RESOLUTION NO. 14-74
A RESOLUTION AGAINST GENERAL ASSEMBLY
HOUSE JOINT RESOLUTION CONSTITUTIONAL
AMENDMENT NUMBER 30
WHEREAS, there has been introduced in the General Assembly of the State of
Illinois, House Joint Resolution Constitutional Amendment Number 30, which
calls for submission to the electors at the November, 1974 General Election a
proposition to amend Section 6 of Article VII of the 1970 Constitution of the
State of Illinois, which section deals with powers of home rule units; and
WHEREAS, said amendment to Section 6 of Article VII would remove home rule
power to license or regulate occupations unless the legislature spedfically grants
the power; and
WHEREAS, the purpose and intent of home rule is to eliminate the requirement
for legislative action each time a home rule unit desires to exercise a power per-
taining to its government and affairs; and
WHEREAS, no valid reason has been or can be shown why this power should be
removed from home rule units in that there is no evidence that there has been an
abuse of the licensing or regulatory powers of home rule units; and in the ab-
sence of some compelling reason being shown, this power should not be removed;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the General Assembly of the State of Illinois confirm the con-
cept of home rule for municipalities and refrain from adopting House Joint Resolu-
tion Constitutional Amendment Number 30.
SECTION TWO: That the Village Clerk of the Village of Mount Prospect forward
certified copies of this Resolution to Mount Prospect's representatives to the
General Assembly.
SECTION THREE: That this Resolution be in full force and effect from and after
its passage and approval in the manner determined by law.
