Public parking regulations should be reviewed from time to time to ensure that the
regulations in place provide our customers with an accessible, easy-to-use public
parking system. Over time, customer demand shifts, technologies improve, and
expectations change. For many areas outside of downtown, neighborhood
residents and the Village Engineering and Police staff keep on -street parking
regulations up to date. For the downtown area, staff began an examination of
parking with the completion of a Downtown Parking Study, conducted by KLOA in
September 2018. From there, staff compared demand, customer requests over
the past several years,, and existing code to determine the best course of action to
improve downtown public parking.
Staff is proposing a series of code amendments to Chapter 18 of the Village Code
- specifically, Article 18 ""Stopping,, Standing,, Parking" and related appendices.
Portions of this code section are outdated or designed in such a way that the
Village cannot make adjustments or improvements to the parking system without
amending the code each time; as a result, there are instances where the Village
has policies or services in place but they are not referenced in the code. For

;txample, the use of the "Whoosh" mobile app to pay for daily fee parking is not
included as an "acceptable"" form of payment, per code. The amendments
proposed relate specifically to parking within downtown, and would not affec,,jL

lack of staffing, are not enforcing ti me- restrictions on Saturdays (and most
businesses and residents are aware of this practice); the areas which have
Saturday time restrictions are varied throughout Downtown (some areas are
Monday through Friday); the Village allows for free parking in the commuter
lots on the weekends with no time restriction, thereby addressing on -street
parking in a similar manner. Time -restricted parking downtown would remain
Monday - Friday (either two or four hour) to prevent abuse by commuter
traffic.
These amendments would impact various departments,, and staff has held multiple
internal meetings to discuss the feasibility of implementation. Each department
has an understanding of the proposed amendments, and if approved, will work
toward implementation in a timely manner.
Police will need at least one overnight shift run through Monday - Thursday
for overnight permng e Emerson Street Deck to be effective. They
determined this would be possible on most nights, unless an officer is out on
a call.
Public Works would help assist in updating parking signage to reflect new
policies.
Village Manager's Office and Public Works will work to market the new
policies, including informing current users,, posting new applications to the
web, etc.
Public Works, Police,, Finance and Administration departments would work
together to implement the online parking permit systems. The software in
place to process payments for the daily fee lots is in the process of being
upgraded to accommodate online permitting and enforcement using the
license plate reader system,, so an officer will know immediately upon
scanning if the customer has the proper parking permit. The key change
noticeable to the public would be the entering of a vehicles license plate
number into the pay stationinstead of the parking space number.
Staff has reviewed parking policies in comparable communities., and it is clear that
this particular section of the Village code is in need of updating. Most of the
updates included in the attached redline pertain to advancement in technology
and terminology, such as the names of the parking areas or permits currently in
place. The other key improvements, as noted above, are in direct response to
consumer demand, resulting in a modern and adaptable approach to public
parking within downtown.

Perhaps the most significant physical change to parking in the downtown in years,
the conversion of the surface lot along Maple Street to a parking deck has an
impact on Chapter 18,, furthering the need for amendment. As a reminder, there
are policies that were in place for the Maple Street Lot that will be maintained
within the deck,, such as having 222 parking spaces dedicated for the use •
commuter parking for residentsonly. A policy with a minorchange prior
of the Maple Street Lot for the overnight parking of the Maple Street Townhome
residents (via special permit). Staff has meet or discussed, on several occasions,,

Fortunately, the Village found a partner in the Mt. Prospect Park District,, as they
are amenable to the townhome residents who wish to park a vehicle in the Lions
Park Parking Lot (both during the day and overnight),, via a permit for a cost of
$45 per month. The park district will receive the revenue., and the Village

Staff presented the draft amendments at the September 8,, 2020 Committee of
the Whole meeting, and the Village Board feedback was supportive. Staff will
continually work on an inter -departmental basis to ensure other Articles within
Chapter are updated !'

18.1301: STOPPING, STANDING OR PARKING OUTSIDE OF BUSINESS OR
RESIDENCE DISTRICT:
A. Upon any street outside of a business or residence district no person shall stop, park or leave
standing any vehicle, whether attended or unattended, upon the roadway when it is practical to
stop, park or so leave such vehicle off such part of said street, but in every event a clear and
unobstructed width of the street opposite such standing vehicle shall be left for the free passage
of other vehicles and a clear view of such stopped vehicle shall be available from a distance of
two hundred feet (200') in each direction upon such street.
B. The village manager shall have authority to prohibit the stopping, standing or parking of vehicles
or to prescribe time limits for parking on any street or highway under the control and jurisdiction
of the village or for the maintenance of which the village is responsible, in such manner as he
shall deem necessary to promote public convenience and safety and so as to facilitate traffic.
Any such regulations adopted by the board of trustees or the village manager regarding the
stopping, standing or parking of vehicles upon any specific street, streets or highways shall
become effective on and after the date of the erection of appropriate signs indicating such
regulations and such designation is included in article XX, schedule V of this chapter.
C. This section shall not apply to the driver of any vehicle which is disabled while on the roadway in
such manner and to such extent that it is impossible to avoid stopping and temporarily leaving
such disabled vehicle in such position. However, at least one door of any motor vehicle permitted
to stand unattended on the roadway shall be left unlocked. (1981 Code)
18.1302: OFFICERS AUTHORIZED T REMOVE ILLEGALLY STOPPED VEHI LE : `II'I III
A. Whenever any police officer finds a vehicle standing upon a highway in violation of any of the
provisions of this article such officer is authorized to move such vehicle, or require the driver or
other person in charge of the vehicle to move the same, to a position off the paved or improved
or main traveled part of such highway.
B. Any police officer is hereby authorized to remove or cause to be removed to a place of safety at
the expense of the owner any unattended, abandoned or disabled vehicle left standing upon any
street, highway, bridge, causeway or elevated structure, or within a tunnel underpass or subway
in such a position or under such circumstances as to obstruct the normal movement of traffic, or
any vehicle left unattended on any highway in this village for a period of twenty four (24) hours or
more. The same authority is also granted regarding any vehicle found upon any street when:
1. Report has been made that such vehicle has been stolen or taken without consent of its
owner, or
2. The person or persons in charge of such vehicle are unable to provide for its custody or
removal, or
3. When the person driving or in control of such vehicle is arrested for an alleged offense for
which the officer is required by law to take the person arrested before a proper judicial official

without unnecessary delay.
Whenever the department finds an abandoned or disabled vehicle standing upon the paved or
main traveled part of a street, which vehicle is or may be expected to interrupt the free flow of
traffic on the street or interfere with the maintenance of the street, the department is
authorized to move the vehicle to a position off the paved or improved or main traveled part of
the street. (1981 Code)
18.1303: PARKING PROHIBITED IN SPECIFIC PLA E :`II'I III
A. Except when necessary to avoid conflict with other traffic, or in compliance with law or the
directions of a police officer or official traffic control device, no person shall:
1. Stop, stand or park a vehicle:
a. On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
b. On a sidewalk;
c. Within an intersection;
d. On a crosswalk;
e. Between a safety zone and the adjacent curb or within thirty feet (30') of points on the curb
immediately opposite the ends of a safety zone, unless a different length is indicated by
signs or markings;
f. Alongside or opposite any street excavation or obstruction when stopping, standing or
parking would obstruct traffic;
g. Upon any bridge or other elevated structure or within a highway tunnel, underpass or
subway;
h. On any railroad tracks;
i. At any place where official signs prohibit stopping.
2. Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge
passengers:
a. In front of a public or private driveway;
b. Within fifteen feet (15') of a fire hydrant. Violation of this subsection A2b shall be subject to
the penalty as set forth in appendix A, division III of this code;
c. Within twenty feet (20') of a crosswalk at an intersection;
d. Within thirty feet (30') upon the approach to any flashing signal, stop sign, yield sign or
traffic control signal located at the side of a roadway;

e. Within twenty feet (20') of the driveway entrance to any fire station and on the side of a
street opposite the entrance to any fire station within seventy five feet (75) of such
entrance (when properly signposted);
f. At any place where official signs prohibit standing.
3. Park a vehicle, whether occupied or not, except temporarily for the purpose of and while
actually engaged in loading or unloading merchandise or passengers:
a. Within fifty feet (50') of the nearest rail of a railroad crossing;
b. At any place where official signs prohibit parking;
B. No person other than a police officer, as provided in section 18.1302 of this article, shall move a
vehicle into any such prohibited area or away from a curb such distance as is unlawful or start or
cause to be started the motor of any motor vehicle, or shift, change, or move the levers, brake,
starting device, gears or other mechanism of a parked motor vehicle to a position other than that
in which it was left by the owner or driver thereof, or attempt to do so. (1981 Code; amd. Ord.

18.1304: ANGLE PARKING • ONE-WAY ROADWAYS : ii�,!J� III
A. Where angle parking is not permitted under the terms of this chapter, every vehicle stopped or
parked upon a roadway shall be so stopped or parked with the right hand wheels of such vehicle
parallel with and within twelve inches (12") of the right hand curb or edge of the roadway.
B. Except when otherwise provided in this chapter, every vehicle stopped or parked upon a one-way
roadway shall be so stopped or parked parallel to the curb or edge of the roadway, in the
direction of authorized traffic movement, with its right hand wheels within twelve inches (12") of
the right hand curb or edge of the roadway, or its left hand wheels within twelve inches (12") of
the left hand curb or edge of the roadway. (1981 Code)
18-1305: VIOLATION OF PARKING REGULATIONS; LEASED VEHICLES:` III
A. Every person in whose name a vehicle is registered pursuant to law and who leases such vehicle
to others, after receiving written notice of a violation of this article or a parking regulation of the
department involving such vehicle, shall upon request provide such police officers as have
authority of the offense, and the court having jurisdiction thereof, with a written statement of the
name and address of the lessee at the time of such offense and the identifying number upon the
registration plates of such vehicle.
B. A person found guilty of violating this section shall be fined as set forth in appendix A, division III
of this code, notwithstanding any other sections or subsections in this chapter to the contrary.

18.1306: SCHOOL BUS STOPPING ON FOUR LANE HIGHWAY: III
A. A school bus traveling on a highway having four (4) or more lanes for vehicular traffic shall stop
for the loading or discharging of passengers only on the right side of the highway and when so
stopped shall load or discharge only those passengers whose residences are located to the right
of the highway.
B. The routes of school buses shall be so arranged that no child shall be required to cross such a
four (4) or more lane highway to board a school bus or to reach his residence after leaving the
bus. This subsection shall not apply when children are escorted by competent persons
designated by the school authorities or by law enforcement officers. (1981 Code)
18.1307: INTERFERENCE WITH FIRE APPARATUS PROHIBITED: ii' III
The driver of any vehicle other than one on official business shall not park such vehicle within the
block where fire apparatus has stopped in answer to a fire alarm. (1981 Code)
18.1308: UNATTENDED MOTOR VEHICLES:''( III
No person driving or in charge of a motor vehicle shall permit it to stand unattended without first
stopping the engine and removing the ignition key, and when standing upon any perceptible grade,
without effectively setting the brake and turning the front wheels to the curb or side of the street.

No person shall park a vehicle within an alley in such a manner or under such conditions as to leave
available less than ten feet (10') of the width of the roadway for the free movement of vehicular
traffic, and no person shall stop, stand or park a vehicle within an alley in such a position as to block
the driveway entrance to any abutting property. (1981 Code)
18.1310: CABSTANDS• BUS STANDS: `' III
No vehicle other than a licensed taxicab shall be parked in any area designated by ordinance as a
cabstand; and no vehicle other than a bus shall be parked in a place so designated as a bus loading
zone; when such cab and bus stands are signposted and included on schedule VI of the appendix to
this chapter. (1981 Code)
18.1311: LOADING ZONE: III
During the times specified herein, it shall be unlawful for the driver of a vehicle to stand a passenger
vehicle for a period of time longer than is necessary for the loading or unloading of passengers, not
to exceed three (3) minutes, and for the driver to stand any freight carrying vehicle for a period of
time longer than is necessary to load, unload and deliver materials, not to exceed thirty (30) minutes,
in any of the following places:

A. In any public alley, during any hour of the day or night.
B. At any place not to exceed seventy five feet (75') along the curb before the entrance to any
hospital, motel or hotel at any time.
C. At any place not to exceed seventy five feet (75') along the curb before the entrance to a public
building between eight o'clock (8:00) A.M. and six o'clock (6:00) P.M. except on Sunday.
D. Directly in front of the entrance to any theater at any time the theater is open for business.
E. It shall be unlawful for any person, firm, or corporation to utilize an area as a loading zone for
commercial purposes, when signs are posted, as provided in schedule XX of the appendix to this

18.1312: TRUCK TRAILER AND BUS LOADING AND PARKING:
A. Residential District: No person shall stand or park any truck, any tractor of any kind, semitrailer or
bus on any street in any residence district within the village for a longer period than is necessary
for the expeditious loading or unloading of such vehicle.
B. Certain Other Districts: No person shall stand or park any truck, any tractor of any kind,
semitrailer or bus in any private parking area, except hotels or motels, in any business, office,
conservation recreation or office research district in the village except for the expeditious loading
or unloading of such vehicle. Under no circumstances shall such standing or parking be for
longer than two (2) hours. (Ord. 5339, 6-17-2003)
18.1313: PARKING OF VEHICLE FOR SALE:''( III :
It shall be unlawful to park any vehicle upon any street for the purpose of displaying it for sale, or to
park any vehicle upon any business street from which vehicle merchandise is peddled. (1981 Code)
18.1314: NO PARKING DURING SNOW REMOVAL:` III
It shall be unlawful for any person to park, cause to be parked or allow to remain parked any vehicle
on any unplowed public right of way within the village at any time within a twenty four (24) hour

permit any vehicle to stand, stop or park in any of the places designated by the village manager and

The parking of any vehicle is prohibited on all weekdays, excluding Saturdays, Sundays and legal
holidays between those hours and on those streets designated by the village manager and
signposted and included on schedule VIII of the appendix to this chapter. (1981 Code)

A. Whenever fire lanes are designated as provided in section 18.2014 of this chapter and
section 24.103 of this code, it shall be unlawful for any person to block or obstruct, wholly or
partly, any duly designated and posted fire lane described in schedule XIV in section 18.2014 of
the appendix to this chapter.
B. Any person found guilty of a violation of this section shall be fined as set forth in appendix A,

. Tampering With Automated Pay Box Or Posted 11 : No person shall deface, injure,
tamper with, open or break, destroy or impair the usefulness of any automated pay
box or posted
G. The provisions of this section shall not relieve any person from the duty to observe other and
more restrictive provisions of this chapter prohibiting or limiting the stopping, standing or parking
of vehicles in specified places or at specified times.
H. Special Penalty:
1. Any person who violates subsections 44E and IF of this section shall be subject to a fine in the
amount as set forth in appendix A, division III of this code.
2. Whenever a police officer is authorized to arrest a person without a warrant because of a
violation of any of the sections of this article, said police officer may, in lieu of the filing of a
complaint in court, in the first instance, issue a citation as hereinafter provided in
section 18.1325 of this article and section 18.1905 of this chapter to any person who violates
the provisions of subsections B, C, and G of this section. Such citation may be delivered to the
violator personally or may be affixed to the vehicle of the violator. Nothing in this subsection,
however, shall be construed to abridge the power of a police officer to arrest any person
violating the above specified subsections and to take him into custody.
-5—.The operation, maintenance and management of the system shall be
under the supervision of the village manager, who shall see that said system is kept in good

working and operating order and is managed to the advantage of the village, and shall operate
the system in an economical and efficient manner.
. Application o0f Proceeds:
1. The village manager, subject to the approval of the president and board of trustees, shall
designate such collector or collectors and methods as are necessary to collect properly all
coins deposited in the automated pay boxes.
2. Such collector or collectors shall be only such employees as are now or may hereafter be duly
bonded in a sum, as set forth in appendix A, division I of this code, for the faithful performance
of their duties.
3. All monies so collected shall be deposited with the village treasurer, who shall credit such
collections to the parking system revenue fund for the purposes set forth herein and shall
submit a monthly report to the village board showing all revenues derived from automated pay
boxes.
4. The coins required to be deposited in automated pay boxes as provided in this article are levied
and assessed as fees to cover: the regulation and control of parking upon public streets; the
cost of automated pay boxes and posted numbers, their installation, inspection, supervision,
operation, repair and maintenance, control and use of parking spaces, and regulating the
parking of vehicles in pay parking zones; and the cost of acquiring, establishing, improving,
maintaining and operating public off street parking facilities.
5. The village treasurer shall pay from such parking system revenue fund the costs of any
automated pay boxes and posted numbers purchased by the village and incurred for their
installation, inspection, service, supervision, repair and maintenance, for making collections
from such automated pay boxes and for the enforcement of the provisions of this chapter
applicable to pay parking zones. The net proceeds of the operation of the parking system in
said parking system revenue fund, after the payment of such costs and expenses, shall be
used for parking studies and for the acquisition, establishment, improvement, maintenance and
operation of public off street parking facilities as the village board shall from time to time direct.
6. The percentage of revenue collected to be applied to the cost of installation of automated boxes
in Union Pacific Railroad lots 1, 2 and 3 shall be thirty three and one-third percent (331/3%) of
the gross revenue as provided in the agreement and lease with the Union Pacific Railway
Company consenting to the installation of automated pay boxes in said lots.
7. The automated pay box fund shall be audited as a separate fund at the time of the annual audit
by the village.
K -M. Prima Facie Proof: Proof of registration of a motor vehicle and proof of violation of this section
shall be construed as prima facie proof that the registered owner of such motor vehicle was the
user or operator thereof at the time of the violation charged.
. Violation: Any person found guilty of a violation of this section shall be fined as set forth in

18.1324: HANDICAPPED PERSONS; PARKING PRIVILEGES:`
A. Any motor vehicle having a driver or passenger who possesses an identification card and which is
displayed in the windshield (which identification card declares the possessor thereof to be a
handicapped person and which card has been issued by any of the townships of the state of
Illinois) or a motor vehicle bearing registration plates issued to a physically handicapped person
pursuant to section 3-616 or to a disabled veteran pursuant to section 3-609 of the Illinois vehicle
code, effective July 1, 1970, as amended, is exempt from any statute of the state of Illinois or
any ordinance of the village imposing time limitations on parking in a business district. Said
motor vehicle shall be subject to all other parking regulations of the state of Illinois or the village.
Time limitations as used herein shall not refer to areas which restrict parking to certain hours of
the day or days of the week, but rather to limitations on the maximum amount of time a vehicle
may be parked in a particular space or area.
B. The parking of any motor vehicle which is not bearing registration plates issued to a physically
handicapped person pursuant to section 3-616 or to a disabled veteran pursuant to section 3-
609, or a special decal or device issued to a physically handicapped person or disabled veteran

pursuant to section 11.1301.2 of the Illinois vehicle code, in any parking place, private or public,
specifically reserved for the handicapped by the posting of an official sign is prohibited.
C. Any person or local authority owning or operating any public or private off street parking facility
may, after notifying the Mount Prospect police department, remove or cause to be removed to
the nearest garage or other place of safety any vehicle parked within a stall or space reserved
for use by the physically handicapped which does not display handicapped registration plates, or
a decal or device as required under this section.
D. The misuse of any special plate, decal or device is hereby prohibited. Misuse shall include, but
not be limited to, the parking of a vehicle in a space or area designated for the handicapped
when the handicapped person is not present as the driver or passenger of the vehicle.
E. Any person who violates this section shall be subject to a mandatory minimum fine as set forth in
appendix A, division III of this code for each offense in addition to any costs or charges
connected with the removal or storage of any motor vehicle found to be in violation of this

18.1325: PENALTY: 1I', III
A. Except as may be provided elsewhere in this article, any person who violates any of the sections
of this article shall be subject to the penalties provided in section 18.1905 of this chapter.
B. Notwithstanding the penalty provisions of section 18.1905 of this chapter, the use of a citation in
lieu of the filing of a complaint in court shall not be available with respect to violations of
subsections 18.1322 E# and IF and section 18.1324 of this article. (Ord. 3422, 6-5-1984)
18.1326: TOWING AND STORAGE OF IMPROPERLY PARKED VEHICLES: °�i�!! IIILEI
A. In addition to the provisions of section 18.1302 of this article, any vehicle parked in violation of
sections 18.1303, 18.1315, 18.1320, 18.1321, 18.1324 . �� of this article
shall be subject to being towed by the village or any of its officers, agents, employees, servants,
contractors and subcontractors, to a location designated by the village at the expense of the
owner of the vehicle towed.
B. The village shall mail written notice to the person listed in the records of the Illinois secretary of
state or in the vehicle license records of the village as the registered owner of the vehicle towed
advising the said owner of the location of said vehicle within twenty four (24) hours after the
vehicle towed is deposited at its designated location. The village may also notify said owner by
telephone.
C. Such notice shall also advise the owner of the reason for action taken by the village in towing the
illegally parked vehicle, and shall provide the owner an opportunity to request a hearing before
the village manager regarding the basis for such towing action. Such request must be made in
writing within two (2) days following receipt of the notice, and the village manager shall take
immediate steps to hold a hearing and review the action taken in towing the vehicle. The
determination of the village manager that the vehicle in question is, in fact, parked in violation of
any of the sections specified above shall be final.

D. Fees shall be as set forth in appendix A, division II of this code.
E. The village shall not be liable for any damage to any vehicle which occurs as a result of the work
to and the towing and storage of any vehicle under the provisions of this section.
F. It shall be unlawful for any person to remove any vehicle from a storage area unless and until the
fees for the preparatory work, towage and storage of said vehicle have been paid. The penalty
for violating the provisions of this section shall be as provided in section 18.1905 of this chapter.

18.1301: STOPPING, STANDING OR PARKING OUTSIDE OF BUSINESS OR RESIDENCE

A. Upon any street outside of a business or residence district no person shall stop, park or leave
standing any vehicle, whether attended or unattended, upon the roadway when it is practical to
stop, park or so leave such vehicle off such part of said street, but in every event a clear and
unobstructed width of the street opposite such standing vehicle shall be left for the free passage
of other vehicles and a clear view of such stopped vehicle shall be available from a distance of
two hundred feet (200') in each direction upon such street.
B. The village manager shall have authority to prohibit the stopping, standing or parking of vehicles
or to prescribe time limits for parking on any street or highway under the control and jurisdiction
of the village or for the maintenance of which the village is responsible, in such manner as he
shall deem necessary to promote public convenience and safety and so as to facilitate traffic.
Any such regulations adopted by the board of trustees or the village manager regarding the
stopping, standing or parking of vehicles upon any specific street, streets or highways shall
become effective on and after the date of the erection of appropriate signs indicating such
regulations and such designation is included in article XX, schedule V of this chapter.
C. This section shall not apply to the driver of any vehicle which is disabled while on the roadway in
such manner and to such extent that it is impossible to avoid stopping and temporarily leaving
such disabled vehicle in such position. However, at least one door of any motor vehicle permitted
to stand unattended on the roadway shall be left unlocked. (1981 Code)
18.1302: OFFICERS AUTHORIZED TO REMOVE ILLEGALLY STOPPED VEHICLES: `�'�i III
A. Whenever any police officer finds a vehicle standing upon a highway in violation of any of the
provisions of this article such officer is authorized to move such vehicle, or require the driver or
other person in charge of the vehicle to move the same, to a position off the paved or improved
or main traveled part of such highway.
B. Any police officer is hereby authorized to remove or cause to be removed to a place of safety at
the expense of the owner any unattended, abandoned or disabled vehicle left standing upon any
street, highway, bridge, causeway or elevated structure, or within a tunnel underpass or subway
in such a position or under such circumstances as to obstruct the normal movement of traffic, or
any vehicle left unattended on any highway in this village for a period of twenty four (24) hours or
more. The same authority is also granted regarding any vehicle found upon any street when:
1. Report has been made that such vehicle has been stolen or taken without consent of its
owner, or
2. The person or persons in charge of such vehicle are unable to provide for its custody or
removal, or
3. When the person driving or in control of such vehicle is arrested for an alleged offense for
which the officer is required by law to take the person arrested before a proper judicial official

without unnecessary delay.
Whenever the department finds an abandoned or disabled vehicle standing upon the paved or
main traveled part of a street, which vehicle is or may be expected to interrupt the free flow of
traffic on the street or interfere with the maintenance of the street, the department is
authorized to move the vehicle to a position off the paved or improved or main traveled part of
the street. (1981 Code)
18.1303: PARKING PROHIBITED IN SPECIFIC PLACES:` III
A. Except when necessary to avoid conflict with other traffic, or in compliance with law or the
directions of a police officer or official traffic control device, no person shall:
1. Stop, stand or park a vehicle:
a. On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
b. On a sidewalk;
c. Within an intersection;
d. On a crosswalk;
e. Between a safety zone and the adjacent curb or within thirty feet (30') of points on the curb
immediately opposite the ends of a safety zone, unless a different length is indicated by
signs or markings;
f. Alongside or opposite any street excavation or obstruction when stopping, standing or
parking would obstruct traffic;
g. Upon any bridge or other elevated structure or within a highway tunnel, underpass or
subway;
h. On any railroad tracks;
i. At any place where official signs prohibit stopping.
2. Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge
passengers:
a. In front of a public or private driveway;
b. Within fifteen feet (15') of a fire hydrant. Violation of this subsection A2b shall be subject to
the penalty as set forth in appendix A, division III of this code;
c. Within twenty feet (20') of a crosswalk at an intersection;
d. Within thirty feet (30') upon the approach to any flashing signal, stop sign, yield sign or
traffic control signal located at the side of a roadway;

e. Within twenty feet (20') of the driveway entrance to any fire station and on the side of a
street opposite the entrance to any fire station within seventy five feet (75') of such
entrance (when properly signposted);
f. At any place where official signs prohibit standing.
3. Park a vehicle, whether occupied or not, except temporarily for the purpose of and while
actually engaged in loading or unloading merchandise or passengers:
a. Within fifty feet (50') of the nearest rail of a railroad crossing;
b. At any place where official signs prohibit parking;
B. No person other than a police officer, as provided in section 18.1302 of this article, shall move a
vehicle into any such prohibited area or away from a curb such distance as is unlawful or start or
cause to be started the motor of any motor vehicle, or shift, change, or move the levers, brake,
starting device, gears or other mechanism of a parked motor vehicle to a position other than that
in which it was left by the owner or driver thereof, or attempt to do so. (1981 Code; amd. Ord.

18.1304: ANGLE PARKING; ONE-WAY ROADWAYS:''( III
A. Where angle parking is not permitted under the terms of this chapter, every vehicle stopped or
parked upon a roadway shall be so stopped or parked with the right hand wheels of such vehicle
parallel with and within twelve inches (12") of the right hand curb or edge of the roadway.
B. Except when otherwise provided in this chapter, every vehicle stopped or parked upon a one-way
roadway shall be so stopped or parked parallel to the curb or edge of the roadway, in the
direction of authorized traffic movement, with its right hand wheels within twelve inches (12") of
the right hand curb or edge of the roadway, or its left hand wheels within twelve inches (1211) of

A. A school bus traveling on a highway having four (4) or more lanes for vehicular traffic shall stop
for the loading or discharging of passengers only on the right side of the highway and when so
stopped shall load or discharge only those passengers whose residences are located to the right
of the highway.
B. The routes of school buses shall be so arranged that no child shall be required to cross such a
four (4) or more lane highway to board a school bus or to reach his residence after leaving the
bus. This subsection shall not apply when children are escorted by competent persons

time longer than is necessary to load, unload and deliver materials, not to exceed thirty (30) minutes,

A. Residential District: No person shall stand or park any truck, any tractor of any kind, semitrailer or

B. Certain Other Districts: No person shall stand or park any truck, any tractor of any kind, semitrailer
or bus in any private parking area, except hotels or motels, in any business, office, conservation
recreation or office research district in the village except for the expeditious loading or unloading
of such vehicle. Under no circumstances shall such standing or parking be for longer than two

18.1320: TIME RESTRICTED PARKING:
It shall be unlawful to park any vehicle in any space designated by the Village Manager as a time
restricted parking area, whether the area is on -street or a village parking lot or parking deck, be it
owned, metered or leased by the village, for a period longer than the time posted on signs in the
area. The Village Clerk's office maintains a list of streets and parking areas deemed time restricted
parking areas.
Each consecutive period, equal in length to the maximum permitted parking period, during which a
vehicle is parking in a limited time parking area shall constitute a separate violation of this section.

A. Whenever fire lanes are designated as provided in section 18.2014 of this chapter and
section 24.103 of this code, it shall be unlawful for any person to block or obstruct, wholly or

18.1322: PAY PARKING ZONES:u!I!!
A. Established: There are hereby established certain parking zones to be known as pay parking
zones, which zones shall be within the districts or upon those streets, parking lots or parking
decks, when signs are posted giving notice thereof. No person shall park a vehicle within the pay
parking zones without having complied with the requirements of this section 18.1322.
1. Union Pacific Railroad lot referred to as West Commuter Lot, the area lying north of the
railroad tracks, south of Northwest Highway, and immediately west of Main Street.
2. Union Pacific Railroad lot referred to as the Metra Station Lot, the area lying north of the
railroad tracks, south of Northwest Highway, between Main and Emerson Streets.
3. Union Pacific Railroad lot referred to as the East Commuter Lot, the area lying north of the
railroad tracks, south of Northwest Highway and immediately east of Emerson Street.
4. Maple Street Parking Deck, located at 301 S. Maple Street.
5. On -street parking along Prospect Avenue, north side of the street between Maple and William
Streets.
6. Emerson Street Parking Deck, located at 30 S. Emerson Street.
7. Wille Street Parking Lot, located on the west side of Wille Street between Prospect and
Evergreen Avenues.
B. Vehicle Sticker: It shall be unlawful for any person to park a motor vehicle in any pay parking zone
signed "Resident Parking Only" unless a current Mount Prospect vehicle sticker is displayed in
the front windshield of the vehicle so parked therein.
C. Pay Parking Zones:
1. No person shall park a vehicle in any pay parking zone in which such parking space is located
unless an amount, as set forth in appendix A, division II of this code, has been paid pursuant to
the provisions of this section. This provision shall not apply to the act of parking or the time
which is required to deposit immediately thereafter pay the required dollar amount via
automated pay box, mobile app, or posting of a valid monthly parking permit.
2. Daily Fee Zones Established:
a. There shall be established, at each pay parking zone where daily fee parking is permitted,
one or more automated pay boxes which are programmed to accept payment for each vehicle
parked in a daily fee pay parking zone.
b. The deposit of sufficient United States coins, currency or debit card in an automated daily fee
pay box, or payment collected through the utilization of the pay parking zone mobile app
immediately after parking shall establish a parking time of one day for the corresponding
vehicle entered into the pay box system.

3. Monthly Permit Parking Zones Established:
a. There shall be established, at each pay parking zone where Village -issued parking permits
are valid, one or more signs posted giving notice thereof.
b. No person shall park a vehicle in any monthly permit pay parking zone in which such parking
space is located unless a valid parking permit is conspicuously displayed and/or the vehicle's
license plate is entered into the electronic permit system.
c. The monthly permit amount shall be paid per the fee set forth in appendix A, division II of this
code, pursuant to each type of permit which is sought for purchase.
D. No person shall park a vehicle in any such parking space for a consecutive period of time longer
than that limited period of time for which parking is lawfully permitted in the pay parking zone in
which such parking space is located.
F. Holidays: There shall be no charge for parking in pay parking zones on holidays, Saturdays and
Sundays.
1. The following days shall be designated as holidays: January 1, Memorial Day, July 4, Labor
Day, Thanksgiving Day and the Friday after Thanksgiving, and December 25.
2. If any of these days shall fall on Sunday and be observed on Monday, or if any of these days
shall fall on Saturday and be observed on the Friday preceding, then such Monday or Friday
shall be considered as a holiday for the purpose of this section.
3. Monthly parking permit fees are not adjusted or modified due to holidays.
E. Use Of Slugs or Counterfeit Permits Prohibited: No person shall deposit or attempt to deposit in
any automated pay box any slug, button or any other device or substance as substitutes for coins
of United States currency. No person shall display or attempt to display a counterfeit, altered,
copied or otherwise modified permit as a substitute for a Village -issued parking permit.
F. Tampering With Automated Pay Box Or Posted Sign: No person shall deface, injure, tamper with,
open or willfully break, destroy or impair the usefulness of any automated pay box or posted sign.
G. The provisions of this section shall not relieve any person from the duty to observe other and
more restrictive provisions of this chapter prohibiting or limiting the stopping, standing or parking
of vehicles in specified places or at specified times.
H. Special Penalty:
1. Any person who violates subsections E and F of this section shall be subject to a fine in the
amount as set forth in appendix A, division III of this code.
2. Whenever a police officer is authorized to arrest a person without a warrant because of a
violation of any of the sections of this article, said police officer may, in lieu of the filing of a
complaint in court, in the first instance, issue a citation as hereinafter provided in
section 18.1325 of this article and section 18.1905 of this chapter to any person who violates

the provisions of subsections B, C, and G of this section. Such citation may be delivered to the
violator personally or may be affixed to the vehicle of the violator. Nothing in this subsection,
however, shall be construed to abridge the power of a police officer to arrest any person
violating the above specified subsections and to take him into custody.
I. The operation, maintenance and management of the automated pay box system shall be under
the supervision of the village manager, who shall see that said system is kept in good working
and operating order and is managed to the advantage of the village, and shall operate the
system in an economical and efficient manner.
J. Application of Proceeds:
1. The village manager, subject to the approval of the president and board of trustees, shall
designate such collector or collectors and methods as are necessary to collect properly all
coins deposited in the automated pay boxes.
2. Such collector or collectors shall be only such employees as are now or may hereafter be duly
bonded in a sum, as set forth in appendix A, division I of this code, for the faithful performance
of their duties.
3. All monies so collected shall be deposited with the village treasurer, who shall credit such
collections to the parking system revenue fund for the purposes set forth herein and shall
submit a monthly report to the village board showing all revenues derived from automated pay
boxes.
4. The coins required to be deposited in automated pay boxes as provided in this article are levied
and assessed as fees to cover: the regulation and control of parking upon public streets; the
cost of automated pay boxes and posted numbers, their installation, inspection, supervision,
operation, repair and maintenance, control and use of parking spaces, and regulating the
parking of vehicles in pay parking zones; and the cost of acquiring, establishing, improving,
maintaining and operating public off street parking facilities.
5. The village treasurer shall pay from such parking system revenue fund the costs of any
automated pay boxes and posted numbers purchased by the village and incurred for their
installation, inspection, service, supervision, repair and maintenance, for making collections
from such automated pay boxes and for the enforcement of the provisions of this chapter
applicable to pay parking zones. The net proceeds of the operation of the parking system in
said parking system revenue fund, after the payment of such costs and expenses, shall be
used for parking studies and for the acquisition, establishment, improvement, maintenance and
operation of public off street parking facilities as the village board shall from time to time direct.
6. The percentage of revenue collected to be applied to the cost of installation of automated boxes
in Union Pacific Railroad lots 1, 2 and 3 shall be thirty three and one-third percent (331/3%) of
the gross revenue as provided in the agreement and lease with the Union Pacific Railway
Company consenting to the installation of automated pay boxes in said lots.
7. The automated pay box fund shall be audited as a separate fund at the time of the annual audit
by the village.

K. Prima Facie Proof: Proof of registration of a motor vehicle and proof of violation of this section
shall be construed as prima facie proof that the registered owner of such motor vehicle was the
user or operator thereof at the time of the violation charged.
L. Violation: Any person found guilty of a violation of this section shall be fined as set forth in

18.1323: PARKING IN VILLAGE PARKING LOTS AND PARKING DECKS:''( III
In any Village parking lot or parking deck, be it owned, metered or leased by the village, it shall be
unlawful for any person:
A. To park a vehicle in any area of such lot which is not designated (by lines or markings painted or
placed on the pavement, wheel stops, etc.) as a parking space.
B. To back a vehicle into any parking space thereof whenever signs have been placed in such lot
which shall read, " Do Not Back Into Space".
C. To park a vehicle, other than those holding valid taxicab licenses issued by the village, in areas
where signs are posted "No Parking - Taxi Stand".
D. To park any unauthorized vehicle in the West Commuter Lot, Metra Train Station Lot, East
Commuter Lot or Wille Street Parking Lot between the hours of one o'clock (1:00) A.M. and five
o'clock (5:00) A.M. on any day including weekends and holidays.
E. To park any unauthorized vehicle in the Maple Street or Emerson Street Parking Deck between
the hours of 2:00 A.M. and 5:00 A.M. Monday — Friday.
F. Maple Street Parking Deck and Emerson Street Parking Deck Permit Parking:
1. The Village Manager, or his designee, shall establish and maintain permit parking systems to
authorize parking within certain areas of the Village parking decks, subject to time, user, or other
appropriate restrictions as he determines to be necessary.
2. The applicable monthly permit amount shall be paid per the fee set forth in appendix A,
division II of this code, pursuant to each type of permit which is sought for purchase.
G. The Village Manager is authorized to establish regulations for the use of Village parking lots or
parking decks, be it owned, metered or leased by the village, and to enforce those regulations
through the posting of signs, police department patrol, and other action incidental to such
enforcement related to:

1. Loitering, prohibition of the use of the facilities by those roller-skating, skateboarding or other
non -vehicular use that presents a danger to the use of the facility for parking of motor
vehicles or to the persons engaged in such unpermitted use.
2. Designation of spaces limited to employees of the Village of Mount Prospect or the Mount
Prospect Public Library, or other specific organization.
3. Establishment of vehicle speed limits within the facilities.
4. Establishment of parking time restrictions within the facilities.
5. Establishment of parking permit systems as noted in subsection F.
6. Any other regulation as may be required to promote the safe and efficient use of the facilities.
18.1324: HANDI APPED PERSONS; PARKING PRIVILEGES:` III
A. Any motor vehicle having a driver or passenger who possesses an identification card and which is
displayed in the windshield (which identification card declares the possessor thereof to be a
handicapped person and which card has been issued by any of the townships of the state of
Illinois) or a motor vehicle bearing registration plates issued to a physically handicapped person
pursuant to section 3-616 or to a disabled veteran pursuant to section 3-609 of the Illinois vehicle
code, effective July 1, 1970, as amended, is exempt from any statute of the state of Illinois or
any ordinance of the village imposing time limitations on parking in a business district. Said
motor vehicle shall be subject to all other parking regulations of the state of Illinois or the village.
Time limitations as used herein shall not refer to areas which restrict parking to certain hours of
the day or days of the week, but rather to limitations on the maximum amount of time a vehicle
may be parked in a particular space or area.
B. The parking of any motor vehicle which is not bearing registration plates issued to a physically
handicapped person pursuant to section 3-616 or to a disabled veteran pursuant to section 3-
609, or a special decal or device issued to a physically handicapped person or disabled veteran
pursuant to section 11.1301.2 of the Illinois vehicle code, in any parking place, private or public,
specifically reserved for the handicapped by the posting of an official sign is prohibited.
C. Any person or local authority owning or operating any public or private off street parking facility
may, after notifying the Mount Prospect police department, remove or cause to be removed to
the nearest garage or other place of safety any vehicle parked within a stall or space reserved
for use by the physically handicapped which does not display handicapped registration plates, or
a decal or device as required under this section.
D. The misuse of any special plate, decal or device is hereby prohibited. Misuse shall include, but
not be limited to, the parking of a vehicle in a space or area designated for the handicapped
when the handicapped person is not present as the driver or passenger of the vehicle.
E. Any person who violates this section shall be subject to a mandatory minimum fine as set forth in
appendix A, division III of this code for each offense in addition to any costs or charges
connected with the removal or storage of any motor vehicle found to be in violation of this

A. Except as may be provided elsewhere in this article, any person who violates any of the sections
of this article shall be subject to the penalties provided in section 18.1905 of this chapter.
B. Notwithstanding the penalty provisions of section 18.1905 of this chapter, the use of a citation in
lieu of the filing of a complaint in court shall not be available with respect to violations of
subsections 18.1322 E and F and section 18.1324 of this article. (Ord. 3422, 6-5-1984)
18.1326: TOWING AND STORAGE OF IMPROPERLY PARKED VEHICLES:''( III
A. In addition to the provisions of section 18.1302 of this article, any vehicle parked in violation of
sections 18.1303, 18.1315, 18.13207 18.1321, 18.1322, and 18.1324 of this article shall be
subject to being towed by the village or any of its officers, agents, employees, servants,
contractors and subcontractors, to a location designated by the village at the expense of the
owner of the vehicle towed.
B. The village shall mail written notice to the person listed in the records of the Illinois secretary of
state or in the vehicle license records of the village as the registered owner of the vehicle towed
advising the said owner of the location of said vehicle within twenty four (24) hours after the
vehicle towed is deposited at its designated location. The village may also notify said owner by
telephone.
C. Such notice shall also advise the owner of the reason for action taken by the village in towing the
illegally parked vehicle, and shall provide the owner an opportunity to request a hearing before
the village manager regarding the basis for such towing action. Such request must be made in
writing within two (2) days following receipt of the notice, and the village manager shall take
immediate steps to hold a hearing and review the action taken in towing the vehicle. The
determination of the village manager that the vehicle in question is, in fact, parked in violation of
any of the sections specified above shall be final.
D. Fees shall be as set forth in appendix A, division II of this code.
E. The village shall not be liable for any damage to any vehicle which occurs as a result of the work
to and the towing and storage of any vehicle under the provisions of this section.
F. It shall be unlawful for any person to remove any vehicle from a storage area unless and until the
fees for the preparatory work, towage and storage of said vehicle have been paid. The penalty
for violating the provisions of this section shall be as provided in section 18.1905 of this chapter.

Northwest Highway (U.S. Route 14) unless said vehicle is parked in a position parallel with the

AN ORDINANCE AMENDING CHAPTER 18, "TRAFFIC,"
AND RELATED APPENDICES OF THE
VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, the Village of Mount Prospect (the "Village") is a home rule municipality,
having all of the powers and authority granted to such municipalities pursuant to Article VII,
Section 6 of the Illinois Constitution of 1970, including the right to exercise any power and perform
any function pertaining to its government and affairs; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect desire
to make certain amendments to Chapter 18, "Traffic," and related appendices of the Village Code
of Mount Prospect as set forth below; and
WHEREAS, pursuant to the authority granted under the Illinois Municipal Code and in
accordance with home rule authority granted home rule municipalities, the President and Board of
Trustees of the Village of Mount Prospect approve the amendments as set forth below.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: Section 18.1303, "Parking Prohibited in Specific Places" of Article XIII,
"Stopping, Standing and Parking" of Chapter 18, "Traffic" to the Mount Prospect Village Code
shall be amended as follows:
18.1303: PARKING PROHIBITED IN SPECIFIC PLACES:
A. Except when necessary to avoid conflict with other traffic, or in compliance with law or the
directions of a police officer or official traffic control device, no person shall:
1. Stop, stand or park a vehicle:
a. On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
b. On a sidewalk;
c. Within an intersection;
d. On a crosswalk;
e. Between a safety zone and the adjacent curb or within thirty feet (30') of points on the
curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs
or markings;

f. Alongside or opposite any street excavation or obstruction when stopping, standing or
parking would obstruct traffic;
g. Upon any bridge or other elevated structure or within a highway tunnel, underpass or
subway;
h. On any railroad tracks;
i. At any place where official signs prohibit stopping.
2. Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge
passengers:
a. In front of a public or private driveway;
b. Within fifteen feet (15') of afire hydrant. Violation of this subsection A2b shall be subject
to the penalty as set forth in appendix A, division III of this code;
c. Within twenty feet (20') of a crosswalk at an intersection;
d. Within thirty feet (30') upon the approach to any flashing signal, stop sign, yield sign or
traffic control signal located at the side of a roadway;
e. Within twenty feet (20') of the driveway entrance to any fire station and on the side of a
street opposite the entrance to any fire station within seventy five feet (75') of such entrance (when
properly signposted);
f. At any place where official signs prohibit standing.
3. Park a vehicle, whether occupied or not, except temporarily for the purpose of and while
actually engaged in loading or unloading merchandise or passengers:
a. Within fifty feet (50') of the nearest rail of a railroad crossing;
b. At any place where official signs prohibit parking;

B. No person other than a police officer, as provided in section 18.1302 of this article, shall
move a vehicle into any such prohibited area or away from a curb such distance as is unlawful or
start or cause to be started the motor of any motor vehicle, or shift, change, or move the levers,
brake, starting device, gears or other mechanism of a parked motor vehicle to a position other than
that in which it was left by the owner or driver thereof, or attempt to do so.

SECTION 2: Section 18.1319, "All Night Parking" of Article XIII, "Stopping, Standing
and Parking" of Chapter 18, "Traffic" to the Mount Prospect Village Code shall be amended as
follows:
18.1319: ALL NIGHT PARKING:
No person shall park any vehicle on any street within the village between the hours of two o'clock
(2:00) A.M. and six o'clock (6:00) A.M. on any day, except vehicles on emergency

pay box any slug, button or any other device or substance as substitutes for coins of United States
currency. No person shall display or attempt to display a counterfeit, altered, copied or otherwise
modified permit as a substitute for a Village -issued parking permit.

1. Any person who violates subsections 14F and IG of this section shall be subject to a fine in
the amount as set forth in appendix A, division III of this code.
2. Whenever a police officer is authorized to arrest a person without a warrant because of a
violation of any of the sections of this article, said police officer may, in lieu of the filing of a
complaint in court, in the first instance, issue a citation as hereinafter provided in section 18.1325
of this article and section 18.1905 of this chapter to any person who violates the provisions of
subsections B, C, and G of this section. Such citation may be delivered to the violator personally
or may be affixed to the vehicle of the violator. Nothing in this subsection, however, shall be
construed to abridge the power of a police officer to arrest any person violating the above specified
subsections and to take him into custody.

the system in an economical and efficient manner.

designate such collector or collectors and methods as are necessary to collect properly all coins
deposited in the automated pay boxes.
2. Such collector or collectors shall be only such employees as are now or may hereafter be
duly bonded in a sum, as set forth in appendix A, division I of this code, for the faithful
performance of their duties.
3. All monies so collected shall be deposited with the village treasurer, who shall credit such
collections to the parking system revenue fund for the purposes set forth herein and shall submit a
monthly report to the village board showing all revenues derived from automated pay boxes.
4. The coins required to be deposited in automated pay boxes as provided in this article are
levied and assessed as fees to cover: the regulation and control of parking upon public streets; the
cost of automated pay boxes and posted numbers, their installation, inspection, supervision,
operation, repair and maintenance, control and use of parking spaces, and regulating the parking
of vehicles in pay parking zones; and the cost of acquiring, establishing, improving, maintaining
and operating public off street parking facilities.

5. The village treasurer shall pay from such parking system revenue fund the costs of any
automated pay boxes and posted numbers purchased by the village and incurred for their
installation, inspection, service, supervision, repair and maintenance, for making collections from
such automated pay boxes and for the enforcement of the provisions of this chapter applicable to
pay parking zones. The net proceeds of the operation of the parking system in said parking system
revenue fund, after the payment of such costs and expenses, shall be used for parking studies and
for the acquisition, establishment, improvement, maintenance and operation of public off street
parking facilities as the village board shall from time to time direct.
6. The percentage of revenue collected to be applied to the cost of installation of automated
boxes in Union Pacific Railroad lots 1, 2 and 3 shall be thirty three and one-third percent (3 3 1/3 %)
of the gross revenue as provided in the agreement and lease with the Union Pacific Railway
Company consenting to the installation of automated pay boxes in said lots.
7. The automated pay box fund shall be audited as a separate fund at the time of the annual
audit by the village.
. Prima Facie Proof: Proof of registration of a motor vehicle and proof of violation of this
section shall be construed as prima facie proof that the registered owner of such motor vehicle was
the user or operator thereof at the time of the violation charged.
Violation: Any person found guilty of a violation of this section shall be fined as set forth
in appendix A, division III of this code for each offense.
SECTION 5: Section 18.1323, "Parking in Municipal Parking Lots," and Section
18.1323.1, "Municipal Parking Garage Restrictions" of Article XIII, "Stopping, Standing and
Parking" of Chapter 18, "Traffic" to the Mount Prospect Village Code shall be amended as follows:
18.1323: PARKING IN PARKING LOTS

In any parking lot , be it owned, metered or leased by the village,
it shall be unlawful for any person:
A. To park a vehicle in any area of such lot which is not designated (by lines or markings
painted or placed on the pavement, wheel stops, etc.) as a parking space

SECTION 6: Section 18.1325, "Penalty" of Article XIII, "Stopping, Standing and Parking"
of Chapter 18, "Traffic" to the Mount Prospect Village Code shall be amended as follows:
18.1325: PENALTY:
A. Except as may be provided elsewhere in this article, any person who violates any of the
sections of this article shall be subject to the penalties provided in section 18.1905 of this chapter.
B. Notwithstanding the penalty provisions of section 18.1905 of this chapter, the use of a
citation in lieu of the filing of a complaint in court shall not be available with respect to violations
of subsections 18.1322 E14 and IF and section 18.1324 of this article.
SECTION 7: Section 18.1326, "Towing and Storage of Improperly Parked Vehicles" of
Article XIII, "Stopping, Standing and Parking" of Chapter 18, "Traffic" to the Mount Prospect
Village Code shall be amended as follows:
18.1326: TOWING AND STORAGE OF IMPROPERLY PARKED VEHICLES:
A. In addition to the provisions of section 18.1302 of this article, any vehicle parked in violation
of sections 18.1303, 18.1315, 18.1320, 18.1321, 18.1324' . of this article
shall be subject to being towed by the village or any of its officers, agents, employees, servants,
contractors and subcontractors, to a location designated by the village at the expense of the owner
of the vehicle towed.
B. The village shall mail written notice to the person listed in the records of the Illinois secretary
of state or in the vehicle license records of the village as the registered owner of the vehicle towed

advising the said owner of the location of said vehicle within twenty four (24) hours after the
vehicle towed is deposited at its designated location. The village may also notify said owner by
telephone.
C. Such notice shall also advise the owner of the reason for action taken by the village in towing
the illegally parked vehicle, and shall provide the owner an opportunity to request a hearing before
the village manager regarding the basis for such towing action. Such request must be made in
writing within two (2) days following receipt of the notice, and the village manager shall take
immediate steps to hold a hearing and review the action taken in towing the vehicle. The
determination of the village manager that the vehicle in question is, in fact, parked in violation of
any of the sections specified above shall be final.
D. Fees shall be as set forth in appendix A, division II of this code.
E. The village shall not be liable for any damage to any vehicle which occurs as a result of the
work to and the towing and storage of any vehicle under the provisions of this section.
F. It shall be unlawful for any person to remove any vehicle from a storage area unless and until
the fees for the preparatory work, towage and storage of said vehicle have been paid. The penalty
for violating the provisions of this section shall be as provided in section 18.1905 of this chapter.
