feet taller, 4 feet wider and double the depth of the current shed. A six foot
fence separates this residential lot from the above noted commercial activity at Ascot Center.

will need that large of an accessory structure. The petitioner should be prepared to discuss their
proposed plans as well as any alternative plans they may have if the 12' x 16' shed is denied. He
must also demonstrate what hardship exists that would warrant the requested variation.
The Police Department suggested that the shed be locked and not store valuable items.
The petitioner is seeking permission to construct a 12' x 16' shed in the rear yard. The lot is pie -
shaped and has adequate square footage for the shed and other activities. However, the petitioner
must demonstrate the hardship that would justify the variation necessary to construct this large of
a shed. Staff would recommend denial of the request and recommend that the petitioner construct
a shed that is within the requirements of the Zoning Code.

WHEREAS, in the opinion of at least three-fourths of the corporate authorities of the
Village of Mount Prospect, Cook County, Illinois, it has been determined that it is no
longer necessary, useful, or in the best interest of the Village of Mount Prospect to retain

WHEREAS, it has been determined by the President and Board of Trustees of the Village
of Mount Prospect that the best interests of the Village would be served by the sale of

ladder truck and inasmuch as no bids were received for this piece of equipment, the
Village engaged the services of a broker to assist in the sale of this piece of equipment.
The broker was successful in locating a buyer for the piece of equipment being the
subject of this Ordinance for the sales price of $100,000, which the Village has deemed
an appropriate and reasonable sales price.
SECTION THREE: The corporate authorities of the Village of Mount Prospect do hereby
authorize the Village Manager to accept the offer to purchase one 1982 Duplex/FMC
ladder truck in the amount of $100,000 and upon receipt of the full amount offered, the
Village Manager is authorized to transfer title of sale 1982 Duplex/FMC ladder truck to
the purchaser.

Camp McDonald / Schoenbeck Traffic Signal Agreement
In conjunction with the proposed Camp McDonald Road improvements, the Cook
County Highway Department determined that traffic signals are warranted at the
Schoenbeck Road intersection. The intersection meets the peak hour warrant,
justifying the need for the signals. The south leg of this four -legged intersection
(Schoenbeck Road) is under the jurisdiction of the Village of Mount Prospect. It is
typical and appropriate that the Village share in the traffic signal maintenance and
energy costs proportional to our jurisdictional interests of the intersection. Thus, the
25% cost share for maintenance and energy of the traffic signals as proposed in the
attached Cook County agreements is proper.
The Cook County Highway Department has also agreed to install Opticom at thi's
intersection for the benefit of Mount Prospect and Prospect Heights emergency
vehicles. The attached agreement also includes provisions for Mount Prospect and
Prospect Heights to share equally the cost (50%) of the maintenance of the Opticom.
I recommend that the traffic signal agreement be approved, executed and returned to
the Cook County Highway Department. An enabling resolution or Village Board
minutes authorizing the Village's commitment must be returned with the executed
agreements.

This letter of agreement is to bind the Village of Mount Prospect
{herein after called Village) and the County of Cook' (here after
called County) to sharing the cost of the maintenance and energy
charge of a permanent traffic signal system to be installed at the
intersection of Camp McDonald, Road and Schoenbeck Road.
The County's intent is to construct a fully actuated traffic signal
system with a push button pedestrian signal for the school
crosswalks. OPTICOM can be included in the traffic signal system
at the request of the Village, with the entire cost to be borne by
the Village and the City of Prospect Heights.
The County will thereupon design and install the traffic signal
system, cause it to be maintained and energized and be responsible
for settings and timings.
It is the policy of the County, that at intersections of County
highways and municipal streets, the municipal corporation is to
bear a share of the signal's maintenance and operational costs.
This share is represented by the relative number of approaches to
the intersection for which the municipal corporation is responsible
with respect to the total number of approaches.

Accordingly, Village agrees that it will:
1. Pay the County twenty five percent (25%) of the maintenance
charges of the traffic signal and 50t of the maintenance
charges of the OPTICOM, within thirty ( 3 0 ) days of

(This share is estimated at $250).
Ow 2. Assume twenty five percent (25%) of the electrical energy
charges, payable to Commonwealth Edison Company in
accordance with the electrical services contract to be
entered into with that Company. (This share is estimated at
$100).
Payments to the County shall be by check payable to the Treasurer
of Cook County, for deposit into the County's Motor Fuel Tax
Account 600-570, and sent to the County Superintendent of Highways.
Should the Village be agreeable to the terms of this agreement
please countersign the copy of this letter and return it to the
Department. Enclose a certified copy of either an enabling
resolution or Village Board minutes authorizing you to thus commit
the Village. We will then,present the agreement to the Board of
County Commissioners with a Resolution to be attached and made a
part thereof which will authorize and bind the Village and County,
their respective successors and assigns, to their respective
obligations herein.

proposed purchase of a replacement booster pump and natural gas
powered standby engine. This pump and engine replacement is
part of our multiyear high service pump replacement program.
At Booster Station #4 which is located on Waverly at Prospect
Avenue we are proposing to replace the old (1968) standby gaso-
line engine and high service pump #4 (1968) as a package unit.
We have $85,000.00 budgeted for this proposed purchase, however
the lowest bid came in 15% above the engineer's estimate, as
outlined on the attached bid report from Winfield Engineering,
Inc. Since this has exceeded our budgeted amount it is my recom-
mendation that we reject all bids.
We will rebid after we have restructured our bid documents to
include only the standby engine which should come in under our
budgeted amount of $85,000.00. The pump would be replaced in
1996 under that year's high service pump replacement program.

The Request for Proposals (RFP) was mailed out to approximately 25 area architectural
firms who had some experience in office rehabilitation and governmental projects. The
Village received 12 responses from various firms. The quoted price for services ranged
from $13,000 to .$68,000. The field was narrowed to seven for consideration by the
Village Hall Space Study Committee members. The Committee further narrowed the field
to four firms for interviews. The Committee included the following members: David
Hulseberg, Deputy Community Development Director; Carol Widmer, Assistant Finance
Director, Mike Sims, Planner and Glen Andler, Public Works Director.
The review process utilized recommendations outlined by the American Institute of
Architects (AIA) in their publication Qualifications Based $election Process. This
selection process focuses on past project experience, references, proposal reviews, and
personal interview and presentation. Committee members ranked the four firms at the
end of the interview process. At the time of the ranking, the quoted pric'es were reviewed
as part of the final recommendation and justification. The two firms which were rated
highest appeared fully capable of completing the project so that once the report is
completed, the Village would have enough information to get architectural plans.
The Study Committee met on May 4 to finalize the recommendation. At this meeting, it
was determined that Yas/Fischel Partnership would be the firm recommended to the
Village Board for consideration.
The recommendation is based on the following items:
1 The Committee felt this firm was the most flexible in terms of offering
creative solutions.
2. The Village would be dealing directly with the principals of the firm.
3. The references were significantly and consistently more positive than the
second choice firm.
4. The Committee felt this firm was more willing to do whatever is necessary
to provide a quality product.
5. The Committee felt this firm would make our study a priority project.
6. The Committee felt this firm would not utilize a "cookbook" approach to
formulate recommendations which showed a philosophy of creativity.
Recommendation
The Committee members unanimously recommended that a contract for services be
awarded to Yas/Fischel Partnership in the amount not to exceed $24,355 and
reimbursable expenses not to exceed $1,000.
Attached for your information is a copy of the cover memo from the June 13, 1995
Committee of the Whole meeting and a copy summarizing the firms which responded to
the RFP.

physical and operational deficiencies present at the Village Hall. The primary
focus of any resulting study is to develop a strategy that will result in the most cost
effective rehabilitation and reuse of the existing facility.

1 Review and approve overall methodology for an action plan that will provide
the Board members with sufficient infOrmation to make decisions relative to
the rehabilitation of Village Hall.
2) -Review and approve commencement -of a space study as the first item in
the proposed action plan.

The need to rehabilitate the Village Hall has been identified through studies
of other public facilities (Public Works and public safety buildings studies).
When discussions concerning the construction of those facilities took place,
some consideration as to resolution of Village Hall problems (overcrowding)
was part of the decision process, but no action was taken.
The Village Board funded a study in 1989 to identify HVAC deficiencies, but
no action implementing the recommendations took place. In addition to the
HVAC deficiencies, other operational and physical limitations have been
identified over the intervening years.
During fiscal year 1994/95 budget discussions, the Village Board authorized
approximately $75,000 be set aside for a space study of the Village Hall.
The Village Board also earmarked an additional $1,000,000 from the sale
of the Pine/Wille property for possible rehabilitation of the facility pending
the outcome of the study.
Additional information and a review of the physical characteristics of the
building can be found on pages 1-4 of the Request for Proposal (RFP),
attached as Exhibit A.
The space study is intended to identify building deficiencies -both physical
and operational, as outlined in pages 2-6 of the RFP (Exhibit A). Physical
deficiencies include outdated, ineffective infrastructure and a variety of
Code violations. Operational deficiencies limit our ability to provide efficient
services to the physical layout of the building. As the staff strives to
implement a one-stop shop for services, a review to determine the best
grouping of like services will accomplish this goal. The building is also not
conducive to secure, "after-hours" public use of meeting spaces. Finally, an
evaluation of employee and patron security is a critical priority.
The study will provide a list of possible resolutions to the identified
deficiencies. The Village Board will then have information available in
which to formulate a decision to address these deficiencies. The information
will include a range of options and recommendations for the Board to
consider. These options will include appropriate cost estimates. Additional
funding sources, if needed will be identified as part of the decision-making
process.
The space study is divided into three phases. Each phase is designed to
address specific areas of the building. Phase I of the study is an evaluation
of the existing physical and operational limitations. Phase 11 of the study
will focus an the work environment and evaluate patron service. Phase III
of the study will provide a general review of possible options available to
the Village Board to address the items identified in Phases I and 11.
Additional information is available on page 2-6 of the RFP (Exhibit A).
A Village Hall Review Committee was formed with the following participants:
Carol Widmer, Assistant Finance Director; Mike Sims, Planner; David
Hulseberg, Deputy Community Development Director and Glen Anther,
Public Works Director.

decision on the status of the Village Hall. Staff seeks the Board's endorsement
of the described Study approach.
Based on the review process _outlined above, the Committee members
unanimously recommend that a contract for services be awarded to Yas/Fischel
Partnership in an amount not to exceed $24,355. Exhibit D provides a summary
of the scope of services which Yas/Fischel is to perform.
