WILKS AND BOARD OF TRUSTEES FROM: VILLAGE MANAGER DATE: JANUARY 12, 2007 SUBJECT: AMENDMENT TO LIQUOR CODE The Liquor Code currently allows packaged goods license holders to conduct periodic "tastings" of products on a limited basis. Daily tasting permits are issued to qualified license holders based on a written request and payment of a small fee. The total number of annual tasting permits for a license holder is limited. The Village currently has a license application pending for a wine shop to be located in the Downtown Central Business District. The nature of their business requires the ability for a customer to be able to taste a particular vintage before purchasing a quantity. By Code, packaged goods license holders cannot allow consumption on premises except by securing a tasting permit in advance. From the applicant's standpoint, this is impractical and problematic. After consulting with the Village Attorney, the Liquor Commissioner (Mayor) directed him to draft a narrowly worded amendment to the Liquor Code that would allow sampling of products in the above-described environment without first having to secure a permit. AN ORDINANCE AMENDING CHAPTER 13 ENTITLED "ALCOHOLIC LIQUOR" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION 1: Section 13-116 entitled "Consumption on Premises" of Chapter 13 entitled "Alcoholic Liquor" of the Mount Prospect Village Code shall be amended by adding the words ", except as follows:" at the end of paragraph B. A new subparagraph (2) shall be added to paragraph B and current paragraphs (2) and (3) shall be renumbered as paragraphs (C) and (0). The new subparagraph (2) shall be and read as follows: 2. The holder of a Class V Liquor License, where the premises is located in a B-5 Central Commercial Zoning District, shall permit the pouring of wine for sampling purposes for prospective wine customers in quantities, the total of which does not exceed 10 ounces per customer per day. SECTION 2: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
