A RESOLUTION DIRECTING THE EXECUTION OF A BOUNDARY
AGREEMENT REGULATING AND ADOPTING THE COMMON
MUNICIPAL BOUNDARIES SOUTH OF GOLF ROAD BETWEEN
THE CITY OF DES PLAINES AND THE VILLAGE OF MOUNT PROSPECT

WHEREAS, the Corporate Authorities of the Village of Mount PrOSpf:3ct arId the City of
Des Plaines have conducted negotiations with I'espect to an agreement setting a cormnDn
boundary t11.at shall separate the two municipalities South of Golf Road; and
WHEREAS, the Corporate Authorities of the Village of Mount Prospect believe that such
Boundary Agreement is in the best interests of the Village of lVlount Prospect;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS.:
SEC,!,_~ o~m: That the Mayor of the Board of Trustees of the "Village of hilount Prospect
is hereby author'ized to sign and the Village Clerk of the Village of Mount Prospect is
hel'eb:y Euthor:i.zed to attest the Boundary Agreement made a part hereof and attached
hereto as Exhibit I.
SECTION TWO: That the said Boundary Ag'reement shall be binding U190l1 all present

SECTION THREE: That the Village Clerk of the Village of Mount Prospect be and he

its passage and approval in the manner provided by law.

WITNESSETH:
WHEREAS, there is unincorporD.ted territory' lying between the cOrpOy.'2.te
limts of IVlmlnt Prospect and the corporate limits of Des 1'1aine8, which territory
is less than one and one- half miles in width; and
WHEREAS, Mount Prospect and Des Plaines each has a duly authorized
Commission created pursuant to authority granted in Division 12 of Artiole 11 of the
Illinois Municipal Code and has adopted official plans pursuant thereto; ar.Jd
WHEREAS, on November 19, 1973, the City Council of Des PIaines passed and
on November 26, 1973, the Mayor of Des Plaines approved annexation Ordinance A-,(-'l3,
annexing into Des PIaines an area generally described as the northeast corner of Algon-
quin and Elmhurst Roads, Cook County, Illinois; furthermore. thereafter on Decem-
bel' 18, 1973, the Mayor and Board of Trustees of Mount Prospect passed and approved
Ordinance No. 2480, annexing the identical parcel of land into Mount Prospect.
(A copy of Ordinance A-7-73 and its correspondent plat is incorporated herein by
reference and attached hereto as Exhibit A. and a copy of Ordinance No. 2480 is in-
corporated herein by reference and attached hereto as Exhibit B); and
WHEREAS. on January 9, 1974, Des Plaines filed an Application ~For Leave To
File A Complaint In Quo Warranto entitled !h~ City of Des Plai~~ vs. Th~..'yiJl~~
of Mount_~rosp~E!.. Case No, 74L385, calling into question the authority by which
Mount Prospect by Ordinance No, 2480 annexed the property Des Plaines believed
to be identical to the property it had annexed in Ordinance A-7-73; and

WHEREAS, on November 19, 1973, the City Council of Des Plaines passed and
on November 26, 1973, the Mayor of Des Plaines approved annexation Ordinance A-8-73,
annexing into Des Plaines an area of 10.262 acres west of Elmhurst Road, south of
Algonquin Road, and north of Oakton Street, Cook County, Illinois, (A copy of Ordi.-
nance A-g--73 and its correspondent plat is incorporated by I'eferenGe and attached
hereto as Exhibit C); and
WHEREAS, on November 29, 1973, the Mayor and Board of Trustees of Mount
Prospect passed and approved Ordinance No. 24'14, annexing into Mount Prospect an
area of 1.1864 acres, commonly known as the "Wilkin Property", lying west of
Elmhurst Road, south of Algonquin Road, and north of Oakton Street, Cook Cmmry ,
Ininois. (A eopy of Ordinance No, 24r{4 is incorporated by reference and attached
hereto as Exhibit D); and
WHEREAS, immediately thereafter on November 29, 19ri3, the l'i'Iayor and Board
of Trustees of Mount Prospect passed and approved Ordinance No. 2475 annexing into
Mount Prospect the identical area of 10.262 acres hereinabove referred to in the Des
Plaines Ordinance A-g-73 (Exhibit C). (A copy of Ordinance No. 2475 is incorporated
herein by reference and attached hereto as Exhibit E); and
WHEREAS, on January 29, 1974, and again on February 5, 1974, representatives
of Mount Prospect and Des Plaines conducted boundary negotiations which concerned
themselves with both the property involved in the above mentioned Quo Warr~nto action
and other property in the same general locale as the property involved in the Quo
Warranto action, but these negotiations specifically excluded the property commonly
known as the IIDawn Fresh!! parcel legally described in Exhibit F, which is attached
hereto and incorporated by reference herein; and
WHEREAS, Mount Prospect and Des Plaines desire to agree upon a line to mark
the boundary of their respective jurisdictions and to settle all annexation disputes be~
tween Golf Road and the Illinois Tollway pursaunt to the boundary line map attached
hereto and hereby made a part hereof as Exhibit G; and

}lliTUALLY AGREED BY AND BETI\EEN THE PARTIES HERETO AS FOLLOWS:
That, south of Golf Road, the co~mon municipal boundaries of the parties
herezo shall be described by a line commencing from a point at Lhe cente~ of ~he
intersection of Elmhurst and Golf Roads; thence proceeding southward along ~n2
center line of Elmhurst Road, to a point on the south line pI Dempster (Thacker)
Street; thence westward along the south line or Dempster Street 223.0 ree~; ~hence
southward to the north line or Lot 4 in Linnemarillis Division or the soutt ~hree-
quarters of the east half of the northeast quarter and ~he west half or the
northeast quarter of Section 23, Towr.ship 41 North, Range 11; thence eastwarQ
223.0 feet to the center line of El~lurst Road to a point which is 2016.63 Ie2~
north of the center line of Algonquin Road as per Document No. 11195787; thence
southward along the said center line or Elmhurst Road to a point formeu by the
intersection of the center lines or Oakton Street and Elmhurst Roads;
notwithstanding the common municipal boundary established by the Iorgoing nOLGin;
contained herein shall prohibit either Des Plaines or Mount Prospect from
annexing the presently unincorporated areas lying on either the north or south
side or that portion of Oakton Street lying west of Elmhurst Road; nothing
contained herein shall be interpreted or construed to permit either Des
Plaines or Mount Prospect from failing to strictly adhere to applicable s~a~e
annexation statutes should such annexations take place.

9. That nothing in this agreement shall prohibit either Mount Prospect from
waiving its rights under this agreement by a resolution duly passed by its corporate
authorities or Des Plaines from waiving its rights under this agreement by a resolu-
tion duly passed by its corporate authorities. which 'waivers shall constitute acknow-
ledgement by such corporate authority that the other party hereto may thereafter pro-
ceed with the annexation of any such parcel, the rights to which were so waived by
such resolution.
10 . That either party may enforce this agreement by an action in Quo lvV' arranto ,
Mandamus, or by any other legal or equitable action which may be proper in the cir-'
cumstances .
11. That certified copies of Des Plaines Resolution No. ____ and
Mount Prospect Resolution No. ,... 7 i of which this agreement is a part shall be
recorded in the Office of the Cook County Recorder of Deeds, and that this agreement
shall be made available for inspection in the offices of the municipal qlerks or both
Des Plaines and Mount Prospect.
IN WITNESS WHEREOF, the parties hereto have caused this instrument to be
executed by their respective officers and affixed hereunto their respective corporate
seals the day and year first above mentioned.

AGREED FINAL ORDER
Now come the PEOPLE OF THE STATE OF ILLINOIS, by
the CITY OF DES PLAINES, a municipal corporation, relator
herein, by its attorneys and the VILLAGE OF MOUNT PROSPECT,
a municipal corporation, Defendant herein, by its attorneys,
and by agreement of the parties, the Court hereby finds and
orders as follows:
1. That it has jurisdiction of the parties hereto
and the subject matter hereof.
2. That t~e relator CITY OF DES PLAINES, by its
Ordinance No. A-7-73, passed on November 19, 1973, and approved
on November 26, 1974, purported to annex certain territory
described in Exhibit A hereto, which description is by this
reference incorporated herein and made a part hereof.
3. That the Defendant VILLAGE OF MOUNT PROSPECT,
by its Ordinance No. 2480, passed and approv.ed on December 18,
1973, purported to annex the identical territory described in
Exhibit A hereto.
4. That the VILLAGE OF MOUNT PROSPECT has alleged

that the aforesaid annexation by the CITY OF DES PLAINES on
November 26, 1973, was invalid and void ab initio.
5. That the. relator CITY OF DES PLAINES has denied
that said annexation was invalid and void and has alleged that
the aforesaid annexation by the VILLAGE OF MOUNT PROSPECT on
December 18, 1973, is, by reason of the prior annexation of
the CITY OF .DES PLAINES, invalid.
6. That the parties hereto have, subsequent to
the initiation of this dispute, entered into an agreement
fixing a boundary line between them pursuant to the provisions
of Section 11-12-9 of the Illinois Municipal Code, Illinois
Revised Statutes, Chapter 24, Section 11-12-9 and Article VII
of the 1970 Constitution of the State of Illinois.
7. That in conformance with the terms of such
boundary agreement, the CITY OF DES PLAINES admits the
invalidity of its annexation of November 26, 1973, and admits
the validity of the VILLAGE OF MOUNT PROSPECT annexation of
December 18, 1973, as to all property described in Exhibit A
hereto lying west of the centerline of Elmhurst Road, which
property lying west of the centerline of Elmhurst Road is
described in Exhibit B hereto, which description is by this
reference incorporated herein and made a part hereof.
8. That in conformance with the terms of the
aforesaid boundary agreement, the VILLAGE OF MOUNT PROSPECT
admits the invalidity of its annexation of December 18, 1973,
and admits the validity of the CITY OF DES PLAINES annexation
of November 26, 1973, as to all property described in
Exhibit A hereto lying east of the centerline of Elmhurst
Road, which property lying east of the centerline of E~urst
Road is described in Exhibit C hereto, which description is
by this reference incorporated herein and made a part hereof.

9. That the CITY OF DES PLAINES consents to the
entry of a judgment of ouster against it with respect to all
property described in Exhibit B hereto.
10. That the VILLAGE OF MOUNT PROSPECT consents .
to the entry of a judgment of ouster against it with respect
to all property described in Exhibit C hereto.
IT IS THEREFORE HEREBY ORDERED, ADJUDGED AND DECREED
THAT:
1. The relator CITY OF DES PLAINES, a municipal
corporation, be and it is hereby ousted, excluded and pro-
hibited from exercising any municipal jurisdiction, power,
authority, control or the like, over or upon the territory
described in Exhibit B hereto, which description is by this
reference incorporated herein and made a part hereof.
2. That the annexation by the VILLAGE OF MOUNT
PROSPECT, by its Ordinance No. 2480 passed and approved on
December 18, 1973, of the ter~itory described in Exhibit B
hereto, which description is by this reference incorporated
herein and made a part hereof, be and it is hereby adjudged
and declared ,to be a valid annexation of said territory and
that the VILLAGE OF MOUNT PROSPECT shall have municipal
jurisdiction, power,' authority, control and the like, over
and upon said territory.
3. The Defendant VILLAGE OF MOUNT PROSPECT, a
municipal corporation, be and it is hereby ousted, excluded
and prohibited from exercising any municipal jurisdiction,
power, authority, control or the like, over or upon the
territory described in Exhibit C hereto, which description
is by this reference incorporated herein and made a part
hereof.
4. That the annexation by the CITY OF DES PLAINES
